♪ ♪ >> emily: the san francisco judge has just released the police body cam footage showing the attack on a paul pelosi at the san francisco home he shares with former speaker nancy pelosi, our producers at the courthouse right now waiting to get physical copies of the video. according to court documents, mr. pelosi was violently attacked in october with a hammer at that san francisco home. david to path is charged with the attack, the body cam footage from the incident is expected to show what officer saw when pelon

the door to the home and his assailant attacked him. we are expecting audio from police interviews with david as well as my mom one calls and home surveillance video as well as other investigative material in their release, we will bring that all to you, we will bring that as soon as we have that. also this hour, cities across the country are bracing for potential violence after the release of police body cam footage set to show the brutal beating of tiring nickels that later led to his death. hello, everyone, this is "outnumbered," i am emily compagno with my cohost harris faulkner and joining us today kennedy, molly line, and todd piro, we have a lot of news at this hour, and we begin with the hour-long footage from body cams that will be released at 7:00 p.m. eastern tonight after schools are out and most businesses are closed for the day. the video has been described as appalling, and the depiction of staggering brutality.

five memphis police department officers involved in the arrest of nichols at that time have been charged with second-degree murder. and now police department's across the country are very concerned that the video's release could ignite violence. there is been a series of calls and information sharing between the law enforcement nationwide, in d.c. the police department have been fully activated and all sworn personnel called in. in new york, nypd is on heightened alert and officers have been deployed to hot spots where protests have happened in the past, nichols mother spoke at a vigil last night pleading for supporters to protest peacefully. >> i want each and every one of you to protest in peace, i don't want us burning up our cities, tearing up the streets, because that is not what my son stood for. and if you guys are here for me and tyree, then you will protest

peacefully. you can get your point across, but we don't need to tear up our cities, people, because we do have to live within them. >> emily: kennedy, from that mother, heart-wrenching, and people across the country are embracing themselves from what they deemed a balance of poor at the result of potential leasing on this video and also yes, for the piece. >> kennedy: there is a lot of wisdom in a lot of pain, and what she is saying is incredibly genuine and sincere, and a lot of people throughout the country have lived with the aftermath of what happens in moments of rage and anger where people come together and they don't check themselves, you know? there is and align, it is just crossed and it devolves into something so destructive, it's really hard to come back from as a community, and so what happens is you focus so much on the

aftermath, the destruction and the violence that you no longer are talking about what might have happened in that police department in the first place or the memory of the person who was killed. >> emily: that's right, todd, the five officers charged with second-degree murder, aggravated assault, aggravated kidnapping, official oppression, just on the second-degree murder charges alone that carries up to a potential sentence, and this is an addition to the policy is that the police chief announced that they have violated, which include excessive use of force and violating their duties to intervene and duty to render aid, that town is certainly rocked and shocked. >> todd: obviously we need the video and all facts come out, but based on what has been imported, this seems like it will be really, really bad. and i go back to my work with good cops hate a bad cop more than anyone, and this does look like you need to wait for all of the facts come out, but it looks

like a series of acts by five bad cops, and they say good cops want the reforms that should be put in place to make sure that bad cops can't do this, and if they do, the penalties are swift, but we cannot get to an overreaction point like we saw during george floyd where because of the overreaction, policies and procedures are put in place that helped no one and in fact ruin the city is that many people a spouse that they want to protect, and so to this point i would go back to what the mom hears, that statement could not of a more perfect and it is coming from a grieving mother, she said, we need to live in the cities afterward, don't destroy them, i think that the message for harris, molly, kennedy, i think that that will get to the people that will launch the protests of the act, i am concerned that those people who don't care about that message and just want to destroy things are not going to be re ready. >> emily: i want to focus on

what todd has said too, they have said that strong young, so the bureau of investigation said what happened here is not at all showing the investigation, and the highway patrol said this was a heinous incident that we in the law-enforcement profession should condemn and work tirelessly to make sure it does not have into another person, so unequivocally members of law enforcement of course support proper policing and see when there is any deviation from such. >> molly: to todd's point, this mother showing incredible strength and resilience in one of the things we can potentially expect to hear in the video tonight is tyree calling for his mother, so we need to listen for her voice here in the days and weeks ahead as it continues to be the search for justice, but when you talk about police reform and other things we are looking at in this video is not just the officers who are charged, but people in the video who don't act, there are other people on the scene, other officers, their firefighters and

