palestine in congress, he responded to that sound. >> the epa, both the federal and the state have made the valid case that the water is clean. this community has a city water system that is routinely tested anyway. it does not get its water source from that creek. lucas: the epa has deployed teams like this to clean the nearby streams and creeks. president biden sent epa chief to tell people that water and air are safe and clean but senator vanve says wanting help from the feds he wants the railway to pay and not the federal government. it will include toxicologists. norfolk southern railways has

told. i want to start with the soundbite from the mayor sympathizing with those concerns and expressing a lot of what we are hearing. take a listen. >> with we have a town of 4700 people that are squared and wan- scared and want answers. it's not a political thing. it's just -- it's true. they were late to the dance as i like to say and, you know, our people deserve better. jacqui: is it fair to say they are late to the dance and something politically that will affect how residents there folks affiliated with the federal government's response to this? >> jacqui, it's an issue of competence and confidence. people don't know if they can drink the water and exposed to long-term damage. they are looking for fin answer. that will fall on the doorstep

of the biden administration much like the situation with chinese spie balloon and discussion of ufo's has been slow. if you look at all of the responses, it's been the mayor, congressman, the ceo getting chase intoed the back of cars but absent from that has been the biden administration whether it's secretary pete buttigieg and president biden. they led from behind and they will pay that political price. jacqui: david, i want to have you r -- respond to that. we know epa has been on site and fema couldn't offer assistance because there was a party involved. the owner of this company is now -- they are finally answering questions and this is not the same thing as hurricane, for instance. is it fair that this politically may fall on the president's doorstep and if so, is it too late to remedy that? >> you know, the biggest mistake may have been made by the federal government is that we

didn't have proper regulations in place to have railroad company to have adequate number of staff and not long train. this was 150 car train that came rambling through this small town. it was unsafe given the size of that train. obviously there was some kind of problem with the train, maybe they didn't have enough staff to recognize that problem and that's why this happened. and so one of the first things we should do after dealing with immediate situation, what regulations laws need to be placed so this doesn't happen in small towns across america. regarding the epa, they are there. they say it's safe. i understand the concerns to have people on the ground there. it sunt seem like we even know which chemicals have been released. how does the epa know what the long-term impact will be on the citizens of east palestine? >> should the president go there and make support for the community now? >> i mean, i think it will be nice if the president went there. the president goes to other natural disasters. this is getting a lot of

attention. this has a lot of concern across america. ic it would be a good message. jacqui: i want to bring up a tweet from the transportation secretary blaming trump for this it seems. he tweets secretary pete buttigieg, we are constrained by law like derailed by trump in 2018 by law passed in 2015 but we are using the powers we have to keep people safe. is it helpful to blame the prior administration, is it fair to do that, where do you see -- how do you read that tweet? >> well, give pete buttigieg credit for one thing, elevated to transportation secretary to most people have never heard of in previous administrations. david raises which is a good one about issues whether there were appropriate regulations, whether there was appropriate safeguards in terms of workers. that was raised in letter from senator rubio and senator vance calling for secretary pete

buttigieg's resignation. that's a fair dills cushion but not -- discussion and they have to get out there and answer the questions because in the absence of any sort of -- of chaos fills the vacuum and that's what's happening right in terms of federal response. jacqui: there's been criticism of secretary pete buttigieg over a number of the challenges that have faced the biden administration. a lot of them have fallen to his lap but speculation that maybe republicans are going after him particularly hard because they look at him like a candidate potentially for bigger office at some point in time. what do you say to that, david, and in that, how do you see the field of -- of democrats in the future developing? >> so i think both are possible. i think the best thing the secretary can do to inoculate himself is to go there and be visible on the issue. it does fall under his

jurisdiction. i don't think it's his fault that there weren't laws and regulations because they were like that in the past administration as well. he needs to act quickly to get in front of this. regarding whether he's a presidential candidate. he might be in the future but as long as biden is likely to run and it seems like he is going to run for reelection, i don't think anyone, any other serious democrats are going the challenge biden. it's biden to win, to take unless he drops out. jacqui: we have to leave it there. we are out of time but on the 2024 note, real quick, last word from colin, who do you say surging to the front of the republican pack so far? >> well, it's wide open. it's anyone's for the taking. we saw ambassador haley get in this week. the former president and the slew of others get in and they are all going to have compelling case to make with the current status quo. if there's case for pipelines in the country it's right now. if you want chemicals moving through the united states safely, it should be through pipelines and not railways. jacqui: a lot of conversation to be had there. thank you for your time. appreciate it.

carried out shootings armed with a shotgun and two handguns killing at least 6 people including his ex-wife and stepfather. the shooting span at least 4 different scenes the first being the parking lot of this gas station here behind me. this is where the sheriff says the suspect identified as richard opened fire and killed a man sitting in the driver's seat of a pickup truck in the gas station parking lot around 11:0. the victim's brother was also in the pickup truck but was able to escape through the woods after cr um allegedly chased him briefly. second call came in about another shooting a couple of miles away when deputies around they found deceased body of woman later identified as ex-wife and current husband george who was wound. we spoke to drane this morning who said the suspect hit him with a barrel of shotgun while his wife begged for her life, take a listen.

