♪ ♪ howard: how did it come to this? how did things reach the point where much of the media have angrily turned against joe biden and his team for their mishandling of classified documents? justice department officials found a half dozen more classified documents after a 13-hour search of biden's wilmington home. what? it just goes on and on. the biden lawyers basically told everyone to shut up, failing to realize their client, the president, is held accountable every day in the court of public

opinion. it didn't help that as the "wall street journal" reported, the fbi decided earlier there was no need to send agents to supervise biden lawyers collecting classified papers that they said they found. that reeked of a double standard. "the washington post" says biden world adopted a strategy of caution and deference toward doj, it was the goody two-shoes approach, more concerned with pleasing investigators than the public. here's a classic example. after white house sat on this story for two months, officials confirmed the cbs scoop about the first batch of documents found at penn biden center. now, the prime minister and his people already -- the president and his people already knew about the second batch but said nothing. it smelled like a cover-up. the post says some of biden's aides now regret the strategy. you think? here's the thing, anyone if can defend himself even when there's a justice investigation. i'm howard kurtz, and this is "mediabuzz." ♪ ♪ if. ♪

house raids by -- raided by the feds? >> there is a sense that they will, ultimately, be vindicated essentially, that what happened here was a mistake and was turned over voluntarily. >> we are learning hat justice department -- that the justice department rejected a federal search for top secret, classified documents housed at joe biden's many properties. they called off the fbi. no raid for joey. joe biden gets different treatment hand trump. >> the administration did not exactively -- actively tell the american people about this, and we have to ask why they did not do that. howard: after a week of silence, biden finally read a statement about having found a handful of documents. >> we're fully cooperating and looking forward to getting this resolved quickly. i think you're going to find there's nothing there. i have no regrets of following what the lawyers have told me they want me to do. that's exactly what we're doing. there's no "there" there. now -- howard: joining us now to analyze the coverage, guy benson and in las vegas, laura fink, a democratic strategist and founder of rebel communications. guy, the search was supposed to be over. then fbi comes in and is searches the wilmington house late pretty night. the biden white house doesn't put out a statement until saturday night. how did all these mistakes and missteps add up to the point where the press really has turned against joe biden and his team? >> well, it has been a disastrous embarrassment for this administration and this white house. nine days ago they told us at the white house that the search had been completedded. trust us, we got it. we sat on it for two months, but it's over. the next day we learned about more documents, and it's like groundhog day, a week later we're doing the same hinge this weekend. it's a complete mess. and i think president has made it worse on multiple occasions for himself. he's not being really fort coming in any meaningful way. peter doocy was able to bait him into giving the corvette answer

in the garage which was not a good look for the president. and in the clip we just played of the president saying he has no regrets and there's no "there" there. with all due respect, there's already thereto -- "there" there. and if they say as they have over and over again, the president takes this very seriously, hen he comes out and says, oh, i have no regrets having classified, top secret sufficient all over the place, it undermines the message. howard: i think there should be some regrets. we're not if sure why the fbi got involved in this search, the white house says there was no court order, but even media allies of joe biden while drawing distinctions with the donald trump case, and they're very different, are saying the president's team has handled this. >> well, i think what we need to distinguish as the american people will is difference between what is of substance here and what is sort of pr missteps. i think when you look and what biden is counting on is that the substance involved in these

documents is going to sort of vindicate him and his strategy. and let me tell you something else, this also shows that the mainstream press that conservatives like to demonize, do hold biden's feet to the fire, do actually come and ask tough questions and pursue these items. the question is, do the american people really care or is an insider beltway strategy where we are talking about this press release and that press release and not talking about the substance of the issues that the american people care about and even the sub stance of these issues. this is something where i think we will see it, his strategy the vindicated, this old school strategy of no tweets, no leaks and kind of keeping things on lock. so it remains to be seen. howard: guy, legally it might be that they discovered these papers, they're bad at searching, and it doesn't amount to a hill of beans. but politically, sounds like the very hinge heavy been telling us that donald trump was doing, and it was horrible, he was being

