>> greg: we're out of time. thank you to my guests and studio audience. >> trace: thank you, greg. good evening, everyone. welcome to fox@ night. i'm trace gallagher in los angeles. breaking tonight, president biden said his goal was always to shoot down the chinese spy balloon when it flew into u.s. air space but his military commanders advised against it, so why not shoot it down when it came near the coast of alaska late last month. chief correspondent jonathan hunt is live with answers. jonathan, experts are baffled by this whole thing. >> reporter: they are, trace. president biden addressed those questions as he arrived back to

the white house from camp david today saying he wanted to shoot down the balloon at the first available opportunity and that, in his view, is exactly what the pentagon did. >> watch it come over into the united states from canada. i told them to shoot it down as soon as it was appropriate. they concluded we should not shoot it down over land, was not a serious threat and we should wait until it got across the water. >> that's, of course, what happened saturday afternoon. a usf-22 fighter firing a single sidewinder missile at the chinese balloon bringing it down just off the coast of south carolina, and the president said the chinese were well aware of what was coming. >> we made it clear to china what we were going to do. >> reporter: but critics, many of them republican, question the wisdom of waiting to shoot down the balloon until after it had flown right across the united states and over several sensitive u.s. military sites.

>> look, i'm not saying detonate this thing over a major populated area. this is the size of three city buses. they had plenty of options to bring it down. the chinese could have moved this thing. they didn't feel like they needed to. >> reporter: pentagon officials used the time that the balloon was over u.s. territory to gather information about its capabilities and they intend to gather much more intelligence now with the remnants of the balloon being collected by u.s. navy ships from waters around 4. the component parts of the spy balloon are being sent to the fbi facility at quantico, virginia. as they're recovered, they'll be analyzed there. no doubt, president biden's action or inaction, trace, will be analyzed just as much as we run up to the state of the union. >> trace: every single day. jonathan, thank you. let's get insight into this

process with dave sears. great to have you on. 47 feet of water off the coast of myrtle beach. it should be a fairly easy recovery, dave, but what do we glean from this? will this be a winfall for us as far as information goes? >> i think it will be a good amount of information you'll be able to get from this and recover from the balloon but i don't see why it had to be done over water or why you have to wait for them to gather intelligence as they come across. it definitely makes it more difficult, the recovery process, over water, so you have the drift of the currents and the debris that could float along. it makes it more diff to recover everything. >> china program deputy director said this on the story today and i want your response on the other side. listen to this. >> i think at the end of the day, what the administration will be well-positioned to do is lay out a very clear case, not just to the american people but

to alleys and partners about the fact this was not a civilian air ship. it was very clearly a spy balloon sent here to collect intelligence. >> trace: a spy balloon sent here to collect intelligence and that's not what we've been told, dave. what do you make of that statement? >> yeah, i think they're finally telling at least what seems blatantly obvious and the truth that this was a spy balloon sent here to collect intelligence on the united states, on the military facilities. if it was able to, it could collect intelligence. more importantly, it was there to test what our reactions would be. how would the populous react? how would our military react? how would our diplomatic and political end of things react to this? they got a lot of answers o outf this. >> trace: dave, this is what you did. you watched this thing float across the country and a lot of people said why not shoot this thing down right before it gets to the coast of alaska? you know it's coming. why would you wait?

>> sure, maybe you wait for it to go over alaska. you have an intelligence gain/loss factor. hey, can i gather intelligence on this as it's airborne, pull signals off of it? see where it flies? and then shoot it down? should i wait for it to transit that and enter just the end of the aletiuan islands or see where it's headed after itcrosses the aletians and shoot it down there. a difficult cold-water recovery. could i shoot it down the beginning of montana or anywhere along the states to make a land recovery? all of that is possible. the administration is really running into commonsense questions it's having a hard time answering. >> my question would be the very same which is did you know all of this before it came across alaska and came down through montana? did you know that, oh, this wasn't going to gather intelligence about military sites? or were you just hoping for the best? your thoughts.

