operation good. thank you for joining us. >> dana: important story there. a dramatic and highly dangerous chase along the southern border. a large group of migrants bailing out of a truck followed by a high speed chase as migrants surge across both borders north and south in record numbers. you won't believe the story coming up. welcome in a new hour of "america's newsroom." bill hemmer is off today. sandra is joining me. i'm dana perino. >> sandra: we'll chat about last night's game. nice to start the week with you. officers along both borders are facing deadly danger and happening on a daily basis as president biden's border policies a tract people from the world. >> you see what's happening along the southern border and how easy it is and how those individuals that are coming across our borders illegally are

rewarded being released into the country and provided with all the resources to live in the country. we'll continue to see the numbers increase not just at the southern border but also the northern border as well. >> dana: eric shawn on the growing surge along the porous northern border. let's get to bill melugin starting us off in mission, texas. >> hi, good morning. that's right. we're back on the ground here in the rio grande valley this morning. people continue trying to find some pretty creative ways to sneak across our southern border. case in point we'll show you what just happened here in mission where we are a couple of hours ago. take a look at the images given to us by texas dps showing troopers with border patrol acongress resting this group of illegal immigrants disguised as on bicycles all from ecuador. these guys came across on rafts,

dressed up like this with helmets. brought their bikes with them. and they came across the border trying to blend in with the morning exercise crowd here. the group of them were arrested and now in federal custody. the pursuit. look at this decks as dps dash kam video. a large group of immigrants bailing out of a vehicle being chased by texas dps and run off into the brush. the driver doesn't stop. she floors it and keeps going. the driver eventually loses control and crashes. she goes bailing out running off into the brush. troopers go after her and you might notice in the vehicle she keeps reaching for her waistband. the trooper takes her down and keeps reaching for her waistband and you will see in the video the trooper finds that woman had a gun on her that was hidden inside of her waistband the entire time. she was arrested and charged

with human smuggling and felony evading. we'll take you to arizona. another major fentanyl bust there. cbp officers at the port of entry seizing 75,800 fentanyl pills and 40 pounds of meth hidden in a smuggler's gas tank. we'll keep you in arizona and show you a child molest tore arrested in the tucson sector. this is a mexican national. he has a previous conviction in 2009 for lewd acts with a child in the state of california. lastly, another sex offender arrested. this one in texas, del rio sector. look at this mug shot. carlos from guatemala and he has a previous conviction in 2009 for sexual assault in the city of dallas. back out here live as those sex offenders continue to be arrested by border patrol it highlights the concerning numbers with the known gotaways

slipping across our border. sources telling fox news just since october 1st there have been nearly 300,000 known gotaways evading border patrol. that averages out to well over 2,000 every single day. >> dana: incredible. you had an airport delay yesterday. we're glad you got there for this reporting. thanks, bill. >> yeah, thanks. >> dana: border patrol officials in new york, vermont and new hampshire say they have caught more illegal crossers from canada in the last two months than the last two years combined. eric shawn has more. >> all the attention has been on the exploding numbers in the southern border but our nation's northern border has seen rah huge jump in migrant crossings. customs and border protection says migrant arrests have soared 743% in the final three months of the last year compared to

2021. unlike the southern border counterparts the northern migrants as you can see are forced to brave the harsh and unforgiving winter elements trekking through snow and ice in subzero temperatures to try to reach the u.s. looking at border patrol photos of individuals and families that show the treacherous conditions that can prove deadly. cpb says a haitian man froze to death earlier this month trying to join his wife here in the u.s. the family of four from india close to death last year crossing over in north dakota. despite the dangers the northern border crossings could hit a record number of migrants. the numbers are smaller than compared to the southern border. in 2022 there were just over 109,000 encounters at the northern border. more than three times higher than the previous fiscal year in 2021 of just over 27,000. since october there were just over 42,000 encounters. that also on the way to a

record. the center for immigration studies says border staffing difference is stark. >> the southwest border is less than 2,000 miles long. the northern border of the united states on the other hand is about three times that large. it is 5,525 miles long. unlike the southwest border where we have about 18,000 agents, we only have just over 2,000 on the northern border. >> to give you what they face today the weather along the canadian border in the northeast is 19 degrees. one degree in north dakota and later this week nighttime temperatures along the northeast border forecast to hit minus two and dana, out west minus 19. >> dana: i've been hearing from family that way and it is cold. important report. thank you, eric. >> sandra: teachers in rhode

