congress finally receives a classified briefing on the matter today. the senate being updated at this hour after the house was briefed earlier today. >> sandra: all of this as senior u.s. military and national security officials warn and have confirmed that spy balloon shot down off south carolina's coast on saturday was part of a major surveillance program run by china's military. so, what else are lawmakers learning in these briefings? we'll ask tennessee senator marsha blackburn and california democratic congressman ro khanna coming up. >> john: begin with lawmakers sparring over the politization of the federal government and whether the justice department has been weaponized against republicans. hello, i'm john roberts in washington. let me be the first to say it, sandra, happy friday eve. >> sandra: and we made it to thursday. good to be with you, john. i'm sandra smith in new york. "america reports." republican-led committee says many questions need to be
10:02 am
answered by the fbi and justice department over what they say has been numerous incidents of discrimination against conservatives and american civil liberties, including whether the justice department investigated upset school parents as domestic terrorists. a characterization doj officials have vehemently disputed. >> john: david spunt has the latest from the justice department. any reaction to the hearings, david? >> john, sandra, waiting for an on the record statement from both the doj and fbi, but privately officials with both agencies tell me it's simply not true that either the doj or the fbi weaponizes against american citizens. however, that's not sitting well with republicans, they now run the majority in the house. that's why we are seeing today's hearing and will see more in the future. here is a little bit from the hearing that just kicked off about 30 minutes ago. watch. >> my time in congress i have never seen anything like this.
10:03 am
dozens and dozens of whistleblowers, fbi agents coming to us talking about what's going on, political nature at the justice department. >> i'm deeply concerned about the use of the select subcommittee as a place to settle scores, showcase conspiracy theories and advance extreme agenda that risk undermining american's faith in our democracy. >> one of the primary concerns for republicans is school board memo by attorney general merrick garland in october 2021, parents fed up with covid restrictions and mandates like critical race theory expressed themselves at meetings a response the national school board association sent president biden a letter september 29, 2021, arguing some parents' actions should be considered a form of domestic terrorism and hate crimes. the group later apologized for the language. five days later, a.g. garland put out a memo on october 4,
10:04 am
2021, he does not use the word terrorism or parent, he has defended the memo since writing it. a subpoena was sent to garland and director ray asking them to produce documents by march 1. doj responded last night to chairman jordan and his committee and doj telling us that we are learning -- they would sit down with the committee on a staff level to have some negotiations first, hold off on the subpoenas, we'll sit down with you, we'll talk to you, about you that coming from doj. going to be a difficult day for employees at doj and the fbi watching this hearing, no question, john, sandra. >> john: all right, we'll monitor it, david, and hear you later today. thank you. >> this sector needs a more effective policeman on the beat. someone over at the department of transportation to get the job done. >> notably absent from the

meeting is secretary buttigieg. just screwed up flights, no reimbursements, and then proceeded to say we want to be in charge of how the airlines behave. >> john: senators sounding off on the state of airline travel blaming transportation secretary pete buttigieg for allowing an airline such as southwest to strand thousands of passengers during the disastrous holiday travel season. more than 20,000 flights were canceled, despite the industry receiving at least $85 billion in taxpayer funds to shore up its operations during the pandemic. let's bring in tennessee republican senator marsha blackburn, she serves on the senate transportation committee. the southwest meltdown over the holiday travel season was particularly bad, but almost every american airline has been suffering problems, despite getting a ton of money from u.s. taxpayers during the pandemic to stay afloat. why is the airline industry in
10:06 am
such bad -- such bad state at this point in time? >> you know, john, this is one of the things that we talked about in the hearing today, and i just came out of that hearing. and quite honestly, i think we should have had several of the airlines there. i know people that can't get refunds from allegiant, can't get back their air miles from american, southwest left them stranded, air canada could not get people home. there's just such a list of issues. but here is what we do know. when it comes to southwest, they have not invested in the technology that would allow their systems to talk to one another. yes, this was a bad storm. yes, everybody was affected. and they all should plan for the worst. they need to kind of war college this, and they did not do that. also we have heard a little bit,
10:07 am
