84% watching so much going on at the border and the skies. >> president biden denying reports that the administration plans to consider non-mexican migrants in the united states. >> ainsley: comes as chinese nationals are actually up 800 percent compared to this time last year. mark meredith is live from the white house. mark? >> president biden is he also sat down with telemundo in which he denied a report that the administration is considering a mass deportation plan which would move non-mexican migrants

out of the u.s. into mexico. take a listen to what the president had to say. >> i'm saying we have not done that. >> would you consider it in the future once title 42 is lifted? >> i don't think we have to do that. >> this week the president told congress the situation on the border is improving as the administration addresses the root causes of migration from northern triangle countries. but this issue extends, well beyond our hemisphere at least 1800 chinese nationals have been encountered at the southern border in the last few months. florida senator marco rubio furious with the border strategy he had a tweet out in which he said on tuesday night biden bragged how his new border plan announced last month by the already cut migration from cuba, haiti, nicaragua and venezuela by 97%. here is an example of what has rubio so upset. this is video from wsvn channel in miami. appears to show dozens if not over 100 haitian migrants trying to reach the u.s. this video getting a lot of attention online. out west in arizona.

rancher george allen kelly remains behind bars. is he facing a murder charge after allegedly killing a mexican migrant who had controlled on to his property. a judge has set kelly's bail at $1 million. but a go fund me page to help the 73-year-old get out of jail, that has been shut down. go fund me telling fox, quote: terms of service explicitly prohibit campaigns that raise money to cover the legal defense of anyone formally charged with an alleged violent crime. any campaigns for the legal defense of someone charged with murder are removed from our platform. now, there is at least one other fundraising page remains up give, send, go. the fundraisers tell us they are not the judge and jury. daily mail story i thought the three of you would be interested in that appeared to show that there were migrants who were in new york city that decided that they had enough of the city and they wanted to mover north into canada and that those migrants apparently divided to turn back after getting a feel of what the temperature and conditions were like across the northern border.

what she is doing for school choice and not going to have anybody's back when it goes to the border. just shows you desperation what is going on. this man is actually not a menace to society. is he protecting his own property. i hope people rally to that go fund me page and get him out of prison. do you know what really got to me? they got to work the ranch if there are people that can volunteer work the ranch in the meantime so they can earn some money. i left of center think it's going to take the american people to be so alarmed now with the chinese up 800% coming through. that links directly to the balloons that were overhead to what is happening all around our country. it's going to take the american people not politicians to get to the point where president biden has to act he seems legitimately clueless on how bad things are at the border. >> steve: what he said the other night is i hope congress helps me once again all about changing

the law because every time a new president comes in they can change the policy about how things are interpreted. ainsley was talking about how in new york city it is delicious irony, the mayor here has complained about the governors of arizona and texas sending migrants via bus to new york. so what does he do? after paying 450 bucks a night at some of these luxury hotels to put the migrants up, he actually paid for migrants to go to canada because they thought objection, there is going to be a lot of jobs. easier to get healthcare. boy is it cold. they are now coming back which is a little crazy. sarah huckabee sanders gave the rebuttal. i think she was pretty effective. there she is in little rock, broadcasting live.

the alleged cop killer is facing first degree murder charges. pennsylvania senator john fetterman remains in a d.c. hospital for another night after doctors are trying to rule out the possibility he may have had a second stroke. fetterman was feeling light headed after attending a democrat retreat on wednesday and was later admitted to george washington university hospital. his communications director says he is being monitored for signs of a seizure. it is unclear when he will be released. hunter biden's lawyer is refusing to hand over records about the first son's controversial overseas business dealings. this after house oversight committee republicans made a formal request for documents as part of the probe into whether hunter biden used his father's political connections to, quote sell access around the world. buff the first son's attorney claims the committee lacks legitimate legislative purpose in seeking the documents. and those are your headlines, guys, back to you. >> ainsley: thank you, ashley. coming up, president joe biden maintaining china's spy flight was not a major breach of national security.

that's because in his mind, i guess it was not recognized which they were able to confirm. but anybody looking at this knows full well that as that traverse continued and they sat over nuclear missile sites. that is actually a major breach and certainly poses risks for the united states, despite the fact that we have capability to attempt to jam it. we don't know we're actually going to stop all of their collection devices to include their communication systems. i mean, we have exquisite systems to be able to look at this balloon and see what's on and it take action against it. let's just ask ourselves this question. if this happened again, with a single balloon approaching the alucien islands, i don't believe we are going to let it enter the united states and traverse it from the west to the east. what if they sent three or four balloons and able to determine

they are doing it in the donbas region, beginning in the western part of luhansk. they moved in elements of three divisions to do that. these divisions have new mobilized troops in them and some of these elements have been training in belarus for some time. they are starting out gradually, not an all-out offensive on multiple fronts. i think they're being cautious to try to preserve their forces. the issue is they want to take the entire donbas region, which has really been their objective ever since they could not take down the capital city. they certainly have learned a lot in the last year in how to go about doing this and not expend themselves. they likely are going to take significant casualties, brian, because these are the same forces that are poorly led, low morale, not particularly well-trained. ukrainians certainly are in the defensive on this operation. what we see is they will likely

now. good morning, senator. >> good morning. >> ainsley: what do you say to the critics? >> well, it's labeled as don't say gay bill because that's because they don't have a good argument against this. parents should be involved in the education of their children and discussions that go on at schools that include gender identity and sexual orientation should take place with the parents' approval. this senate bill 134, we titled the vulnerable child compassion and protection act. and what it will do is prohibit any school personnel are at public or charter school from promoting, affirming or incouraging elementary or elementary school student from affirming gender orientation. in the bill it was a little bit too broad. narrowing the language a little bit and committee substitute that will allow for discussions for pertinent curriculum in schools that would have to do

with artistic significance or materials used in classes like biology anatomy, physiology or sex ed classes. so, if a student approaches a school official and wants to talk about these two topics, then the school official will be required to contact the parents within 24 hours to alert them and get their involvement. >> ainsley: all right, senator. i know you sponsored this bill after hearing the story of a young man in your district. tell us his story. >> well, i can't say a whole lot about it because there is an ongoing case. but, a brief overview is that a young student who is mentally challenged approached a school personnel and talked about gender identity and sexual orientation. and apparently, from what i note, the student was encouraged to pursue transition. afterward, the student attempted

suicide. it was fortunately, unsuccessful. but some extreme trauma has been realized after the fact. so, ongoing case. i don't know exactly how that will end up. but it's unfortunate that's happened. that was in my senate district in the park place school district near st. louis, their school policy states that school officials are not to inform families or parents when a student is discussing these issues with them. in fact, i believe it was washington university which was in the news yesterday, encouraged school districts' policy while students were chest binding at the school not to inform parents. that's a dangerous practice chest binding. it can have significant physiological effects. so, this was simply senate bill 134, simply to get the parents