irresponsible, and undoubtedly reduces the chances politically that trump will be charged with anything. >> oh, for sure. and i think the lack of charges for hillary clinton who, i think her conduct was much worse in the handling of classified documents than either of these two the men. she wasn't charged, so i think the likelihood of trump getting charged was low on front, and now with this rolling catastrophe for biden politically, i think that underscores the point that you're making. and with all due respect, i don't understand this talk about vindication. the unlawful act is having these documents in the paris place. we learned in the new trove, some of the documents date back to his term in the senate which was multiple decades, of course, meaning he's had this stuff somewhere since at the latest 2009? and there are senators who are out there tweeting and senate staffers saying you can only view classified materials as a senator in one of these very highly sensitive the places. how would you ever get anything to out of the senate like this? we now have more questions.

i thinkable term vindication is a bizarre one. howard: laura a, the biden people haven't tried to explain why, they learned this before the midterms, until cb cbs broke the first piece of this. and "the new york times" says everything was closely held by anita dunn and her husband, bob baur, who is joe biden's personal lawyer. the bet seems to have backfired. you do pr, you certainly understand. maybe you say it's inside the beltway stuff, that way this is a news story every day, even last night if i had to update the scripts today, it's not been a good look for the biden white house. >> no, i wouldn't say it's idea. [laughter] i probably would have done a couple things differently, maybe have a special individual to answer all of the questions. howard: yes! yes. >> overall, the key lack of concern over donald trump's national security breaches threatens to overplay their hand here. when you have conservatives like marjorie taylor green and jim

jordan absolutely breathing fire over the national security issues and you don't have them speaking to the issues with respect to trump the, we -- it becomes a wash for the american people. it becomes that that beltway noise i was talking about earlier. >> see, i would have a challenge for democrats. can you please address the biden mishandling of documents without mentioning the word trump? is that possible? it seems challenging. howard: well, it may be a wash -- >> i think my first two answers showed that i did that. howard: all right. well, it may be a wash, but in any view, that's kind -- my view, that's kind of a win for trump. we've been hearing about all the terrible things they did with classified documents. guy, i'm reminded of the book, "the best and the brightest," which was about the jfk whiz kids who led us into vietnam. here you had tony blinken who worked at that biden penn center, they had decades and decades of government experience, and yet they were so busy kissing up to these doj lawyers that they created a

credibility gap. >> these are supposed to be the adults in the room, that's what they tell us about themselves in a self-congratulatory way, and here we have this drip, drip, drip of their own making because of their own ineptitude i and incompetence on 207 of the potential -- on top of the potential illegal conduct here. to call it a bad look, i think, is an understatement. and you're right, this is a man singularly, the president of the united states, who has been at the highest levels of our federal government for the better part of half a century. if anyone knows what you and cannot do or should know with type of material the, it ought to be joe biden which in some ways makes this worse for him. there's no ignorance excuse that's viable. howard: laura, for six days i watched biden not engage with reporters because he didn't want to take questions on this, and i'm glad that he finally read that statement in california. but at the same time, i take your point they should have had a lawyer come out and, you know, karine jean-pierre is getting eaten alive every day. she's not even in the loop on

this stuff. but i don't understand why joe biden has to read a piece of paper. he's the president of the united states. he can say, look, i have regrets, this is what we did, we are cooperating, it's different. he can say whatever he wants, but he seems to be taking the advice of saying very little. >> well, and he's also taking the advice of lawyers because it's a legal investigation. you look at the actions that have been taken, respecting the special counsel, not needing subpoenas and not obstructing the the situation, full cooperation on the legal front, and nobody is disputing that. we're having a pr and an optics conversation, but we're not talking about the actual substance. and i think joe biden and his team are counting on the substance winning the day. and you know what? only 14% of americans in the latest poll show that they want to see investigations on this issue, and yet republicans are marching forward. so there is a disconnect between the beltway obsession with the optics and the american people's, you know, concern with this issue. so beware of that divide. >> respectfully, howie, the

