there and get her hands around that. once that part; it's the phase of the special councils investigating to find out what the intent was. how these documents got there. and whether any crimes were committed in the process. spinning one thing we have discovered is a lot of times the person in question was if you believe what biden says her vice president penn's believe what he said, they had no idea they had them in their possession. that raises a number of thorny issues as well. that someone else to put them in boxes or whatever it may be in a move or what ever. but had access to stuff that should not have had access to, right? >> yes that is when the real surprising aspects of this. it appears at least the way it has been explained to us this is all inadvertent. the vice president, the present did not know what was being packed up someone else at the packing they were simply unaware they are taking classified documents with them when they left office. but to your point that is exactly right.

we should not be having people who lack security classifications or don't really know classified document when they see one being in charge of putting together material that's being taken out of the white house and brought elsewhere. neil: still too early in the process and i understand that, do we over classify? dooey overgaard documents are there just simply too many that we file away? a lot of these files have included newspaper clippings and the like. i don't know what goes into it, you do. this argument it's exponentially grown i think the number i heard is four times more than the prior administration each new administration for the sheer volume of documents. >> i do think we have an over classification problem. the fact that every administrate the volume of classified documents in existence is growing exponentially tells you something. i think frankly the default rule for a lot of government bureaucrats is when in doubt classify. you've got a document sensitive information not quite sure what

to do with it the easiest course is to check the classified box on the document print that creates a problem as we have seen where your ending and administration trying to figure out which documents you can move what you can't so many are classified. classification levels can shift it's very, very confusing. we need to evaluate how to classified documents in the united states government. >> who seem safe to say it with joe biden or even vice president pence or maybe donald trump i cannot see charges being filed, can you? >> at this point i really don't. i think the fact every month there's some new official nutro of document makes it much more difficult for the justice department to maintain prosecution of any of these people there is going to be everyone doesn't sort of defense. you are right i do think it's really, really hard to see criminal charges.
