this is "america's newsroom." this all happened yesterday in orlando, florida. authorities say the gunman shot and killed his first victim around 11:00 a.m. she was a woman in her 20s as an acquaint answer of the suspect. >> bill: the gunman fled the scene and returned five hours later and opened fire on the reporter and photographer. they were rushed to the hospital. the reporter died of injuries identified as dillon lyons a journalist for spectrum news 13. >> dana: the gunman sphered a home and shot and killed a 9-year-old girl and wounded her mother. his actions were totally senseless. >> it is unclear why the suspect entered that home. we don't know what was in the mind of this suspect. and hopefully at some point he will talk to us about what his motives were. >> dana: the suspect was 19-year-old keith moses.

he has a mile long rap sheet. >> bill: phil keating is live in miami with more on this. hello. >> good morning, bill. tragic story. the orlando police are withholding the names of the tv news crew until family could be properly notified. we now know the identity of the spectrum news 13 orlando area central florida reporter who was at that murder scene. it had already been cleaned up by the investigators and ambushed simply for doing his job. he is dylan lyons who had his first job in the gainesville market. the photographer he was with was also shot and he remains in critical condition but is reportedly responsive. according to the orange county sheriff it started wednesday morning with a woman in her 20s shot and killed in her car.

the news crew responded after the fact and was setting up to do their evening newscast. they pulled up on the scene and were then shot while in their news vehicle. according to investigators, this is the killer 19-year-old keith moses facing several felonies. after the news crew was shot the sheriff says moses went to a nearby house shooting a mother and 9-year-old daughter. the girl was killed. deputies say all three crime scenes were seemingly random and unrelated except for the one connection, the suspect. >> no one in our community, not a mother, 9-year-old or news professionals should become the victim of gun violence in our community. >> according to the spectrum news 13 website he grew up in philadelphia and fueled by a desire to tell stories that impact local communities. even the white house press secretary posted this yesterday.

our hearts go out to the family of the journalist killed today and the crew member injured in orange county, florida as well as the whole spectrum news team. this suspect mr. moses has quite the lengthy criminal record. gun charges, aggravated battery, assault, battery, burglary as well as grand theft. we expect he will probably be in court this morning making his first appearance. in all, there were three separate shootings in this rampage. three people killed and two critically injured. >> bill: tough stuff. we wait for more out of orlando on that. >> dana: residents of east palestine, ohio are criticizing the white house's handling of the toxic train crash for nearly three weeks. now secretary buttigieg is finally getting there getting a firsthand look after the train derailment sent dangerous toxins into the water and air. what it is like there this morning, mike? >> that visit from secretary

buttigieg is already underway almost three week to the day from the train wreck. he has been out to the site of the 38 car pile-up. he was accompanied by officials from the ntsb and railroad administration and hazardous materials safety administration and waiting on comments from the ntsb for findings from the investigation. they have already released some information that surveillance video detected a wheel bearing was overheating on one of the train. 11 cars carried hazardous material a component in the manufacture of place i can. a decision was made to burn off the hazardous material creating smoke and weeks of uncertainty. in the face of criticism the biden administration was slow to respond. former president donald trump moved in yesterday towing clean supplies and bottled water. his visit forced the timing of

quietly preparing and looking to april as the suggestion on behalf. what do you make of it if true? >> two things are going on here. one is when should biden announce for re-election if he is running? the idea that he said he would make a decision in december and then we thought he would do it after the state of the union and so forth. this is -- it is to the president's advantage to be the president as long as possible. so the idea that he has to go out now and announce as a candidate is faulty. he can put together a campaign quickly and he has time to do it. the second question is the more important question which is should he run? there is a great deal of dissatisfaction about that question. take a look at some of the polling. in july of 2022 cnn had a poll

and 64% said they wanted somebody else among everybody. abc poll in september '56% somebody else. cnn exit poll of everybody who voted in the mid-terms 31% said they wanted somebody else and most troubling of all in february just this month a.p. national opinion research center 37% of democrats want biden to run. that means 63% either don't have an opinion or they don't want him to run. so there is a growing sentiment, i think out there from people that look, he would be 82 if he runs for re-election. if he serves all four years he would be 86. it would draw a lot of attention to kamala harris. people would say to themselves if something bad happens to him, who is next in line? his numbers aren't great. hers are terrible. i have long thought there is a good chance at the end of the day he might not run. i have to admit in the last couple months there has been a lot out of the biden camp how he

will run but there is a long way between now and when he really needs to get into the race and there is still time for him to make a decision not to. >> dana: the question about -- we have former president donald trump, former governor and u.n. ambassador nikki haley and entrepreneur vivek ramaswamy. there is also one who might be flirting with the idea and that is senator tim scott. listen to him yesterday in iowa. >> right now we have politicians who want to say that grievance is our future and not greatest. they believe that by using the racial history of our nation that they can create a wedge in this nation that will bring more power and more resources to their progressive agenda.