not my anointed job in the world to stop national press from making a fool of themselves. howard: guy benson, are biden and hissal allies so accustomed to getting preferential treatment that it's the fault of reporters being too tough when he gets hammered? >> you're losing because they are entitled on the left and in democratic circles, they feel entitled least, to positive treatment from their typical allies in the news media. they're usually on the same team rowing together, and when that doesn't happen, there's a senses of betrayal that leads to anger. and i think part of this is fueled by the fact that they have been so incompetent at the white house in the rollout where the initial, my suspicion here, howie, is that a lot of reporters sitting will that first day said, okay, they've sat on this for two months, so they probably have this thing with a bow on top -- howard: right. >> -- it's over. here are the talking points which they started to recite, and they've been made chumps and fools for two consecutive the

weeks plus, and i think that probably ticks hem off which is why you're seeing some of this feeding frenzy energy in that room. howard: laura fink, i get that james carville and lawrence o'donnell are as part san as they come, but when o'donnell says reporters are all over biden and karine jean-pierre but not donald trump, i'm sorry, are we living on the same planet? >> i think that james carville in particular has a history with the rhythm of the press, and we know the press loves a scandal. they love add fuel to the fire, and they love to cover it. and that's true whether you're talking about republicans or democrats. i find the notion that somehow there is this liberal press and that there is a deeply financed conservative media whose job it is to create and to focus on so-called scandals. i think that the conservative media is fired up about this, and i think that this is an example of the main stream media doing their job. and i don't think that there's anything wrong with that. however, i do also think he was to be in touch with -- they have

to be in touch with where is substance, where is the beef, where is the actual crime. what is the justice department doing antibiotic. and instead, we are focused on all of the other sort of ancillary issues and at no point has anybody said joe biden should be locked up over this. we're getting into ridiculous field here, and i think that the press needs to be mindful of that that as do political commentators on the left and right. >> laura, if you had documents marked top secret sitting in your garage and they were discovered, you'd be in handcuffs, yes? is that a scandal or a so-called scandal. >> so here's the question. the question is, how did they get there, who brought them there, and all of those need to be answered by the justice department, and none of those have been answered except, guy, when you draw conclusions that, in fact, these are the height of criminality. let the justice department and the fbi do their job and also have some balance when it comes to the security documents of trump. there's been full cooperation, this could have been a mistake. we have much, much more to talk about and to look at, but

jumping to conclusions helps no one. howard: well, i would just say, guy, that the media has not exactly followed in the months since the mar-a-lago raid, oh, let's let this play out, there's a special counsel, let's see where it ends up. now, donald trump, of course, fuels a lot of coverage when he attacks the investigators and all that. but to suggest that, you know, the focus has been off trump for a few days, but for months on this very issue, classified documents, it was one of the hottest stories around. >> yep. i was critical of trump on the mar-a-lago stuff, i'm critical of biden here. the substance, the beef is these documents cannot be where they are. and if it was a mistake, that's actually not a legal defense, but maybe sympathetic people can say, all right, let's let slide. it shouldn't happen again. the president should say regrets, not no regrets, but it's not a mistake. it would have to be what now, six mistakes? six different troves of documents? several of which have emerged after they told us the search was over, all being done by the

president's lawyers on their own timeline? it's just sort of a very absurd, almost comedy the of errors at this point, and the spin is pretty feeble. howard: except for the fbi search yesterday -- can excuse me, friday, and we don't know why that happened because the fbi initially declined, laura. and then, of course, it count get announced until saturday night which is when you always try to bury bad news. you know that as well as anyone. so it's just really striking to me how this is a story that should have been maybe a few days, and it just gets stretched out. >> well, you know, i think that's optimistic. i think that the press is looking for a scandal. 9 i think you hear guy's comments and yet he wants, you know, every move to be fold, every release, a press release on everything because the view is, is that this is ultimately, you know, condemnation before information. and i think that we have to get used to this biden administration that doesn't have leaks and betweens, it doesn't go out on a limb to create additional scandal as you were saying, howie, and the american

