president is having speaker meet with him. he said he would always work in bipartisan way and reach out to republicans and work with with them where they wanted to but he has a position that i think a lot of democrats have. we've spent this money. it's time to pay the bill and if you want to talk about cutting spending which i think a lot of people would agree we have to, then we can do that at a different time. this isn't the time to do it. it's also really politically hypocritical for republicans all of a sudden the care about the debt and deficit when donald trump ran you have 25% of 31 trillion and they raised the debt ceiling without hesitation 3 times during his presidency. it seems they only find fiscal responsibility when democrats are in charge, but democrats are willing to talk to them about it. they are just not willing to do it when you're riskying defaulting on our credit and collapsing the global economy. that's where the difference is. it's who joe biden, he will work with anybody. he got a ton of bipartisan stuff

done in the two years and i bet he will get more done in the next two. mike: critical face to face on what is expected to be hot issue between now and june or so. >> well, i think it's good that president biden wants to come to the table this early. i think one of the points that speaker mccarthy has made and couple of democrats have made and take ridiculous point that republicans want to chop social security and medicaid. it's been a talking point. the difference that we are with trump with the debt ceiling, debt limit and joe biden is we had 7%, 8% inflation fueled by democrats reckless spending. for two years democrats could have solved the problem, they didn't, republicans are willing to come to the table to get this done, make good on the money we've already spent here, raise the debt limit but there has to be talks and rein in inflation and rein run away spending.

mike: here is texas senator ted cruz from earlier today. >> there's an entirely different level that we need to know which is whether any of the classified documents that joe biden had illeillegally in multiple locats involve his own family's business activities and potential corruption. mike: jonathan, how do you respond and what about the questions being asked about the president's handling of those documents? >> i think the stark difference between how the two are handling is president biden has worked with the justice department, he's worked with t the national archives, he said i'm going to be fully open and transparent with them, we not going to talk about it or tweet about it because it is irresponsible to do. i know it is boring for us when we want to cover something but there's big difference how president biden is handling in responsible way and how donald trump who has lied, deceived and ignored subpoenas also i hope ted cruz is just as concerned if

any of trump's kids had dealings with china, saudi arabia about what classified documents he's kept. i just think we have to accept that this is going to be handled the way it's supposed to be. look, mike pence and joe biden don't have a lot of in common but what they do have in common they handled this responsibly and correctly and that's why you are seeing the justice department come in, special prosecutors getting appointed and they are going to investigator it and at the end of the time they will figure out what it was and they will make the report. it went -- you won't be hearing tweets and leaks and comments from the white house like we were so used to under the trump administration. he's doing it the way it's supposed to be done because he has such a long history of dealing with this information and i'm confident at the end of the day, yes, some mistakes were made and handled appropriate way after we figured it out. mike: garrett, frustration between the intelligence committees in the capitol hill about information that lawmakers are receiving as it relates to

these classified document probes, what about that? >> so i think one interesting thing here, there is a stark difference, though, between the way that donald trump and joe biden handled these documents which is this, the then vice president certainly then senator joe biden had no legal right to declassify or maintain the documents. president trump and his lawyers have put out memos saying they did declassify, he had declassification authority. vice president biden at the time did not. so there is a stark difference there. let's also be real, the fbi and doj showed massive bias raiding the former president's home when he had heavily guarded and secured mar-a-lago, big difference than having in home, garage that's not secured. joe biden is not handling responsibly, interesting talking point and hilarious to think through but not the case at all when he had no legal authority to be able to do this to begin with. >> i would just point out that there was a-ia boss just photographed at mar-a-lago and chinese officials constantly at mar-a-lago so the idea that

mar-a-lago is a secure place is -- we don't know where the documents are stored and one of the things about the memo about declassification is none of those people have actually said that under oath because it's very different to have your lawyer go on tv and tweet about something than it actually is to say it under oath before a judge and that's why you are not seeing it done that way. also i point out none of the national security officials who would have known about declassifying have ever said they knew anything about him declassifying any information that he then took with him to the white house. it's just good to clarify those points. mike: garrett, final words. >> i would push back heavily. president trump as the president has right to declassify. presidential records act apply certainly to former presidents and not vice president. dc circuit case under obama and obama judge, bill clinton stored 8 years of records of tapes in his sock drawer essentially, dc circuit judge ruled he had