i questioned about the cost of fuel. this accelerated cost of fuel has cost these airlines to move money away from improvements and use it to just get the fuel to put in the planes to get them in the air. >> john: you know, i had a flight from san diego to washington, it was supposed to be a direct flight. because of the fuel problem in san diego, we had to fly to los angeles to gas up the plane before we came across country. i want to ask you about the chinese spycraft and the spy flight across the united states. had you a classified briefing on it. obviously you can't answer every question but what questions did you go into the briefing with and were they answered? >> we did not get sufficient answers in the briefing. i got the feeling they knew this was out is there, they followed it for several days, they wouldn't have said anything if it had not been for a citizen
10:08 am
who is a pilot who takes a picture, puts it up and says what's the deal here? and then they did that, of course, blinken did not want to cancel his trip, he ends up cancelling his trip, but here is what we have learned. this is a global network, china is putting this up, it's part of their surveillance. they are trying to spy and surveil whether it is dealing with our economy, whether it is great power competition, what they want to do is dominate. they know that joe biden is weak, joe biden is not going to do anything to them, indeed he let this thing sashay across the united states from one corner to another and waited until it went into the atlantic ocean to shoot it down. rather than having done that when it came right near alaska or doing it there in montana,
10:09 am
and i think we all want to know what did they get and we also want to know what they are going to learn from the pieces they are picking out of the ocean. >> john: you know, senator, one of the questions that i have is that after this flight transited the united states, suddenly the pentagon is saying and the state department saying oh, it's not the first time, it happened during the trump administration, and also earlier during the biden administration, but my question is, norad did not know about these. they admitted they did not track this. so who did know about it, who saw these balloons, why weren't they reported and where are the records of these flights near the united states? >> well, and if -- if information was gleaned from the intel community or norad or dod, why was this not shared and why was congress not informed that there is an issue with this, with these spy balloons. and if china is building a fleet
10:10 am
of these, why has our intel committee, why has our armed services committee not been given a briefing on this. the lax nature of responsibility, the lax nature toward accountability is boggling, mind boggling. you have to say what do they think they are doing, why are they hiding this, and again, we have a president who is soft on china, and he does not want to challenge the chinese communist party. so he is letting them go ahead, whether it is spying, whether it's great power competition, whether it's a blue water navy, whether it is the atrocities that they are committing against the uyghurs, the mongolian, tibetans, hong kong freedom fighters, bullying to taiwan and other pacific island nations.
10:11 am
this has to stop and this administration needs to get tough on this. congress needs to take back some of this responsibility from the administration because they can't seem to make a decision. they can't even decide when to shoot down a spy balloon. >> john: it's clear between the two of us, senator, there are a lot of questions yet to be answered about all of this. we'll see if we get the answers in the days and weeks ahead. thanks so much for joining us. it is a question, sandra, you know, we see this balloon and say whoa, where did that come from, who owns it, suddenly we have the state department and the pentagon saying oh, by the way, part of a global program china has to surveil countries like the united states and others. who knew about that, why weren't they saying anything about it before? >> sandra: and what else do the officials know that we don't yet know. we'll ask ro khanna, the democrat from california will join us next hour. hopefully we learn more along with the audience about what has
10:12 am
happened in the past. >> john: we'll see. >> sandra: we look forward to that. a possible clue uncovered in the murder of a new jersey councilwoman. a person seen here running around her apartment complex shortly after she was shot and killed. this as we learn another new jersey councilmember was skilled yesterday in a neighboring county. alexis mcadams joins us with more on this bizarre string of incidents here. >> to hear this one situation happened a week ago and yesterday this other person is killed, not related at this time and no arrests in this case of the councilwoman, but did know a person was caught on camera near the crime scene moments after neighbors heard nearly a dozen gunshots. you can see the shadowy figure running, just moments after dwumfour was shot and killed last week. neighbors heard nearly a dozen gunshots. dwumfour was found dead inside
10:13 am
of her own car outside of her townhouse in new jersey. the down, 35 miles outside of new york city, the community honored the young mom and politician with a bright future. first-ever black woman elected in that town. she was from guiana. >> to eunice, sayreville was the most beautiful place she could be. she did not care. black, white, brown, gay, straight. >> hours before the memorial, milford, new jersey councilwoman heller was shot down.
