laura:protesters took to the streets across the us last night, most of those demonstrations were people -- peaceful but the fallout is unfolding as the sheriff opens an investigation into two deputies who were also on scene that night. steve harrigan is live in memphis with more on this and the video we are about to show you is difficult to watch. here is steve. >> reporter: small number of protesters gathering in memphis at police headquarters. it is been largely peaceful since the tape was released at 7:00 pm eastern last night. the tape about one hour long, detailing what happened to tyre nichols on january seventh, first a traffic stop, initial beating, nichols runs away and a second beating, some details to note from that video, first, nichols was attacked with a variety of weapons, tasers,

batons, punches and kicks. at 6 foot 3, one hundred 35 pounds there is no sign he offers any physical resistance during the beating. instead he is restrained at times by one officer while hit by another officer. he calls for his mother several times. at some point officers even wind up or run to deliver a more powerful kick or punch to the head of nichols. for 10 minutes after the second decisive beating that lasted 3 minutes, no aid was rendered despite the presence of two fire department emts on site. we can see more charges against those police officers who were there who stood by and did nothing. >> a statute, criminally negligent homicide, could face one to 6 years if convicted. it says you are negligent in your actions and had gross deviation from the standard of care. >> those 5 officers who carried

out the beating are released on bond. they have several felony charges include aggravated kidnapping and second-degree murder. laura: so many tough elements. rich: demonstrators hit the streets across the united states. most protests were peaceful after repeated calls for nonviolence from the nichols family and local and federal officials. is tense in some major cities. >> reporter: nationwide demonstrations follow the release of the intense body camera footage and in some places it preceded it. in memphis protesters display grief and outrage over police brutality blocking off traffic on i 55, the bridge that connects tennessee and arkansas, that lasted 2 hours, no damage reported. >> this is about humanity, this is one hundred one humanity. we need to be able to raise our

voice and help the family raise their voice so we are out here tonight to make sure we alleviate some of the pain that will never go away. >> a handful of demonstrators can see stopping on police cars in times square last night while yelling burn it down. police fired tear gas in an effort to disperse an out-of-control crowd outside the police department headquarters. tyre nichols grew up north of their, 350 miles in sacramento. he relocated to memphis in 2,020. 's family described him as a joyful person, a loving son and father to a 4-year-old boy. no indication he had any kind of criminal record. 's mom told him he was near-perfect, and spoke about what he was doing on january 7th. >> he was on his way home, to

watch the sunset. that is his passion. going to the skateboard, but he was on his way home. >> the memphis grizzlies held a moment of silence before their game in nichols's on a. a friend told the new york times, at one point nichols considered becoming a police officer. and changed things. rich: thank you. laura: president biden at camp david, calling the family of tyre nichols, he put out a statement after the footage was made public calling on congress to pass criminal justice reform. this comes as the white house continues to defend the president's handling of classified documents. national archives asked former presidents and vice presidents from the last 6 administrations to check if they are holding

onto sensitive materials. lucas tomlinson live from the white house. >> reporter: before seeing the video, president biden spoke to reporters before flying to camp david. >> a lot to do at the image of america, whether or not we are the country we say we are. a country of law and order, and the means we peacefully protest and make judgments. >> reporter: after biden saw the video, the white house saying like so many i was outraged and pained to see the horrific video of the beating the result in tyre nichols after death, reminder of the fear and trauma, pain and exhaustion black and brown americans experience every day. the former vice president mike pence making news, also found classified documents at his home in indiana.

he spoke to richardson, his first public marks on this since the classified documents were found. >> mistakes were made but i take full response ability for it. i'm directed by counsel to work with the department of justice with the archives and congress on a full investigation and we are cooperating as we speak. >> reporter: democratic caucus when sean garamende spoke on this. >> there's a difference between the trump situation and the pens situation, president biden voluntarily turned over their documents. trump did not. there's a difference raise there. clearly, if there's a felony conviction, that would be disqualifying for whomever. >> reporter: there's a long-standing policy the part of justice not to charge a sitting president with a crime and that is unlikely to change. laura: thank you.