somebody who -- we all know those people who lie allot, we've all had to deal with those people, but it's really extreme to have somebody bring things like the holocaust and 9/11 into it. there's obviously something fundamentally wrong with this person. howard: right. and then he doesn't answer questions from the press on most of the things that have been factually proven to be untrue. but then he puts up this tweet when he was accused of having worked in brazil as a drag queen saying this is the most recent obsession from the media, making yo outrageous claims about my life while i'm working to deliver results. except that later in an interview he said, well, i might have dressed up at a party and had some fun. so it's really hard to know what's going on with this guy. and i think it's becoming more of an embarrassment for republicans but, of course, he was elected, so not much they can do at this point. >> right. of course it's an embarrassment, especially when it is this ridiculous. i think one of the top comments or replies to that between is the photo of him wearing drag,

wearing some very clearly, in his face. he doesn't get to come out and say this isn't true and have anybody believe him ever again for his entire life, which is why most people don't do stuff like that other than the fact that most people, again, don't ever have whatever mental issue it is going on with this guy to actually -- i'm not a psychologist, i'm not a doctor, but i've been alive long enough to know that that is not normal. [laughter] howard: you know, there's no evidence that santos knew about the alleged ponzi scheme at this harbor city capital, he was never chargeed. nor does he report some big salary after having worked, he says he managed a billion and a half dollars. more layers of mystery especially when it comes to money, and i think these money investigations might ultimately prove his undoing. >> right. those are the issues where it could be rather than some of these lies where, you know, services just for attention or he wanted to have this fantasy

life story because he thought it was more interesting than his actual life story. his actual life story wasn't really boring, so i don't know why he did all of this stuff. i don't think any normal person will ever be able to understand why he did all sufficient, but the legal issues where he could actually get charged with things, yes, that could be his undoing. howard: i just can't figure out who plays him in the movie. >> yeah. i don't think it's done yet. there's going to be more. community and really the entire community, because i think we're all going to be hurting based on tragedy. on saturday, january 21st, 2023, at approximatelye monterey park police department responded to a business in the 100 block of west garby avenue in the city of monterey park regarding a shots fired call. when officers ace arrived at the location, theying observed numerous victims and patrons in the business parking lot. additional officers made entry into the business and located numerous gunshot victims. monterey park fire department responded to the scene and started to treat the injured. and i do want to point out these police officers that get there, they don't hesitate. they go in right away. and then our partners at the fire department and not only the monterey park fire department, but many others who came to

assist the victims, survivors who needed assistance. there were at least 10 additional victims transported to numerous local hospitals. but i do want to start off with saying that, unfortunately, when the fire department did get into the business, hay did pronounce 10 of victims deceased at the scene that i just described. but the 10 additional victims were transported to numerous local hospitals. they are listed in various conditions from stable to critical condition. there is a male suspect that fled the scene and remains outstanding as of this moment. our very preliminary description has been described as a male

asian, and that's from the scene here in monterey park. and it's taken us a while and please be patient with us because as we're interviewing victims and witness, we've gotten different descriptions of one suspect. so when i say it's preliminary, please, again, be patient with us. we are here to tell you that we are quitizing every resource -- utilizing every resource to apprehend this suspect. and what we believe to be one of the county's most heinous if cases. our local, state and federal law enforcement agencies are working together to better serve the residents here of los angeles county and to apprehend this attacker. sheriff's homicide investigators are working diligently with the monterey park police department. the federal bureau of investigation, the california governor's office of emergency services and numerous other law enforcement agencies. bottom line is here we're going