authority to do that. the same applies to president trump. jonathan know this is working in the senate they have no right to have the documents in unsecured location in his garage. mike: we will follow all of it. to 2024 here is former president trump out on the stump. >> this campaign will be about the future, this campaign will be about issues, joe biden has put america on the fast track to ruin and destruction and we will ensure that he does not receive four more years. mike: is that more effective jonathan? >> it's definitely better than him constantly complaining about a fraudulent election but i do think, look, joe biden ran defeated donald trump just saying this he would provide a better america and alternative to him in 2020 and he won by 7 million votes. in 2024 he will have probably the best record of any first term president to run on and

contrasting that with donald trump who i imagine is going to add some point go back to his airing of grievances and weird conspiracy theories that he brings up and that will be the majority of his campaign. i'm so excited that donald trump is out on the campaign trail. ly giver him money, i will volunteer for him if it helps him be the nominee against joe biden i can't wish for a better race in 2024 as a democrat. mike: i'm sure garrett wants to respond to at least some of that, one possible candidate is new hampshire governor chris sanunu he said today that he thinks former president trump has lost his mojo. >> he comes to new hampshire and frankly gives mundane speech. he went away. he's not really bringing the fire, that energy that a lot of folks saw in '16. in many ways it was disappointing to some folks. mike: garrett, your thoughts and what do you want to respond to jonathan's comments -- >> yeah. first, a real quick response if

charles watson live in memphis tennessee with more details. charles: we are learning that the five former memphis police officers charged in the death of 29-year-old tyre nichols will officially be arraigned in court a few weeks from now on februarg this bit of information less than a day after the memphis police department announced that it has permanently deactivated what's known as the scorpion unit. it was a street crime task force that included at least some of the officers who were involved in the brutal beating of nichols during what is considered a questionable traffic stop on january 7th and officials say led to nichols' death. while we are told they agreed with the decision to shut it down, attorney says this was an easy step and in tweet says quote, abolishing the scorpion

the unit in memphis, that was easy. the corrupted unit is gone, now the real reform is required. now mike, this new development about the scorpion unit comes after the release of body cam video that i want to warn our viewers is disturbing and quite frankly hard to watch even for me. on the video you see officers repeatedly and savagely kicking and punching and pepper spraying the defenseless nichols, all five men have since been fired and facing second-degree murder and other offenses in relation to nichols' death. >> this is not a matter of training. this is a matter of basic humanity. i don't know how you train police officers into having the moral contract ernesto not commit murder on the job the way that they did. charles: yeah, we are learning more about the officers specifically former officer demetrias hailey, he was named in 2016 lawsuit accusing him and others of brutally beating an

inmate at a prison where hailey worked as correctses officer. the inmate in question tells the new york post during search for contraband officer punched him in the face at least twice and slammed his face into a sink. he claims hailey was the most vicious of all of those officers. now i do want to note, mike, that the lawsuit was ultimately dismissed by a judge because he ruled that the plaintiff in this case did not serve one of the -- one of the defendants properly so the case was ultimately thrown out. as for protests, mike, they have been peaceful the whole way through. we heard all week long from the nichols family specifically his mother asking people to protest peacefully. mike: charles from the outside it feels like memphis authorities have responded swiftly. they cannot do anything to bring back the young man's life but it seems like they've been swift in taking action. do you get a sense from folks, the community there that that's

been helpful in terms of seeing some action at least by authorities? >> yeah, i do get a sense from folks in the community that the swift action in this particular case has been helpful. it has put a lot of folks at ease but let's be honest, mike, a lot of people are still upset about this and we heard from civil rights attorney ben crump who says this case needs to be the blueprint for police misconduct moving forward, acting swiftly and giving the families justice. it shouldn't take forever for charges to be brought in a case like this. mike: charles watson live in memphis, many thanks. more twists and turns in the case of alex murdaugh on the murder of his wife and son after the break. ♪

mike: disgraced south carolina attorney alex murdaugh trial will resume tomorrow after breaking for the weekend, murdaugh accused of shooting and killing wife and youngest son at the family's hunting lodge in 2021. senior correspondent laura ingle is live with the latest on the shocking case, hi, laura.