10:14 am
he worked as a supervisor. the gunman was a former employee and the gunman later drove off and killed himself. so this morning all eyes remain on the surveillance clip, this afternoon, rather, as police try to catch the killer of dwumfour. they are hoping somebody comes forward and has information to lead to arrest. she has a little girl left behind inside when she was killed. >> sandra: just tragic. hope to learn more soon, john. >> john: a terrible tragedy. a new poll shows the glaring disconnect of how americans are really doing financially. the staggering number of americans who say their financial security is buckling under the pressures of high inflation as they pay more and more for basic necessities. >> sandra: rules for thee but not for me. why staunch climate activist, wait for it, bill gates, says his private jet use, that's not
10:15 am
a problem for the environment. money man charles payne has something to say about both those stories. we'll join us next. all across the country, people are working hard to build a better future. so we're hard at work, helping them achieve financial freedom. we're providing greater access to investing, with low-cost options to help maximize savings. from the plains to the coasts, we help americans invest for their future. and help communities thrive.

>> john: in a move that would appear to make the already overwhelming border crisis even worse, telling fox news the biden administration is ending the use of most surveillance blimps at the important border. it allows agents to see from a height who is crossing into the united states illegally. number of blimps reduced from 12 to just 4 due to cost. our sources also say the loss of the balloons will have an immediate and negative impact on border security. sandra. >> things are costing more now, things are more expensive, and i think it's just digging us into a deeper hole. yeah, we are making more money but the same time, things are costing more. >> cost of living is crazy expensive. my rent is mind blowing. yeah, if i didn't work in a restaurant, i don't think i would be able to afford to eat food. stand --
10:21 am
>> sandra: half of americans, 50% say they are financially worse off than they were just one year ago while just over a third say they are better off today. all this as president biden takes his economic message on the road to voters in battleground states touting success. charles payne, you always tell our viewers exactly the way you see it. a lot of economists say things are not so bad out there. but time and time again, especially over the past year, you have people saying their own personal finances are getting worse. so, what is this disconnect? >> you have to listen to the people. brilliant people on my show, like 1 trillion in excess savings. what the hell is that? and 999 billion of it belongs to rich people who don't need it.
10:22 am
we are doing ok, i saw this number and this number, forget the spreadsheet, look at common sense. a reason there is a massive disconnect what you heard at the state of the union and every poll going in there. this gallup one caught my attention. take the income brackets, upper income, better off, only 39% of upper income are saying they are better off. 43% of upper income are saying thinker worse off. >> sandra: up on the screen, percentage of americans who say they are worse off, sorted by annual household income, ok. so the category who says that they are faring the worst is making the least, under $40,000 a year, 61% say they are worse off. that number gets better as the income level goes up. but isn't that the category the administration says they are out to help the most? >> yeah, but the main point i was making, even the upper
10:23 am
income folks, more of them say they are worse off than better off. >> sandra: living paycheck to paycheck for example. >> here is the problem with the biden administration and folks who think like he thinks. you cannot punish one niche of the economy, people who spend money, put money into the economy. talk about taxing them to death, roadblocks around the business, all you are doing is hurting folks who like to climb the ladder of success themselves. and we see it every time, they go back-to-back to the same policies and now things like delinquencies go up. what was really intriguing, monday we had the consumer credit number and people max out the credit cards last year, $930 billion, a sharp decline. savings are going up, households are hunkering down, they feel something, know something, and no wall street analyst is
10:24 am
talking about that. >> sandra: before we run out of time, perhaps yours and my favorite story of the day, bill gates, major climate activist says well, his private jet use, that's -- that's not a problem. >> i spend billions of dollars on climate innovation, not only am i not part of the problem by paying for the offsets, but also through the billions that my breakthrough energy group is spending that i'm part of the solution. >> sandra: rules for thee, not for me. >> he's a real ass, he really is, let me tell you something. on social media, i thought it was click bait, i thought there was no way he said that. made me think all the bad things af heard about him are true. you can go out and commit a crime, maybe murder someone, but pay to the benevolence

association and pay for jail time, you don't have do it. he is saying no, i can pollute the earth, damage the earth, i can do it because i find an offset. are you serious? and the trips to africa, i beg the africans, don't listen to this guy. he doesn't want you to have the population -- >> sandra: same thing as john kerry, their time is more important than ours. >> they are asking people in the other countries never grow your economy, never. richest countries in the world use the most energy in the world. they are telling them never use energy, never, never, stay where you are, never have hope for you, or your children, stay where they are. poor people in america, they like the status quo, it works for them and we need to rebel against that. >> sandra: oh, boy, john, we got him going over here. charles payne, thank you very much. see you on fbn this afternoon. >> john: wind him up and turn
10:26 am
him loose. i love it. troubling nearly surfaced emails from hunter biden's laptop, how he wanted to deepen ties with a chinese company, miranda divine joins us next. >> sandra: high school graduation, a rite of passage. one 9-year-old has checked that off. and what is next after getting his diploma. >> i wanted to do it, because i had the abilities to do it. so why not use those abilities to the greater good. e, son, wite elbow grease, you can do just about anything. thanks, dad. that's right, robert. and it's never too early to learn you could save with america's number one motorcycle insurer. that's right, jamie. but it's not just about savings.