>> right, exactly! all these commonsense questions are being asked. you know, i heard different congressmen or senators bring up the idea that, hey, it's crossing montana. it's crossing wyoming, kansas, all of these areas where you couldn't find a couple of square miles where you could put it down in where it's not dangerous. what did you know beforehand? did it even cross the allusions? more balloons came across during the trump administration but they didn't know about it. there are so many unanswered commonsense questions they should just address openly instead of trying to hide this veil of competence that's not there. >> trace: open is not a word i would use with this administration in recent months. dave sears, thank you for coming on. in the meantime, all the balloon intrigue this weekend led to an american-owned research balloon soaring over the southeast being mistaken for the chinese spy

craft after 5,000 flight radar users tracked its movements. the aircraft tracking site corrected the record stating on twitter, sorry, this is the chinese balloon. -- this is not the chinese balloon. are you better off now than four years ago? for a record number of americans, the answer to that decades old political question is a resounding no since president biden took office. the white house correspondent kevin corke is digging into these numbers and is live with us here in los angeles. kevin, welcome to the left coast, my friend. >> always great to be back in the southland, my friend. when you see these numbers, you're going to say what in the world is going on? a brand-new poll is out and shows a record number of americans that say, yes, as trace pointed out, they're worse off financially since the president took office. in fact, the most ever recorded by the abc/"washington post" poll in its 37 years of asking that question. now, according to the poll, 41% of americans say they are in a tougher financial situation since biden's inauguration back in january of 2021 while just

16% say they are better off. now, those numbers stand in stark contrast to when the poll asked americans the same question two years after the election of former president donald trump when just 13% said they were worse off and a whopping 25% said they were in fact better off. meanwhile in the very latest fox news survey, biden's approval amongst independents is at just 33%, down 22 points from a high of 55% back in june of 2021. and if you're the white house and you think, well, that's pretty bad, well, this is worse, because when asked about the upcoming presidential election in 2024, 62% of americans said they'd be disappointed or angry if biden were reelected. just 36% said they'd be enthusiastic or satisfied. by the way, the number of americans who categorized themselves as extremely or very concerned about major hot-button

issues, well, they're huge when it comes to inflation and higher prices, higher crime rates and, yeah, you guessed it, political divisions as well. and i want to leave you with this. i think you'll find this fascinating. the fox news survey also said in a hypothetical head-to-head matchup between the current president and former president trump, trump would win 48-44 according to that survey. >> trace: which is fascinating. kevin, stand by. you can help me grill these gentlemen in a minute. in the meantime, that's not the only poll casting the president's job performance in a negative light tonight. let's talk about that and the infamous chinese balloon with pete peterson and the executive director of the national security institute jameel jafar. welcome to both of you. pete, i want to go to you first. i want to put "the washington post" poll off, are you better off? americans feeling economic pain under president biden. are you worse off? 41% say they're worse off and 16% say they're better off. what they don't say -- and you

can kind of read it at at the bottom -- t these are the worst numbers in 47 years. >> when you look at the data coming out nationally -- first, let's take a look at inflation. inflation out of december and january is still running at 6.5%. that is far higher than when biden took office. when you look at interest rates, that's the double whammy, right? you have consumers that are running up credit card debt. now, it's at a higher interest rate to pay on that. a number of different economic factors are cutting against president biden. >> trace: yeah, i think the real issue here is there are a number of americans who feel like they're forgotten by this administration. you're spending $100 million in ukraine and yet i can't pay my grocery bill or put gas in the car. they're doing a lot for a lot of other countries and a lot of other people but a lot of americans feel like they're left behind and it's exacerbated by the increasing costs.

>> i want to put the second poll up. this is democrats, right? and are you -- do you want the president to run again? these numbers are striking. are you enthusiastic or satisfied if biden is elected in 2024? 36% say yes. 62% say dissatisfied/angry. your thoughts? >> well, you know, trace, i think, look, it's obvious the american people are not thrilled with the job that the president is doing. the economy's been a challenge. our role in the world has been a challenge. look at our withdrawal from afghanistan. look at the chinese spy balloon. americans don't feel like americans, whether it's economically at home, their opportunity to gain success here in the united states or our ability to influence world events overseas. they just don't see it. and then they blame the president for that. >> this poll by the way is just democrats, kevin. i thought this was fascinating. this is just democrats. put this up. it is among 24 democrats, right? run among the democrats.

president biden 31%. somebody else, not even -- no name here, just anybody else, please run! pete, you've got 31%. kevin, i just was looking at this and i thought when you get to a number like that of you name it and i'll take him, it's bad for the administration. >> political death nail here, because what it basically says is not only are we so dissatisfied with you, we'll take just about anybody else you put up. i think the real challenge s who do they turn -- challenge is who do they turn to? if it's not michelle obama, is there somebody that could get the job done and beat president trump in a head-to-head. not a long line there. >> what do you think, pete? >> that's a very good point by kevin. when you look at some of the stories that came out recently about vice president harris, it certainly seems like she's not going to be an option. where do democrats go? many of the polls are reflecting many americans are unsure about the president's ability to run for re-election just physically. it's a lot of -- a lot of voters