responding medical personnel as well, and some of the questions as far as across the country are who should be intervening when, how do you intervene? how do police, good police stop others from being bad police in the moment, and we have seen that in other occasions where there are police violence. our officers ready to step up in the moment and intervene when other officers aren't acting appropriately, or in a potential like this with deadly consequences. >> emily: there is that a formative duty, absolutely. harris. >> harris: what i was going to say when he talked about to the agitators in the streets, the people who would bring things down, we just recently were seeing some of this in atlanta where people were coming from out of state like it was some sort of a party that they could come to you that was not about protesting anything to do with the peaceful protesters that were already in the streets, and then when you listen to tyree nichols mom as its leadership she is showing in a moment when she understands that people are

going to come out and if they will speak for her or tyree or their family, then they must do so peacefully. that is just so much concepts limit consciousness and clarity through pain that it is humbling. and i pray for her to sustain and to have the strength to get through this coming you know, we don't know yet what is on that tape, but i agree with you, when you hear the police chief, sarah lynn davis describe it as defying humanity what is on that videotape, she is actually going to be in the position to answer some of those questions going forward, great questions that you just asked, and that is when this is going on, who does intervene? what are the protocols for that? they have already said from the police department at the specialists unit, some of them are highly trained up to five and six years, at least half of the guys were, and doing great work as a total unit, not necessarily those five, we did not know specifically, but as a

total unit to keeping the peace and neighborhood, that's what they were formed for, so there will be a lot of questions about how they were carrying out their job and who could have been in that time, but right now my prayers and thoughts are with that mom, who is teaching us all about how to lead even when your heart is broken. >> emily: two firefighters are under investigation for exactly that same thing, internal policy investigations that are going on, molly, we have talked about everything a person, every single american deserves a fair trial and an impartial journey, and i just know to the attorney for terry nichols family has invoked the memory of rodney king and that vicious meeting we saw and the subsequent riots that looked at multiple towns, that was switching to ensure that the defendants received a fair trial in contrast to what happened in your city in boston, the boston marathon bomber, they are the judge said we have a huge pool here, if he can't get a fair trial, there is nowhere

that there is not going to be a fair trial and it remained today are in boston, massachusetts, so what are your thoughts on when we see images like this with the balance of the truth and what we can see with also the balance of bias? >> i think that a lot of those challenges are something that the judges tend to tackle and they ask distinct questions of a jury pool and try to get to the bottom of that, when we question upon appeal which is what they want to avoid coming you don't want to drag a community through something and end up on appeals saying all right, this wasn't fair, there was too much exposure, and back to the beginning of some sort of process, that will be something to watch for, we see that in any case in any community as to whether or not this will ultimately end up being tried in this community. one of the other things that i thought of as this was unfolding is the release of a video tonight, sadly we have seen the core, and this is officers that understand with the body

cameras, and as we know in today's society there are surveillance cameras everywhere, so the question is how is a group comfortable to do something that they know can be reviewed later in the trial, the four superiors, how does this unfold? how are you comfortable enough that something like this -- >> kennedy: i think it's the same way people get comfortable burning down entire cities, it's this mob mentality and you given into that anger and the moment and it's as though the rational part of your brain is completely cut off. >> harris: i would say one thing, we cannot judge everybody by what if you choose to do, we just have to remember that, that there will be things -- we have seen the rhetoric against cops, and there will be things that will be said out of pain out of hurt, but we still need protection, we still need are police officers, and justice must be served, whatever it will be in this case.

the images, we will bring it to live. we are also expecting because a judge released other items, not just from the body cam, but also other investigative material that could be miscellaneous, 911 calls coming in home surveillance videos, so all of that is put into the public purview now. and we will go through what we have with this body cam footage and get it to you as quickly as possible. according to court documents, paul pelosi was attacked in october of last year with a hammer at the san francisco home he shares with his wife nancy appeared to the police body cam footage from the incident is expected to show what officers saw when paul pelosi opened the door to the couple's san francisco home and his assailant attacked him. 42-year-old david to pat has been charged in this attack. nancy pelosi reacted to the video's release yesterday on hill to fox news digital.

>> after the release of the body cam footage on the assault on her husband come i wonder if you support them doing that? >> i've nothing to do with the legalities of respect to the system. >> does the body cam footage something you have seen at this point? >> no, i don't even know if i will see it. i mean, that would be a very hard thing to see an assault on my husband's life. but i don't know. >> thanks a lot. >> what is the latest update? >> i've yet to see it. spin on the shock of that has shared humanity, i think it will be hard to see anybody on the end of the footage that you love being beaten, but it will answer a lot of questions, this is a lot of information to put in the public. >> todd: as to the nancy pelosi part of this, you can despise nancy pelosi and her policies, but to your point, harris, you can't fault the woman for not wanting to see this video. i don't think that anyone can, she is entirely within her right to not want to see it.

