[cheers and applause] >> steve: more of that in a little bit. ainsley and brian, we have breaking news. >> brian: yeah, we do. that is great stuff, steve. we will check back in with you shortly. >> ainsley: put that in your office, steve. now to a fox news alert. u.s. officials are telling fox that the gang of 8 has been briefed on the chinese surveillance balloon hovering near critical u.s. military sites. >> brian: how is this still in the sky? so what's being done about it? get right to mark meredith live at the white house with more. mark? >> brian, ainsley and steve. good morning to all three of you. u.s. officials say for the last few days they have been monitoring this high altitude surveillance balloon as it has been floating over the continental united states. while officials stress they do not believe that this balloon poses any physical threat, there are still a lot of concerns about where this balloon has been coming from, several u.s. officials stressing that they believe this did come from china. it's sparking major concerns

about how the u.s. plans to respond. we did hear from pentagon officials late yesterday. >> the u.s. government to include norad continues to track and monitor it closely. the balloon is currently traveling at an altitude well above commercial air traffic and does not present a military or physical threat to people on the ground. >> balloon has been floating over sparsely populated areas of montana. we have been told that have been discussions both here at the white house and across the river at the pentagon about potentially shooting it down. military experts reportedly warning against the idea over concerns about falling debris. reporters were in the oval office yesterday trying to ask the president all about this. but he chose not to talk publicly. take a listen. >> folks, we're going to get to work, thank you for coming in. >> those reporters tried very hard to get their questions in. while the president chose not to talk publicly, we are hearing from the governor of montana who says from the spy balloon to the chinese communist party spying on americans through tiktok to ccp linked companies buying american farmland i'm deeply troubled by the constant stream of alarming developments for our national security. we are also hearing from the canadians overnight. their defense department putting out a statement saying they are watching the possibility of a second incident that they have also been monitoring but not a lot of details about what that potential second incident would be. also this morning we are hearing from a spokesperson from the chinese foreign ministry. china not claiming that they own this balloon yet. instead, that they are calling for qu calm. the quote they have flow intention of violating the territory and airspace of any sovereign country. they are aware of this report. they are looking into it. calling for calm but still not claiming that this balloon is theirs. although u.s. officials say with high confidence they believe it is. steve, ainsley, and brian, back

to you guys. >> brian: do you know what i'm going to do. i have a balloon and fly it over china. let's see if they are that cautious about taking it down. remind me after the show. would you do that, ainsley? >> i also want to mention there is high stakes to this because the secretary of state is expecting to be heading over to china in a matter of days. they said we're not sure if the chinese were saying that they weren't sure if this was going to impact the trip at all. you have to wonder what this could mean for the secretary as he heads overseas. >> brian: mark, thanks so much. i know tom cotton said it's over, it's done. we're not going to do it. let's talk about this. 300 miles up into the sky. they say well, it's really not that big a deal because they have satellites that actually are more precise and more intrusive and they are allowed and permitted right over this area. but this is a balloon that went through the islands around alaska. the northern part of canada. goes into montana. f-22s ryan up about it. the president says blow it up.

at the last minute the pentagon says oh, let's not do it. believe me, montana is sparsely located. you could eviscerate this thing and nothing onto the ground i am sure. this is at thi at timidity at . all encompassing let's test the super power game plan. >> ainsley: if you want to shoot it down make sure the people below, i'm sure there are experts that track where it will fall. >> brian: hand out helmets. >> ainsley: get the people out of their houses or could they send some sort of fighter jets around it, cast a net over it and drag it down? and how did this get in the air there? did they -- is that why they are buying property in america? they want to use the farmland so they can launch balloons like this as surveillance and to spy on americans? there has got to be a way to get it down. they are saying that tensions are -- tensions between the u.s. and china are really tense right now, not only because we are sending our leaders to china but

also the defense secretary lloyd austin is -- he is heading right now to the philippines so tensions are ramping up. they are worried about the philippines being so close to taiwan and what that means for their country in the future. lloyd austin, the joint chiefs of staff chairman mark milley and general glen van hurt, they quickly convened to talk about this to look at options to how to get this balloon down. they said it is over the sparsely populated area it like brian said. they couldn't risk shooting it down. they are worried about the part on the before the the balloon and all that of that equipment and where it might fall, steve. >> steve: you know, it's really interesting it's other one of the least populated areas