are questioning that. >> trace: let's talk about the china balloon, jameel. i want to run this by you. this is former secretary of state mike pompeo on hannity a short time ago. mike pompeo, john radcliffe and john bolton said no one notified any of them about the balloon in the trump administration. >> i never heard anything like this or briefed president trump on anything like this or talked to anyone on my team about this. no one saw the balloon the size of three balloons travel across a bunch of our states over five days at any time during our administration. >> trace: your thoughts on this, jameel? >> it's not surprising. what we learned from the department of defense in recent days is that, in fact, the department of defense didn't even know these balloons had transited american territory. they learned this after looking back at prior information into the behind administration, so it's -- into the biden administration.

it's no secret the biden administration didn't no. the department of defense didn't know this happened when it happened. they called an awareness effect. it's shocking and deeply troubling they didn't know about these balloons flying over american territory over the last four or five years. >> trace: pete, your final us? >> -- your final thoughts? >> it appears to be common for this administration to blame the previous administration. in the last chinese spy balloon case, we're hearing from officials from the trump era they had never heard about this. >> trace: seems like a lot of transparency we're not getting. it's the documents and everything else. >> clean up on aisle 5. this is a catastrophic mess from a pr perspective. i don't think they have the answers we deserve. >> trace: we'll have you on the night cap coming up, kevin corke. federal authorities arrested a woman and a man from florida

accused of attacking baltimore's electric grid. brandon clint russell and sarah beth clandaniel conspired to "completely destroy the entire city with widespread blackouts." fox news embedded with texas authoritiesed in the middle of a pursuit that led to the capture of a number of illegal immigrants and illustrates the continuing crisis of human smuggling. marianne rafferty shows us the exclusive new video from the southern border tonight. marianne, we see a lot of compelling video coming out of the border. this is among it. >> we're talking a constant stream now of migrants coming across and keeping the human smugglers very busy as well. take a look at this exclusive video from our fox team at the border. texas dps troopers involved in a foot pursuit after migrants bailed out of a smuggler's vehicle. many were found crammed on top of each other inside the trunk. all of them single adult males. while these troopers are searching for illegal migrants

in thick brush, vice president kamala harris was in washington this afternoon asking for more money touting the admini administration's route causes approach. >> data from the department homeland security shows the number of migrants from guatemala, el salvador and honduras where our root causes, efforts have been focus have significantly declined over the last 18 months. >> reporter: but republican congressman andy told fox on sunday those numbers are misleading and simply throwing taxpayer money at the problem is not going to stop the influx. >> you're going to hear them produce the administration's narrative the number of encounters is going to go down. that's true numerically. categorically, you're just changing the filter about where those people are coming. >> reporter: hours before the president will deliver his state of the union address, we'll hear from top border patrol agents when they testify before a house

committee on tuesday as house republicans ramp up their investigations of why nearly 300,000 migrants have crossed into the u.s. illegally over just the past four months. >> trace: 2.5 over the past two years. just keeps going on and on and on. marianne. >> no sign of stopping. >> trace: thank you. >> thanks. >> trace: well, the fox news @ night commonsense department went back to look at video and news reports from a few months ago about new york mayor eric adams lashing out at governors in texas and arizona for having the teammate to bust migrants from the south west to new york. he's calling it inhumane saying the governors didn't understand the plight of the migrants. the migrants wanted to come to new york. now, they want to leave new york to find a better quality of life. many of the migrants say new york is filled with "homeless people, people who shout and people on drugs." they fled their home countries

because of oppression, corruption and drug gangs. now, the migrants want to go to canada. you know who is happy to help them get there? the new york mayor eric adams. he's even willing to use taxpayer dollars to buy the migrants bus tickets to the canadian border. mayor adams is now passing his problem onto canada. common sense finds it intriguing how the very same bus tickets issued to migrants by republicans are inhumane but when issued by democrats, boy, they're the epitome of generosity. in the meantime, coming up, the south carolina judge in the alec murdoch murder trial made a key ruling today. it is a huge blow to the defense. later, have you heard this story? so a michigan woman finds $15,000 in cash in a plastic bag on her daily walk to work. what does she do? she returned every penny. what would you do? would you give it back? maybe be a little tempted to keep it?

