where we know the arrangement date for those five police officers accused in the fatal beating of tyre nichols. >> brian: it comes after the shocking body cam video. the footage released over the week and 7:00 eastern time has sparked protest across the country for the most part peaceful. >> will: will live in memphis, charles. >> hey, good morning those five police officers are charged with second-degree murder and 29-year-old tyre nichols death. it will be back in court next month and expected to be arraigned february 17th. but look after the release of the brutal body cam video we want to warn the viewers it is graphic and disturbing. there was a lot of questions whether others should or will be charged in this case. on that video, once again, tough to watch but officers participating in the savage beating of tyre nichols where he's kicked, punched, pepper sprayed and struck with a baton multiple times as seamlessly he's left defenseless. you also see the video of their officer show on t show up on the

scene and just stand around and wait 20 minutes for medical attention. we know at least two men with employees and sheriff's deputies have been relieved of their duties. an internal investigation moving forward. the county d.a. says he will not rule out new charges for others who may have played a role in nicole's death. but he says it could take a while. >> something like this could take months at a minimum. given the number of people involved. the amount of video involved in the amount of discovery that might be undertaken. it might be longer than that. >> so, there have been protests in memphis and obviously across the country for days. but they have remained largely peaceful at the request of the people's family. and they described tyre nichols as nonviolent, a father to a 4-year-old who love to skateboard and watch the sunset.

people across the country that are police officers wearing uniform are going to be facing backlash. others thinking about going to the academy and applying will not do it in proactive policing so many times has been effective. it will be pulled back in order to avoid conflict. >> ainsley: apparently the d.a. has charles was saying, not ruling out charges against other people. there will people at the scene that did not respond like first responders were police officers. they didn't immediately render aid. so as an officer as a first responder you have to give aid immediately if someone is hurt. >> will: to the point that no one intervened. this weekend on "fox & friends," the military talked about this and it's very difficult in a hierarchal environment for someone lower to step in on someone who may have seniority or rank over you. so some lower officer is not

you. we are standing by at the watson hotel. we will give you look what is happening. we have two empty buses that pulled outside the hotel. some of the migrants have decided to go ahead and hop on and go to the brooklyn cruise terminal but over a dozen standing out here and saying they are not moving. i had a chance to speak to asylum-seekers early this morning. they tell me they had a chance to go to the brooklyn cruise terminal. they did not let the crews out there. there is no privacy and there is no heat out there but they would rather stay at the hotel. some have set up tents and have been sleeping there since last night. they are staying because the city has seen easily over 42,000 migrants since last spring. we have also heard from a spokesperson for the city. i want to get to a statement and that person say the brooklyn cruise terminal will provide the same services as every humanitarian relief center and will go to the brooklyn terminal this week and took place as planned. we remain and support of both state and federal governments.

>> brian: the philadelphia eagles will take on kansas city chiefs in the super bowl lvii. you finally can watch and we have the matchups on fox. the take away from the championship game, the best-selling author of the best seller talking to goats, "let's go to podcasts" jim gray. we have watched two games and i'm sure you were watching as well. first off, let's break down the first game. san francisco really was finishing up the string. they actually had no quarterback. i don't remember a situation like that. >> i don't either. i mean fourth string quarterback, johnson gets hurt and can't continue the game so they have to go back to the guy that started the game who is replacing the guy who was hurt who is replacing lance who was hurt. none of them can play. so the elbow damage just change this game in the first possession. it was really kind of sad to see

san francisco who had been so proficient and done so well and never lost a game. and no one is back there to play quarterback. it is a tough way to go out to. >> brian: we knew this game was done in the third quarter and we just don't know how what hurt he will have to deal with whether a rupture of six weeks or more than that. so let's fast-forward to the game last night with a tough time finishing up. we did and see kansas city come back to win. to set the table when the bengals have the ball left 2 minutes left and get infield gold range but kick off return sets up kansas city to do something special. >> it sure did. it looks like perhaps we would have overtime in this game. then, you just saw what happened. the officiating yesterday is going to be a lot to be desired. proper attend that crew gives kansas city an extra down. it turns out they tried to call the play dead. in the end, he just pushes the

guy out-of-bounds. a clear film xo harris buckner comes into kick the 41-yard goal and gets an advantage. but the play of patrick mahomes, the toughness, mental strength, courage, this guy is playing on a horrible ankle and probably would not play a couple of weeks if regular season game. he goes in and guided it out. he made a play on a couple of occasions, a touchdown pass. there was probably nobody else in that circumstance that physically disabled to make that play in this campaign. you know, it is just remarkable to be able to see this guy. he is magical, even on one ankle. it was so much to see him play like that. heartbreaking for cincinnati. and you really have to feel for them today. >> brian: absolutely the other good news demar hanley got a video talking about how grateful he is and an idea of his condition

but the first since his cardiac arrest and here's a little bit of it. >> what happened to me and football is a direct example of a guy using me as a vessel to share my passion and my love directly from my heart with the entire world. now, i'm able to give it back to kids and communities all across the world. >> brian: so much money flooded into his charity to give toys across the world. your thoughts, jim? >> you know, it is just terrific. the fact that he was able to do this videotape and we can hear in his own words, he thanked the medical response and the buffalo training staff in the cincinnati hospital and to see this young man up and walking and moving so well. we saw him at the game but it was a little bit hidden underneath the hood. he didn't want to take attention away from his teammates. they use it as inspiration and he is an inspiration in the