as for the video itself, i am appalled that there were entities that wanted to keep this from the public, if something is in a court of law, it should be made -- 's bill and why would there be a call for that? we are getting ready a few hours from now to see something that would be awful to watch, it's part of the case that will probably captivate the nation. >> todd: there are members of the d.c. swamp and bagman on the west coast they want to keep things like this from the public. the reasoning come i think that there is a lot of reasons, too many to get into here, but at the end of the day there are forces that don't want things public. we espouse the virtues of transparency. the court of law as a public court of law, you have a legal right to see things that are happening in the court, that's why courtrooms by and large are open with the exception of very, very specific instances, and so we have a right to this, the judge in this case ruled perfectly, there is no reason based upon conspiracy theory potential to keep this from the public, that was a horrible argument by the prosecutors in this case and i'm glad it was

shot down. >> harris: emily. >> emily: just to articulate what those arguments were, so the d.a. argued that yes, it would allow people to manipulate it in their quest to spread false information, the defense attorney as well agreed, he said yes to that and also it would inhibit the ability to get a fair trial, now on the other side where the news agency is that said, you already used it in your preliminary hearing, so you can in fact have a capacity within the court, the public does not have an unfettered legal right to access, once it has been released into the public domain, then there is zero law enforcement or prejudicial interest that outweighs the fact that it was already out, so the judge ruled correctly and i agree with you, but certainly on the realm of common sense which was it was already out there and importantly, you don't eliminate the public right of access just because of concerns about conspiracy. >> harris: kennedy. >> kennedy: the conspiracy grows when we are in a note-taking environment and we don't have answers and you have

some statements from law enforcement that contradict each other, and that may have been accidental, one of the offers and officers may have misspoken income of one of the responding officers talking about the scene that they encountered, so that's why you take all of those questions away by releasing this stuff, otherwise, you know, if you or i were assaulted or god forbid we assaulted somebody, that information would be made public. you never want to see especially in a state like california that is a democrat enclave that people in power and privilege to happen to be members of the party in power that today are protected and shielded, and given afforded different rights than any other normal person who might've been convicted of the same crime. spin on the most recent that i can think of applicable example involves paul pelosi when he was pulled over and had been drinking, and for days there were things about that case that the public was not told and was not allowed to know, things that

we could not see, so on and so forth, do you remember that? >> molly: the view of transparency, we all share that view, it's a court of law, we should be able to see it, what took so long has really been months and months and months in the making, and finally we are getting something that was basically stonewalled with the judge determining that now is the time, get it out there, and instead of contributing to the conspiracy is, i think shedding the real light, the real truth, the real release does the opposite. you know, just let people see it for themselves, make their own determination, we will get the information as it comes down potentially seeing it here with the rest of america and anyone who has an interest. >> harris: there was a lot of interest around the 911 call, so that will be in the bevy of materials released today, paul pelosi placed a 911 call, todd, during the attack after convincing the assailant to let him go to the bathroom where his cell phone was charging and he spoke cryptically to police. another network, cnn previously reported that body cam footage

from the incident is expected to show what the officers saw when pelosi first open the door, so they had gotten there because of the 911 call, we will get pieces of the puzzle now verse what he said on the call, whatever cryptic happens to mean, but it was enough to get them there. and court documents revealed that it allegedly wakened paul pelosi carrying a large hammer, several white zip ties, demanded where is nancy, where is nancy, so potentially since other investigative materials are part of what is being released today, maybe we will learn more about that. >> todd: you nailed the key things that not only police, amateur detectives that we all are in this day and age want to hear, but obviously people in the court of law want to hear that as well, the point when it would go to trial, but going back to the public access part, this all comes down to public policy, and the reason we are able to have faith in our justice system is because of

access to watching the court process play out. to your point, emily, yes, not everything is open, a rape victim, there is no reason the name of that individual should ever come of that goes against public policy, but public policy here is for a free and open ability to see what is happening in this court, and that's why they made the right decision, and we need to see all of those things that you mention, because that's the only way we will get this puzzle put together coming into your point, kennedy, it's going to dispel a lot of the conspiracy is that many us had because of california is a democratic spit state and we see the pattern in the past to limit past where i hate to make this political, but democrats hide and not be transparent when something could potentially make them look in a bad light. >> harris: we want to let everybody know that our team of producers is going through what we have received, so far and that is the police cameron footage, the body camera footage, as soon as we get it and we will share it with you. coming up, the senate intelligence committee once

for, she wants reform. we want this to intervene to become tyree's law, just like they have the law in the state of new york, and for those of you who don't know that, attorney spoke this morning, a black police officer, she witnessed one of her fellow officers brutalizing a black citizen and she intervened and stopped them, and scott assaulted herself when she tried to stop them. but because she intervened, she was retaliated against? and she was terminated and had to fight almost a decade long battle to get justice, because they had no duty to intervene with police officers before her