>> trace: well, the death toll in turkey and syria continues to climb from a massive 7.9 magnitude earthquake monday morning. death toll stands at at least 4,000. the death toll could climb exponentially. thousands of others have been injured. countless bodies are believed to be buried under rubble as some survivors have been texting or tweeting out calls for help from beneath the debris. >> my wife and i grabbed our kids and pulled them towards the entrance of our home.

a wooden door fell on us which saved us. we started taking people out and we heard screams but we did not know the source. we did not see anyone. they were all under the rubble. the situation is too bad. we need urgent help. >> the temperatures are below zero so we need to find people as soon as possible. >> yeah, the region is facing an ongoing threat of major aftershocks. one measured 7.6. it hit southern turkey within 12 hours of the first quake and a 5.6 magmatude -- magnitude quake has been reported tonight in central turkey. in the meantime, first up in tonight's crime crisis round-up, a pennsylvania police officer was shot and killed earlier today and another injured. 32-year-old sean was honored tonight with a police procession leaving the hospital. the two officers were responding to a domestic call when they encountered the suspect who opened fire.

the suspect was struck by a third officer and apprehended. an off-duty new york police officer is in critical condition tonight. the 26-year-old father of two was shot in the head during an apparent robbery attempt in brooklyn while buying a used car ticessed on facebook marketplace. py police have a person of interest in custody. tonight, earlier today, mayor adams was confident the suspect would have a long rap sheet. watch. >> just highlights the 1,700 bad guys we keep talking about. recidivism. i guarantee you when we catch him that he'll have an extensive past and a criminal record of violence. >> trace: in the meantime a memorial for fallen police officers in portland, oregon, has been vandalized. you can see the before and after pictures here. the portland police chief called it a senseless, destructive and intentional act.

so far, no one has been arrest snide florida teen aiden fucci plead guilty in the murder of tristyn bailey found with 114 stab wounds near his home. his mother has been charged with evidence tampering after video was found of her washing blood from her son's jeans after he was taken in for questioning. the now 16-year-old will be charged as an adult. philadelphia police are on the lookout for two suspects who broke into a grocery store. the suspects took an atm machine, the whole thing, before grabbing items off the shelves and also opening the register stealing cash. so far, no suspects named or found in this case. well, another big day in the court in the double murder trial of alec murdoch. in addition to the testimony of two prosecution witnesses, there was an evidentiary ruling by the

judge that is likely to hurt his defense. here is david lee miller. >> reporter: accused double murderer alex murdoch's defense suffered a setback in court monday. a ruling by the judge will allow prosecutors to present evidence to support their theory he murdered his wife and son to divert attention from his money troubles. with the jury away from the courtroom, eight witnesses tabefied murdoch's financial woes. judge clifton newman then ruled jurors could hear about the possible motive. >> i find that the jury's entitled to consider whether the apparent desperation of mr. murdoch because of his dire financial situation, threat of being exposed for committing the crimes which he was later

charged with resulted in the alleged crimes. >> reporter: about the time of the murders, murdoch stopped at the home of his elderly mother. testimony from her anguished caregiver suggested murdoch may have visited the home to try to establish an alibi. >> why are you crying? >> a good family and i love working there. and i'm sorry all of this happened. they're good people. >> reporter: in a late afternoon decision, the judge ruled against the defense on another matter. the judge said he will permit testimony about a blue rain coat containing gun residue investigators found at the home of murdaugh's mother. trace? >> trace: david, thank you. now for legal analysis on the case, let's bring in criminal defense attorney and federal litigator. it's always great to have you on. i look at this whole thing and i think i can't quite wrap my mind around how all of these financial crimes getting in and getting to the jury is such a detrimental thing for the

defense. >> anytime you talk about a financial crime, what you're really saying is the person you're talking about is a thief and cannot be trusted and even though the judge, judge newman in this case, said you could only consider it for motive, because this is a circumstantial case, consider it for motive but nothing else, that's an academic exercise, trace. you can't have the jury unthink or unlisten or not consider something for one portion of their calculus and not the other. if we were in law school, we say the judge made the right ruling but this is a bombshell and a real defeat for the defense. >> trace: because even if you only use it for motive when you lay out all of these financial crimes, it looks like an interesting motive. >> absolutely. you think to yourself can it really be that simple? can you really think a suspect and a defendant would off his wife and his 22-year-old son just to distract from the attention of his thieving and crimes? but in this case, t prosecution believes it is in fact that simple and the jury is entitled

