coming right up. first hunter biden finally admitting the laptop filled with his emails incriminating documents and embarrassing photos does indeed belong to him. welcome to a new hour of in us news, i'm dana perino. >> bill: how was the first hour? >> dana: good. >> bill: a plus? good morning. i'm bill hemmer and good morning. after years of widespread claims dismissing the laptop as the work of hackers or russian disinformation hunter's lawyers conceding it indeed belongs to him and calling him hunter the victim. that change of tune coming as newly empowered republicans launch investigations into hunter's business dealings including his role with bhr, a chinese equity firm banked by some of china's largest state banks. he joined the board in an unpaid position in 2017. he pursued deals involving china's largest private energy firm. later that year a hunter biden

associate says that joe biden was consulted on deals with china. one year after that, the department of justice launched and investigation into hunter's foreign business dealings. then in 2019 f.b.i. agents in delaware take possession of hunter biden's laptop. now the d.o.j. investigation into hunter's business dealings remains active. president biden is not being investigated as part of that probe. miranda devine, who works for the "new york post" is breaking stories on the laptop for more than two years last night told laura ingraham the biden camp has plenty to fear. >> they admitted the laptop is his. which we've been telling people for more than two years. finally they've admitted it with this kind of ridiculous attempt to go on the offensive. i think that there is panic in the biden camp. >> dana: rich edson is live in washington with this story.

hi. >> good morning. nearly 2 1/2 years after emails and photos from this laptop hit the "new york post" hunter biden's attorneys acknowledged that the laptop belongs to hunter. in that same letter his attorneys want delaware and federal prosecutors to investigate the computer repair shop owner who passed along data from hunter's laptop. the photos, emails, other document eventually ended up with president trump's lawyer r rudy giuliani and other outlets just before the 2020 election. >> what you have to recognize in all of this is the person who brought the laptop to the fore was rudy giuliani after his clear, inappropriate conduct regarding ukraine. he was at the lynch pin for donald trump's extortion of ukraine. so rudy giuliani at this point has no credibility. >> he maintained hunter

abandoned the laptop. the owner of the shop received the laptop in 2019 and tried for months to notify hunter to pick it up. just before the 2020 election on october 19th more than 50 former intelligence officers including former cia directors john brennan and mike hayden and others say the laptop release has all the classic earmarks of a russian information campaign. twitter and fast book throttled users from sharing stories about it. with republicans in control of the house they'll investigate hunter's business dealings and the classified document found at the president's home. >> major coincidence the documents pertained to china and they pertained to ukraine. which were the key business areas that hunter was involved in. we still have a lot to learn there. certainly doesn't look good. >> republicans say they get hearings on this issue. back to you. >> dana: rich edson in d.c.

thank you. >> bill: no additional classified documents were found during an f.b.i. search yesterday at president biden's rehoboth beach home on the beach in delaware. other paperwork, however, was taken from there which special counsel robert hur's team will comb through. he is 100% officially focused on the president's document investigation as of yesterday. david spunt picks up the story at d.o.j. hello. >> good morning to you. robert hur became special counsel appointed by garland a few weeks ago on january 12th. since that day he has been getting up to speed at a private law firm looking at this investigation into the president of the united states. he is now left has law firm in washington and fully on board dealing with this investigation. f.b.i. agents spent 3 1/2 hours at the president's vacation home yesterday in rehoboth beach. the president's personal attorney bob lawyer says no

documents with classified documents were discovered. agents did take other paperwork and handwritten notes and it is possible, bill, there is something classified on those pages. they are just not marked classified. now all of the material will be in the possession of special counsel robert hur who was at the justice department yesterday getting acquainted with his staff. he will work off site at an undisclosed location, typical for a special counsel. these are the four special counsels we've had in the past four years, busy. all have worked on an off site location. robert mueller, same with john durham and jack smith investigating former president donald trump. now the white house is in damage control mode with a new chief of staff at the helm for his full day today. a spokesman said the theme of the investigation is cooperation. watch this right here. >> the president has been fully

cooperative and directed his team to be fully cooperative. we cooperated fully. we're being fully cooperative and offering up access to the president's personal homes. >> the spokesman refused to say if any other sites have been searched or will be searched. bill. >> bill: thank you, david spunt with the latest on that. >> dana: a few days away from president biden's state of the union speech as he gets ready to lay out his agenda for the year. he wants to build support. fox new poll finds 81% of voters see the united states as a dysfunctional family up from 71% two years ago. what happened? karl rove is a former white house deputy chief of staff and fox news contributor. one of these things we can show as well, 73% of people say that they are dissatisfied with the things in the united states. with how things are going. so how do you put a state of the union together with numbers like that?