>> hi, mike, you know, most of what we learned in the first week of testimony at trial was about the evidence in this case who collected it, where it was sent and how it was processed. alec murdaugh charged with death of maggie and son paul in estate in south carolina told arriving officer that the murders could be related to beating accident which his son paul was involved with telling officers his son received many threats after a friend of his was killed in the crash. maggie and paul murdaugh were shot at close range leaving bloody crime scene and when alec murdaugh was questioned, officers noticed there was no visible blood and hands and white t-shirt even though he told investigators that he had touched their bodies to check them. a detective told jurors last week of devastating injuries. >> and then the first body that i approached was the deceased

male. he was laying down in angle with feet inside plane of the door. there was obvious trauma to the top of his head. he was covered with a sheet but i could see the top of his head from underneath the sheet. obvious trauma. >> prosecutors contend to distract from legal problems and slow down the attention of 98 criminal charges against him. murdaugh surviving son buster has been present at the courthouse during testimony and expect today be called as witness and when asked by the daily mail in november if he would be supporting his father he answered he doesn't want to see it written anywhere that he is supporting his father. tomorrow's session will begin with cross-examination of one of the inves investigators. he faces 30 years to life if convicted. mike: more on case in eye-popping mysteries surrounding the murdaugh family

live attorney and king's college senior fellow mark smith. mark, welcome. so here is an argument made in court by the prosecution, let's play it. >> neither paul nor maggie had any defensive wounds and the evidence is going to show that maggie and paul were shot at close range and the evidence is going to show like a tattoo when you got shot to weapon it leaves marks that the forensic pathologist can see. they were shot at close range and they did not have defensive wounds. mike: mark, what about the argument in the case that the prosecution is making? >> well, the most important thing to understand about this case right now it's clearly not a slam dunk for the government and the best proof of that is the government's own actions. they've alread t notion that they will seek the death penalty which in and of itself is indication the government has concerns that they may not win this case.

the other thing too keep in mind, mike, this is a circumstantial case, everyone agrees with that although you can be convicted on circumstantial evidence it does make it much harder and gives the defense a lot of opportunities to pick a way at the prosecution case and as the to this specific argument about no defensive wounds that's true but then you also have to look at the fact that there was no blood on the white t-shirt of alec murdaugh suggesting did he change his clothes or not there, i wasn't there when it happened. mike: key pieces of evidence presented during the trial, let's put them on the screen to show our audience. there's the 911 call from murdaugh, bodycam footage and the listed evidence suggests it was family gun. the seat belt of his vehicle, dna from the victims on alec murdaugh's shirt, what about

that and how it's being presented in court? >> i think one of the key moments coming up in this trial is the forensic evidence involving the blackout cartridge and whether or not the casings associated with that rifle round lines up with other rifle rounds and on the property shot at different times and as we know neither the shotgun nor the rifle that was used in the murders was found. can't find it. so what the prosecution is trying to do is to say that the cartridge rifle casings found by the wife's body match but they haven't found the gun and that's subject to a very difficult cross-examination when the state presents the expert testimony which i'm sure it's coming up in the next several days. >> how difficult of a case is this when you have no direct witness, no camera evidence as you mentioned no weapon and no

obvious motive for murdaugh in the killing of his wife and son? >> i think it is a difficult case for the government. that doesn't mean they are not going to win by the way but before they can use circumstantial evidence, it's very difficult. usually in a case like this, there's a clear financial of some other motive. a spouse is having an affair, life insurance, proceeds, something clear benefit to murderer -- the alleged murderer, the motive but not essential element of the crime it's very telling us to the narrative the government's case and the alleged motive of trying to cover up financial crimes unrelated to the family, i don't know, i can see a jury rejecting that as just not credible. mike: interesting, mark smith from king's college, thrilled to have you today. have a wonderful day. >> thanks. mike: new disturbing details