fragments that are breaking now, emily, talk to me about this as evidence in the case. >> emily: keep in mind that the suspect is facing federal charges and staging at the same time, in december he was indicted, penalty 20 years of federal attempted kidnapping of a federal officer as well as federal assault on the immediate family member of a federal employee or officer, that carries with it a potential penalty of 30 years in addition to that 20, and that is in addition to the six state charges that include assault and attempted kidnapping and more, so what we are looking at here is an absolutely violent entering attempted entering into a home, keep in mind that one of those charges is burglary which includes an ant the false entry into a home and abode with the intent to commit a felony, so what this is doing is step one of that, now we see him entering, that is frightening to

watch. he is now inside the home of former speaker nancy pelosi and her husband, who then suffered a brutal hammer attack. that night. >> harris: this is on a loop, and still waiting to get the other items that the judge ordered to be released to the public, this is a home surveillance video coming up heard emily just now talking about all of the charges against this particular suspect, and of course, no one knew who this was at first, but now we can serially limit clearly seed, todd, you can see that shards of last, but he has a big bag of something that he has taken with him. and you will see a repeat itself because it is on a loop, as soon as we see the body cam through our producers working on that, it takes a little bit to go from what we see and get it on the air, we have done that so quickly and successfully with home surveillance video, which is a good place to start.

nothing has happened at that point, todd, that we know of other than this man breaking into the house, the 911 calls, have not happen, all of the things we are going to see, this is the first thing we see. >> todd: this is a lengthy puzzle, and peace number one that we are getting. we will put it in conjunction with the others, and specifically with regard to t this, and that backpack goes to intend, because i can't imagine going through somebody's house with a bag that size at this took place unless i had the attempt to do something, and i think based on the back of that size is pretty clear, but i think -- >> harris: he is taking stuff out of the bag -- did you see that? >> emily: it is an iron rancher or a crowbar of some point, a window, or glass door, and can't imagine if there was audio, it would be incredibly loud, so that bag contained at least right now what we're

seeing at the entry, and it might be the hammer, the same hammer that he then beat nancy pelosi's has been with. >> todd: trying to ask all of that together, what was in the bag and wasn't utilized in the commission of a crime within inside the residence? one question i have is widely reported that paul pelosi did not wake up, obviously we don't have sound on this home surveillance video, but the acts we are seeing look like it would be extremely loud, so this is not a lawyer asking, a human asking, what do you wake up to that? it's been on the one thing i would say is that it might've been louder to somebody who is standing outside than it would have been what floor you are on, i don't know about the makeup of the townhome -- >> emily: it is a mansion. >> harris: but something making this much noise, and without force, picking up though shards of glass, and look at, he liked takes its whole body and puts it through the hole that he

just created, so it was a sustained amount of noise, i don't know what you would hear on the inside, but it is hard to believe they would not hear hear something from the outside. >> molly: what i would ask paul pelosi, who knows how good his hearing is, potentially absolutely true if he has in a dead sleep, and just did not hear, but the bags reportedly homeless, so that could be essentially his belongings, that he might travel on a regular basis, so it's something he would get on the streets of california, we see people on the streets of california, may not be unusual for certain members of the homeless community where people have substance abuse issues to live out on the street. the question about what is the item he is using to break in? is that the hammer that was actually used in the attack allegedly on paul pelosi? we would have to really zoom in and try to get it -- >> harris: hold on one second, from the loop, he comes in, he

sets down one item and then he has a huge backpack, i just want to point that out that there are several things that he has with him. sorry, molly, go ahead. >> molly: yes, so is it the same item that later we will be able to see something in the next video. and who knows if we will see in the chronic logical order, seeing this as the time goes forward. >> kennedy: at the beginning of a horror movie coming out something awful is going to happen and it's shocking to see, to todd's point to this much intense, because he was not wandering around aimlessly, muttering to himself, not bumping into things, and all of its actions are an incredibly deliberate, he is obviously very alert, he knows what he is doing, he knows what he has going for, you can see the force that he is using to break the window or the doorjamb, and he knows he is using just enough, but still a lot to get inside and that was his motivation, he

a violent attack, and then i am articulating something graphic here, the fact that paul pelosi immediately was absolutely immobile, as we continue to develop that struggle, we saw depape struggling, the officers with him, they were subduing him, artfully, and the entire time, pelosi's feet were absolutely immobile, which to me suggests an absolute unconsciousness, with one blow an elderly gentleman was rendered incapacitated. we saw the windup of depape, it was especially powerful, that's part of what made it so graphic. absolutely, the wind up he engaged in was absolutely horrific, and the police responded immediately, but that's just goes to show immediately is still a nanosecond slower than that force at the hammer, which we then saw the results to poor paul pelosi. i wonder, my final point is this, a question, both the prosecution and the defense