>> well, you don't get involved in happy talk. this is -- i think that's an interesting question about dysfunctional family. america in a way has always been a dysfunctional family but what's really important is the question of do you think the country is going in the right direction? depending on what poll you look at, those numbers are from 2/3 to 3/4 of the american people think the country is going in the wrong direction. the most important thing for the state of the union address is not engage in happy talk. this white house has done routinely to its disadvantage. everything is okay. economy is coming back. everything is groovy, wonderful. we've done a terrific job. the great things we've done. that's not where the american people are. start by being where the american people are. >> bill: tick through these quickly. biggest issue, higher prices and inflation 86 pers percent. crime at 80%. as you go down the list. there is your political divisions. big concerns of the american

people. see whether or not he addresses any of those directly next week or which ones he chooses. job performance. now we have approval rating as of our polling this week at 45%, disapprove 54%. ron klain has made it clear, karl. the joe biden is running for a second term. on his way out yesterday he said the following there in washington. >> as i did in 1988 and 2008 and 2020, i look forward to being on your side when you run for president in 2024. >> bill: now we were giving indications that will be the case. how do you size the re-election campaign up as of today? >> well, if he decides to enter the contest, which i hope he doesn't. if he does decide he is the frontrunner for the democratic nomination. i don't think he will be unchallenged. by the end of the year we're

likely to hear somebody say it is time for a generational shift. we have been governed by people from the baby generation for 32 years. i will lay out an alternative vision for the future of our party and the future of the country. it won't get better for president biden. approval rating in our poll was 45%. if you look at the average he peaked in early january and drifting back down. the performance is not going to get better. he is struggling on the job. it will et worse, not better. the democrats have a huge bench of talent and they would be much better off and the country would be in my personal opinion if he were to step aside and allow the democrats to pick a new face. >> dana: can i play devils advocate for a moment? the white house is looking at some of these economic numbers saying look, some people were forecasting disaster. doesn't look like it will be that bad. it takes a long time to get a presidential campaign up and

running as you know very well. it doesn't seem that there are even if there are biter stars and younger stars in the democratic party that they would even be ready to do that by the end of this year. so in a way doesn't he sort of become the default nominee for one more time because they think that he is the only one who could beat a possible republican nominee in donald trump? >> look, i've been talking to a lot of democrats. they will say if he wants to be the nominee he is likely to be the nominee. they don't agree that the conventional wisdom that he is the only guy who can beat donald trump or beat the republican. they think just the opposite. he is the one democrat who might not be able to beat trump and certainly not be able to beat somebody who is other than donald trump. think about it. we would have a faltering 82-year-old who says trust me, i'll be -- if i serve another term i'll be closer to 90 than 80 and a vice president whose

numbers are dreadful compared to me and let me lead the country. if the republicans have a younger, dynamic, forward-looking candidate with a convincing record that they can get things done the democrats are in big trouble. >> dana: any of those democrats willing to go on the record? not yet. >> some of them are pretty close to saying it. there are a number of democrats out there who have been -- >> dana: send them our way. >> excellent. >> bill: you want to name names? >> i will let them name their own names. this is an item of widespread conversation among democratic politicos. there is a deep concern about the future of their party. a recognition they have enormous talent. i was with a prominent democrat yesterday and started ticking off the list of josh shapiro, governor murphy of new jersey, cooper of north carolina and whitmer of michigan. the talents the democrats have in the next generation. >> dana: setting the cats among

>> dana: surveillance cameras capture an unusual retail robbery at a mall in canada. 2 suspects drive through the mall stopping to break in and load up at an electronics store. police say they stole the car and smashed through a store's glass entrance to make way. this happened early yesterday morning when the mall was closed. thankfully no one was hurt. police found the car but the two suspects are still on the loose. >> bill: did you say break-in? right? break in, you got it. >> dana: got it. good one, bill. that's a good one. >> bill: now to south carolina we go. this was riveting. testimony is underway today. it resumed only moments ago. alex double murder trial. cell phone evidence to the jury claiming it shows the disgraced attorney was with his wife and son when they were murdered. jonathan serrie picks it up from there in atlanta with what happened in court yesterday.

jonathan. >> hi there, bill. prosecutors say that the defendant's son, paul, shot video on his iphone minutes before the murder. the video shows the family kennel and in it you hear several voices. take a listen to the video. >> he has birds now. >> forensic expert say there are three separate voices on the recording. prosecutors asked a family friend to identify them. >> do you recognize paul's voice? >> yes, sir. >> do you recognize maggie's voice? >> yes. >> do you recognize alex's voice? >> yes, sir. >> 100%? >> yes, sir. >> can you point out alex murdaugh in the courtroom? >> sitting there in the gray jacket. >> let the record reflect he has identified the defendant. >> earlier that evening paul posted a snapchat video where you hear him joking with his

