montana, which is home to our nuclear silos and intercontinental ballistic missiles. beijing claims it is a civilian aircraft used for media meteorological research. that got knocked up by bad weather. but the pentagon says that is a bunch of b.s. >> we know this is a chinese balloon and it has the ability to maneuver. the balloon has changed its course, which is again way we are monitoring it. speak with the balloon continues to move eastward and currently over the center of the continental united states. we assess the balloon is not a military or physical threat to people on the ground at this time. we will continue to monitor and review options. we assess that it will probably be over the united states for a few days. >> judge jeanine: so why the hill hasn't joe biden shut this thing down yet? defense officials advise the president not to take it out.

fearing it could cause debris to fall and put people in harm's way. >> any potential debris field would be significant and potentially cause civilian injuries or deaths were significant property damage. so again, this is part of the calculus in terms of overall assessment but again we will continue to monitor it and view our options and keep you updated. >> judge jeanine: the republican say biden looks weak each second he gives us communist balloon in the air. >> we have to bring this darn thing down. if we have the capabilities and tools to do it, i'm confident that we could have done so safely. i think we probably still could do so safely. >> they should have shot that blind town and the biggest wrist would be hitting a cow, and a low. >> the political level, we have to push back and defend american sovereignty. we have to make clear to the chinese that we will not tolerate this.

but now we hear it has been there since tuesday and today is friday. why would they allow this thing to stay there? >> harold: i don't know the answer to that and there are more questions. you have raised some of them around the table. i think for me and it will be back around the table a few days. but for me, curious that secretary blinken who i respect, like, and know when we detected the born at that point we prevented to take pictures and collect information but the two questions, when did we detect it? and two, we were collecting information before it was detected. two, i think the president it would behoove the president to congressional leaders and democrat and republican alike and perhaps the secretary of defense or the secretary of state or both even the president to give a briefing about this to get some comfort and confidence what we all can assume and give the benefit of the doubt it is being handled.

i think it is important that they do that. the big notion of it being shot down, that talk will only increase if we don't get information to the american people, those in the press, those concerned about this about why they are not doing that. i thought the brigadier general was fine, but we need something more comprehensive to get people a sense. at the heart of this, if we don't send a strong message to china in a relationship with mutual domestic mutual interest the central piece of a relationship, you violate that relationship and i think democr, republicans put that aside. americans want to know what this balloon is doing, how long it has been there and if it has caused any harm to the national security. >> judge jeanine: i will go to you, martha. my resources tell me that this balloon, they can essentially assess the trajectory pure they can study the current spear there was a way to take it down. it doesn't have to be shot down. they can take it down as long as

it is over an area where there's not going to be like los angeles or new york city, major catastrophe. they haven't done that. how are we so sure what this balloon is doing, especially since it is been seen in areas where nuclear sites are. >> martha: there is a couple of areas where it should be easy to do that, alaska, apparently for quite a while. then montana and you saw a conversation with steve dance. that is why we call this guy country. >> judge jeanine: right. >> martha: we have plenty of open space in montana where the people who live in the state want it to be shot down over their state. i think that is something we need to think about. i also think for a lot of people who feel really uncomfortable about this, the greatest thing you could have heard from the president would be an early morning announcement, you know, last night or early this morning

and we disabled invader chinese by bolin because the pentagon said this is a surveillance balloon. and we took it down. we took it down safely. we have the technology to do exactly that. we are examining it. we are taking a look at what is on it. if it is on oculus, we can return it to the chinese government to make sure this never happens again. because if it ever does, we will do the same thing again. and also this afternoon for the general, expect more of these. expect more balloons to cross over the country, gathering information about our silos that keep the intercontinental ballistic missiles. the message a lot of americans will take right now, the southern border is open and the skies above america are open. tom not quite sure where people feel like we have real sovereignty in this country at this moment based on just the facts on the ground.

back-and-forth between the parties and payback will never stop if someone doesn't become an adult in the room. offensive language and behavior in politics, if that is the standard for not being able to serve on a committee, many people would not serve on committees in congress because someone teamed someone's language as offensive or opposing it. two, i don't see -- the racial part of it is not something i see. i'm quick to point out race when i think race is an issue. but i think here, democrats were guilty in the congress before intaking one or two republicans because they didn't like their language or like they are words. i think the words of margie taylor mcdill mike marjorie taylor greene i found offensive and deeply disturbing, but i'm an old-fashioned guy when it comes to politics. the way you defeat someone in politics as you defeat them at the election. and... you do something that violates the standards of the house, if

you get indicted you cannot serve on a committee and not imperil or in question but this sense, i don't understand and i hope at some point that an adult-like behavior comes back. because democrats win the majority in 2024 or 2026, they will win it again. we will have the same kind of thing happen probably. and i just hope and pray that adults in adult behavior emerges again. >> martha: what do you say to that? is there a point that i totally disagree with omar and i think she should be basically being canceled for anti-semitic remarks. that is what is happening here. >> judge jeanine: let's be clear on this, the democrats did it. i think the criticism should come the democrats did it. because we told them they are establishing president. you establish presidents, what is good for the goose is good for the gander.