usually burn up on reentry. isn't it curious that china has parked it over montana. i wonder whether or not perhaps they are simply trying to provoke us. look, that thing is hard to miss. you can see it from the ground. i think they are trying to provoke the united states to get us to do something. the big question is will we take the bait? i just asked the folks here in kansas city a moment ago what you would do. 90% of the people said "shoot it down." now, michael waltz from florida says the pentagon said no, not a good idea. here he is earlier. >> it was suggested to shoot it down and the pentagon has decided that what they think this balloon is able to surveil isn't worth the potential civilian casualties from the debris and the collateral damage but, from what i can tell, it's over rural montana or the dakotas, not over downtown l.a. so i want to see that analysis.

american satellites down. >> ainsley: steve, they are trying to provoke us. they are the ones putting a spy balloon over our country. >> brian: it's not a satellite. >> steve: right, exactly. that's my point. i think they are trying to get a reaction from us. it will be very telling to see how this is all resolved. >> brian: not the first one either. >> steve: they have got a button in china where they could deflate it. let's see if they deflate it. >> brian: i don't know. i have never heard of the deflate button. i know they have had other balloons we have let through. >> ainsley: how would another administration handle this? >> brian: you mean the previous one? goodbye balloon. no question. meanwhile, 10 minutes after the top of the hour. ashley strohmier according to reports is poised to give you was the other news. >> ashley: we are going to start with this. a california doctor was killed while out on a bike ride. after a driver runs him over and then stabs him to death. witnesses say the suspect hit dr. michael mahoney with his lexus before plunging a knife in his back.

the suspect pulled out a gun, firing multiple guns before dislarmd. not found any connection between the two men. that suspect is set to appear in court later today. a disturbing video shows the moment students attacking a 9-year-old girl on a school bus in florida. we do want to warn you this video is graphic. [screaming] [shouting] >> ashley: that is so horrible to watch. that poor little girl. two boys repeatedly struck the girl who is only able to defend herself with one hand. two adults, the driver and aide were on the bus at the time. the girl's mother is pressing charges against the boys and the schools. miami school says the offender has been arrested awful. the january jobs report is due out in just over an hour. as disappointing tech earnings dragged down the stock market.

amazon's earnings signaling cloudy skies, the retail giant is planning to cut cost by closing some amazon fresh supermarkets as well as a number of amazon go convenience stores. those are your headlines, back to you. >> brian: thanks some. let's turn to the hunter biden laptop story. >> ainsley: well, his lawyer is denying that they admitted that hunter's laptop is real after asking the doj to probe its leakers. hills attorney writing, quote: these letters do not confirm mac isaac's or others' versions of a so-called laptop. they address their conduct of disseminating what they allege to be mr. biden's personal data wherever they claim to have gotten it. >> brian: joining us now is the man in the eye of the storm. john paul mac isaac himself. the computer repair person who blew the whistle on hunter's laptop along with his attorney brian who joins us right now, too. first off, john paul, what's your reaction to them not only saying the laptop is real but

then walking it back in the afternoon while still trying to tell you they are going to sue you for letting out this laptop. do you believe he admitted that the laptop is his? >> well, i think that what it teams like is feels like hunter's legal team needed to run something by the white house before they sent that out to the press. and now they are forced to back pedal peddle pedal it. this whole thing wreaks of retaliation but going off half-cocked. >> ainsley: brian kilmeade interviewed someone earlier and he said that john paul, he can take ownership of this laptop and he is able to disseminate information after a certain period of time. after hunter doesn't pick tum. did hunter sign some sort of a waiver saying i will pick it up by this date if not it belongs to you? legally, is he allowed to release the information on that laptop? >> well, first of all, hunter

