there were police there. it looked calm. lots of media cameras. it is happening. new york is stungling to house more than 40,000 migrants bused from the southern border over the past year. the city is also plagued by crime and homelessness. the president will be talking about infrastructure. >> bill: he will announce $3 hundred million in funding for a new tunnel under the hudson river. critics say it's distracting from issues. >> dana: a new poll reveal what voters say the country's biggest problem is. not infrastructure. it is poor leadership. >> bill: just a few blocks from the west side rail yard where the president talks today, the migrants crisis is boiling over. talking a few blocks now. authorities trying to relocate adult male asylum seekers from one hotel to a new shelter in brooklyn to make way for new families coming in. some of the men, though, all of them coming here single, are

refusing to leave. >> dana: the president should visit the hotel. they won't hold their breath. >> this is an abject failure of the biden administration. his immigration policies are disastrous. he knows it. the best thing to do is not look at it and pretend it's not there. >> dana: "new york post" reporter john levine has reaction on set. david lee miller. you started us off with this story yesterday. what happened overnight? >> good morning. a few dozen men spent the night on the street on manhattan's west side rather than be sent to a temporary housing facility at a cruise terminal in brooklyn. they are all single men who the city removed from a hotel being used for migrant housing in order to make room for migrant families with women and children. many of the migrants agreed to be relocated and a few hold-outs boarded a bus to brooklyn a short time ago. the ones now living outside the

hotel on the street reject inferior accommodations. migrants said the cruise terminal is cold, too far from the subway and lacked basic facilities. >> for all men it is only four bathrooms. if one gets sick, everyone gets sick. it is very ugly. the beds are horrible. they are a piece of fabric like a military bed. >> mayor eric adams tweeted out a video last night as his unannounced visit. he showed it was safe and clean temporary housing. >> it's warm inside. about the food not being there, healthy food is present, even the snacks are healthy. >> the mayor again repeated his plea for money from the federal government to help pay to house the migrants as well as feed them and other things. in just a few hours' time we

part of it is a little bit of the policies of the city being a sanctuary city means you get to come here. he is frustrated not just with the governors down in texas and arizona but mad at the biden administration but not been quite willing to really stick it to them yet. >> he is in an untenable situation. the city has a right to shelter law and legally obligated to find housing somewhere. hundreds of migrants a day. this money, we don't have. unless we receive federal funding we have to raise taxes and they're already very high in new york or cut services elsewhere. >> bill: so whether it's nicaragua, honduras or mexico or manhattan or brooklyn. those distinctions you are trying to draw. back to the mayor. listen to everything he says in the side bite and tell me whether or not he is wrong. >> it doesn't matter if it's

stores. so that is something that the migrant activists said they want. when you go over to brooklyn terminal guess what you get? you get a ferry card so your ferry fares will be covered. that's not true of other new yorkers. what i sense in this city a growing frustration that i do not see how it is solvable unless the mayor and president can figure something out immediately. these people will keep coming. >> there needs to be a broad based federal solution. getting hundreds of new migrants a day, we don't have the space. as the mayor said, the inn is full. i don't know where thug. >> bill: we'll end the covid health emergency not today in january and not in february, but in may. >> should have brought champagne. >> bill: why take 90 days to get it done? >> i thought it was two weeks to stop the spread three years ago and okay, we'll do a vaccine and then it's over.

state's first border czar. michael banks says his mission is to make texas the least desirable place for anyone trying to cross into the country illegally. let's go to bill melugin live at the border in mission, texas. good morning, bill. >> dana, good morning to you. the biden administration is making it a lot easier for migrants to cross into texas by expanding its controversial use of what's known as the cbp1 app. what's that? take a look at the video the team shot in eagle pass. a group of honduras allowed to enters the united states to fill out an application online, get an appointment at a port of entry and seek an exception to title 42 to be released directly into the united states. that's what happened with this group. they entered eagle pass. the administration says it is a way to cut down on illegal crossing and discourage cartel

two-day span. one bust 300,000 fentanyl pills. another bust 458,000 fentanyl pills hidden in a car's gas tank. a third bust 14 pounds of pure fentanyl powder hidden in the rear bumper of a car. one port of entry in a 48-hour span. lastly look at this guy's mug shot. a convicted murderer arrested by border patrol after crossing illegally in the tucson, arizona sector. he has a 2005 conviction for felony second degree murder out of the state of maryland. back out here live going back to that cbp1 app the biden administration said they are expanding it to allow 30,000 migrants per month from cuba, haiti, and nicaragua into the united states per month on humanitarian parole. 360,000 people every single year. republicans not happy about that. they say that's illegal under

