in our air space. >> gillian: this is "america reports." secretary of state antony blinken was supposed to leave today for his own visit to china, high stakes diplomatic trip. he has indefinitely postponed the visit. the chinese foreign ministry admits it did originate in china but insist it's a civilian aircraft that's used for agricultural research. they also say they regret it has now flown into u.s. air space. the pentagon is firing back at the assessment a moment ago saying it was sent to collect intelligence on a key air force base in montana, that houses many of the nation's icbms. >> john: despite the brazen move to send the aircraft into u.s. air space, defense officials have advise president biden not to shoot it down, it has limited value and attempting to take it

out to lead to civilian casualties on the ground. >> john: jacqui heinrich how the president is responding, and jennifer griffin starts us off live at the pentagon. jen. >> john, u.s. defense officials tell us the balloon is moving east and has left montana air space. it was launched from mainland china, i'm told. brigadier general pat ryder moments ago. >> the balloon continues to most eastward and currently over the center of the continental united states. about as specific as i'm going to get. >> does the public not have a right to know? >> the public has the ability to look up in the sky and see where the balloon is. >> the pentagon does not believe it was a weather balloon that flew off course, despite apology from the chinese foreign ministry blaming a weather

event. there was no weather event that caused the chinese surveillance balloon to enter the u.s. air space, this was intentional, an official told me. flying ot 60,000 feet. u.s. does not fly spy planes or balloons over mainland china. questions about why the military advised the president against shooting down the chinese spy plane for now. one u.s. official said to me there's a lot of empty space in montana but also a lot of schools. it is not unpopulated. what happens when this balloon, which is carrying heavy equipment and is the size of at least two school busses lands on someone's home or on a kindergarten. the official added if we shoot it down, the balloon and the equipment on board will plunge to the earth at meteoric space. the possibility of civilian american casualties and collateral damage is the main reason the president opted not to shoot down the balloon for

now. the white house and pentagon still have options for bringing down the spy balloon when it is deemed safe to do so, perhaps once it is over a body of water. the u.s. government has been tracking this balloon for some time, was not surprised by its appearance over the u.s., but described the chinese action as bold. u.s. officials tell me they have mitigated the ability for this balloon to survey any sensitive sites, blocking it from doing so, and that they are learning a lot by monitoring the balloon. john. >> john: jennifer, thanks. >> gillian: coverage continues as president biden and the entire administration face growing concerns over their handling of china's violation of u.s. air space. jacqui heinrich is in philadelphia where the president is heading after ignoring questions about the balloon and china. this incident now straining the already tense relations between the u.s. and china. hi, jacqui. >> hey, gillian. yeah, one of the biggest things that came out of president biden's trip to bali for the g20

summit a few months back and the meeting with chinese president xi jinping was plans for secretary of state antony blinken to go to beijing. that was supposed to happen tonight, he was going to leave. and that is no longer happening. the state department says they have noted the prc's expression of regret over all of this, but they have also said that it's a clear violation of u.s. sovereignty and also international law. we are told an official did brief staff on the gang of 8 to bring this information to members of congress in an expeditious way but not fast enough or widespread enough for some of the president's republican critics. >> i can tell you the overwhelming majority of members of congress that i've spoken to in the last 24 hours had no idea about this. so, this administration again is the least transparent administration in the history of america. this is very concerning. >> the president this morning

about the size of a fire truck. it's massive. and people need to understand where that thing is moving to. it's going across the northwest moving to the south but the fact is it's going across all of our major missile fields out there. 340 first missile wing, 90th, 91, all the 400 missile sites are under it. and people don't realize the slant range on the sensors is huge, like ok, i'm on the first floor of a building, and different on the 50th floor of the building so we are looking deep and vacuuming information. the beauty that balloons give you, they can loiter, they can stay a long time, and so what they are doing, collecting information on us, and i think it's really unfortunate we have not done something about it. i mean, this is agregious, not like they are not just travelling say cross the southwest. these are going across the most sensitive sites that we have, our three missile wings out there, and the icbm field part

investigations saying his client's personal computer data was accessed and then distributed. hunter biden's attorney is not claiming the laptop belongs to him. andy mccarthy, former u.s. assistant attorney and fox news contributor. andy, we talked about this briefly yesterday but i think it bears revisiting if this laptop is not and was never the property of hunter biden, then why are his attorneys demanding this criminal probe on his behalf? >> the only way that it makes any sense, gillian, is if it's a public relations strategy because as a legal strategy they could not even have it hang together for 24 hours, you know. when they first sent these letters out they seemed to be a clear, i don't want to call it implied admission, it was an expressed admission that this data was hunter biden's personal property and when they realized

