pain and anger spilling into the streets of memphis and across other cities in our country. protests have been mostly peaceful after friday's release of body cam video showing the brutal beating that led to the death of tyre nichols. demonstrators now demanding justice. hello everyone welcome to fox news alive i am arthel neville, hi erica. >> hello arthel thank you for joining us i am eric shawn. five officers involved in a deadly beating have not fired and now charged with murder.

some are members of the city's so-called scorpion unit scorpions answer street crimes operation to restore peace in our neighborhood. yesterday the memphis police department permanently disbanded that unit. >> eric we are also learning the five former officers will make their first court appearance on february 17 to be arraigned on murder charges for charles watson is live in memphis. charles, first off what can it tells the timetable for this arraignment? >> well, arthel, those arraignments will happen a few weeks from now as you mentioned on february 17. we are unsure whether that is normal timing for something like that barely reach out to a defense attorney who said it is a normal timeline for those arraignments considering five former memphis police officers taken into custody last week after a grand jury indicted them and freed after posting a bond

that raised anywhere between $253,350,000 were getting this information just a day after the memphis police department announced known as a scorpion unit this three crime task force that included some of the officers that were involved in the brutal beating of nichols during a questionable traffic stop that led to tyre nichols to death but we are told the remaining officers that were assigned to that unit agreed with the decision to shut it down. the attorney who represents nichols family said this was an easy step in a tweet he says abolishing the scorpion unit in memphis is low hanging fruit that is easy. nonetheless police the corrupt unit is now gone. now the real reform is required. this development follows a release of the body cam video

which frankly two days after it was released it's really hard to still watch. showing officers savagely kicking, punching pepper spraying as seemly defenseless nichols. all five men have been fired interfacing second-degree murder and other offenses related to nichols at death. >> this is not a matter of training for this is a matter of basic humanity. i don't how you train police officers into having the moral character necessary to not commit murder on the job the way that they did. >> you know, arthel, we are also learning former police officer demetrius haley was named in a lawsuit accusing him and others of brutally beating an inmate where haley worked as a corrections officer for the inmate in question tells the "new york post" during a search for contraband heat wasn't punched by officers in the face at least twice in his face was

slammed into a sink. he claims haley was the most vicious. i do want to note the lawsuit that was filed by that inmate was ultimately dismissed by a judge because he ruled the inmate did not properly serve one of the defendants in that case, arthel. arthel: don't apologize to our viewers we should have warned you we were going to play that video. i personally have not watched it, i cannot watch it is disgusting. so i apologize we did not give you a warning we're going to show it to you. but charles i do want to ask is or something more we can expect in terms of development this coming week? it's. >> yes, couple things this week, arthel. we were told last week about two memphis fire department employees were relieved of their duties pending an internal investigation into the care or lack thereof they gave to tyre nichols after that brutal beating for the memphis fire

department tells us results of that investigation should be completed sometime this week. we're also hoping hoping to learn more about the internal investigation injured to shelby county sheriff's deputies who showed up on that scene after that brutal beating of nichols. it investigation is ongoing were hoping to learn more about that and then of course we are expecting on wednesday the funeral for tyre nichols. we've been hearing from the family all week long but reverent at the funeral. throughout the week we've heard the family said they want a peaceful protest. that is what we have seen so far, arthel, people seem to be really respecting the families were discussing the mother of tyre nichols we expected to be a pretty emotional week. arthel: what a dignified woman she is in the protest happened peaceful which is really great. we have to show the video because people need to see how

the so-called officers beat poor tyre nichols savagely. it is horrible. alright charles watson i know you're staying there it memphis and will continue the coverage forced from down there. thank you charles watson, eric appears to be for what can we expect for the officers arraignment and the consequences for law enforcement as the department of justice opens it civil rights investigation process for your former attorney general united states find and why a civil rights investigation? can you explain that considering the officers were black and the victim tyre is blacksburg texas civil rights team skin color in no way was the cause of what happened here. the video is very, very tough to

watch there is no question about it. there has to be accountability. the department is going to work closely with the memphis officials. whether they will come in officially will depend whether or not they are comfortable that there would be investigation by the city that city may on its own. invite the department to come in and work with them but frankly i think confidence perhaps in the police department perhaps in city government generally it may be shaken. seller may be wise to have the department of justice involved. typically the department is also very sensitive about not intruding upon the police powers of local governments. we will just have to wait and see what happens. one thing i do want to mention in that is i have a brother who was a police officer for something like 30 years in houston. day and in day out police officers do a great job. it's only a few that because it's kind of coverage for a promise you since the day of

