hunt is live with us with the breaking news. >> good evening, trace. we learned the balloon is just one of a fleet operated by the chinese military. with a significant game of spying on the u.s. in this game, many other countries in many other cases and the balloon shot down by a u.s. fighter jet on saturday was laden with sophisticated equipment to gather intelligence and possibly to transmit that intelligence directly to beijing. >> the tool package, the equipment package on that balloon, was enormous. we were not able to jam the transmissions. we don't know the extent of the program. >> as the u.s. navy continues to collect debris from the waters off south carolina where the balloon was brought down, it's emerged that some of the recovered parts were western made and had english writing on them. officials have not pickly name the manufacturer of those parts,

but they have said they believe that manufacturer has a direct relationship with the people's liberation army of china. despite those revelations, president biden is playing down the incident. >> it's not a measured breach. look, it's totally a violation of international lawyer, it's our airspace and once it comes into our space we can do what we want with it. >> but republicans on capitol hill are still wondering why if that's the case the administration didn't do something sooner when it was over alaska or montana, for instance. >> they could have taken that balloon down. the greatest risk would have been hitting a cow. >> the chinese foreign ministry in the meantime continues to insist that the air ship was just a weather balloon that got blown off course. the u.s. says that's simply not true, and that information gathered by u-2 spy planes that

circled across the united states clearly showed it was designed for spying. and trace, despite the differences on capitol hill over the speed and nature of the president's response for the chinese action, republicans and democrats in the house came together today to condemn china for a "brazen violation of u.s. sovereignty." trace? >> i think that's a fair assessment. jonathan hunt live for us in the newsroom. jonathan, thank you. let's bring in one of the lawmakers who was briefed on this on thursday, a member of the house intelligence committee, florida republican congressman michael walls. congressman, thank you for coming on, biden was asked a bit earlier if the chinese balloon was a major security breach and he in essence said no, quoting here, "look, the total amount of intelligence gathering that's going on by every country around the world is overwhelming. it is not a major breach." in other words, congressman, he said no worries. a lot of people think this is a

big worry. >> yes, trace, i certainly think it's a big worry. this balloon hovered over not only our missile fields of which we only have three, it hovered over one of them but also hovered over the command, the strategic command, that command and controls all of our nuclear missile sites, and then we've asked a lot of questions and we're still waiting on the analysis, i don't think we know yet for sure what exactly they were able to take and what they were able to transmit back to beijing, but trace, at the end of the day, i think that answer by the president completely discounts the message that the rest of the world got, was that america is either incapable or unwilling to defend its own airspace against a balloon. so, you know, that's a message sent to both our adversaries and

allies and it's not a good one. >> i've got to tell you, congressman, i was a bit baffled, you clearly had lawmakers on both sides of the isle in this classified briefing and they came out with two entirely different takes on this. watch. >> my feeling is right now that this should have been shot down over alaska, that the department of defense has too many lawyers, and we're just perceived as very weak across the nation -- across the world. >> everything i learned today confirms that the administration made the right decision. >> i mean, this is about as far apart as you can get. it's a country apart. you're talking about some saying shoot it down before it gets to alaska and some saying, yes, totally fine to wait until it got to the atlantic. your thoughts? >> i think there were some silver linings, so to speak that we were able to collect on this asset of the chinese and see what it was able to do and

certainly now retrieve it from the shallow waters in the atlantic. had we shot it down over the pacific, as we should have, in my view, it would have been deeper, it would have been colder and more difficult but you have to weigh that against what they were able to collect and the message that we sent. at the end of the day i think it should have been shot down over the pacific ocean, not the atlantic ocean. don't shoot down a spy craft after it's done spying. trace, the other thing that's remaining unanswered in my mind is why chairman decided to do this. chairman xi. this was in your face move in the wake of his meeting with biden and just before blinken's visit which means either she didn't know about it which means you have rogue elements making this decision, and he did. what we make of that and that kind of escalation is still yet to be answered. >> a lot of people have echoed that. congressman, thank you for coming on, sir. we appreciate your time.