i stand here to tell you, not on my watch. >> dana: i think tomorrow, karl, you will have an event in texas. will tim scott be there? >> that's later this afternoon there will be a dinner held for him in the home of one of the supporters of our voter registration project and tomorrow at a conference at barton creek resort he will be interview by senate colleague john cornyn tomorrow afternoon. it will be interesting to see how it plays out. clearly, he is interested and it was not an accident that he went to des moines, iowa and drake university in order to make a speech that lays out a different approach than what we've seen. he wants to run on optimism and civility and agenda and what the country can be born out of personal experience. he was here two years ago one of

the most powerful 45 minutes i've ever seen. interviewed by his friend and colleague then congressman kevin brady and they talked about his personal story and there was nobody in the room who was not riveted to this conversation between these two friends and went away with a great appreciation of what a remarkable person tim scott is. >> bill: we'll see what happens there. 2016 we had 17 candidates on the republican side. that's the over/under, right? i will take the under in 2024. karl, what are you taking? >> i'm with you. there is a sense among a lot of republicans that they want to win and in order to win they have to have somebody other than president trump as the nominee. the way he won last time around was getting consistently 35% of the vote in the early contests but getting a majority of the delegates because the republicans award many of their delegates by congressional district and you need -- you have to get past a trigger to be considered for that. in many instances south carolina

in particular he got a plurality of the vote but all of the delegates because nobody else with so many candidates got above the floor. so we're likely to see -- we have a lot of people say i'm interested in running but they're hearing from a lot of republicans around the country, want to see what you've got but don't stay in too long if you don't have what it takes to win the nomination. >> dana: you aren't getting momentum. interesting stuff. thank you. >> thank you. >> dana: good to get that underway, right? talk to him about that. >> bill: under 17? >> dana: i will say under. i never understood over/under. i will say there will be fewer than 17. but there might be more than eight. how is that? i'm just making it up. i'm working on my gambleling prowess and knowledge. here is somebody you might want to talk about. hunter biden missed a deadline to turn in document related to

people aren't going back to work at the same time so people are subleaseing and having a different approach to work and that, i think, could be a lynch pin in terms of accelerating the slowing in the economy. we have a problem in real estate. you will have a major problem in the recession and macro story in my view. >> bill: kamala harris thinks they've done good things. she is selling the idea this administration has lowered costs for the american family. >> we have reduced heating and electricity bills so folks have more money in their pocket to buy things like school supplies, replace the dishwasher or take a family vacation. we do this work because we know that when we lower costs for working people, when working people can buy a home, when working people can thrive, our nation thrives. >> bill: we have debate all that. gas prices, however, they were over $5 a gallon. right now today they are at

it's cheaper. >> dana: maria, when you look at going into an election year, we know the white house will continue to say look at all the wonderful things we've done. they will tell you that inflation is coming down. you will hear all the things that kamala harris we saved you so much on heating bills. what is a way republicans fight back against the bully pulpit in that regard? we were talking about the jobs number in january was 517,000 jobs. even if it is revised downwards the democrats have the wind at their back in terms of the reporting. >> there is a lag effect to higher interest rates. we see the federal reserve going from 0, we were at 0 for 15 years, 0 to 450 going to 5% in a hurry. this all happened in an 11-month span that rates are going higher, the string of interest rate hikes. it will continue. the feds say they're not done yet as rates continue to rise you will see a lag effect impact