to consider it. >> trace: we saw one of the family friends on the stand, michelle smith. there's this theory alex murdaugh used her as an alibi to get her to lie. >> did alex murdaugh ask to you tell someone how long you'd been there? >> he said if someone asks you, 30 to 40 minutes. >> she went onto say she wasn't there that long. she wasn't there 30 to 40 minutes. that's a big deal. >> it is. we have dozens of charges and unrelated trials he's going to be facing, the financial crimes, the embezzlement, etc. that's dissuading a witness. he knew at that point in time a few days after the slaughter of his family a serious crime and a serious investigation took place. now, what you don't want to see as a defense attorney is tears and real emotion because every jury instruction throughout the union says you're entitled to entertain a witness' demeanor and she was telling the truth and she was doing his darnness

to make sure she wasn't going to do that. >> trace: if you're a defense attorney, you have to be fast on your feet to try to get over that. >> that's exactly right or you wear a purple tie the next day to distract from that fact. there's little you can do to take away from that shine. >> trace: i want to move to the alec baldwin trial, it starts the 24th -- the prelim -- of this month. a witness list has now been released. it includes the following here, director joel who was shot in the movie set. lane louper. during a press conference months after the shootings, he told reporters the movie's producers were cutting too many corners to save money and negligence on set led to hutchins' death. >> it's like building a house! when you have negligence, the most important piece of evidence you need to combat as a defense attorney and need to promote as a prosecutor is, have you done this before?

has the suspect engaged in reckless behavior before? something that touches all of us, unfortunately, are vehicular homicides, involuntary homicides. have you seen the defendant in this case drive recklessly before? drive under the influence before? all of that goes to build a house of recklessness and negligence which is the required state of mind for these offenses in new mexico. >> trace: i've got 20 seconds left. this is in the idaho murders. the neighbor says this, quoting, at one point during the four days surveilled by the fbi, prior to his arrest, he was observed putting trash from his family's house to the neighbor's garage bins around 4:00 a.m. why are you getting rid of your trash, brian? >> for the prosecution, a suspect's trash is a prosecution's treasure in this case. it's not only evidence of premeditation with the receipts from walmart, with evidence that was used in commission of the crime but also covering up your track shows consciousness of guilt. that's what the prosecution is

these presales going on so i tend to think it'll go a little bit more smoothly than the last one although there will still be people who are unhappy. >> trace: the last one was a fiasco. people are talking, you have to break up livenation, ticketmaster. i'm wondering, do you think that will eventually save people money? would it save them or get them tickets easier? what are your thoughts on that? >> i guess it eventually means 10 years, 15 years -- i honestly haven't been a big proponent of the idea of completely surgically breaking this thing up because i come from the music industry and see a music ecosystem. i know how it works. i think it's probably unrealistic in the short term so, no. but i do think over time if they can free up those exclusivities between these venues and the ticketing services then, yes, it's good to have more competition that's in there. i will say this, biggest platform, most scalable, the artists are turning to it. they're not coming out and supporting it in any big way but they're using it regularly.

you have to wondering about that a little bit. >> we talked before congress and there was no celebrity in the building coming out and supporting ticketmaster. want to move onto disney. disney's streaming losses are mounting a little bit. these are the operating losses. this is q3 2022, almost $1 billion. in q4 $1.5 billion. now they're trying to kind of move and sell some of their content to other platforms. what do you think? >> i mean, it's a smart move. look, mr. iger there has got a bunch of challenges there. there's probably a lot of money they're leaving on the table by not licensing and selling all of that content, marvel, pixar, hollywood. they've got a tremendous catalog there. it makes a lot of sense. they're under pressure to subprofittability. the street is looking at all of these streaming services. his competitors are doing it as well. he has to do it essentially. i think it's smarted. >> trace: the reasoning was is they wanted disney+ to be much stronger is it an indication to you that maybe disney+ is not really going to make it down the road?

>> there's definitely huge competition in that space. i think, you know, netflix, disney+ and hbo to me are the three top horses. i think there are some ones underneath it. paramount, some of the broadcasters, individual ones -- i won't name them all but i think disney+ is in an incredibly strong position. >> trace: i can't get away without showing this video, of course. this is sam smith who performed what some say is a say tancal undertones, blood dancing stuff kind of thing. i mean, there was a lot of people online that were complaining about this calling it satanic and maybe that's exactly what sam smith wanted, seth. >> we were talking about this before. at least people are talking about it. these awards shows have a tough time getting people's attention anymore. maybe that's the only thing i could come up with on that one. the shows keep getting better and better. the broadcast audience seems to get smaller and smaller. i know the kids probably pay attention to the digital side of it. i think they want to get people paying attention to it, too. >> trace: there was a lot of outrage. if you're sam smith and the others, you're thinking, listen, if it's viral, it'll help us,