january 7, the day of this beating yes we did lose a life and mr. nichols that was tragic there should be accountability. but there's probably been scores of lives saved by the good work of police around the country. one of the things i wear about these kind of incidents and the coverage, obviously it's important, we need to have coverage in order to ensure accountability is that it discourages a good people -- it encourages people to and i think that's unfortunate. let's remember folks, while we need to pursue accountability here, and a question about it. police officers risk their lives day in and day out for people they do not even know. eric: overwhelmingly we know law-enforcement does the right thing. obviously this is any type of decency. does the d.o.j. also look at police training? procedures? supervisors? the culture that could potentially make these officers think they can do this without

impunity that could be in the memphis police department? >> no question about up or they will look at prior incidents for example per they will look at training. nothing is off of the table as far as looking to see what may have caused and contributed to this. because you sure don't want anything like this happening again. really there's a lot of unanswered questions still today, why was the initial contact so vigorous? an escalated so quickly. in my mind and talking to other law enforcement officials, a lot of question about what happened here? what was the motivation? what was going on here? there still some questions we don't know the answers too. obviously whatever those answers may turn out to be, the response that occurred that we witnessed on that video was not justified. eric: talking federal oversight could there be legal action for a dissent decree? we've seen other local

departments taken over basically had federal oversight we saw baltimore, new orleans, ferguson, missouri after that incident. and elsewhere do you see that potentially happening here in memphis and oversight by the feds over the procedures and actions? >> yes a consent three is an agreement between the local authorities and the federal government. an order is issued by the judge. parameters are established in the consent decree so very possible we will set happening here in memphis. one of the things they will be looking at -- typically one incident is not enough. they will be looking at the history of what is happened in memphis before making that kind of decision. so from that tragedy the poignancy of this happening in memphis the national civil rights museum nearby and the history of that city. your sense in your reflection on civil rights and overseeing unfolding here?

well i currently reside in tennessee in nashville. there is a long history. proud also tough history about racial relations in the state. we like to think perhaps we are bonded beyond the civil rights violations that occurred back in the 50s and 60s. obviously more work needs to be done. this is something that's taken very seriously here in the state of tennessee per expect the officials in memphis, the governor's office to relate look at this very closely for this is something we need to address forcefully and quickly. the four absolutely. missed former attorney alberto gonzales. arthel: eric, more dramatic testimony expected tomorrow in the murdoch murder trial that's also been gripping the country

president biden saying in the vein of protecting asylum-seekers while also quote securing the safe removal of migrants who have no legal claim to stay in the united states, they expressed disappointment again with the new biting policy that provides a more legal options a safer asylum-seekers from those countries. given no path to become citizens of the united states. what is your reaction to these lawmakers concerns? >> they're trying to say what's going on at the border is important to them but what they want to do in essence is not allow the president to exercise his authority under title 42. again the u.s. law passed by congress to send people back into mexico from those four countries. and then on the other side of doing some kind of legal avenue for people to apply online from home. they have no authority to speak on this. this has been a problem for both democrats and republicans for quite some time.

but they're advocating for is a lot more people into the night states illegally and had them release at the border. that is what they are advocating for blaming the president saying they are disappointed there were all disappointed was seeing the images you just showed on the tv screen of thousands and thousands of people coming every single night. what those lawmakers know what they failed to send their statements many people come here seeking asylum will never go to immigration courts were there were no more follow up on this claim is for these the roots of asylum to come into the country illegally, be released by cbp never to be seen again. i first saw title 42 was a covid enacted restriction just because we did not want to bring diseases or markovian into the country. that is been lifted and charge it wanted that to go away, correct? is it still standing, you are the expert on this. what is a deal on title 42? it seems she wanted there but the judge says no we can't do that.

>> is not a perfect scenario is not a perfect fix for what is going on but allows a border patrol to adjudicate cases and expel people back into mexico quickly. so instead of spending two or three hours and putting them into the system and releasing them, they booked them it really quickly adjudicate them and send them back to mexico for that gives them a better workflow gives them more time for that will give them more time to patrol the border, and to discover human trafficking to make drug seizures. if you take that away you're going to exacerbate the problem that we arty have. arthel: got it, let me move on the biting policy states again 30,000 migrants from the four countries i mentioned, they will be eligible to apply for humanitarian parole protection from their home countries and mexico has agreed to take back 30,000 of those migrants per month. isn't mexico fully committed incapable of hurting 30,000 migrants a month and mexico and processing is ready at the u.s.