background to our suspending the story, the fbi said you better watch for this because it might be coming down the pike. not specifically about hunter biden but tuning their antenna. miranda, can you hear me? >> oh, sorry. yes, john. you are right. >> john: you are just taking it all in, i guess. >> yes, waiting for a sound bite. look, i think what you are hearing from the fbi is just their plausible deniable, past masters at that, and did not go directly to the social media companies and say you must censor hunter biden's laptop, of course not. they just prebunked it by explaining as yoel roth, one of the executives said in a sworn declaration that you know, we are expecting that there will be some sort of russian
10:34 am
disinformation hack and leak dump in probably october and likely about hunter biden. so of course they were sort of presuaded before the story to view it with suspicious eyes as russian disinformation and did what they had been groomed and brainwashed into doing and of course the fbi was pushing an open door because these executives at twitter, as you could see, were tweeting their own, yoel roth tweeting anti-trump diatribes calling everyone at the white house a nazi. >> john: in the hearing on the weaponization, says the fbi took possession of the laptop fully nine months before your story came out, and that the computer

repair guy, mac isaac, and gave it to the fbi, the fbi was trying to stay quiet. listen to what johnson said. >> as the fbi left his shop with the laptop, mr. mac isaac recalled one agent saying "it is our experience that nothing ever happens to people that don't talk about these things." that statement was the opening salvo in a coordinated effort over the next ten months to sabotage any public revelation of hunter biden's laptop or any wrongdoing connected to the bidens. >> john: sounds like that that the fix was in. >> look, that was a pretty sinister statement as retold by john paul mac isaac. when he first told me that, i thought well, look, he's a bit paranoid, often whistleblowers get nervous and i'm sure that's not true.
10:36 am
but over the ensuing couple of years we have seen whistleblower after whistleblower come forward from the fbi and talk about how the laptop, which john paul mac isaac handed to the fbi in 2019, buried, put aside so no one could investigate it. and how other witnesses, any other material derogatory to joe biden, that was also buried, including the testimony for five hours that tony bobilinski gave before the 2020 election and the contents of three devices he handed over, which showed that in his business dealings with the biden family, that joe biden was involved and that they were getting millions of dollars from china. you would think that that material would be something that the american people should have been able to see before the election so they could do the proper due diligence on one of the candidates for president but
10:37 am
"the new york post" was the only outlet trying to get that information out to the public before the election, and of course we were immediately censored by twitter and facebook. >> john: even though the information was true. i want to read this, don't have time to discuss it, but hunter biden email suggests even deeper connection with china. he was sending an email hiring an employee to act as a liaison with a bank of china private investment fund, attached is a rough budget for the bhra employee housed in washington. responsibility of the individual coordinate on a full-time basis with the beijing staff on behalf of partners in the u.s., and officed in rosemount seneca, a separate entrance, though, all during the time that joe biden was vice president. a lot more to dig on here. miranda, thank you to talk to you. >> thanks so much, john. >> sandra: just three days away,
