five now fired. now-fired memphis officers are facing charges of second degree murder, aggravated assault, sep, officialsault, kidna misconduct and official oppression. we will go liv misconduct,e to n where stev moments where fox's steve harrigan is standing by . but first,e ding we turn to foxo chief breaking news correspondent trace gallagher. >>f all right, chris , whatappene more have we learned about whatt happened that night? >> well, shannon, the videoe vi covers two separate scenes, but at first, the first scene, the video kind of picks up right before terry nichols was pulled over for recklessthe this driving. the thing is , we don't see an,y ifidence of reckless driving or erratic driving. and if police officers somehow fear that terry nichols is posing a threat,a the officers appear to violate common protocothreatrs appeal, a protect themselves and asknd nichols to exit the vehicle. instead, they go right t up to the car . they pull him outdiatel y and immediately try to push hm to the ground in the process. nichols is apparently pepperd wh sprayed with some of the sprayso getting into the eyes of the officers on scene, and they
12:02 am
either tase him or trysc a taset . works.nclear if the taser actually worked. and here's an what the attempted arrest sounded like. >> watch this. as you don't get all the great ones now. all right.>> okay, rachel , go back. not no, you guys are really doing a lot right now. you decide to go home.o ho >>me they hold him down. and then finally, terry nicholse gets loose and he runs away. they ce officers give chase, but they cannot catch him. then several minutes go byy befe before another police unit spots and catches nicholsofficeo officers from the first scene, then proceed to the secondscenen d thscene. at told thahat point, we're told that terry nichols is onlyt about a half a mile from his ena home. but the police encounter at the second scene is captured by both body cam video can and memphis police departmentphs video from a mounted camera a
12:03 am
on a light pole. d camera ou can see where offic throw terry nichols to the n two officersd grabbed nichols arms and put b them behind his back and begine punchinghi him. h another officer is kicking him.. he is clearly unable this point ev to defend himself. and even when he's finally wheon back on the ground, you can still see officers going uofpg and kicking him. it's hard to make out whatre nis terry nichols is saying, but wei know for sure that he's askingld for help and apparently calling for his mom. >> listen, you know, yeah, the body camera video is veryy e damaging. rayou see here the pull videohe shows a wide screen perspective of exactly pole vide what police doing and how bad the threed minute beating was. how bahaveand then there's the f issue, shannon, which is thatin while nichols is on the ground
12:04 am
,you can see police officersicet just standing around. there's no urgency in getting not just tdical help, . and at this point, it's not just the five officers, because if you take a wider look, youe r can see there are eight ,eight, nine , maybe 10 people on scened and nobody appears to be scrambling for bottom line.o it's harted to tell what initiah threat that waers to police thae justified the initial response secor really what promptediniti the beating at the second scene. terry nichols is six foone.t three , weighs roughly one hundred and forty five pounds with no criminal history. y 145 poundsthand aside from th police officers that i'veof spoken to sai'vey the memphis officer not only broke the law, poey violated numerous police policies, which tendss to indicate, excuse me, a lackto of trainin ag and or a lack ofkf supervision. >> jennifer. all right, trace, thank youcovee very much. we'll see you for more coveraget throughout the night.hat an and on fox news at night. thank you, trace. we go now live to memphis, where fox news seniorsteve harr correspondent steve harrigan is standing by . okay, steve ig, you've beenh may through many of these situations tonight.
12:05 am
what can you tell us about? the protest? terry nichols family has pleaded for them to beichols' fy peaceful. >> what ar peae you seeing? peal we have seen peaceful protests,r but certainly some annoying ainlprotest, especially for a lt of truckers as well. they're just beginning to move s . about three hundred protesters o managed to block this interstate. fifty five for about two or thrs three hours. a small grou. p really just lining the roads and blocking trucks, blocking traffic. a lot of people trying to get home, a lot of truckers trying their bu to do their business. they were chantingsi, take our lives, we take your money. that was the rationale foror the the blockage. they sarchust starte away now. so after aboutta a three to marr takeover of a section of se the highway traffic, once againe again beginning to move. it beginning to mov he here. viole it hasn't been violent, but they have made their presence felt. they've stayed out of midtownan. and the police kept their distance. it looks likike e a decision was made by the police just to let t them chant, yell themselves out and control a section of the highway for a few hoursfe time. shannon, back to you.