(upbeat music) >> dana: overnight a sixth memphis police officer has been relieved of duty using his taser in the beat are of nichols. five other officers have been fired and charged with second degree murder. the memphis fire department firing two emergency personnel and a lot accused of violating properly by failing to properly assess nichols as he just laid on the ground. body cam video shows several officers repeatedly beating and kicking nichols after a traffic stop january 7th and he died three days later. >> bill: the alex murdaugh murder trial set to resume minutes from now. accused of murdering his wife and son in june of 2021 and he

says he is innocent. yesterday there could have been a bombshell statement in court. a witness admitted on the stand there could have been a second shooter. >> one explanation of this data would be two shooters. one explanation, not the, but one. >> not the only one. >> but it is a reasonable explanation just like one shooter going up that way, correct? >> sure. >> bill: we have the trial covered from all angles. nancy grace standing by outside the courthouse with legal analysis. first let's get to what happened inside the courtroom with jonathan serrie to break down the details now. hello. >> good morning to you, bill. the defense is trying to poke holes in the prosecution's case suggesting this theory that perhaps two shooters were involved and questioning whether first responders may have damaged the crime scene tracking bloody footprints. prosecutors show the hunting lodge. state agents found shells around

the property that are consistent with the types of ammunition used to kill his wife maggie and son paul. >> do you know a specific brand and make and caliber, ammunition that was used to kill maggie murdaugh? >> the hand stamps on the shell casing was s and b300. >> in court the prosecution also played a second police interview recorded three days after the murders. in it murdaugh describes maggie as a wonderful wife and great mother and then listen very closely to what he says about paul. >> it was just so bad. it was getting so bad. >> you asked the defendant about the traumatic picture that he saw of paul and maggie. what did he say? >> it's just so bad. i did him so bad. >> in court right after that you could see murdaugh shaking his head as if he dis'greed with the

agent's interpretation of what he said. others in the courtroom said it is possible he said they did him so bad instead of i did him so bad. it will be very interesting bill and dana to see what the jury thinks. >> bill: sure will. thank you for the report. jonathan serry. >> dana: excited to bring in nancy grace inside the courtroom every day and right now outside live there at the courthouse. nancy, let's tackle the issue of the possibility of two shooters. what should viewers know about that? >> well, i can tell you this, the big sound bite is where the crime scene analyst said it's possible there are too shooters. what led up to that was about an hour of the defense beating on her, getting her to say that because she kept saying no, no, it's not probable, it is not reasonable. finally said is it possible there were two shooters?

she said it's possible just like it's possible that little green men came down from mars and did it. it's possible but is it probable? no, it is not. and another thing, you no he that sound you just played, what should i believe the defense attorney and the defendant alex murdaugh or my lying ears? i heard the video and he said and i quote it's a slip. he said it was just so bad. i did him so bad. he was in the midst of this big drama crying and snotty and carrying on in the middle of that, by the way, he sees a guy go by he knows and says hey, how are you doing? he has just seen his wife and son dead in a dog kennel. in the middle of all of this crying and carrying on he says it was so bad i did him so bad. i heard what he said and that is what he said. >> dana: i have the timeline for everybody to look at. murdaugh murders, look at the timeline from june 7th when he

called 911. and then september he reported that they had been shot and september 4th he called 911 from the side of the road and said he had been shot in the head. we go on now at this trial. the second part, though, where he was shot in the head is not even a part of this, right? >> no, it is not part of this and i doubt the judge is going to allow that in under any circumstances because you can't try a person based on other bad acts unless they go to prove a fingerprint climb like motive, course of conduct, frame of mind. i don't think either that nor all of his millions of dollars of theft and embezzlement will come in. which i believe was the motive for murder. >> dana: what do you expect today in the courtroom? >> well, i expect the state to continue forward with another sled, south carolina law enforcement division. officer on the stand going

they charge for the privilege? this is amazing. the underbelly to the underbelly, right? soaring crime all over the country. now making it difficult for some car owners to get insurance coverage. state farm and progressive are the ones no longer underwriting insurance policies for certain kia and hyundai models because they don't have an anti-theft device. car thefts up 59% since 2019. thefrts of some of those models are up almost 300% in some cities. the model years 2015 to 2019. experts are saying what they are missing is what they call an engine immobilizer which simply prevents hot wiring of cars that are keyed to start. hyundai says it's working to fix this telling fox business engine immobilizeers are standard on all of their vehicles produced as of november 2021 and long standard equipment on all hyundai vehicles with push

