biden laptop story up to the run-up of the 2024 election. happy wednesday. >> sandra: we'll let you know as the lights get flipped back on, this is "america reports." three former twitter executives were subpoenaed by james comer and forced to testify under oath today after internal emails revealed their discussions and the ultimate decision to censor what they saw as negative information relating to the now president's son and biden's family business dealings. >> john: many critics say it interfered with the 2020 election. >> sandra: pete sessions is standing by with fresh reaction from the new testimony. >> john: first to david spunt, how long has this hearing, david, been in the works for? >> john, it's been in the works for a long time.

republicans have been eying such a hearing since 2020 for about two and a half years, they have not been in the majority until now, doj and fbi watching the hearing, hearing from former chief legal officer, also from former deputy counsel james baker and yul roth, three names integral in making key decisions before during and after the 2020 election. is "the new york post" story weeks before the election. delaware computer shop owner contacted the fbi in late 2019 after he says hunter himself dropped it off at his shop and never picked it up. the fbi took possession. and then new york post ran this cover, biden's secret emails, exposing information about

secretary, austin, immediately after the u.s. shot down beijing's spy balloon on saturday. we are also getting more brand-new images from the u.s. military showing the debris recovery as that is still in process. bryan, what are we able to see and what are the conditions today? >> from our vantage point, the conditions are perfect, especially from a salvage operations perspective. the water is nearly completely still, flat, calm, it is 64°, unheard of here, a rare day in the middle of winter off the coast of myrtle beach, south carolina. there is a ten nautical mile security perimeter set up, this is as close as we can get. fox news drone has a shot up, live pictures where the warships are over that debris field. what's left behind from the chinese spy airship. we saw at least four more boats put into the water by the navy

10:08 am
>> the balloon does not belong to the united states. the chinese government will continue to resolutely safeguard its legitimate rights and interests. >> as far as what they have been able to recover thus far, the pentagon just said in a press conference that they have learned a lot about this surveillance program based on what they have captured. but would not get into more detail. sandra. >> sandra: way to keep your balance there as you delivered a very strong report through that. thank you very much. >> john: you have to know he's about to throw a rod in the water, too. discuss the growing china threat in a moment, but first the top story on the house hearing into how big tech suppressed the hunter biden laptop story and whether they are guilty of government organized censorship. pete sessions serves on the house oversight committee and will talk to us. thank you for joining us. i want to play something that the committee heard from the

former head of trust and safety for twitter about censoring the hunter biden laptop story in "the new york post." >> i've been clear in my judgment at the time, twitter should not have taken action to block "the new york post" reporting. just 24 hours after doing so, the company acknowledged its error, it isn't obvious what the right response is to a suspected but not confirmed cyber attack by another government on a presidential election. i believe twitter erred in this case because we wanted to avoid repeating mistakes of 2016. >> john: even hunter biden's attorneys are now, congressman, acknowledging at least the data, if not the laptop itself, belonged to hunter biden, yet here we have twitter by itself censoring a legitimate story for political purposes. that might strike some people as being just plain wrong. what do you say? >> well, in fact it is, and the only reason we found all of this
10:10 am
information out you remember we were told, none of this was true until elon musk made sure we had the actual documents and came forward. these perpetrators that were before the committee today have all admitted they made mistakes, that they, if they had to do over again would not have done is that. but the bottom line to this is it was hidden until they were caught. they got caught and so theirs is a different story today than we had heard for several years. we are going to meticulously move through this, jamie comer -- james comer, young chairman, is making sure we are gathering the information that we need. questions still abound, why did the fbi approach them, what did the fbi ask them to do, were they compelled to do things because they felt like it was the right reason. were they provided information that was false. and the bottom line is to all this even "the new york post"

10:12 am
began all this in 2016. not only misinformation but actually untruthful evidence that they were presenting and the federal government was co-opted by this also. every bit is not only realtime information we need but our friends, the democrats, of course, want none of this to be told and they say it's irrelevant. it's very relevant when the government is initiating their information to suppress free speech, we know we are in trouble, and that is what it appears as though we have captured that dead on. >> we just have a little bit of time left here, congressman, i want to ask you about the chinese situation and the balloon and where we go from here. what the president said about the balloon last night at the state of the union. listen here. >> make no mistake about it. as we made clear last week. if china threatens our sovereignty we will act to
10:13 am
protect our country, and we did. >> john: about all he mentioned about the balloon. invading u.s. sovereignty is one thing, but shooting the balloon down after it has transited through sovereign territory is quite another. congressman mike turner, your colleague on the oversight committee, likened it to sacking the quarterback after the game is over. >> i think that what the chairman said is true, but the policies, not just the united states military but intelligence has been to keep things from happening as they saw it and to keep our data and information and security clear. this was a clear violation, the american people found out about it, and this administration got caught. they are not up to making sound national security decisions as evidenced with hunter biden and the president himself. we have seen this for a long period of time. it's coming full circle right now, right in front of us, about

the chinese influence on the democratic party and in particular president biden and his family. >> john: congressman pete sessions from the great state of texas, hopefully they have the lights back on and you can get going again. appreciate your time. >> thank you. >> john: sandra, you hear the chinese foreign ministry saying the balloon does not belong to the united states, although i think the law of the sea might kick in. something that's at the bottom of the ocean to whoever finds it. >> sandra: everybody has a different reaction whether or not the president went strong enough on china, ro khanna, the democrat from california suggested the president should lead with it, that obviously did not happen. he did address it, so more on that coming up. >> john: looking forward to that. >> sandra: fox news alert, south carolina, the courthouse where alex murdaugh's trial is underway, it has just been evacuated, we have been told, putting the double murder case on hold for the time being.