12:06 am
>> all right, steve , thank you very much. if you'll stic>>k around with ul through this hour, we'll come back to you. >> joining me now, howardyou. safir, former new york city m police commissioner. >> all right, commissioner, ifvs you've watched these videos, it's excruciating. it, s excrucia your watching a y being victimized by people thati we trustctimiz to and have a duy to protect our communities. these men are facing charges. they were swiftly fired.swiftly they were wearing body cameras. that's how we get so much ofof this information. is it your sense that they feelu justified in the behavior thatrt they carried out? and what we witnesse theyd in these four tapes? >> i don't know ifd they feltn justified, but there's absolutely no justification for what they did. you know no justio, i will alwao first defender of police when they're accused of improperln t but from what i know in this case, these are five criminals and police uniforms assaulting a man who is committing a mino violation. so there's no excuse foro this. i mean, there's a lotht we don't know.
12:07 am
as tracey pointee d out when werst video, t started that first video there, they're already rolling up officerse where a scen already i in there's already beenteon't some interaction. we don't know what led to that point. knoo that but later when they catc but there and then laterh , when they catch up with him, after he's run from them, there's such an enormous amount of response. i meanous, eight to 10 officers estimates at some point why that many to deal with one person? >> i reall dy don't know. but i can tell you that whatsion is lacking there, there's a lack of supervision. i don't see sergeant there with that number of police officers respondin police offict occasion. there should definitely be asioy ssenior officer or at leastupea a sergeant to supervise what's t'going on . now, this this was a really. egregious incident. t and i will say thahat the memphs pd and the mayor of memphis didr exactly the right thing. out they reached out to the transparen they were transparent and they fired the officers on the spot thou ,even though that's notly. protocol. normally, i think it was g to do. thin
12:08 am
>> yeah, there's been>> s some praise even froham benjamin e atp, who is the attorney, one of the attorneys assisting tothe family in the situation, saying that this should be a model for how quicklypolice depr the police department worked and also abouttmt how the distrb attorney worked there. f think we havite a little bit o what he said about how thisthis played out in this case, how fast the police chief ofpoli the policece c department terminated the and we look at what the district attorney bothr charges. this is the blueprinought going forward. and this time any of us will be black, will be held in. so, commissioner, he talkst th about the swift response. we've covered cases like this. you' whu've tracked them in the pasvt where therere have been weeks, months, even years, sometimes ys before the video comes forward,s
12:09 am
there is full transparency and it seems to only delayanspaf the inevitable, the suffering that will happen for the community when it's finally released. ll happethe communitt's finaand, happened, the underlying crime ther the e is this pain of feelingisled, that they've been misled or the community. this has beethn hidden from the. so what do you make of the swift response? responseis it, as benjamin crumd there, a real model forel how other departments, they have to handle something this horrific, get it donec an? it is a model. of course, each casedividu alis individual. it has its own facts.ey but in this case, i think they did exactlydid exac the rit thing. i had a similar incident when i was commissioner. i immediately reached out to the community and they immediately worked with the us attorney to get the four officers who were involved,l indicted, and they all ended up. going to jail. soso what's important is toto maintain confidence in the community, to lemaintat the, this is not the norm for policeo officers. >> thilis is really aberrant behavior by criminals in police uniforms.