what i find fascinating is rashida tlaib said a black woman or islam, sexuality is not a defense to every argument that someone makes. she was taken off because they had to pass a congressional resolution for her attacks on israel and, benjamin's and all the other stuff and supporting bbd bds, a state apartment to fd anti-semitism. so we are talking an ally of the united states. she has crossed the line many times. this has nothing to do with her color or her religion. if that were the case maxine waters would not be sitting on committees, okay? let's make it clear what this is about. this is a woman with displayed behavior that people believe she shouldn't be on the foreign affairs committee and she shouldn't have that kind of information. you know, no intersectionality

♪ ♪ >> jesse: violence is way out of control. new gut wrenching video shows two boys viciously beating a 9-year-old girl while on this school bus. it is hard to watch. the mom said to adults on the bus but no one tried to stop the attack. she is pressing charges against the middle school boys with the school district said one arrest has been made. and in georgia, ninth graders facing charges after brutally attacking a teacher. the teacher suffered multiple injuries including a broken leg. the schools fear these type of situations become way too common. >> they are out of control. there is no excuse for the violence. no excuse for those who are coming to our school. and wreaking havoc so others cannot learn.

>> jesse: judge, what is going on when there is adults on the bus? they had to have seen it. it is a blizzard of punches. you have to have hurt it. >> judge jeanine: jesse, that is the question. how many adults were on the bus? you have the bus driver and used where there is a bus monitor. i remember there used to be bus monitors. who knows, maybe at the school budget, cutbacks and all of that whether they have that, but the truth is nobody is standing up for this little girl. she is nine years old and beaten by two other kids. look, this will continue to happen. it is painful to watch this. i mean, this boy is going at her full throttle. they are talking about metal detectors. i'd tell you what they need to talk about, reversing the age. what they did across this country as raise the criminal responsibility until you are not responsible until 18.

kids are smarter than they used to be. there are more violent than they used to be. it is about time we showed some consequences. there was no consequences. the mother in this case was told by the school after she reported the bowling before this beating, we can't do anything about it. you should take your kid to another school. the teachers have given up. where is the covid money? invest the covid money in cops and rent that school like an organized school. >> jesse: how would you have handled the situation if you are the school administrator push mark do you kick the kid out of school administration and put them in v? charged them? speed for raises good points whether we should lower the age. i am a parent who i want to be involved how my kids are taught to. you have to be involved at home. parents have to teach kids actively and consistently teach kids violence is wrong. studies show kids who are hot that far likely more to avoid violence than not.

but kids are simply out of control with a violence issue but what is amazing with me we did a story about a year ago in philly, something in philadelphia on the subway where people watched a woman be violated and nobody did anything. these kids are filming this like this at some sort of video game recording and they watch it later. so there has to be some combination of what the judge said. i think even thinking about holding parents liable for their kids. i wouldn't want that kid in my school and where you syndicate like that? do you disclose where that kid goes to school? they absolutely should. >> jesse: back in the day, this is how it would have been handled. the father of the girl will visit the boy's house, knocks on the door and asks to speak to that kids dad appear that is how you handle that. >> martha: i think a measure of that should be in play again. i go back to the obama

administration, actually. we did stories back then about the elimination of detention and expelling students. in principles could no longer do that. it was considered that it was racist in some way or picking on the wrong kids and they should be able to stay in the classroom. as a result, you have a lowering of the education level for all the kids in the class because absolutely no discipline here they are not learning anything and some of them are trying to stay safe throughout the course of the day on the bus ride home. but we have to empower principals and teachers. they have classrooms totally out of control. the principal doesn't have their back on the parents don't have their back. if my kid beats someone up, he can stay home for three days. you know, we have to have expelling and detention. there was no punishment whatsoever. you also have to ask the question about this girls whose pummeling her teacher. i don't know what happens at home, but i bet it's no good. she probably learned that behavior from someone in her