>> dana: democratic st. louis prosecutor kim gardner has until noon to resign or face removal proceedings. the demand from the missouri attorney general comes after a weekend accident that ended with a teenage volleyball star losing both legs in a car crash. the suspect was free on bond awaiting trial for armed robbery. jonathan hunt is live with the details. hi, jonathan. >> good morning. the clock is ticking for kim gardner the st. louis circuit attorney who has never been far -- the republican drawing a line in the sand and saying gardner, a democrat, must quit by noon today or he will start the process to remove her from office saying she has repeatedly let down the people of st. louis and adding, quote, it is time for the circuit attorney to go and for the rule of law and justice to prevail. the final straw for the a.g. appears to have been an incident

over the weekend where 17-year-old janae edmondson in town for a volleyball tournament was injured as the result of a car crash that happened ated edmontonson walked downtown with her family. she lost both her legs when pinned between two vehicles. the driver who caused the crash was named as 21-year-old daniel riley. he was out on bond and on house arrest over and august 2022 armed robbery case and court records show he had violated that house arrest order more than 50 times. kim gardner said her office was well aware of riley's criminal history but blamed the judge for allowing him out on bond. in a statement gardner also said, quote, i will insure my office will put all of our resources into holding daniel riley accountable and providing support for the young woman and her family on her road to recovery. but gardner, who came into office as part of that wave of

republican mike gallagher, chairman of the china committee. stands by. first to the news of the white house and aishah hasnie from the north lawn. >> good morning. start off with the breaking news from the south china sea. pentagon officials tell fox the administration is going to be sending up to 200 troops to taiwan to expand its military training program in that island because of the china threat. it comes as the u.s. is watching this very cozy relationship get even warmer between china and russia. they say if beijing indeed sends lethal aid to russia to use in the war in ukraine it would bring ramifications and consequences. the administration according to the "wall street journal" here could also sometime soon release evidence they say they have to prove that china is considering sending weapons again to russia. officials are watching this

relationship with moscow very closely. china's top foreign policy diplomat met with putin in the kremlin just yesterday. president xi is reportedly expected to visit moscow in the near future. russia is also making moves here. it conducted a failed intercontinental ballistic missile test this weekend and then it pulled out of the new start treaty this week raising fears out there, bill, that putin might use nuclear weapons in ukraine. although the president just said he doesn't buy that. >> president biden: look, i think we're less safe when we walk away from arms control agreements that are very much in both party's interests and the world's interest. somehow this means they are thinking of using nuclear weapons ant ballistic missiles, there is no evidence of that. >> still no update from the white house on a potential call between biden and xi. some experts say the u.s. is not

equipped to take on a united russia and china. in a recent report out also says the u.s. is not ready for a possible chinese invasion of taiwan but again the u.s. now expanding its training program in that island nation. bill. >> bill: one to watch. we shall. thanks, aishah hosni on the north lawn. >> dana: let's bring in mike gallagher chairman of the house china committee and house intelligence committee. welcome back from taiwan. i want you to listen to call for number one, the deputy press secretary talking about their concerns on china and russia. >> there will be consequences for china should this partnership with russia further deepen. it would be a miscalculation of china to provide lethal aid to russia. >> dana: this morning, congressman, the "wall street journal" in a report says this. the u.s. is considering releasing intelligence on china's potential arms to transfer to russia. should they do that?

>> i think that would be wise. i think it would show that this no-limits partnership between china and russia is a very real threat to our national security. that xi is turning vladimir putin into his junior partner and indeed what i heard consistently from taiwan leaders during my visit there was the idea of an increasing strategic convergence between russia and china that serves china's interest. they can buy russian oil and gas at a discounted rate. ukraine should be a massive wake-up call for all of us. certainly our friends in taiwan see it as a massive wake-up call. overall my concern is we're not moving fast enough to learn and implement the lessons from ukraine. foremost among them is the need to arm our friends and partners before it's too late. we still have a backlog of foreign military sales items nearly $19 billion which have been approved but not delivered to taiwan. that's unacceptable. we need to put hard power in

xi's path before it is too late so he does not feel bold and thus launch an invasion across the taiwan strait. >> dana: what was the feel on the ground there in taiwan? >> there is a sense that people are moving in the right direction. taiwan has increased its defense budget by nearly 14%, over 2% gdp on defense spending. the question is whether they can use those funds to invest in asymmetric weapons and defense like anti-ship missiles, smart mines. we've been pushing them to do that for years. if we can't deliver those systems, then it is hard for us to lecture them about implementing it. the other thing, dana, the real missing part of our strategy is the economic portion of our strategy. we aren't moving fast enough to deliver on a 21st century trade agreement with taiwan leading to a free trade agreement. there is double taxation