father about a fallen tree. prosecutors pointed ole alex is wearing long pants and button down shirt suggesting that he changed clothes after the murders when he was seen wearing a clean t-shirt and shorts. the defense showed a video from a week before the murders showing paul presenting his father a birthday cake, two long time friends testified the defendant appeared to get along well with his wife and son. this morning we are about to hear testimony from a representative from snapchat to talk more about some of the specifics of the videos that the prosecution is presenting as evidence, bill. >> bill: really interesting. thank you for that out of atlanta today. >> dana: we're now with criminal defense attorney phil holloway, a former assistant district attorney. how did you assess the witness yesterday saying he recognized the voices on that video? >> good morning, dana. great to be with you guys. look, alibi evidence if you are a defendant can be very powerful

and can win you the case if you have a solid presentation. they really need good alibi witnesses. but in this particular case this is a great example of how an alibi can cook your goose if the prosecutor can refute it. that's what they've done. if the jury in the deliberation room comes to the same conclusion the state's witnesses have that this was, in fact, the defendant's voice that was at the murder scene just minutes before these brutal murders took place, it's over. that's just how powerful alibi evidence is, dana. >> dana: what about the changing of the clothes? >> look, the idea is if he was there doing what he said he was doing, which was checking on the bodies, he would have a lot on him, okay? he didn't have a lot on him. if they can prove he is taking actions like changing his clothes and basically using these types of efforts to get

around criminal liability it shows he has a consciousness that what he was doing was wrong and that he is trying to deceive law enforcement. the jury will see that and that also is very powerful information that this jury will use, i think, to convict him. the defense hasn't put up their case. they still have their case in chief and interesting to see what they can do, if anything that will counter this powerful prosecution evidence. >> dana: the judge is set to rule on important issue today. tell us more about that. >> the idea is we want people to stand trial on the actual facts of the particular case at hand. we don't want to use evidence of their character or back character to smear them to get a conviction on an unrelated case but there are exceptions to that. one of them is if the evidence, even if it touches on character, tends to show someone's motive. here the prosecution's theory is that he committed these brutal murders to basically cover up

evidence of real corruption within the biden administration that is on that laptop that is going to drive these investigations. >> dana: i believe it was mark levin tweeting this from a legal point of view if they want to go down this road it opens them up to discovery. okay, will we do that now and be able to ask a lot more questions? >> i think so. he has carefully considered this. has a great legal team. a budge of the articles made it clear. it wasn't the route his father wanted to go. they wanted to stay away from it and he has a strategy for this to work better. if you drop your laptop off at a repair shop, i don't know why the proprietor has a right to go through your financial records which is what happened. last name is isaac, i think. the chain of custody of this laptop. the "washington post" verified 22,000 emails but not 129,000 on it. there are real questions about

every neighborhood. >> bill: you know this as well as anybody. they are asking border patrol agents from texas to go work in arizona because they don't have the staffing. why would you close down these inland border checkpoints? >> i can't think of a good argument that supports why these border checkpoints are being closed when we know how vital they are to interdicting and stopping the flow of fentanyl coming into the country. once they make it past that checkpoint, they will make it into the city. the cartels know the more individuals that are crossing the border, that will draw customs personnel away from those checkpoints and make it easier for those vehicles to get access to the country. >> bill: talking about illegal drugs from yuma county arizona. they say you are keeping the agents from doing their jobs and how drugs fan out to other places with an impact on whole united states. drugs once they pass the checkpoint, that's it. you referred to the 80s. what did you learn back then? >> we learned the checkpoints

opioids like heroin or prescription pills. >> good stuff, casey stiegel in dallas. >> dana: the idaho student murder investigation, a new report that says the f.b.i. lost track of quadruple murder suspect bryan kohberger for house on his trip from washington to pennsylvania. what happened? we're live in seattle with details. >> bryan kohberger was the prime suspect starting on november 28th when a washington state university police officer discovered kohberger had registered a white elantra on campus. the lead detective pulled up a picture and realized bushy eyebrows and build matched the description by the surviving roommate who say he walked by her for the night of the murders. investigators gathered more evidence and kept tabs on kohberger.

but then he left his father for a road trip back to pennsylvania. f.b.i. surveillance team lost him sometime after he left that apartment and for several hours had no idea where he was. it wasn't until a license plate reader in colorado picked up his plates that they were able to resume surveillance. he was pulled over twice in indiana for traffic stops. the f.b.i. says the stops were not directed by them but indiana authorities knew it was interest in a white hyundai elantra. he was allowed to proceed without getting a ticket. the f.b.i. source said the surveillance team went from panic to despair when they thought they had lost kohberger. that team was also told to get dna samples from kohberger to match it to the dna found at the crime scene and eventually did get that dna sample from the garbage at the home in pennsylvania. police for a while thought they