>> thanks. >> and breaking tonight, fox news has confirmed that former vice president mike pence has been subpoenaed over multiple investigations into trump following weeks of negotiations between federal prosecutor's and pence's legal team. this subpoena seeks documents and testimony related to the attempted overturning of the 2020 presidential election. a house judiciary subcommittee held its first hearing on thursday on the alleged weaponization of the federal government. even former fbi agent said weaponization started at the top. and trickled down to the field offices. the white house correspondent kevin corke is live in the nation's capitol with the new information on this. good evening. >> very interesting day here in washington. the house weaponization subcommittee's very first hearing actually featured a pair of panels of witnesses and they were expected to presents testimony and to it it how they believe the doj has compromised american civil liberties, and it

took almost no time at all for democrats to warn republicans of the dangers of -- wait for it -- weaponizing the congress. >> congressional oversight conserved to protect the integrity of our republic. but there is a difference. my colleagues, between legitimate oversight and weaponization of congress, and our processes, particularly committee work as a political tool. >> lawmakers and panelists scrutinized many of the more controversial decisions made by some of the country's most powerful agencies like the doj including its handling of the biden pay-for-play influence peddling allegations. >> in my time in congress i have never seen anything like this. dozens and dozens of whistleblowers, fbi agents coming to us, talking about what's going on. the political nature at the justice department. >> even worse yet whistleblowers say the bureau itself is now

compromised. >> over the course of my 12-plus years the fbi's trajectory has transformed. on bureau, the bureau's mission remains the same but its priorities shifted dramatically. the fbi became politically weaponized starting from the top in washington and trickling down to the field offices. >> also very interesting, we noticed how in this particular conversation, held by lawmakers, is a decision to go back and look very carefully at how the doj handled its treatment of parents. you may remember back in 2021, the attorney general merritt garland issued a memo that in effect challenged the doj to get out there and possibly arrest anyone threatling school officials. back then a lot of parents felt like there was great deal of overreach and that's an element of the story that will bear a much closer eye as we continue to watch it unfold here in

"washington times" affair political report and law professor. senator chuck grassley said this about the fbi and hunter biden. listen and i'll get your reaction. >> other whistleblower disclosures made clear that the fbi has within its possession very significant, impactful and voluminous evidence with respect to potential criminal conduct by hunter and james biden. these disclosures also allege that joe biden was aware of hunter biden's business arrangements and may have been involved in some of them. >> that's the trifecta, alex. you've got hunter, joe, and james biden. that's a big statement. your thoughts? >> yes. jim jordan keyed up, i believe we'll be hearing more and more

from those whistleblowers, he said they have already held one deposition. i believe they have two more already scheduled, i think we'll end up getting more details on that whether it's from lawmakers ahead of time of any sort of release as the media gets some leaks as we often do but one thing i will say, during that hearing that i thought was under-reported was the issue with big tech companies and them working with fbi agents in terms of censorship and we saw that with the hunter biden laptop story, and thomas massey asked about that and what type of liability these tech companies should have and they really were working with, it could be alleged, government officials in exercising viewpoint discrimination so when there are questions about first amendment, should there be some sort of constitutional violation that's usually with the government but these are private companies working with the government so it does raise a lot of legal questions here and it will be interesting to see what republicans do. >> on that note, here's a former fbi agent during the hearing.

of the american people, has been pursuing an ideological partisan agenda. you listed it, investigation of protest at school boards. we saw the tampering, playing around with the steel dossier and its influence on the 2020 elections and 2016 elections. we've seen now social media and government perhaps in cahoots in a way that might have affected the last election and now we're talking about suppression of the hunter biden laptop story. congress can't prosecute people but they can conduct investigations to make sure that the justice department is doing things freely and fairly and get it out in front of the american people and they can make their minds up at the next election. >> i want to get this in, this is minority leader jeffrey saying this. watch. >> the american people do not support this weaponization committee but it's exhibit a of the extreme maga republican agenda which is not designed to do anything to make a difference in the lives of the american people.

families. >> southwest airlines chief operating officer andrew waterson acknowledged an apology alone would not suffice for the roughly 17,000 flights that were canceled. telling lawmakers, "we messed up." >> i would like to explain to you how we messed up. in hindsight, we did not have enough winter operation resiliency, from where and how we de-ice aircraft to the cold resiliency of our ground support equipment and infrastructure. >> they said they are on the way to prioritize enhancements to their software and they told reporters outside the hearing that executive bonuses they will be reduced this year because of this fiasco. now democrats were quick to point out that southwest's ceo didn't attend the hearing, while republicans like ted cruz questioned why transportation secretary beat buttigieg was not there to answer for the failure

