answers. i will go back casually to the couch or excuse me to the chair. >> ainsley: to the curvey chair. excellent answers and brian will interview them again at #:50 and steve will be with them in the last hour. >> steve: listen to this story. an arizona rancher is being held on a million dollars bond and facing first degree murder charges. that guy right there, george allen kelly is accused of shooting and killing a mexican citizen who was apparently trespassing on his land. >> ainsley: griff jenkins is live in washington with the latest for us, griff? >> griff: good morning, ainsley, steve and brian. this story highlights the reality that ranchers living along the border have been dealing with for the past two years. hundreds of thousands of migrants illegally crossing cron their property all hours of the day no one there to stop them or take them into custody. now in arizona a sits in jail shooting a migrant who trespassed on his land.

73-year-old george allen kelly facing first degree murder charges after a body was recovered on his property which sits some 75 miles south of tucson in just a mile and a half off the u.s.-mexico border. you can see here on the map. now, kelly is begging a judge to reduce his bail set at $1 million fearing for his wife's safety. saying in court documents, quote: she's there by herself. nobody to take care of her. the livestock, or the ranch. now as santa cruz county sheriff's office investigates this case. local reports say the deceased man was a mexican national with a history of crossing the border but had no connection to kelly. now, the incident highlights the crisis in arizona which cbp says there has been more than 150,000 migrant encounters so far this fiscal year. and in this tucson sector, where this occurred, agents tell me that they lead the nation in the number of known got-aways. now, all of this comes as the border patrol chief of the tucson sector, john modlin is

set to appear in just a few hours before the house oversight committee alongside gloria chavez the chief of the rgv sector. first time we have heard from sector chief since the border crisis began two years ago. meanwhile over in texas. governor greg abbott posting a picture to twitter, video, actually, of more border wall being constructed as a state effort to try to supplement what he sees as a lack of federal resources along his border. now, that wall section, you are looking at, is being constructed in the rgv sector. perhaps that will come up in the hearing with chief chavez today in the more than 10 years that i have covered the border guys, every agent has told me they need three things to keep things under control. manpower, technology, and infrastructure that wall obviously infrastructure. see what happens. the hearing starts at 10:00 a.m. brian, ainsley, and steve. >> steve: we will cover it. >> ainsley: i read an article in "newsweek" george allen kelly the man griff was talking about

the 73-year-old cattle rancher. he does return to court tomorrow and he said i can't afford a million dollars bond. he said please reduce this. my wife is on the ranch by herself. there is no one to take care of my life stock. he was arrested because according to this article the investigation initially revealed he was shot the immigrant was shot in the area. he was found up to 150 yards from the kelly property. but, he -- it's also being reported that he was shot on his property. so they don't know if the immigrant ran and then was found on someone else's property later. >> steve: right. so, at the next court hearing. it will be interesting to hear what other details are revealed about mr. kelly pictured right there. there aren't a lot of details that have been released so far. it is unclear, although slim, whether or not they knew each other. and no motive has been listed at this point. but, they -- i was reading in one of the stories, i think it was in the daily mail this morning, it said that a friend of the rancher said that he had issues with people who were on his property illegally and also

apparently this particular man from mexico had a history of crossing into the united states illegally and apparently had been deported a number of times. lots we don't know. we just know he is still in jail. and details coming up tomorrow. >> brian: all right. let's bring in congresswoman elise stefanik, chairman of the house conference member of the house intelligence and armed services committee. welcome, congresswoman. >> good morning. >> brian: now that you are officially in leadership in a position. as we look at the state of the union tonight, how often do you think you will be standing? >> well, certainly that's up to joe biden. and i don't think joe biden is going to be reaching across the aisle. i think he is going to try to lecture house republicans and frankly double down on his failed far left policies that we have seen for the last two years whether it's the trillions of dollars of reckless spending that have caused this debt crisis or whether it's the border crisis which we just heard from griff. house republicans are going to highlight our commitment to america in the guests we bring

'a briefing not just for congressional leadership but for all members. certainly the committees on which i serve, the intelligence committee and armed services committee, we're going to ask many, many tough questions. again, as we think about a rising china in terms of being a top adversary for the united states in the 21st century, we need make sure we have an understanding of what information were they collected? what intel was this chinese spy balloon collecting? and why do we even allow it to enter our sovereign airspace? governor, china is watching, our adversaries are watching. they have seen weakness from day one from joe biden as commander-in-chief. i think this actually goes back to the catastrophic afghanistan withdrawal both russia and china were watching that weakness and they are asserting, trying to assert their strength to take advantage of that weakness. we need to return to the policies we saw under president trump and republican leadership when we had a strong commander-in-chief. >> ainsley: we also wanted to ask but thursday. because i know this is the first hearing for the subcommittee on

political weap weaponization ofe federal government. witnesses from both sides. is this to talk about agencies, government agencies who particularly targeted conservatives? >> it's great question, ainsley. so i think this will be some of the most important work of the house republican majority. this is about transparency and shining a spotlight. so this first open hearing is to set the tables. if you talk to elder americans, they are deeply concerned that federal agencies are targeting hard-working americans. and that there is two sets of rules. if you happen to have the last name clinton or biden, crimes are brushed under the rug. we have seen how the fbi and the department of justice have not addressed hunter biden's clear crimes and yet, at the same time, they are targeting conservatives and republicans because of your political beliefs. we see that in their targeting of parents. we see that in their targeting of whistleblowers in their own agencies who raise concerns. so, this is going to set the tables that this is an issue, this is important to address. and we are going to leave no stone unturned. i believe this is going to lead