journal and a fox news contributor. thanks for joining us this afternoon. do you think former vice president pens has managed to separate himself from the heat we have seen from donald trump and president biden? >> circumstances have separated him from donald trump, and so too former vice president, now president biden, in a certain regard the fact that this has happened to republicans and democrats sanitizes this as a political issue in the campaign. everybody can point at the other candidate at this point but some of the circumstances around how the documents were found and handled will perhaps dictate a different level of political discussion. as pence pointed out, he went to the authorities to say we found these. biden the same way, they invited the authorities to do additional search. donald trump did not do that.

there are questions about obstruction, respect for law and order. he was fighting with the national archives for a year, there had to be an intrusion into mar-a-lago where they found additional documents. it's a difference in tonality for sure and some legal issues as well, but overall at this point the question is who next? rich: that is a good question. when you look at who could potentially be on a debate stage a few months from now in a republican primary, you've got a number of republicans who served in the trump administration or at least in congress, all with access to classified information. do you expect that some of these more finer points, that could enter into a republican debate, when you take president biden out of the equation and just have republicans on stage

do you think this becomes a major issue with donald trump standing there? >> it could, you make a good point, nikki haley, former secretary of state pompeo, do they have documents, they don't expect they do, but moving out of the white house, out of the un is a messy prospect and things get thrown into boxes. some of this will happen to -- wait to see what was in the boxes. how sensitive was the material? should they have known better? should there have been better tracking? do you want managers who can't manage documents like this managing the affairs of the country, some of that will be an issue, and who else finds the documents. i do think the trump situation is slightly different but at the end of the day, lindsey graham said a problem that had

been a problem for republicans, a political problem for the republicans has now become a national security concern for the country given we have so many documents found in garages, libraries, and places that they shouldn't be. rich: you talk to people in washington who are not senior administration, they go through all the steps they have to take to review classified information, to reserve the skiff, to get the time to do that, the penalties given for those who violate it on a lower level. here you have a number of senior people saying hoops. does that play into this at all? >> it probably does. the top people at the top of the food chain get a little more latitude. this is going to come down to nature of the documents that are found, also, whether the

individual cooperated, or tried to obstruct justice or whether they didn't. it is a messy business and everything you are saying about the documents, we are talking tens of millions of documents that end up in the national archives or presidential libraries where they are supposed to be transferred by the national archives and it gets to other issues like are we classifying too much. and procedural things, itineraries for travel, that really aren't a national security issue any longer. should that be addressed, reclassification take place downgrading a lot of this, should we be better at handling it, handling the day when the movers arrived, should there be better oversight? rich: terrific perspective as always.

laura: shocking details on the person accused of attacking nancy pelosi's husband during a home invasion last year. hours after police released this graphic body camera footage from the october incident, the suspect called our fox affiliate in oakland with the chilling apology for not going any further that night. christina coleman is live with more on this. this is wild. >> reporter: very bizarre. a coalition news agency including fox news filed a court motion to gain access to audio from paul pelosi's 911 call and police body camera footage of the attack over objections from prosecutors who claim publicizing the evidence would lead to a distortion of facts. rumors were swirling about this case. san francisco judge ruled in favor of the media. we can show this video and clear up questions but we want to worry and our audience the video you're about to see is disturbing and graphic.

of them. >> >> for federal charges combined, sent to prison for life. laura: christina coleman, thank you. rich: three people are dead and others wounded after mass shooting in california. los angeles police say it happened in a short-term rental home in an upscale neighborhood just north of beverly hills. the lapd says 3 victims were killed while sitting inside a car. two of the four hurt are hospitalized in critical condition. authorities are not releasing information on the suspect who is still at large. police are trying to determine a motive for the shooting. laura: a group of doctors fighting the biden demonstration saying they are being forced to provide gender reassignment treatment to go

people carrying fentanyl but there's a reason is they didn't turn themselves into take advantage of the giveaway program of the biden administration. >> reporter: there are migrant encounters, the people border patrol or texas dps capture and that is a staggering figure. the us government reports there were 250,000 migrant encounters last month in the month of december. that is an all time high. laura: the biden health department requires doctors to provide gender transition surgeries and puberty blockers even if those procedures go against their professional judgment. two medical organizations are suing the biden administration claiming the mandate violates healthcare workers rights of conscious speech.