island getting a request to raise thousands of dollars to help pay off a human trafficker who recently smuggled one of their students into the country illegally. bryan llenas has that story. >> good morning. migrants pay thousands of dollars to coyotes or human traffickers to take that across the border in the u.s. families take dangerous loans from cartels putting their homes up for collateral and risking lives to pay off coyotes who they are then indebted to. assistant principal in rhode island is now under investigation for soliciting donations from school staff members the pay off a coyote who supposedly brought one of the school's students to the u.s. in an email to staff the assistant principal wrote we have a student who came to america with coyote which is a group that helps people. she went on to write our student needs our urgent support to raise another $2 thousand to meet his goal of $5 thousand by

february 1, 2023. a subsequent email from the principal retracted that email writing the nature of the request is not appropriate. all funds contributed will be returned and we will seek more appropriate methods to support our students. during an interview with a local radio station, the president of the providence teachers union said she never has seen anything like this in 30 years. this is an extremely serious issue and she is surprised the assistant principal wouldn't know coyote isn't a group that helps people but human traffickers who prey on the vulnerable. we've asked whether law enforcement has been contacted and haven't heard back. the providence school district said the emails are real and the district in investigating. >> dana: a major flip-flop in senator elizabeth warren now backing vice president kamala

harris after initially declining to do so. to set this up let's listen 20 to what she said initially. >> he should run again because he has gotten a tremendous amount done. >> should kamala harris be his choice the second time around? >> i want to defer to what makes biden comfortable but they have to be a team and my sense is they are. i don't mean that by suggesting i think there are any problems. i think they are. >> dana: what happened to the sisterhood there in the democratic party? she came out and said i fully support the president and kamala harris should be on the ticket. the initial instincts were different. >> yeah, dana. i don't know what's worse. the slip-up from her which she later corrected or kamala harris's polling number. a lot of democrats worried about the vice president's political

standing and her polling numbers. if you look at the 538 polling average she is only at 38% with her job approval. a lot of democrats, one of the reasons you see a lot of democrats encouraging biden to run for re-election is they're worried that vice president harris would be a less an ideal standard bearer if biden stepped aside. it was very notable to hear warren not instinctively give harris an endorsement at first. >> dana: maybe she should think she should be on the ticket. we know biden and harris will go to the dnc winter meeting this friday and expect the state of the union february 7th that biden will announce for re-election and we're off to the races. speaking of that. former president trump was on the trail in new hampshire and north carolina. he did say if desantis would

decide to run that it would be an act of disloyalty. we know there is some consternation among the democrats but maybe more among the republicans as they look to 2024? >> well, dana, i was in new hampshire this weekend to see president trump give his first campaign speech of the 2024 cycle and look, one of the things that was so much different from the past election is that this was not a big rally. it was a crowd of new hampshire political rank and file republicans. lawmakers, state officials and it was a much smaller room. less enthusiastic crowd than the former president is used to. there was a lot of excitement for ron desantis among the republicans in new hampshire that i talked to. and we may be seeing something of a changing of the guard in which donald trump is the only presidential candidate running and was in south carolina as well over the weekend but there is a lot of interest among even trump supporters about what ron desantis would bring to the

table if he runs for president. >> dana: we have a lot to look forward to as we cover this. it might feel early for some people. if you run for president you have to get your ducks in a row pretty early. good to see you. we'll see how many people decide to put themselves in the race. you see people tip toeing up to it. despite some questions about president biden that he will get a primary. >> sandra: you will see a lot of those politicians tip toeing questions like elizabeth warren. a little awkward. the white house taking heat putting retirement at risk. half the states in the country are suing to keep a radical climate agenda away from your hard earned savings. >> dana: eagles and chiefs heading to super bowl lvii. what is to be expected for this epic match-up?