>> i wasn't aware, i heard her pleading for her not to hurt her or killing and he took what was left of shotgun right to her head. shot her in the head with a shotgun. charles: some time later a sheriff's deputy recognized the car matching the description of the suspect and try today pull him over but authorities say he did not stop and let the deputy on a chase that ended at crum's where deputy would arrest him and two handy man behind crums's home and bodies of stepfather and stepsister inside of neighboring home. the suspect is jailed right now without bond. he's facing right now at least one count of capitol murder and we expect that to be upgraded to

jacqui: prosecution resting its case in the murdaugh double murder trial after laying out detailed timeline of the night the murders occurred using cell phone and gps data to pinpoint alex murdaugh's location that night. alexis mcadams is live with the latest on this very interesting story, what do you know, alex. alex: hi, jacqui, lots of twists and turns and the data on court can be key in the case as prosecutors lay out a timeline where murdaugh was during and after when his wife and son were shot and killed. so the double murder trial has been going on for several weeks. the nation watching closely is alex murdaugh on trial for allegedly killing 22-year-old son paul and wife maggie, on friday in court prosecutors really zeroed on the defendant's movements on june 7th of 2021 pointing out this cell phone video you can see here. this video was recorded by his son paul according to

authorities just minutes before he was gunned down. you can see it's a kennel there, dogs out on the property and investigators say the clip was taken on the property in south carolina low country steps away from where his son and wife were killed. friends of the victim did identify the defendant's voice talking in the background of the clip which was key placing alex murdaugh at the time around the time of the killings. that was the last time, jacqui, there were any communication from paul or his mom maggie here. so just about 20 minutes after the murders gps data shown in court here shows that murdaugh left the property and drove over to mom's house prosecutors say, though, he lied about how long he was at ace mornings with maria's house. gps data tracks him back home at 10:00 o'clock that night. that's when investigators say he picked up the phone and called 911 and the body camera footage is the officers arriving to the crime scene trying to figure out what had happened as alex murdaugh found wife dead. murdaugh's defense team says

he's a loving man and he didn't do it. >> circumstantial evidence showed defendant called wife maggie and son paul. alex: murdaugh's attorney will have a chance to call their own witnesses if he's found guilty, jacqui, he's looking at 30 years to life behind bars, jacqui. jacqui: we w will be watching, griff. griff: thank you. here to break down attorney alexi rigden. here we've had more than 20 days of this trial and the prosecution has rested. what have we learned, where do we stand? >> well, i still think the most important piece of evidence that came out was the kennel video because it put him in the kennels 5 minutes before the prosecutors say the murders took place and what's important is that he lied about it and that's one of the reasons that criminal defense attorneys tell their clients not to speak to the police because he had a lot of face time with investigators and he lied to them every single

time and it was played in front of the jury which is one of the interviews that was played this week. so, you know, i don't think this is thought to necessarily be a slam dunk for anybody as has been stated this is a strictly circumstantial case where there's no direct evidence he actually did this but this is guilt by a thousand pinprickses as it should and the prosecution is taking little piece of evidence or big piece of evidence and trying to tie it in to paint a picture that he's the one that did this. griff: a thousand p pinpricks. apparently paul talking with his dad about that saying, mom, i want to talk about that. this is discovery of pills that alex had taken before the month before the murders, wasn't right at the end but what do you make

of that? >> seems like the motive is shifting a little bit and will depend on how the jury sees this. him trying to somehow cover up or mitigate financial issues, also the boat crash and getting rid of paul would mitigate financial and some of us have been following for this a long time. the jury members were selected, people who are not supposed to know what's going on. i can't imagine when they get back in the jury room and they are finally able to talk about, this they probably feel like their hair has been blown back. they have been confronted with so much extraneous stuff, financial crime, drug use, suicide for hire plot that wasn't supposed to come in but it came as a result of the defense attorney opening the door. jim griffin, the same defense attorney who opened the door to financial crimes. i would love to be a fly in the

wall when they talk about the case. griff: let me put you on the defense's driver seat, what are they going to do? >> i expect they are going to have to try to basically mitigate and try to make it seem as they've start today do. they are going to have to make it seem that the timeline isn't right because that's really important but hard to do especially with the gm onstar evidence by the way just came in. this evidence on friday kind of wrapped a nice bow around the prosecution's case but it may not have been but it was for the publicity that it came. gm said no, we don't have anything responsive to the request and only a week ago they said we have this information and shared it with the defense and that really helped because instead of relying on cell phone orientation and cell phone evidence which sometime is imprecise and the fact that car was on and off, that time evidence literally gave you a second by second show where he

