texas dps lieutenant is here with reaction and first to case stiegel live in mission, texas. >> that proposed rule was introduced by the department of homeland security and department of justice. there will be a 30-day public comment period and if it's passed as you said it would be implemented later in may have when the title 42 program officially comes to an end. it would make migrants ineligible for asylum in the united states if they traveled through another country to get here like mexico, for instance, but they don't apply for protection there first or if they illegally cross the u.s. border without making an appointment with cbp at a port of entry. texas governor greg abbott says his state will continue to step up. at a round table with state leaders yesterday he vowed to push forward with operation lone star and building the private border wall. the governor has also appointed the state's first-ever border

czar. meantime texas dps special ops teams this past week discovered and apprehended at least 34 migrants hidden inside rail cars in maverick county. according to u.s. border patrol, in the las days alone more than 17,000 total apprehensions have been reported, including at least four sex offenders and three gang members. also 28 pounds of cocaine seized. again, bill, all of that just in the last four days. >> bill: wow. another week rolls on. casey stiegel on the border. >> dana: let's bring in texas dps lieutenant chris all var yes, do you think the new biden proposal would stem the flow? >> it is a complete shell game. it will create a larger magnet for illegal immigrants to claim asylum at ports of entry to create a more orderly process

and refrain from having large groups come across. this will be a more widespread abuse of the asylum process. majority of the immigrants are seeking asylum for political or economic reasons which are not justifiable asylum claims. by using this cbp1 app they have to use that app and are doing so they'll be allowed to enter the country as far as which would be considered illegal immigration. now would be legal. it takes away from the bad optics but not stopping the flow of people across the border. create a much larger magnet on a larger scale when title 42 is ended. >> dana: interesting to me that people desperate who crossed the gap and made the trip all have the ability to have an app that works. that's pretty amazing. the left is not happy with president biden on this. listen to this woman. i'll read to you. justice action center is against

what president biden has done from the left she says this. it is indirect contravention of president biden's campaign promises to reverse trump's racist, xenophobic immigration policies and give all folks seeking safety a fair shot at asylum. there will be some hearings taking place at the border and you have more congressional delegations going down there. you can see some lines being drawn between the left and the right on this. but in your experiences, i know you joined a round table discussion about this in the state with the governor, do you get a feeling that there might be some way for the left and right to at least understand what the facts are on the ground and try to get something done legislatively? >> we're hoping for that. we've been taking on this problem since march of 2021. we're hopeful there could be some type of agreements between both parties. something needs to be done not just in terms of the mass migration but taking into account the amount of drugs coming across our border. fentanyl and the gotaways.

something needs to be done. there needs to be action put in place and that's what the governor talked about at the round table yesterday. he made it his priority to secure the border, to protect texas by using every tool and resource that we have at our disposal to try to stop the flow of people coming across but focus on the criminals. drugs, fentanyl, the gotaways, criminals. those on the terrorist watch list. we need to focus on them. something needs to be done and need to be agreements. there needs to be something as far as we can agree on to put in place to help put an end to this because it is not slowing down. the present numbers from january to december of last year is not a fair compareson. last fiscal year of 2021 and 2022 this fiscal year is much higher in january. we see the numbers rise going into march and summer. there needs to be action put in place. governor is doing as much as he

train derailment has exposed laws that need to be changed. >> the ridiculous thing i found out right after the horrible train derailment occurred is under the current law the railroads are not obligated in any way to notify the state or notify local officials when a train like that is coming through carrying very toxic material coming through. they weren't even required to notify us. >> that train derailed february 3rd. 20 cars contained hazardous material. 11 of those 20 derailed. february '65 of the tanks were punctured. vinyl chloride set on fire and created the smoke. residents complained of headaches, rashes and foul smell. schools are closed today in anticipation of the former president's visit for security reasons. the mayor of this town says he doesn't want this to be become a political circus to the extent

it has gotten complicated. kurt volker with me now. good morning to you. about 30 minutes ago we were watching the president at the table there with the b-nine as they call them, the bucharest nine. what's the takeaway. >> several things. first the president's visit to ukraine was very important and shows we're in this and going to support ukraine and attaching u.s. prestige, which is important. solidarity to american allies. he is saying that we'll be there in case they're threatened as well. he is also showing that the u.s. is engaged and involved. as you pointed out earlier china is now trying to step forward and nudge aside the u.s. saying they're looking for a peaceful solution. it is actually a very strong statements by president biden this week. >> bill: let's go to china's