esg, environmental and social and corporate government. a reversal of a trump-era policy that banned money managers from focusing on a social agenda rather than long-term financial stability for investors. now the rule being challenged by a lawsuit led by utah attorney general and joined by 24 other states. they say that putting climate and social justice issues ahead of returns could harm the financial interests of customers and put america's golden years at risk. listen. >> the new rule issued by the department of labor that they're prioritizing woke esg investing over the retirement assets of hard working americans. $12 trillion for over 152 million working americans. >> specifically the lawsuit maintains the new rule violates federal law that requires filed oesch ears to act in the sole interest of investors leaving

the esg movement are massive investment firms like black rock and others. lawmakers are pulling billions in investments from the funds with florida leading the charge withdrawing over $2 billion. now black rock is increasing its spending on lobbying adding registered lobbyists in texas and florida. it is no wonder invest ores are unhappy. they avoid energy stocks and that was 2022's top performer and only positive performing sector in the s & p 500. >> dana: everyone is watching that story. >> sandra: the super bowl lvii match-up is now set. the kansas city chiefs will meet the philadelphia eagles in arizona. mark the date, february 12th on fox. kansas city beat them.

in australia djokovic won as he was not able to play last year. watch him here. >> this has been one of the most challenging tournaments i've ever played in my life considering the circumstances, not playing last year, coming back this year. i want to thank the people that made me feel comfortable and welcome. only team and family knows what we've been through in the last 4 or 5 weeks and this is probably the biggest victory in my life considering the circumstances. >> dana: gracious in victory, clay. >> this is what actual bravery from athletics looks like. he took a stand, refused to get the covid shot whether you agree or disagree with that, and as a result wasn't able to play last year in australia. he made up for it this year, came and only lost one set in this entire tournament. so he was dominant on a level that's rarely seen.

we will work with you every step of the way to help you achieve it. so let us focus on the how. just tell us - what's your why? ♪ >> sandra: four suspects accused in the rape of madison brooks the night she was killed in an unrelated car crash two weeks ago. reports show she was intoxicated but not excessively drunk. casey stiegel has more. some conflicting reports from what we originally heard. what did the autopsy report reveal? >> first of all one of the suspects in the case turns out as we now know has been previously charged with a similar crime and he is back behind bars. 18-year-old washington now charged with first degree rape stemming from an incident in 2020 accused of raping a 12-year-old girl after she left an apartment swimming pool

according to arrest reports. washington is among three others charged with the january 13th rape of lsu college student madison brooks. police say they dropped the victim off on the side of the road where she was accidentally struck by a ride share driver. the college sophomore died days later at the hospital. earlier that night, friends say brooks had been partying at a local bar where she met the suspects and was later seen leaving with them. >> people around her should not have taken advantage of her. they should have protected her. gotten her home safely. the opposite of what these individuals did. >> lawyers representing these men say that this surveillance video from outside the bar that night obtained by news affiliate wafb helps prove his clients are innocent because it shows madison brooks chasing after the guys. they also claim it helps prove the victim was not sloppy drunk and unable to consent to sex. investigators say brooks's blood alcohol level was four times

over the legal limit. a number lawyers for the accused do question. >> the understandable anger in the community wants someone to pay for her death. we understand that. but our clients did not do that. >> funeral services for madison brooks are scheduled for later this week in her hometown of covington, louisiana. >> dana: the new york city police commissioner calling out criminal justice reforms claiming they have led to a rise in teen violence. one statute prevents police from charging teens as adults even for significant crimes. assistant commissioner said we aren't giving them a time-out. let's bring in inspector paul morrow. do you experience this when you were with the force? >> i was fortunate enough not to have to operate under the raise the age rules. i caught it at the end a little bit and began to see the impact. they're undeniable.

in 2019 the legislature statewide went from 16 as the age of criminal responsibility up to 18. but as usual the devil is in the details. the 16 and 17-year-olds who commit crimes, they now go to family court. generally they don't receive much, if any intervention. those records are sealed. so what does that mean? repeaters don't really take any more of a hit if they come back to family court. when they hit 18 and referred to criminal court none of those records are visible. it looks like they've just made their first mistake. even judges are upset. the district attorney in the bronx, she is on this issue. a former judge. she makes the point that as a judge, she is flying blind on these cases when she was sitting on the bench. that is somebody's opinion you