preventing taiwan direct investment in the united states. there is more we can do to enhance the economic partnership at the same time we're enhancing the military partnership. >> dana: let me ask you about this. you are off to the races here on your committee. you are investigating a hong kong promotional video with an appearance by a j.p. morgan executive. what are you trying to get at there? >> we don't want -- when americans praise the rule of law in hong kong, it sends a bad signal. obviously the rule of law has been eviscerated in hong kong. the chinese communist party has effectively taken over hong kong. the rule of law is whatever the whim of president xi is what he wants to do. for americans sending a message the rule of law in hong kong is alive and well in hong kong and link it to taiwan. what i heard consistently on the ground in taiwan is the ccp

chooses to testify. now, if he does testify, his attorneys are concerned about the scope of questions that he will face from the prosecution during cross examination. separate from the murder charges in this trial, he faces allegations of approximately 100 financial crimes. his attorneys don't want him to incriminate himself in those separate cases and in the double murder trial that we're watching right now, they don't want these allegations to serve as a reflection on his character in the eyes of the jury. the allegations that murdaugh stole millions of dollars from vulnerable clients and close friends is a problem for the defense. even friendly witnesses who say murdaugh loved his wife and son admit there was a side to him they didn't know given the scope of his alleged financial crimes. >> i'm mad as hell. you just don't know how mad i am. but on the other hand, i'm not

surfaced which witnesses have said contains his voice. only alex murdaugh can validate that alibi. if he doesn't testify the case is over. the whole thing about limiting the scope of cross examination, i don't blame the lawyers for trying that because it makes sense. you don't want the jury to convict somebody based on other things. you want them to convict if they will do it on the merits of this particular case. however, you don't get to have it both ways. if you are going to testify, you will be cross-examined about everything that's relevant in the case. >> bill: the judge is clifton newman. as murdaugh was standing in front of him he told the judge i am going to testify. it is going to happen. it will happen within an hour or less than that. as we await for that, phil, a couple of things. you talked about the kennel where the murders happened. there was a snapchat video that was on his son's phone and you are right to say that alex

murdaugh is the only one who can clarify his presence based on that video. how does he make his case? >> he has had an advantage that other witnesses don't have. he gets to stay in the courtroom and gets to hear all the other witnesses testify and see all the other evidence that comes out. the regular witnesses have to wait outside the courtroom. they can't be present. he gets the added benefit of hearing what they have to say and has days and days and days to perhaps think about how he wants to craft his testimony. i really don't know exactly how you can explain away that video. all he can do is basically say look, it wasn't my voice. i wasn't there. but ironically the jury will be hearing his voice as he utters those words and they will be able to compare his voice in the jury room when they have access to play that video again. >> bill: a double edged sword. tough with this time frame.

there is a time stamp on that video. we'll see how that plays out here in a moment. another claim, the defense is arguing that his dead wife was five foot two and alex is six foot four. he couldn't have been able to fire that weapon physically. you can buy that or been on his knee. >> you know, that's a head scratcher to me, too. i'm familiar with firearms and rifles. i don't know how you can make the claim that someone who is six feet tall could not fire a rifle at someone who is 5 1/2 feet tall. that's a bit of a head scratcher to me. alex murdaugh has the opportunity here to make or break his case. it is a hail mary but he has to do this, bill. if he doesn't testify on the basis of the circumstantial evidence alone. he is sunk. i imagine his best hope right now is to try to get a hung

jury. i don't think you'll get 12 people unanimously to say he is not guilty at this point. >> bill: stand by. we'll bring you back as we get ready to watch this shortly in south carolina. >> dana: this is so unique. you don't usually have a defense witness actually testify for all the reasons that phil and you just talked about. this is going to be a show stopper of a trial. we'll see this within the hour, i think. >> bill: a lot of these financial crimes. a lot of people testified that know him very well that were not aware of it. the opioid addiction he claims to have as well. it can all come into play now with the defense going first and the prosecution cross examination, which i think we'll probably find like the gist of this entire case. >> dana: one other thing that could come up when he testifies is the question of his own suicide attempt later on. the murder for hire. that came up in the trial. it could come up again. we'll find out more and watch it for you as well.