think is great bill, and you have some republicans that you think is too harsh for a bill. you have to start strong because every bill is going to be negotiated. start from a strong stance because you know it's going to be negotiated down. you have people like tony gonzales who would rather work with senator cornyn. senator signed the bill that gave the border patrol zero. i hope the republicans get together and come up with great legislation and -- force the democrats to pick a side. griff: quickly, what would chip roy's bill do? >> pretty much follow the trump administration's bills. if you claim asylum you will be detained which is what the law says. so it pretty much mirrors a lot of the trump policy that we have proven has worked. what i'm asking is the republicans get together and if you need to negotiate the bill softer that's fine, come together as a bill. i think the oversight hearing

will force some democrats when they hear the evidence and hear witnesses they will have to pick a side. they will prove oversight hearings that the border is not secured, record amounts of fentanyl coming across the border and they can't ignore. border security is important. griff: you know, i think we have seen with the unprecedented amount of deadly fentanyl reaching far beyond the border that states do care and every state has become a border state. i want to talk to you -- there was one tweet of the border papatrol raúl ortiz and they seized fentanyl between legal ports of entry enough to kill 100 million people. that's jus in the first four months of the fiscal year.

an important point that's not just coming through ports. >> great tweet by raúl and i've been screaming for months that the democrats want -- the white house keep pushing that the fentanyl is coming through the port of entries. certainly some that does but most of the fentanyl is not coming through the port of entry. most of the fentanyl seized at the port of entry because they stop every vehicle, they talk to every driver, they have cbp targeting system that has data in it. i can't tell you what's in it. this vehicle may be a vehicle that you might want to pull over based on the data on in the report. but between port of entry, the cartels are going to use the route of least resistance which is between the ports because of this crisis, griff, you know this, 70 to 80% of agents are pulled off the line. so that border is wide open now. it's not a coincidence in historic illegal immigration that you have historic illegal drug flow and the two things

jacqui: loudoun county school board voting to release report of their handling of two sexual assaults, parents and community remembers have been calling for more transparency from the school board for months. for more ian prior, fight for schools. ian, this report was commissioned by the district to go over how it handled these two assaults by the same student and whether -- questions of whether or not the school was competent in how they dealt with these incidents. i know this report was finished in january of last year and we've seen parents and activists pushing for its release for a year now and then we get this vote. why is the board rejecting -- why are they deciding not to release it and are parents going to be able to have confidence

that their kids are safe not knowing? >> well, those are all great questions and that's right. they commissioned this report in october of 2021 actually and they waited to announce that they had commissioned this report until after glenn youngkin and jason had been elected. so that was suspicious number 1 and then in january of 2021 we tried to foy it, we tried to sue for it over attorney-client privilege claims but we weren't successful but assume that at some point after grand jury report came back that the superintendent's spokesperson would be indicted. several school board members in december meeting said they would be in favor of releasing this report yet we get to february when they actually have to vote on it and some of those same school board members turned around and voted no. i believe it was 5 democrats and one republican voting against releasing the report and two republicans and one democrat voting for it. lack, -- look, bottom line you a

grand jury report that is detailed. my personal opinion is that they think there might be things in this report that were communicated under attorney-client privilege than communicated to the grand jury and that could be a problem for them. i don't think there's trust in this school board unless there's new group of people there because quite frankly they have shown a complete unwilling to be transparent, accountable and responsible to constituents. jacqui: interesting point that you make there because what we have seen reported that some people didn't want it released because of concerns that attorney-client privilege would have been revealed or details that, you know, students maybe wouldn't want out would get revealed and also this concern that it was commissioned under superintendent who has since been fired but you are saying if it comes out maybe it'll show that their testimony in court wasn't completely accurate, that is right? >> well, certainly the testimony of the administrators that

testified both, both of the special grand jury but also talked to these lawyers but i do find it interesting, you know, one of the school board members who voted against the report and said, well, you know, this was commissioned under superintendent zigler who we fired, the member knew what was on the report and still vote today g--voted to give him a rad member who won election and campaigned on releasing the report and then she said it again in december that she supports releasing the report yet when push came to shove and she had to vote on it, i'm going to vote no, i don't want to release a redacted version. a redacted version would be better than no version at all. jacqui: are you pushing for at least a redacted version? >> sure, yeah. i think a redacted version with names redacted is perfectly acceptable and i think you look at the history of how these things have happened all across the country whether it's pen inform state, michigan state, ohio state that have had their
