declining power and they can't even stop one of our most basic surveillance tools, a balloon. that they are either incapable or they lack the political will to take tough action. >> dana: mark meredith is live at the white house this morning. hi, mark. >> good morning to you. the balloon is no longer flying over the united states, the political and national security headache for president biden is still very much in the air. congressional republicans continue to criticize the administration's response while the white house insists the reason it delayed shooting the balloon down is because of safety concerns. the president said he first ordered the balloon shot down on wednesday after being briefed. the military didn't shoot it down until saturday near myrtle beach, south carolina. the president thanked the military personnel involved. how often the balloons cross over into the u.s. and will it

become common? he hasn't answered many questions but hope he says more in two hours when he returns from camp david. republicans criticizing the white house's response to the entire incident including mitch mcconnell who writes in a blistering statement, as usual, when it comes to national defense and foreign policy the biden administrations reacted too late. we shouldn't have let the china make a mockery of our airspace. the chinese continue to call this a civilian air ship which never had been shot down in their view and this morning hearing from a spokesperson for the foreign ministry in china saying that the misadventure of the air ship into u.s. airspace was an isolated incident but tested the u.s. side's sincerity in improving relations the way it handled the crisis. we don't know whether secretary of state blinken will reschedule

his trip to china or whether a new change of action there and also watching to see if the president makes any mention not only of this incident but what is going on with china in his state of the union address tomorrow night. >> dana: mark meredith. thank you. let's bring in general jack keane and your take. i would love to know what you think this morning. a couple of days since it was shot down to think about it all. we got some reaction from republicans. what do you think? >> well, clearly this is a major national security failure. no way you can dress this up, dana, by the fact that we fine le shot the balloon down. but it already had completed its mission. the reality is when you look at it, the entire nation witnessed the balloon, spy balloon over our country for almost a week. that's a psychological victory for the chinese. there is a sense of vulnerability that china has a spy plane here and we aren't doing anything about it.

the american people are questioning why aren't we? don't we have a capability to do that? and look, the real reality here and we need to get this explanation. the balloon left mainland china on january 21st. for seven days it was en route to the united states off the coast of the aleutian islands. norad, responsible for tracking nuclear ballistic missiles and nuclear bombers, certainly had the capability to track this every single minute leading to the united states for seven days. what were we thinking during that time frame? why didn't we make the decision to take this balloon out as it approached the united states? they are trying to minimize it saying it only past over the aleutian islands for a few minutes. well, we had seven days we were tracking it. and that -- the american people are owed this explanation. certainly i think it's going to

>> dana: now to america's crime crisis. san francisco police department taking nearly 15 hours to respond to a burglary that is due to a major staffing shortage. here to talk about it is one of our favorites. my husband is british and tells me all the time this is quite common across the u.k. now. there will be a burglary and the police say look, just write it down, send us a report, call your insurance because they do not have enough staffing. here is eleanor haines, wife of the bar owner that was robbed to the san francisco chronicle saying small businesses in san francisco are getting squeezed all the time and no protection from the city. the message is you should just be happy it wasn't worse. is she right on that? >> well, she is right about part of it. we are running things like a

mash unit. we have to pick and choose what we can respond to given the staffing that we have. so when we're down to about 15, and 84 eligible to retire we have to pick and choose. for property crimes you will be waiting. she hasn't been the longest. i have oh he seen runs on the board waiting a couple of days, more than 24 hours. so, you know, unfortunately we have to pick and choose. is homicide more important than property crime? >> dana: call for three shows that san francisco police department staffing exodus, a 12% increase in the number of full duty sworn officers from 2019 to 2022. you are not alone. this is also happening in other places. i'm sure you talk to some of them that decide to leave the force. what is their main reason for leaving? >> it's across the board. resignations, probably hitting

us the hardest. we've had retirements. the amount of people who are resigning we just had someone resign the other day four days on and the recruit said he was tired of going from call to call writing reports. he didn't sign up for that. didn't like our policy so you pick and choose, right? but people are leaving. no one is coming. we need to keep the officers here that we have. >> dana: this is also a heartbreaking one. we learned of this story from some writers. child protective services failed to rescue a 14-year-old girl from an alleged ms-13 sex trafficking ring. apparently she was 14 years old and it just is heartbreaking when you read the details of the story. you would agree that we need more in order to be able to protect innocent young people like her. i will give you the last word.