>> federal law guarantees anyway they can see their patients, treat them as they really are, follow medical judgment, not experiment on them and respect their consciences, above all do no harm to their patients. laura: doctor marc siegel, always good to see you. if you could explain what the health department does, sounds like gender transition surgeries are happening frequently. tell us about it. >> we have been reporting on it for a while now, what is the age? 1.7 million people identify as transgender. gendered dysphoria is less than one% of children.

many by the age of 10 to 13 no longer identify that way. what we don't want to do is intervene with something somebody regrets later on. if you identify as transgender, you need a support system. there are issues of therapy involved, and then it is the do no harm point which is once you start with puberty blockers, hitting kids when they are at puberty, when they are supposed to get an outpouring of hormones, it affects bones, fertility later on, and development. the surgeries are irreversible. i think the issue is at what age do you talk about this and the second point is doctors should be free to say what they think. we can't be muzzled and if you have a physician that isn't in

favor of this, go to someone who as if that is what you are looking for. there's 20 of choice here. >> reporter: a lot of patients talk to their doctors and say what do you think? that's part of seeing your doctor and i want to bring up the age, you talked to any teen-year-old who regrets transition surgery. listen here. >> i didn't understand what i was doing to myself, the loss of my breasts and potentially my ability to mother children nationally, might be the most painful part of it. laura: tell us about that interview. >> very disturbing that somebody would reach the age of 18 like that and say maybe i made a mistake. it is -- emphasizes the point i am trying to make, what age are you considering doing this and are we looking at long-term side effects? with of that person it was surgery but even the puberty

blockers, we don't know the long-term side effects. i must point out to show the other side of this, plenty of people who go through gender reassignment are happier as a result, not that we are against it, but when it is considered and who doesn't does it, not all doctors should be compelled to tow the line, that is not what medicine is about. >> these medical organizations, is this something you can see going forward or is this something that will be held up in court's? where are with with that? >> everything is held up in the courts because it is always political but from a medical point they have a fundamental point that people shouldn't be forced to practice in a way that goes against their religion and ethics, same we feel about patients we feel about doctors, it is inevitably going to be political and that is not where it is a, it is a medical issue. >> how does the process work

for doctors, they consult with the patient, parents too if the patient is 18 but what happens when there are regrets? anyway to reverse these procedures? >> of course they can be reversed. that's more arduous. if you are talking implants, restoring something that has been taken. the important point, what role do the parents player? is this a political situation? doesn't come from a child? it does come from the child. where's the support system? where is the role of therapy? there are issues regarding psychotherapy that have to be looked at before you proceed down this road. laura: we will follow this with you. thanks for joining us today. rich: expert say giving thanks to ukrainian forces could be a game changer in the war against russia but it will be months before the first american tanks reach the front lines and

laura: ukrainian fasttrack talks with allies about equipping long-range missiles and military aircraft as the us and germany agreed to send tanks to the war-torn nation and russia continues its assault. trey yingst has more on this. >> reporter: intense battles rage on as russian forces look to capture more territory.

in the don bas region, new vido shows the scale of destruction with widespread damage from artillery battles. the town sits to the southwest of donyet, and their making progress threatening to encircle ukrainian stronghold by cutting off the main supply line. 3 civilians were killed today due to a russian missile attack as others were injured. overnight, ukrainian president volodymyr zelenskyy described the situation. >> translator: occupiers, not just throwing our positions. they are deliberately destroying towns and villages around them with artillery, airstrikes, missiles. the russian army has no shortage and can only be stopped by force. >> analysts believe russia is

preparing for more extensive ground operations in the coming weeks perhaps to get away of the delivery of western tanks. the ambassador to france said 320 tanks been promised to ukraine including the german-made leopard 2s and the m one abrams. ukraine is asking for western fighter jets specifically f-16s. going to reports, they might just get them. laura: thanks for that report. rich: almost one year into russia's war in ukraine and no sign of peace talks between the countries. ukraine maintains control of much of the country, russian forces have gained ground to the southwest. some more analysts say sending more tanks, long-term aid from the us, germany and other allies could be a game changer. let's bring in ambassador kurt volcker, former ambassador to nato and special representative for ukrainian negotiations. thanks for joining us.