that's not who republicans said. robert read it, it was a long plan scott came out with, rejected by republicans, part of, eliminate federal programs that can be done locally, move government agencies out of washington, and then he says all federal legislation, all federal legislation, sunsets in five years. that was not accepted by republicans, but it's the same thing that happened -- let me finish, robert. same thing done during the 2020 campaign when -- we are friends, when a lie came out from the biden campaign saying that there is a social security plan that eliminates all social security that washington post gave that pinocchios. so he's lied about it before and he's lying about it again. >> sandra: so much i want to get to, that was your reaction to that. he also said some of my republican friends want to take the economy hostage. i can't imagine you agree with

there are some theater, coming from the leaders. >> john: i don't think the president was going to get into your particular issue during the state of the union address. for the audience point out you have been a tireless campaigner to ensure female athletes have an equal opportunity to perform in women's sports. let me just repeat that. to ensure female athletes have an equal opportunity to perform in women's sports. the fact that you even have to do that is beyond ironic. >> it's beyond ironic and honestly, you have all these people telling me how couragegous it is and how brave i am, but does it make someone brave to acknowledge women deserve equal opportunities, that's how far we have come as a society and in our culture. >> john: and but n criticized by many people for taking that
10:47 am
stance, you don't hear about male athletes fighting that make sure fael athletes have an equal opportunity for men's sports, no. if a woman transitions to a man and competes in men's sports, it's no competition, but the other way around as it did with lia thomas, from number 462 to numb we are 1 overnight. >> that's important worth noting. the state bills being passed, everyone arguing in opposition of the fairness in women's sports bills are talking about trans women being able to compete and it's because trans men are not under jeopardy. the men's category is not under threat, it's the women's category under threat. >> john: one of the things that you are campaigning against with the ncaa is to make sure that men who have transitioned to be a woman do not share the same locker room as female athletes. did you share a locker room with lia thomas? >> yes, ncaa of course we competed against thomas but were not forewarned we would be sharing a locker room with lia.
10:48 am
we did not give our consent, they did not ask for our concept, but in that locker room we turned around and there's a 6'4" biological man dropping his pants and watching us undress, and we were confronted with male genitalia. that to me was worse than the competition piece. not even probably a year, two years ago, this would have been considered some form of sexual assault, voyeurism, but now not even are they just allowing it to happen, it's almost as if these large organizations are encouraging it to happen. of course, after ncaa champions, the ncaa nominated thomas for woman of the year, so we are celebrating this movement, this is not something that happened by chance on a one-off basis, they are encouraging men to compete in women's sports. >> john: following graduation, your intent to go to dental school, you have put that off because you want to continue the
10:49 am
battle you have begun and hoping that other female athletes will step up to the plate here, but they're not. and why don't you think they are? >> you know, people are terrified, especially speaking from my experience of talking to other ncaa swimmers specifically. lia thomas's teammates are told their school has made their stance for them. they are told if they feel uncomfortable seeing male genitalia in the locker room, they should seek counseling resources. told they will never get into grad school if they speak out, terrible, awful things that are not true. and that they will be called a bigot and hateful and trans phobic, but there are two sexes, you cannot change your sex and women deserve opportunities. >> john: we'll keep watching you. riley, good to meet you. >> sandra: interesting discussion. two people who helped former ftx ceo sam bankman-fried will

remain a mystery for now. why his legal team is keeping their identities a secret. >> john: an arizona rancher is facing first-degree murder charges, after a man who repeatedly crossed the border, but was he in self-defense? >> something goes wrong, i will defend myself but i hope that doesn't happen. i'm bill lockwood, current caretaker and owner. i heard about the payroll tax refund, it allowed us to keep the amount of people that we needed and the people that have been here taking care of us. see if your business may qualify. go to getrefunds.com.

>> sandra: the two people who helped former ftx ceo sam bankman-fried with the bail bond will remain a mystery for now. kelly o'grady on the latest saga. why do the lawyers want to keep their identities a secret? >> they don't want to deal with the death threats his parents have been receiving, so yesterday we did expect to get the names of the two individuals beyond his parents that co-signed his $250 million bond, so the judge ruled to release those names to the public. in the 11th hour, the court repealed counsel submitted a notice they are going to fight it in the court of appeals. they have argued the cryptoking's parents have received death threats and

serious cause for concern the two additional people would face similar intrusions on their privacy and threats if the names are redacted. meanwhile, sbf will appear in court tomorrow for a hearing to modify his bail conditions following accusations of witness tampering, the prosecution is seeking to make permanent a temporary ban on his access to encrypted messaging apps, and his communication with all ftx employees. and following a heated back and forth, his lawyers indicated they had agreed on a compromise, which the judge promptly rejected. so, sandra, legal experts tell me it could be as much as the judge wanted clarity on the particulars of the deal, but sometimes they don't appreciate parties modifying court orders outside of sessions. we will watch that closely. >> sandra: we will indeed. >> john: a major fentanyl