that that meant that he was basically acknowledging that the evidence was authentic and accurate and this is information that would put, you know, joe biden up to his neck in the interests of his son, they back pedalled and say no, it's not -- and claim prosecutions of people stealing the information from him does not make any sense anymore. they could not keep it together for a day and that suggested it was not a very well thought out public relations strategy, not a legal one. >> john: andy, i was of the mind it was his personal data but his legal team is saying just because it's his personal data does not mean it was his laptop. let's take a look at what the letters to the delaware attorney general said and what the statement from his attorneys said. first of all, abby lowell call

for number 3, write on behalf of our client, reason to believe violated delaware laws and copies and/or disseminating mr. biden's personal computer data. and says mr. mcisaac has gained it without mr. biden's consent. he has copied the data without mr. biden's consent. logically that would assume that the laptop was hunter biden's, yet lowell engages in pretzel logic saying these letters do not confirm mcisaac's or other versions of a so-called laptop. address the conduct of seeking, manipulating and disseminating mr. biden's personal data wherever they claim to have gotten it. you have to suspend disbelief to think there is not a laptop involved in here somewhere and the existence of the laptop is very important, like a law of

thing that's important, which is the information, and for purposes of national security and purposes of, you know, how much we could potentially be compromised based on some of the information that's on that laptop, they are succeeding in having us talk about, you know, this sort of nonsense rather than the real substance of what's in these emails and other documents. >> gillian: andy, just to kind of recenter this for a moment. the reason that this is a front page news story is because of investigations into the alleged connections between hunter biden's business dealings and his father who was formerly the vice president, now the president. that's the thread here that's of interest. that's the reason why we cover this story. >> yeah. in just one year's time, gillian, only a slice of what we are talking about, this chinese conglomerate called cefc, the

and they were driving a stolen vehicle. they are from san antonio. we'll get right into that dramatic video. take a look, brand-new from texas d.p.s. i-35, they lose control of the vehicle, hit embankment and launched, the vehicle goes aircraft and then crashes on to i-35 with a migrant inside. texas d.p.s. rushes in to get into the car and rescue them. they initially pulled the 12-year-old passenger out first, minor injuries and then a badly bloody migrant who is critically injured, and after that, the 15-year-old driver. take a listen to some of the scenes of this crash. you can hear how young the boys were. >> 12, my brother is 14, my friend is 14. please, help me out. >> and again, both of those boys were u.s. citizens from the san

antonio area. law enforcement believes they were recruited to smuggle by cartels on social media. something that's becoming a huge problem down here at the southern border. pretty striking to see just how young those boys were. everybody survived, including that migrant. then we'll take you to another major problem, fentanyl pouring into the country. major bust out of border patrol san diego sector, agents as well as one of their canines seizing 250 pounds of fentanyl pills they found in a vehicle during a traffic stop. 57 packages of pills. enough to kill 30 million people in a street value of $3.4 million. border patrol reporting in the month of january they saw a 300% increase in fentanyl seizures compared to the same time last year. lastly, take a look at this mug shot. border patrol in the miami sector, reporting on all these boat landings in the key west area, they just arrested this

man, a honduran man, previously deported felon in the key west area, interpol notice, red alert notice on him for attempted murder in honduras, so that is one of the guys they just nabbed landing in the key west area. back out here live, everything we just showed goes to show you it's not just the southern border getting activity. boat landings in the miami sector up 400% since october 1st. then the northern border, border patrol in vermont and new hampshire reporting in the last three months alone they have arrested more illegal immigrants than they did in the last two years. we'll send it back to you. >> john: bill, quick question. are the cartels recruiting juveniles because they face lesser charges than an adult? >> that's exactly right. i'm told in this case with this crash, the 15-year-old driver is charged with felony evading and human smuggling. unclear if the 12-year-old will be charged. hit the nail on the head. you know they are not going to get as many penalties because of their young age.

murdaugh trial, looking at the financial motive of the murders of his wife and son. the judge is still deciding whether to let the evidence into the actual trial. complete coverage now, criminal defense attorney phil holloway is standing by with thoughts on this. but first, jonathan is live in our southeast bureau and jonathan, how important are these financial allegations to the overall murder case? >> well, prosecutors are hoping that they can convince the jury that alec murdaugh killed his wife and son to distract from financial crimes which they say were catching up with him, especially on the day that the murders were committed. without the jury in the courtroom for most of the morning, the judge listened to the testimony from these potential witnesses, including a banker who discussed murdaugh's unpaid loans. >> did his account run to negative $347,000?