anti antiquated. like the faa systems these are very similar. they are really no different but they really need to be brought up to speed quickly. >> but the southwest pilots association, kyle, has been saying for years, and i talked to a southwest pilot not too long ago, for years, they have been saying, listen, this stuff has got to be updated because it's bad, and southwest is like, we'll get to it when the time is right. listen to one of the union guys and we'll get your opinion. >> unfortunately, despite many opportunities southwest airlines management did not listen to its pilots, and front line employees who saw this meltdown coming. >> pilots have a unique perspective to the airlines' operation, from the flight deck we coordinate with nearly every employee group from the front line to the airline headquarters. >> so what they are saying is in this case, i'm sorry is just not going to cut it. southwest has to make amends to somebody somewhere. >> that's correct, and, you

manhunt is under way in the northeastern maryland air for a suspect who allegedly shot two baltimore police officers severely injuring one. they are searching for 20-year-old david lithicum. the police pursuit spilled over into neighboring hartford county where he bailed out of the vehicle. residents have been urged to stay in place during developments. we'll keep tracking the story.

the roundup, for the second time in a week a new jersey council member has been gunned down. yesterday, republican russell heller was shot and killed inside his car outside his workplace. investigators say the gunman was a former employee and later killed himself and one week earlier, about 20 miles from that shooting, republican new jersey council member eunics -- was shot and killed inside her car. new surveillance release shows a person caught on camera near the crime scene moments after the councilwoman was shot in her car, there are some voices on that tape as well. and this morning in the nation's capitol a man assaulted minnesota democratic congresswoman angie craig. police say the man grabbed craig by the neck in the elevator of her d.c. apartment. she did suffering some bruising. ♪

>> trace: prosecutors continue to present evidence in the massive double murder trial of alex murdaugh. that he killed them to prevent an embezzlement scheme from being exposed. >> friends and colleagues devastated by deceit. prosecutors working to prove motive in the case say there is a long list of people financially swindled at the hands of former attorney alec murdaugh, excused in the brutal murders of his wife maggie and younger son paul to detract attention away from his financial world that was crumbling around him in the months and days before the murders june 7, 2021. witnesses telling the panel alec murdaugh overdrafted with his bank, stole money from his partners at his law official, his clients, and even his best friend who testified that he confronted murdaugh about missing funds from his law firm and demanded answers. >> i looked at him and i said, alec, i'm sure i said f or h or something, i said what the --

focus is all on the financial crimes, light? and one of his best friends, kris wilson was testifying today, and he said this, which i found kind of interesting. watch. >> he told me he had been addicted to opioids and i think he said for either for 20 or over 20 years. >> and also -- >> that he had been stealing money from clients on the firm. >> not only was he a financial thief but a drug addict. >> the prosecution won because they got this evidence to prove their theory of motive which i think is so preposterous. i don't think it will resonate with the jury and it will backfire. he killed his wife and son to evade financial crimes? no. >> trace: it's having because murdaugh's attorney said that same argument to the judge, right? the judge wasn't buying it. watch this back and forth between he and the judge and we'll get your response. >> this is a murder trial, not a financial fraud trial. >> i find that this testimony is consistent with the state's

theory, of the defendant being in a frantic state, seeking to avoid disclosure of these financial crimes and thefts. >> trace: in a word, the judge is telling him to suck it up. these are in. we let them in. you've got to deal with it. >> horrible ruling. it will be an appellate grounds if he gets convicted on that ground. the bottom line is you can't show someone is bad and therefore they committed murder. this is not a financial crimes trial, it's a murder trial. >> trace: if you look at the timeline and you look at the time that he was spending -- the voice was on his tape, four people, and you find he didn't go to his mom's house for more than 20 minutes because now you have two different pieces of evidence that says he was there for less than 20 minutes and it kind of really destroys his timeline. does that hurt the case? >> that's compelling for the prosecution, yes, but we haven't seen the defense put on their case in chief yet.

we have to reserve judgment until they do so. >> trace: would you think that the defense is going to tear all of this apart? >> they are going to tear it apart. they have done such a good job already turning some of these prosecution witnesses into defense witnesses. we saw that with the gunshot residue expert. we saw that with these financial crimes witnesses. they are getting testimony that he was actually a good guy. he loved his wife. he loved his son. so i think they are going to kill when it they get their turn to do their case in chief. no pun intended. >> trace: a minute left, switch topics, saying, you know, we know the husband, and her child, they already setted this whole thing but now you have the mom and her sister saying, we need some money out of this, too, because our hearts are broken. >> a second lawsuit. he'll settle this case. he's facing criminal manslaughter charges, so i don't think he wants to take the civil case to trial. he's not going to want to litigate it. he'll pay some money and make this case go away and gloria