button ignitions. they provide free steering wheel locks and offering to install customized security kits. get this, the most interesting part of the story. the vehicles are so easy to steal that kids as young as 11 are boosting cars and joy riding. they are using tiktok video instructions to do it. unimaginable, right? your 11-year-old goes out the door and steals a car? they put the video of themselves stealing the car on tiktok. >> or youtube, too. the most common probably the easiest application is do the steering lock in the near term. they can ship all the steering locks out, cover the consumer and make sure they are taken care of. >> you can either call the maker or go to a local police department or sheriff's office because some of them are stashing these for people who come in. in particular hyundai is sending these out to police departments.

american express set aside $5 hundred million to cover loan losses. hope it doesn't go that way. i don't think it's a ton of money for big companies like that but you can answer it in a second. stunning. americans living paycheck to paycheck right now, larry, right now they are at 64%. how do you see it? >> i hardly know where to begin. banks are in pretty good shape, by the way. they have a lot of capital and it is prudent that they put together some additional loan loss reserves. we are going to have a tough year. i think 2023 will be a difficult year. more than 50, 60% likelihood of a recession. so you've got some problems there. on the household expenses versus income, it is true those numbers have been rising. i don't know if i can verify -- i tried to verify some of the numbers. i couldn't verify all of them.

i looked as census borough and others but no question that more people are living day-to-day, month-to-month, household expenses exceed income. i don't think it is a calamity yet. labor markets are still okay. i'm not sure how long that will last because there is a lot of bad indicators out there that are pointing to a down economy. so this is just another sign. this living expenses exceed income and that's another cautionary tale. >> you have consumer spending but a lot of time government put the money in their pocket and running low is what the stories are telling us. >> that's -- >> bill: the fed is meeting this week. i don't know if you favor a quarter bump. some are arguing for half a point. what would you do?

>> i probably go a quarter, i might go a second quarter in march. inflation is starting to come down, okay? we have had decent progress, the year-on-year numbers, what the fed watches, 5% inflation. last few months it's dropped down actually to 2 or 3% inflation. so that's good. if we can stop congress from spending, if we can give mccarthy moral support in his meeting with president biden. surely we should be cutting spending as the price to pay for another hike in the debt ceiling which is already too high, as everybody knows. so, you know, let the fed do what the fed needs to do. inflation is coming down. look, the key point here is you can't go from 9% inflation, which is where we were let's say 5 or 6 months ago, down to 2%

inflation, which is the fed's target, right? the fed is taking cash out of the economy left and right. they are raising interest rates significantly. this is not an easy thing. the trick was don't make the mistake in the first place. having made the mistake, when nobody believed it in 2021, now the fed is off setting that. in history, almost always leads to recession, i hate to say that. i am a long-term optimist and i believe this little socialist interlude we find ourselves in will pass over time. and i don't think people should sell all their stock market holdings. i know there is a lot of bears out there. people should look to the long-term. if the market goes down you should probably add some money to it. buy the indexes and the exchange trade funds, the s&p 500 which

>> dana: the parents of lsu student madison brooks shutting down allegations she consented to sex the night she was hit and killed by a car. they call the claims absolutely shameful. this as authorities say one of the men charged with raping her has been arrested in connection with another rape. senior correspondent casey stiegel has the latest. hi. >> the family says they want to set the record straight saying since their daughter's tragic death she has become the victim of a smear campaign mostly from lawyers representing those

accused of raping the 19-year-old college student. her funeral is scheduled for friday. madison's heart, her obituary reads was pure. laugh infectious and she lived every day to the fullest. her legacy will forever shine in the stars above. she died earlier this month after being struck by a car. investigators say leading up to that maddy as she was called was sexually assaulted and left on the side of the road. >> she was raped. rape is rape. it is a horrific, terrible situation and to the extent that those involved with the alleged rapist want to blame the victim and show press conferences and say things we can talk about in a minute we're standing up for maddy. that's not right. >> in response to comments made by lawyers representing the four who have been charged with maddy's assault. they argue the lsu sophomore was not overly drunk and did give sexual consent. 18-year-old washington has been charged with rape in a second