the courtroom just after 11:30 this morning. the defense argues that murdaugh's alleged financial crimes have no bearing on the double murder trial. john. >> john: jonathan, thank you. gillian. >> gillian: let's bring in phil holloway, criminal defense attorney also a former assistant defense attorney, excuse me, assistant district attorney out of georgia. what do you make of the snapchat video we saw yesterday, murdaugh was shown in one set of clothes hours before the murders, talking about the video where he's standing outside, he's surrounded by trees. and then when he's interrogated he's wearing a different set of clothes. >> yeah, good afternoon, gillian. great to be with you. listen, that snapchat video and frankly i think the other cell phone video taken by the son who is the victim are going to be big pieces of this.

obviously the prosecutor is setting the stage to show that alec murdaugh was acting with this knowledge of guilt, ok. that he -- he knew that he had done something wrong and so he was taking these steps to hide his criminal behavior. he didn't have a whole lot of physical evidence such as blood or dna on his person such that he would have probably had had he done what he said which was to check on the victims and check on the bodies, ok. he had none of that on him as you would expect, so the prosecutor is saying that he changed his clothes in an effort to throw law enforcement off his trail and by extension, to throw the jury off the correct trail according to the prosecutor. >> gillian: it's an interesting tactic. take a listen to this, phil, call for number one, exchange between the prosecution and palmetto bank ceo on murdaugh's financial misfeasance.

>> let's say if it had come out from 2010 up to june of 2021, or at any time that alec murdaugh had been stealing money from his partners or stealing money from his clients, would this bank have continued to loan him money? >> no, sir. >> gillian: what do you make of that? >> listen, certainly lots of dirty laundry that could be aired if the jury is allowed to hear this. listen, we don't generally want to try people based on their general bad character or based on other crimes that they may have committed. we want the crimes they are in court for to stand or fall on the merits of their own legs. but, an exception to that. if these prior crimes or prior bad acts are relevant to show motive, then they can be admissible even if they make the defendant look like a really, really bad person. now, i think the judge is going to let some of this in, it's

consistent with the prosecutor's reasonable and rational theory he committed the murders to hide his other crimes so that's reasonable. then the question is how much of it is going to come in. we have heard a lot of information and the judge does not have to let all of it, i don't think he will let all of it. the reason we are hearing the detailed testimony so the judge can make an informed decision in the first instance, but then fast forward to the possibility of appeal in the event of an conviction, all of this is being taken down, it's in the record and there for the appeals court to look at in the event there is a conviction down the road. but the jury is certainly going to i think get the benefit of some of this because it is very consistent with the prosecutor's stated motive in the case. >> gillian: which way do you think the judge should rule on this particular -- >> i think he should let it in. the rules will allow it to come in. he might put some limits on it,

this far, you have stuff with the law firm, you have thefts from clients allegedly, you've got everything related to the death of the housekeeper, you know, he's also had this other bizarre incident where he was, he faked a murder-suicide, right, so the question is how much of this does the judge let in. if he let in too much of it, the danger is the jury will convict him because they hate him for other stuff and not on the basis of the merits of the case. >> gillian: phil, we have to leave it there. thank you for taking time this afternoon. >> john: news alert from the white house, moments ago president biden left to board marine 1 as he leaves for philadelphia. he does not acknowledge the many questions reporters shout, most about the chinese spy balloon. >> oh, come on. come on. one question. are you worried about the balloon?

10-month-old child. that woman is 16 years old, jumps the fence, a gang member and he shoots her there. those were two of the six individuals killed that day, on january 16th. had two shooters under surveillance for basically the last two weeks, until they were able to make their move. today not only did the sheriff, but also the d.a., tim ward, really came down hard on governor newsom. they want to pursue the death penalty here, governor newsom has suspended the death penalty. the sheriff indicated a conversation with governor newsom saying listen, we have done our job, it's now your turn to do yours and lift that. but nevertheless, the video is basically surveillance video of the shooting that happened several weeks ago and six people are dead as a result of it. this morning a shoot outwith one gang member, alive and in the hospital in stable condition. the other individual turned himself in. that's the status as we speak.