i want your take on the us and nato announcement to send tanks. is that a game changer? >> i wouldn't call it a game changer but it is a step up. every little bit counts. we saw the us provide stingers that help with air defenses, patriots that help with missiles, tanks will help blunt any potential new offensive coming up in eastern ukraine and may help ukrainians punch through russian lines to go on a counteroffensive later this year. all these things add up. the bottom line after a year of this war is russia is unable to win. they are trying to consolidate what they can. this is ukraine's moment. to try to push the russians through. rich: russia has been unable to win but is ukraine able to win? what does victory look like for ukraine?

>> it will play out this year. if ukrainians are successful in pushing that ground line of communication, that will help isolate crimea. and try to push back into the donbas area and luhansk, that will cause people in russia to question what they are doing. rich: that will set the stage for negotiations between the countries? there's been discussions but nothing serious. >> putin has 0 interest in negotiation. he's trying to set the terms militarily on the ground, take as much of ukraine as he can and ideally wants to topple the government, they still talk about demilitarization. they have an absolutist position. if they are losing on the

battlefield and others in ukraine can put the military leadership and intelligent leadership see this and they know it will get worse, it could set the stage to think about how to end it. >> we are beginning to hear some reports that russia is planning a major new offensive ahead of the one year anniversary which is a month from now. does russia really risk building up at least to their population, there military, that they are going to do something far reaching if that offensive fails like many of their offensive has over the past year, what is russia risking? >> that the point. it does risk failure, they are not training their troops, not recruiting as many as they want. they don't have equipping to give them, personally quit or unit-based equipment. no real reason to think this is going to go better for russia.

you are right that sets a condition where the population is expecting to see progress. if they see another failure it will have implications for the regime in moscow and the direction russia takes the war after. rich: you know ukraine very well. what have you seen change in ukraine since the invasion? >> a lot more self-confidence, they always believed in themselves in terms of national identity. but they were always unsure about their military capability. they were going to do their best. we've seen them become more capable and confident. that is the result of the training and equipment they are getting and continued support for the united states and other

countries and battlefield successes as well. in addition, i think ukrainians, we saw millions of them leave the country at the beginning of the war, fear the war was coming to them. millions of gone back. we are seeing ukrainians, to the country, trying to build and that is an indicator of where things are going to go in the future. rich: you have tanks, and discussions about fighter jets and war weaponry. does that help? on the flipside does that risk retaliation in the west? >> of russia could do more, they will already be doing so and they can't afford to widen this war and direct engagement with nato forces, they are having a hard enough time with ukraine as it is. i also think it is an

beating of tyre nichols, scorpion unit was launched in 2021. it stands for street crimes operation to restore peace in our neighborhoods. it was focus on violent crimes like homicides, assault, and robberies. five former officers have been charged with murdering nichols's death. it is unclear how many were involved. it comes as protests against nichols continue across the country. here is alive look at a demonstration in memphis. we will continue to follow this and other developments for about the day. laura: there is more violence rocking israel. police say a 13-year-old palestinian gunmen wounded two people today in east jerusalem, this coming the morning after another palestinian open fire outside a synagogue killing at least seven people. kitty logan is live in london with details on both attacks. >> reporter: this latest

shooting took place in east jerusalem and it comes at a time of rising tensions in the city. israeli police say young palestinian teenager opened fire wounded a father and son, they were both rushed to the hospital and are said to be in stable condition, this follows the deadly attack outside and is really synagogue, the worst in many years, 7 people shot, 17-year-old woman. ten people were wounded and what is really police are calling a terror attack. police have made 40 more arrests. the israeli military is sending hundreds of troops to the west bank in response to the latest violence. they are on heightened alert. tensions have been running high already after an israeli on thursday at the refugee camp in the west bank.