12:10 am
by criminalsand they need to bet with and dealt with as quickly as possible. >> yeah, we know the vast majority of men and womenke who take the form on in any law enforcement agency and head out there do sago the vast majority and a very selfless, veryble wa. honorable way. and as you said, when there aret those who violate that trust and commit crimes, they must crimes,be quickly hauled out and tried. >> commissioner, thank you very much for your time. ti googood to be with you again. >> joining us now, pat ryder, nassau county police commissioner, and randy sutton, retired police lieutenannassau t with the las vegas metropolitan police department and the founder of the wounded blue .e okay, commissioner. this video is brutal.this is br there'utals a conversation about fry release it tonight. on a friday night. there has beeniday night. a bui we've been warned about how badd it was. and those of us who have watched it now know, unfortunately, that accurate the description was very accurate. it seems so far tonight thatit e people are peacefully protesting . e but what do you make of the timing of this release and how it's playing out ? is a lo
12:11 am
>> well, there's a lot that see on behind the scenes that the world doesn't get to see chief davis and her team downr d owin memphis did a great job. they briefed us three times this week. rcement all the law enforcement agencies around the country, major city chiefs, country, got t a briefing from the chief and her team giving us thef ande heads up so we can prepare she as she was also preparing for alspossible unrest in the t our community. >> so the timing of it, it'singf nobody cant choice. >> you know, nobody can pick. the right time. there' ths never a right time to give bad news to anybody.avim but chief davis, the team did a good job getting it outght. tonight. see so far , everyon everybody is staying calm. the messages got oute i calm.n t and we'll see how the rest off the weekend goes. we>> shay?th nnon: you and i have had this conversation, unfortunately, because there have been other casebeen oths like this and we r there will be cases like thi mst in the future. but we've talked about my latehe father was a law enforcement officer. there's nobody who hates a bad cop worse than a good cop because this now colors the ability for everybody a
12:12 am
to getbility for a out there sao their jobs. when you've got a community,co when you've got peoplemmunity ao who have been hurt, who are wary of you and don't wantt want to cooperate with police, how much bad has this case donew for the good men ?s this case doand women in unifor? >> well, you've hit a very important point. and you know what?y import we have seenant here is another watershed moment, i'm afraid, in law enforcement. rodney king was a watershed moment. george floyd and nowmoment, wee this this debacle in memphis. as a police trainer, i spent spt many, many years as a trainer watching what unfolded here in memphis. was actually shocking to me. i saw horrible policing. i saw bad techniques.i sa i saw w out of control officersl no supervision, no leadership. >> and this is a recipe for what just took f place.e. there was there was just there was just it was a feedingt
12:13 am
frenzy and it was it was policing at its worst. s policinow, i can tell you thit that from my sources in memphis, the rank and file realize that these individualsdu went wayal, way overboard and they support the the actions of the chief. c >> and that thathief not doesn't always happen. a >> so i'm proud of of the memphis officers recogni recognizing this this misconduct. bu t there's a lot of other here, s issues here, shannon, that we can go into reference their training reference, hiring reference. you know, there's a there's an. investigation needs to take place into the hiring practices that were taking place when thee these none of these cops have murdered more than two ore al three years on . so, yol u know, ifhire if we'red hired about the same time and you have it's a symptom. so it really needs to be to be addressed. that's coming down the roadip no that the memphis police
12:14 am
leadership needs to take a looke at. >> yeah, and there are a number of investigations, state these igl, that will dig into these issues and clearly make suggestions about what shouldha come next, what to play, what benjamin crump, the attorney for the nichols familycrime,, sd about race and police culture. here's his take. >> racism and bias is the institutionalized police culture is not just the police culture. it's the justice system. this to n't see officers doing this to white citizens becausewh our court system has said that they value white life more than any other life. >> now, against that backdrop,, i thought it was interesting i that the police chienterf theren memphis, s.j davis, said sheall thinks this actually is not anre issue of race. what she said is it's about. human dignity. integrity and accountability and the duty to protect, our community. bilitycommissioner, what do youe of that part of the conversation? >> well, they want to make it
12:15 am