can take to heart and i think they have to look at this. we are -- there is no disincentive and the perps know it. they use the younger kids to carry out a lot of the nefarious stuff so their hands are clean and the younger kids are being institutionized into criminality. >> sandra: the stats are heartbreaking. the level of perpetrators, juveniles in the shocking rise that we're seeing, the change just year-over-year up 20% seen on the screen there from 62 to 124 in 2022 alone. >> that's right. the trend is going in the wrong direction. nypd has an outgoing commissioner who name checks it today in the papers saying we're seeing massive repeatism as a result of this and somebody whose word you can take to heart. the problem is, as it is with the discovery reform put in at around the same time and bail

reform. it was a package deal as part of criminal justice reforms and the police and prosecutors were not invited to the table. the defense bar, who designed this entire package, they just got their wish list. nobody was there to say no. now we are starting to see covid delayed it for a while so people said the numbers are skewed because of covid. you are starting to see the real impact. >> dana: is there any move in new york city or in albany for there to be changes? the reason this is important for viewers watching here is that a lot of these ideas start in new york or in los angeles on the coast and imported to other cities. >> illinois put in a similar package statewide. as if chicago doesn't have enough trouble. you are right. this has to be undone in albany. it has to be done there. good luck getting anything done there. the legislature doesn't seem to have the votes to do it or the interest in doing it. kathy hochul does not seem to have again the interest or the

seat enough votes and power to get it undone while everybody else is pointing to the idea that you went too far. you have to pull some of this back. aspects of the raise the age are reasonable. housing, 16 and 17-year-olds with hardened criminals who are much older, people understand that. some reform was necessary. but this went way too far and we're starting to see the results. and the victims are in the same age bracket. >> dana: you have a piece on foxnews.com on the tyre nichols murder charges. >> i do. we're all of a similar mind on this how outrageous it was, etc. we get to the point where we have to look at what's the correct response on that? so up on foxnews.com on my webpage if you can click opinion you will see where i this i the case should go and where it should not go. because this is going to get complicated. five persons charged at this point. i think it will be maybe more. >> dana: do you think the police

now even more scrutiny on these controversial government grants to a u.s. nonprofit that funded research in wuhan, china. the department of health of health and human services inspector general released its report on $8 million in grants to eco health alliance. they sent 1.8 million of that to several other groups including the wuhan institute of virology. the report found quote nih did not adequately monitor the grant awards in accordance with its policies and procedures and other federal requirements. the inspector general says eco health should have immediately notified the government of unexpected research results. it did two years later. republicans across congress are investigating the contracts to eco health. >> we all know despite what dr. fauci said, american tax dollars were sent through eco health alliance to the wuhan lab in china for gain-of-function

research. but yet dr. fauci hasn't come before congress in the house of representatives. >> dr. fauci has said he would comply with congressional oversight. in april 2020 then president trump ordered the government to terminate eco health's grant and n.i.h. later restored funder with stricter conditions. then this past august n.i.h. canceled more funding to eco health that the group used for research in wuhan. it has already addressed many of the concerns in the report. as a result of the inspector general's report republican senator ernst has called for an emotion and permanent end to taxpayer funding of eco health alliance. >> dana: rich edson, thank you. >> sandra: a four star air force general is predicting war with china. beijing will likely invade taiwan while the u.s. is distracted by the upcoming presidential election.

i said i hope i'm wrong. my gut tells me we'll fight in 2025. general jack keane. thank you for being here today. that's a big warning he is putting out there saying that we'll be at war with china in two years telling the officers that he commands in this memo in which he made this prediction to get ready to prep by firing quote a clip at a target and aim for the head. do you agree with his prediction? >> well, we don't know for sure whether this is imminent or not because subjective analysis to be sure. listen, we're at peace relatively speaking and it is the duty of commanders to prepare their troops for war. i have spoke in direct blunt language in preparing my troops during peacetime for war as well. it is an internal memo. i am not sure he thought it would be p publicized.

this general laid out goals for preparing, he included building a fortified ready integrated and agile maneuver team inside the first island chain. will congress follow through on the demands you just said? >> first of all the executive branch has to make that decision. they control the department of defense. listen, he has background in the indough pacific region. his current command is that he would support it with airplanes. you take his counsel. he has an understanding of our deficiencies to be sure and that's what's driving him to his conclusions. we need to executive branch to step up and really thicken our defenses in the first island chain. we need more ships, we need more airplanes and more land forces that control and influence the major navigation routes in the region.