>> you're absolutely right. that girl was failed in many steps, many ways before we were contacted. but let me tell you something about that article. if you came to the station and said that there was a 14-year-old being sex trafficked, no copies nitty going to leave the station and try to get that person, right? so again yes, we need more officers but it is an across the board problem. every department is dealing with this, right? every department. we are losing people and unfortunately down near fresno the young officer killed on the 31st. we come to do this job and sometimes we may not go home, either. yes, we're losing people but we need to get people into this job. it is still a worthwhile career. the ball is in the city's hands. do your thing. >> dana: lieutenant. great to see you. >> thank you.

>> bill: now a suspected boat thief caught thanks to a daring rescue. the coast guard operation off the coast of oregon on friday. a huge wave crashed on top of the boat causing it to capsize, cruise rushed to save the man who was wanted for stealing that very boat. dan springer is running down this story. >> a story with a lot of layers. starts out with the coast guard getting a may day call about a boat in trouble near oregon on friday, afternoon. rescue swimmer on his first mission was dropped in the water but just before he could get to that boat, a huge wave of some 30 feet rolled the yacht tossing the guy on board into the water. fortunately the rescue swimmer was able to come out of that surf and find the man tossed into the ocean. >> i looked to my left when i saw the big wave. i didn't think it would do what it did to the boat.

i realize he was going to take a ride on the boat. >> the man rescued was unhurt after getting checked out at the hospital. he was released. it turns out he is a canadian who is wanted by police in victoria, british columbia on several charges including criminal harassment and it turned out he stole the yacht he rolled. he was also the guy who two days earlier was caught on surveillance camera leaving a dead fish on the porch of a house where the goonies movie was filmed. police searched for him and found him in a warming shelter for homeless people. now he is in the northwest detention center run by immigration and customs enforcement. in a boat load of trouble for a weird couple of days. >> bill: a lot going on, didn't he? my gosh. dan springer, thank you in seattle. thanks. >> dana: the family of one of the idaho murder victims appealing a gag order take restricts them from speaking to

>> bill: that is brand new video into us at the fox news channel. look at the building collapse in eastern turkey. a town about 180 miles due north of the border with syria. the reason i mention that is because this earthquake affected turkey and northern syria. so you are talking several hundred miles of potential damage between these two countries. one report suggesting watch the building go down one more time again.

they are dealing with throughout this entire region. back on that story momentarily. 10:30 in new york. >> dana: human smuggling cases are on the rise along the southern border. fox news was embedded with the texas dps and got exclusive video of this pursuit that led to illegal migrants bailing out of a human smuggler's vehicle. they ran and got tackled by troopers. inside the vehicle more illegal immigrants were found crammed on top of each other. bill melugin is live in mission, texas. good morning, bill. >> dana, good morning. when people cross the border here illegally most of them don't want to stay here. they want to get deeper into the interior of the country. it often involves the use of human smuggling. as you mentioned we were embedded with texas dps in the mission area over the weekend when they went after one of these human smugglers, brief pursuit. illegal immigrants bail out of the vehicle run off. troopers tackle them to the ground and take them into custody. the driver was an illegal

im grant from mexico. others were hiding in the trunk. eight mexican national and one man from cuba. then here look at this video last night. the pd. stopped a vehicle that had five smugglers in the front. four american teenagers from san antonio the. a group of friends who wanted to make quick cash. didn't work out. they're facing felony human smuggling charges as american teenagers get caught up in this. three suspected cartel-associated guides that texas dps arrested in the brush over the weekend. these are the people who guide migrants through the brush and help them find waiting vehicles for smuggling after they crossed the river. dps tells us the three people you look at had multiple

previous apprehensions by border patrol on their records but 0 federal prosecutions. now the state of texas has them in their custody and charge them with texas law violations of human smuggling. take a look at these images. we see an uptick of chinese national apprehended at the southern border. five chinese migrants we saw apprehended in the rgb over the weekend. contacts telling me in the last two days in eagle pass five chinese there as well and three from yemen and four from africa. goes to show you these migrants continue coming in showing up at our southern border really from all around the planet. we'll send it back to you. >> dana: thank you. >> bill: so the attorney for one of the idaho murder victims has filed an appeal to lift a gag order issued by the judge. that attorney cites first amendment rights. judges issuing gag order