about race, but the truth of the matter is our job is too prt protect and serve all we aree people, no matter your race, religion, your gender. we're out there to serve out the public. these five officers, they threw that out the window today.ffice out the windthey decided that te going to go above and be better than the law. and what they did in the attack on mr. tireder is is way abovemi the training muscle memorys t, n practice. how you play. the everything went out the window.t they let their emotions take and over and then they tarnish the shield. they ruined the reputation of all the good men and women out there, law enforcement that work hard every single dayd ever and go out there and take the risk. it's hard enough to retain its it not enough to recruit and now it makes it even more difficult. 'sthat's why we need the support of our local politicians like we do here in nassau county. do for the good folks that arey out there in uniform trying to serve the community. commissioner randy, we thankun you both very much. ity.sioner, we may come back .'g please don't go too far . offic the five fired officernos now

12:22 am
innocent until proven guilty. >> that is theguar guarantee oa our justice system. wht it wasbut it was really dift to watch these tapes tonight. what do you make of the charges pending so far ?e ch >>arge and it was physically revolting to watch those tapes . if you're not moved to thee depths of your soul by watching an extension of the state, ann extension of the state, we give police officers power.n they're not born with it.wi we give them that power. so they're an extension of us to watch an extension ofbeats the state, beat a helpless mansv to death. if that doesn't move you to theo depth of your soul, youru may nt have a soul. murder two is a knowing killing. i'm sure there are people outy there wondering why is this not murder one ? and technically, it couls not m. it's not premeditated. you're not going to convincetedy a jury of that, is it?ouon 't a killing during the course of a serious felony? is you mention kidnapping. kidnapping is a serious felony. what you never want to doo do is
12:23 am
is charge something. you're going to havearge some a a difficult time convincing 12 people of you can get 15hey years to 60 years for whatd wit, they're charged with . and my guessd my guess is if the convicted , they'll get the top end of that. so do no t jeopardizeen as a note guilty verdict, do not give any reason to say, well, it waswasnt terrible, but it was a premeditated murder charge. what youpremed could reasonably prove. >> and that's murder two. yeah.der 2. charge which you can prove. okay, i want to mention that the attorney general, merrickou garland, also talked todayral ci about a federal civil rights investigation under a color ofa law statute. what does that mean? how is that different thanthat f the state's doing here? >> yes. and both can go forward. there is no double jeopardy when when the feds pursuersue one cause of action and the state pursues another. no, there's a prominent movie tk out there and people think about double jeopardy. it's not double jeopardy. they're different sovereigns. color of state law.
12:24 am
>> you are just as i was explai, explaining, acting through the the power of the state.. i mean, these five individuals have no power except what they have been given. so they are acting given, on behalf of the state. they have taken someone's life. we havs lie seen other cases whd the feds stepped in, in my own state of south carolina, it wasc the feds who convicted dylann roofarthe feds con and the murdf nine black christians at mother emanuel church. so in a perfect world, the twof. systems work together and frankly, you go where you are most likely to get a conviction if your prosecutors and oftentimes that is federal court, wantplay somethy something quickly from one of the attorneys forin the nicholg s family and then get your response. >> i ds o anticipateof the mores . i'm not going to say the sta wht the state's attorney is going to do, but i will say that in that room that was absolutely discussed, it has not been ruled out. i can't guess what they're but going to do. but is there any questio in that
12:25 am
more charges should be broughtyo ?n, i in my opinion, in this person's opinion, there is no doubt. dou. >> and trey, the question hasesn been whether there will be more charges to these five officers or whether additional officers oricers orhr personnel who were on the scene may be charged. where does m go from here?e? >> well, it could be eithert col one , if you remember that initial car stop, which for the life of me, why in a word, will you get someone suspected of a minor traffic offense? offense and put them on the gro i mean, it could happen to you when and me, shannon, when wer get sophus speeding, could it be the officer that said,e stwant you to stop him? i mean, the closed caption says stop, but that's not what he sai said. he said stomping. could it be that they're considering considering takinggd murder one to a grand jury anyway? who was around this?anyone who i anyone who held mr. nichols, eld anyone who had a duty to stopd a and failed to do so is subject d to potential criminal culpability. o soand i hope the d.a. chargese
12:26 am
everyone upon which probableble cause exists.ex and i wish himis allts, and thn the world and getting allg the convictions. >> well, you know what that'l sn all abouow, t, having done ittry yourself. trey gowdy, thank you for, lending us some ofthan your expertise tonight. ks f to some ofyes, ma'am. >> thank you. what happened in memphistragic is obviously tragic. i've seen the video myself, you,i and i will tell you i was was appalled, struggling to find a stronger word. but i would just i tell you i ws appalled. um, the fbi working with thefbig justice department, uh, takes great pride in our culture of law investigations. and we wil and we will pursue, as has already been announced, an alrey announced, and investigation investigation here will do it professionally without fear or favor by the book.ionall wias i think is expected of us . joining me now, chris swecker, a former fbi assistant director , allchri across the fa says a color of law,ys color investigation and civil rights investigate will ongoing will happen on going into this. so what can you explain about