did sign a consent to have john paul access the computer. he also on that work order, it also said if he did not pick up the computer within 90 days, after completion, it become abandoned property and become property of john paul. i do want to correct though. john paul didn't disseminate any information. he gave it to the fbi. when the fbi didn't seem to do anything, he then took it to the president's attorney. most people, especially people who are not attorneys trust that an attorney will handle the property as he expects them to. and it was for president trump's protection. john paul throughout was information on there and we all know there is that could have helped during his impeachment proceedings. >> brian: john paul, one thing they allege in the letter on the laptop they now say they are not even sure if it's hunter biden's

which is a joke. they said folder were added later dates into the laptop that showed more incriminating information. do you think anything -- do you know what they are talking ab about? >> for quite some time i have actually been very public in announcing that there has been several attempts by several individuals to modify, to insert fake data to muddy the waters or to discredit the overall contents of the laptop by inserting fake data into the laptop. i'm not surprised that after two years of "the washington post" examination of the drive after it's passed through countless numbers of hands is going to record some things. that's why i made a copy of the drive before i gave it to the fbi because i didn't trust the fbi. i held on to another copy of the drive because i just didn't know what was going to happen to that drive once it got out into the wild. >> brian: wait a second. you are saying you admit the dry you handed over to the fbi has been inflated with additional folders and you don't know how

that was done? >> no, no, no. the drive i handed to the fbi is the exact copy of what i recovered from hunter biden -- well, the fbi has hunter biden's laptop, a, b, they have hunter biden's backup drive. the copy that i held on to was a copy of that. the only time i have noticed any data or any efforts to insert data into the drive was after the fbi took possession of the laptop. so, and then after i gave the drive to rudy giuliani's lawyer bob costello. so, any effort to say that i manipulated or modified that data is a complete lie and the fbi can back me up on this because they are sitting on the original. >> ainsley: okay. well, brian, if you read the "new york post" it's the front cover this morning refuse to admit the information on the laptop belongs to hunter his attorneys now. it says one of his lawyers' letters seems to say that it was his. is that accurate? >> oh, absolutely.

there is no doubt hunter knows it's his laptop. hunter showed up at john paul's shop not just once, but multiple times. first time to drop off the laptop ands second time to drop off the external hard drive to which john paul transferred the information. i think the question that people need to ask hunter, which had never been -- which has never been asked is where were you at that time? , john paul knows where he was because john paul met with him multiple times. but no one has held his feet to the fire on that question. >> brian: right. are you going to counter sue? >> we are considering our options right now. we have got a lawsuit pending right now. but we are considering other options, too. >> ainsley: all right. >> brian: he was that brazen. he wrote a book and did a book tour and wouldn't answer the question is that your laptop? john paul mac isaac thanks so much. >> thanks, guys. >> thank you. >> brian: trying to beat up on the little guy.

it senseless, destructive and intentional. quote this memorial honors heroes, people who had the courage to give their lives while serving the city of portland. no amount of destruction can erase their legacy no. arrests have been made in connection with the vandalism. a new study finds arizona was the most popular state to move to in 2022. according to the moving company allied van lines, south carolina, north carolina, and tennessee followed pretty closely behind. but the report also finds total moves dropped by 20% between 2021 and 2022. illinois, california, new jersey, michigan and pennsylvania saw the most outbound moves last year. and cheerleaders at st. john's university are refusing to perform after the school did not recognize him on national girls and women in sports day. they wore custom t-shirts protesting calling out the school for not including cheer and dance as official sports on its website. the university has apologized, calling it an inadvertent admission and working with the

it is a very alarming situation. both of those cartels, they're the two most powerful cartels in the world. and they're all over the world. and not only are they dangerous in all the drugs they are distributing throughout the united states, especially the fentanyl that's resulting in killing tens of thousands of americans and destroying family, they are involved in violence here in the united states and a lot of people don't realize that. the sinaloa cartel a few years ago was involved in beheading a 13-year-old little girl in huntsville, alabama area. the new generation cartel was involved in a full blown shootout involving ak-47s at a trailer court in north carolina. these mexican cartels, these two cartels are simply too comfortable here in the united states. and i saw an example of that where you have got the sinaloa cartel actually spray painted on the back window of their pickup truck sinaloa cartel number 1. that if that isn't too