considers whether or not the public statements will prejudice the jury and the judge can use other methods to insure a fair trial and whether or not a gag order would address specific problems. with all that as a back drop i want to bring in criminal defense attorney out of atlanta, welcome back to our program and here is what the attorney for shannon gray said. call for number two. as attorney for one of the victims's families. regarding any part of the case as they were allowed to speak about the case under the first amendment. do you believe the judge is right in the gag order first? let's start there. >> no, absolutely not. good morning, bill. look these gag orders are what we in the law call a prior restraint of free speech. a prior restraint is a court order that tells somebody that look, you can't go out and talk about something even before you want to do it or before you try to go out and talk about it. obviously that's like flipping

off their switch to their first amendment at least as it pertains to this particular case. now these things are oftentimes not necessary and whoever wants a gag order in a case like this has a very high burden to show it is necessary. the reason i say they are not necessary is really two-fold. prosecutors already have a built-in ethical obligation not to try their case in the media or on the courthouse steps so to speak. likewise, defense counsel, they have a built-in vested interest in protecting their client's right to a fair trial so they won't go out and say anything in the public or media that will jeopardize their client's right to a fair trial and courts can always change venue or do other things that are less drastic. >> bill: the judge is trying to protect the sanctity of the process and make sure nothing is considered prejudice before the trial begins.

you said we can't presume an unfair trial just because there is intense media and public interest. when you consider the location for this story, how do you find a jury? how do you pick a jury? everyone has heard about it. >> of course they have. that's kind of what my point is. there will be media interest no matter what happens. and so to tell this family member that they nor their lawyer can talk about this case is a direct violation of their free speech rights and we have to balance these things. of course the right to a fair trial for the state and the defense. those are very important. but look, not only the individuals are impacted here but the media. the media has a right here to collect the news, to gather the news and to report the news and even to come on television and talk about it like we are right now. so these gag orders like i said, are presumed to be unconstitutional. when an appeals court looks at this, bill, they will start that

analysis from that place. the presumption of unconstitutionality. and whoever wants to keep the order in place is going to have to show that there really is no other way to protect the fair trial rights of the parties involved in this case. that will be very difficult to do. >> bill: we'll lean on you a lot. the trial doesn't get underway until the end of june. several months to go. we'll see if the gag order holds and what the judge says about it. >> dana: always good to have him. >> bill: june 26th is the trial. remember when the order was issued by the judge? you will have until late june a mini trial inside of a trial. we'll see a lot of evidence then. >> dana: also the possibility there might be a plea between now and then as well. we haven't seen that, though. there is no chirping about it at all. now to the horrific scenes in northwest syria and southeast turkey. two major earthquakes have

this? >> good morning. you know what? i've been looking this over the last couple of days. i'm in favor of hf146. they are considering this legislation. it is not done yet. for the state to be kind of a trans refuge. this is why i'm in favor of it. i have watched this transition for the last seven years very closely and i see what's going on here. trans people, there is like -- i feel like there is different levels of being trans and how trans are you? it's almost like athletic ability. some people are born with very little athletic ability and some people are born with a lot of athletic ability. the same way with trans people. i see very young trans people that are out there. i'm talking 3, 4, 5 years old that parents are dealing with that they call say my little

daughter. the kid could -- i'm not your daughter, i'm a boy. these parents are struggling with these issues at a very young age. and they are very much overlooked because right now there are so many states that are coming up with their trans policies like utah saying basically you can't do anything until you are 18 years of age. tennessee is coming up with strong. south dakota. this has become a big political issue in the united states. i don't want the trans people to be used as a political tool. they need a place to go. especially very young children. they need a place to go. >> dana: the republican governor is his decision vetoed a transgender bill saying i don't understand what they are going through or why they feel the way they do but i want them to live and all the research shows even a little acceptance in

connection can reduce suicide significantly and i would imagine you could probably agree with that part of it. >> i certainly can agree with that part of it but every trans person is different. look at me. i was trans since i was, you know, a little kid but kept my mouth shut. i grew up in the 50s and 60s. trans issues have become this big political battle in the united states and this is not going to stop until 2024. these issues are being used by both sides of the aisle to politically posture themselves and where they are at. i don't want the trans community -- this is such a small part of our society to be used as political tools. i will fight for that. i'm also going to fight for those young trans kids and parents especially who are struggling at a very -- with these kids at a very young age,