"wall street journal." this is what they write editorial board. if russia receives arms from china, the war will descend to a bloodier stalemate or ukrainian defeat. the risks of backing ukraine are real. the risk of abandoning it are greater. they've put up a fight. absent more advanced u.s. arms this story could end with mr. putin a greater menace to europe, china emboldened, the united states weaker. not a peace to desire. apologies about the bad read. that's how they see it. you have to be in it to win it and do it with military weaponry. >> couldn't agree more. the president, as i said, has staked u.s. prestige on the line supporting ukraine. if putin defeats ukraine and takes over the country it's a tremendous loss for the united states and our credibility as well. when the president goes out there and says this is

important, we need to stop putting restrictions on our aid to ukraine. they need longer-range artillery and aircraft and more ammunition. get it there as soon as possible so that they can end this as quickly as possible. >> bill: you mentioned in your first answer china and peace. there seems 0 talk of any sort of negotiated peace or cease-fire. that seems ominous. >> well, it is but there is a reason for that which is that vladimir putin has these visions of reestablishing the russian empire taking the territory and lives of neighboring countries. he has been very explicit about it even in his speech yesterday. he is putting out all this propaganda claiming they didn't start the war and reclaiming russian lands. in that situation all the ukrainians can do is defend themselves and fight back and

they need our help. >> bill: what's the next chapter in the story? is it f-16s, the summit with putin and xi in moscow to be named later? >> there will be several things. several chapters to this. one of them is an effort by the chinese to assert themselves more, try to push the u.s. aside as the peace broker in this. i don't think it will work. putin isn't interested in peace. the other part of this is that the ukrainians will have some military successes this spring and summer. they are stopping the russian offensive now. very hard for them, very difficult but as the new tanks come in, as the longer-range artillery comes in ukrainians will be making advances toward the south and east and i think that's going to cause some soul searching in russia, to be honest about how long they can continue this war. >> bill: thank you for coming on. appreciate your expertise on this. kurt volker, thank you in

from atlanta. >> buster's testimony. we'll get to in a moment and the ballistics engineer. the forensic engineer questioned a alex could have committed the murder. someone shorter than him had to have fired the gun. >> can you say to a degree of engineering certainty that alex murdaugh did not file that shot? >> it in my opinion it's very unlikely he fired that shot. >> bill: buster painted a picture of a family that was loving and enjoyed being around one another and his dad as being destroyed after the murders of his mother and brother and later went on to contradict the prosecution's assertion that alex could be heard on video during an interview with investigators following the murders saying he harmed his

family. >> this is so bad. so bad. >> what did your dad say? >> he said they did them so bad. >> during cross the state hammered away that alex committed the murders to distract attention away from millions of dollars he was accused of stealing from clients of his law firm and mounting wrongful death lawsuit from the family of mallory beach killed in a boating accident involved alec's son, paul in 2019. asked about his father's financial issues buster said he had no indication anything was wrong. dana and bill, the defense says it could wrap its case as early as friday. this morning they have indicated that at least thinking about putting alex murdaugh on the stand but arguing they don't want the prosecution to ask about financial crimes. the judge says he won't rule on that before they put alex on the stand. >> dana: we'll follow that

today. >> bill: let's bring in jonna spilbor. you've been with us since the beginning of the trial. let's move forward on this witness. did he make a good witness for the defense and for his father? >> well, i think he accomplished one very important thing. buster really humanized his dad, which look, the jury needs to know. the picture that has been painted by the prosecution is this guy is a monster who tried to detract, distract from his financial crimes by violently offing his wife and son. if you believe that, then he is not a human. buster took the stand and said what you saw about my father in the police interrogations was real. those tears were real. i was with him the night this happened and it was real. he is a human and he accomplished that and it was a good thing for the defense. >> bill: what about the clip charles played about him interrapting what his father said. he said they did them so bad. as opposed to what the state

says is that i did them so bad. go ahead. >> i think that entire clip is much about nothing. if you are in the middle of this terrific, horrific homicide and you are in a police car and you are making statements and sobbing and blabbing. who cares really what came out of his mouth is not what the jury will hang their hats on. he could be talking crazy at that point. plus the fact that buster is saying i can recognize my father's speech. i know this is what he said. it is a little something. i don't think the juries will hang their hats on it. >> bill: the forensic engineer testified that the mother who was five foot two could not have been shot by alex murdaugh because he was six foot four based on the trajectory of the weapon and how it was fired. if you are sitting or laying down the state could punch a

hole through that, could they not? >> well, they tried to. they didn't do a very good job on cross examination. i was not impressed by the state's cross of this witness at all. the main takeaway of that. the main takeaway the defense is trying to show what the prosecution failed to do. that has been one of the themes from the get go. this was a shoddy investigation and by putting their own expert on the stand to say look, here is the measurements i took and these angles prove somebody other than alex murdaugh must have been the murderer is great for the defense because it really points the finger at the prosecution to say see? if we did it they could have done it and they didn't. >> bill: you said something there. you said the defense has shown that the state has not proven that he did a, b, c or d. and you are a defense attorney you look at it from a certain angle here. what have they failed to prove in this trial thus far in your

view? >> they failed to prove there is any direct evidentiary connection between alex murdaugh and the crime. this is a purely circumstantial case. they clearly picked their outpick and picked alex as a perpetrator and tried to squeeze all the square evidence into a round hole. i think it's clear. one quick point i want to make. prosecution's job is not to search for evidence of guilt but to search for the truth and follow the evidence wherever it takes you. big difference when you do that than when you pick your suspect and you only search for evidence that supports your theory. it is a whole different ballgame. that's the defense's point and the defense is doing a good job of illustrating that and they are only in day two. >> bill: can the state call the son back on the stand? >> they can in their rebuttal case they could call him as their own witness. he is not a good witness for
