classification can happen instantaneously. it did with president bush a few years ago when he declassified something on the spot. there is no criteria. the burden of proof is on the government. i don't believe the government can prove beyond a reasonable doubt that the material in trump's possession was classified. on the biden side there is another problem. the statute requires that the classified documents be knowingly removed. the person has to know it was classified and it was removed with an intent to retain it. what biden claims, i didn't know. it was just among other papers. that's why i have concluded after 50 years of litigating criminal cases there will be no

i disagree that intent and knowing and willful is the only standard. if you examine section f, of 793, that provides for gross negligence or carelessness. well, the increasing number of locations where joe biden's classified documents have been discovered, renders implausible and instead seems to be the definition of recklessness and gross negligence under the statute. legally, there would be a strong case. president biden's excuses in his bag of alibis, his whack a mole rebuttal to every newly discovered batch of documents is more preposterous.