12:27 am
how that may proceed? yeah, this the fbi has beenabou investigating these types of hoceed?cases for decades. >> it is under title 18 of8 of e the u.s. code, its color of undr law, acting under color of lawld as trey gowdy just explained, means you're acting under y official your official duties during the course ofurse your official duties, of your official exercising thu been conferred on you. exercisire exercising them inpo an unconsciousng t manner. you're depriving someone ofe of a constitutional right under the color of your official position.color of your official. in t and in this case, their life. so is a parallel investigation at the fbi will run with the the state investigation. i don't e obviously has already indicted. i don't think the fedsthin will come in and actuallk the f indict if there are significantr sentences handed down. but if there's an acquittal orln if there aren't significant sentences handed down, they'll swoop in right behind this
12:28 am
prosecution and levy their own indictment and their own prosecution federally. >>utio and chris, what do you me of this so-called scorpion unit? it wasf this so-called this groy really supposed to be cracking down on crime. there aro be cracking downe thoe weren't bad reports about this group before, but thatout this group before, but th they thought obviously these weg officers were acting in a waya that's completely inconsistent y that'swith training, with whae expect of police officers. base >>on yeah, i wouldn't be surprised based on what i saw in those videos., if we don'if we don't find out thh there's some history with this unit, then when you have specialized street units that semiine semi independentlyd st, plainclothes, unmarked cars and that sort of thing,s, and they're on the stree t all the time. >> they need to be closely tim and proactively supervised. s ce and in this case, i saw no evidence whatsoever of supervision. what i saw was angry, undisciplined, unsupervised men with badges beating on somebody and nobody stepped up to issue any orders orders o supervision. and , you know, i think thatt goes beyond just these
12:29 am
five officers. i saw eventuallyi sa five , you know, five or so more officers mingling around. , al they're all talking and fist bumping and that sort of thing. i sense a cultural issue here with that unit and if we find out that that that has you know, if they have a history,or they're then you could actually see the city and the department get sued. >> shannon one poso, chris , at one point when we're watching thesere watchinvideos, they're talkinge discussing, i think at this point, terry nichols is propped up against a car. we und essentially, we understand it any kistd it too 20 minutes or e a little bit more for emts or dir any kind of medical help to show up.n have did these men have a duty in that interim to be providingsomn him some kind of assistance or medical care to the best ofhe their training while they awaited those professionals, the medical professionals? they absolutely did. they did she medicaly absolu professionals, when they did show up, didn't do anything. do it appeared to me and i thinkadn they've already been suspended. so there wthere was a duty
12:30 am
to to to provide medical aid or whatever whatever emergency aid th they were trained to do. the problem here is i've seee p no evidence of training.f traing i see incompetence. i see officers that could two a officers can't put handcuffs on a guy who's sort of resisting but not armed and not punching and not trying to harm the officers. he's jusharm the offict not bei. i see no evidence of of like thy training there. t you know, it's like they took gh five people off the street, gave them badges and equipment and said, hey, go hit"hey, go ht the streets and be cops. it's bizarre. >> chris , quickly, could you >> shann give me any kind estimate, even a rough timeline for how longlou you think a federal investigation would take? i'm assuming based on what weedl have seen in past practices, it's a matter of months. >> this is not something in a matter of days or weeks, bit they move a little bit slower, l but they're going to be looking at the same evidence that the district attorney and whoever invests whatever agencys theystigated this case, they'lli be looking at the same evidence. so i don't think it'll tak'll a i don't even think it'll take
12:31 am
a month. i think they'll put the fullthi court presthey'lt the s on and e this and they'll be ready to indict in a coupldy te weekss >> okay, chris swecker, thank>>n you very much.: chris swecker, for your time. we appreciate it, sir. >> thank you. up next, we're keeping an eye on protests in cities all across the country. we're goin all acrosg go live th in moments whereis one journalii has been walking with the protesters all night. >> we'll check in with him next. and once ignored, educational epidemic has become a nationwide issue. we are destroying an entire gender nation of children. our public schools have become targets of the culture. if they can't change the way you think, they want to change the way your children's. we're not getting the education that talked about responsibility. the teachers unions have become puppet masters and they are controlling legislators at all levels. you're going to see not just testing, but all standards