to use every resource available to us, because we need to get this person off the street as soon as possible. but again, we are still in the very early stages of this investigation, and there's probably -- there actually is a lot more that we don't know than what we know at this time. as i said earlier, the men and women of of the sheriff's department -- howard: we are monitoring in the news conference. the one bit of new information from sheriff robert luna is that the suspect is not only male, but asian. this is potentially significant because the shooting occurred in an asian-american area of monterey park at a ballroom dancing place where they were celebrating the chinese lunar new year. we'll also stay with the story all day. now back to our regular programming. the media are out utterly vis rating some of -- eviscerating some of kevin mccarthy's picks. >> marjorie taylor green got two

the hugely powerful committee posts today. we're not surprised. i mean, she was right next to kevin mccarthy through the last several weeks. >> now the insurrectionists are in charge of the house of representatives. where they will accomplish exactly nothing. howard: joining us now from jacksonville, susan free choa -- ferrechio, and here in studio, ameshia cross, political analyst for siriusxm and wvon radio. susan, kevin mccarthy getting blisteredded by the media for putting some of the most incendiary conservatives on the oversight committee, but this comes after nancy pelosi and the democrats stripped two republicans of their committee assignments, are you seeing a double standard? >> oh, completely. just look at the roster for the oversight committee and look what he was done historically. first of all, the ranking member, who will be the top democrat on the committee, is jamie raskin. he was one of the impeachment

managers who went after president trump in the second impeachment case. he also voted against certifying the election for president trump in 2017. so it's always been a place for sort of the bomb throwers and the more aggressive members of congress. that is nothing new. it doesn't surprise me at all that scott perry, marjorie taylor green and lauren boebert are members of these committees. they're really interested in biden administration oversight, so this is actually the perfect mace for them, and it's exactly where democrats put three members of the squad on the oversight committee. so it's truly a double standard. howard: ameshia, i don't have a problem if you want to call this payback, but the biden white house spin is they're thrilled to have these high profile targets, handing the keys of oversight to the most extreme maga members of the republican caucus. >> agreed. i don't think there could be a stronger gimme for democratic strategists, pollsters, for those who are following the trajectory of what has happened to these individuals who are part and parcel of january 6th

insurrection be it through the tweets, the cheers they gave to several people who believed in and helped to propagate that lie about, basically, the 2017 election being stolen from donald trump. and at this point, these people are still the pushing the exact same lies today. and it's frustrating because, yeah, they ended up essentially having keys to the castle on a committee that investigates the very things that people like them took part in. howard: susan, the meeting described marjorie taylor green as a denier. she was in an interview with me two weeks ago said she no longer believes this garbage, so is it fair to a attach that label for life, for example, to the congresswoman from georgia? >> well, all politicians have a tendency to evolve and, certainly, she has evolved a lot. the washington time thes wrote a big story about the evolution of marjorie taylor grebe now where

she's working -- green now where she's working with kevin mccarthy, moving more to the mainstream part of the party versus the outer edgings. of course it's not, you know, everything is fair in politic things. this was never going to go away, but i will point out there are members of democratic side of the aisle on the oversight committee who challenged president trump's election in 2017, have been big bomb throwers themselves, have been controversial. rashida tlaib, aoc, ayaan a that pressly, all these people have made their own controversial statements. the oversight committee is really the perfect landing place for these people. don't forget, these committee hearings can be televised, they're fiery. this is a committee that holds members in contempt of congress, a.g. barr, bill were raz, erin holder. -- wilbur ross. so this is place for this type of lawmaker. howard: the suggestion here, ameshia, is the press is tougher on the more incendiary members of the right, on the republican party, and kind of shrugs its shoulders at the more extreme members on the left. >> quite frankly, our nation

hasn't seen anything relative to january 6th since the start of the civil war. and i think that we have to be very serious about that. it's one thing to say there are incendiary remarks made by some members on the left that even democrats didn't like or -- howard: yeah, criticized them. >> but when we're talking about threatening to overturn an election, we're talking about the incidents we saw on january 6th, the taking down of the american flag, the piercing at law enforcement officers, the process of that day and everything that went into it in trying -- and trying to prevent something like that from happening again, we cannot compare the two. and i think it's very serious we take into consideration the aftereffects of january 6th, what it meant for our nation, the rest of the world and how they view the united states in peril and basically holding on by a thread. howard: we're a little short on time, but, susan, the supreme court -- i was hardly shocked -- not able to find the leaker of the dobbs draft decision opinion

to politico. donald trump says if the reporter won't reveal the source, put him in jail, then put his editor in jail and so on. this is not a criminal probe, it's not a question of national security secrets, so what grounds would you put the political reporter in jail? >> well, reporters have been put in jail before -- howard: sure. >> it's never in the public interest to harm transparency by putting reporters in jail. i completely disagree with that, and i disagree with the president on it. howard: ameshia, the florida judge has hit donald trump and his lawyer with merely $1 million in sanctions -- nearly. in the has to do with a lawsuit charging hillary clinton and a couple of dozen doj and fbi officials of conspiring to prosecute him. the judge throwing it out saying it's frivolous abuse, the case never should have been brought. it could be overturned on appeal, but what strikes me is how little media attention this received given the characters and all. >> it was a big hubbub about nothing when he filed the lawsuit to begin with.

accident onset of movie rust, alec baldwin has been charged with everyone voluntary manslaughter -- involuntary manslaughter. baldwin has insisted he didn't know the gun had ammunition and that it wasn't his responsibility to check. >> mr. baldwin had a duty at base level to never hold a gun and point it at a person while pulling the trigger. but he also had a duty as an actor and a producer on that set to have the bullets checked or check them himself to make sure that they weren't live. howard: baldwin's lawyer saying in a statement the decision distorts halyna hutchens' tragic death. mr. baldwin had no reason to believe there was a live bullet in the gun or anywhere on the set. we will fight these charges, and we will win. we're back with kat timpf. i think this amounts to overreach by prosecutors looking at a famous target which in turn gives this them a big platform.

what's your take? >> yeah. we don't know all the info that the prosecution does or doesn't have, but there's been a lot of coverage of this. there's a piece in reason, i talked to a law professor who said you have to prove he actually thought about the fact that he thought it could be loaded before he, you know, that happened. and really that's hard to prove. there's a piece in slate talking to another lawyer saying there's different rules on a movie set for an actor. he's not allowed to make any other kinds of considerations bppedzs that. i think that a lot of people, you know, kind of want to see him charged because, quite frankly, he's kind of a jerk. [laughter] howard: is that sufficient reason for criminal charges? i don't think so. >> no, i don't think so either. howard: but it's an interesting point, which i've noticed that. and legal experts have given their take, and many of them hi this is a hard case to win. but if you are conservative and you think alec baldwin is a jerk, remember, he had a liberal msnbc show, you're more likely to say, yeah, he should be prosecuted than if you're

somebody on the left that kind of likes him, you say, well, this goes too far. >> right. and again, we still don't know what evidence the prosecution does or doesn't have, but this is also a case sort of similar to this in npr, somebody got killed denly with a -- accidentally with a prop gun 30 years ago, there was no charges there. he really said horrible things about gun owners, about the nra. he, you know, for example, accusing, you know, dana loesch, she doesn't care how many bodies she steps over, and he ends up shooting someone which he -- she has never done. i understand that, but it's the also -- howard: baldwin could face 18 months in jail, an extra 5 years. and i just think these new mexico prosecutors, and just briefly, i think they're making an example of him and if it was a much lesser known figure, probably we wouldn't see this case. >> there's a piece in "the new york times" too, actors are concerned about this because a lot of them aren't gun safety
