fox news live, i am eric shawn. president biden said he has no plans to visit east palestine for now. he does say the administration is on top of the situation. transportation pete buttigieg visited the site for the first time thursday after weeks of scrutiny. ohio governor mike dewine says officials from fema say it's safe for the residents to return to their homes but many people have not come back because they have health concerns. we spoke to some residents during our last hour here at fox news live, they say they don't know when there lives will return to normal. >> how has this changed your daily life and routine? >> changed everything for our lives. essentially our home doesn't feel like that safe space anymore. >> my thing is if they don't have answers, i'm okay with them saying that, it's just don't dance around it to pretend like you do it, like you don't.

eric: monitoring the fema news conference when it begins but let's go to mike tobin live in east palestine with the latest. >> i can tell you that high-profile activist aaron brockovich has been in town hall last night and made-for-tv moment with ohio governor and michael reagan where they drink tap water making the statement but it's safe to drink. he said the water may be testing fine now but the real test is long-term when contaminants have had time to leak through the soil and buildup in the body. >> we've got companies that poor maintenance, they put all of us at risk and continue to think once we poison our community, just imagine they go away. >> researchers from texas say the epa's own data determined they are indeed nine pollutants

at elevated levels that could raise long-term health concerns so they are known to cause cancers and others can cause headaches and other symptoms, the things local people have been talking about. this is what crews need to focus on as the cleanup is underway. >> it's not clear what the source of these things in the air are, it could be from water or soil evaporating into the air so that's another thing that would need to be investigated. >> the president said he will not join the list of high-profile people who have come to east palestine. he gave a videoconference to the people here in the president dispatched teams on the ground to go door to door to people in the affected areas and find out their concerns and get them to the right agency. eric: all right, thank you. we will bring you the updates from that news conference, you can see it happening as soon as

that crashes under investigation this afternoon. border patrol is not clarifying to us if any of its own agents were killed in the incident. we will update you as we can confirm more. in a separate incident outside of eagle pass, border patrol confirms to fox news agents were involved in the use of force incident this morning, one person injured, are owned one enforcement and border patrol sources say an agent or agents lives might have been threatened via female in a dramatic incident. one agent might have opened fire on that female. we will keep you updated as we can confirm more in that situation. we don't seek border patrol agents using their weapons too often. we do however see human smuggler's leading deputies on high speed chases, some end up in crashes as well this week on an suv flipped here along the southern border. we have video southwest of san antonio, texas dps their pulling over afford 150 off texas state highway 85 when the truck comes to a stop, for illegal immigrants bailed out and started running. texas dps rest of the driver and charged him with human smuggling for illegal immigrants were turned over to u.s. border patrol and knew this afternoon,

southern to pause, shouldn't waste off-site. until february 24, until yesterday norfolk's southern had been solely responsible for the disposal of waste generated by east palestine train derailment. the company supplied ohio epa with their list of selected and utilized disposal facilities february 23. moving forward, waste disposal plans including disposal location and transportation routes for contaminated waste will be subject to federal epa review and approval. epa will ensure always disposed of in safe and lawful manner, epa facilities to prevent further release of hazardous substances and impacts to communities. i've been able to visit east palestine will double times since the derailment. i've had a chance to meet with

mayor conaway and to talk to other residents. one thing that smith made clear to me is everyone wants this contamination gone from this community. they don't want the worry and they don't want the smell. we owe it to the people of east palestine to move it out of the community as quickly as pos possible. at epa we have decades of experience dealing with hazardous waste both from cleaning up contaminated sites to regulating landfills where it's disposed of. we know it's far better to have it safely stored . arthel: we've been listening to epa administrator deborah sure addressing waste disposal which is very concerning there were reports earlier that some of the waste would be transported from their east palace scene two

areas like texas kamala harris county which incorporates houston, the most populated county in texas. harris county there. she's just clarifying saying let me be clear that this waste will not be transported to those areas at this time so that's a concern for residents and east palestine, they want the contamination gone. epa is on site addressing that and we will keep you posted because this is a big part of the story of the cleanup and where the contamination will be transported. ♪ arthel: testimony this week during day two of alex cross examination. not yesterday. another disgrace facing it discussions over his whereabouts the night his wife and son were shot to death and admitted he lied about a key part of his alibi. charles watson live with more on this fascinating disturbing c

case. >> fascinating indeed. prosecution took his time in cross-examining alex murdaugh who struggled to explain in detail his whereabouts in the moments before and after his wife maggie and son paul were shot and killed on the families property. alec admitted to lying to police about not being down at the gym with his family that might have a hard time explaining what exactly he was doing after he's left his wife and son and drove back to the home on a golf cart. forensic evidence tracked his movements and show he retrieved this phone not long after the murders and took more than 280 steps during the time he told investigators he was napping. he could not specifically tell the prosecutor what he was doing at the time and later on when questioned about his call to 911 after he discovered the bodies of his wife and son, he denied he touched their bodies despite telling 911 operator the opposite.

prosecutor focusing most of his attention on his credibility after the accused killer and disgraced attorney admitted lying to authorities and stealing money from clients even as he denied killing his wife and son. >> once i told a lie, i told my family, i had to keep lying. i did like to them. i wasn't thinking clearly and i lied about being down there. i am so sorry that i did. arthel: the spring and criminal defense attorney johnna, i want to ask you, did alec murdoch help or hurt his case with his testimony? >> my goodness, alec single-handedly changed his case in his favor with his testimony. let me say this, i think it's a shame that he squandered his

life and career because if you want to learn the fine art of being an unbreakable witness, that man could teach it. what his testimony did in essence, this is pivotal, his testimony basically gave the jury permission to believe him that's so important because as we heard in that clip, alec murdoch is a liar, a thief, a cheat, that came out through dozens of witnesses but now the jury has permission to believe he's not a murderer despite all of his past misdeeds. incredible to watch. arthel: was it risky? when you answer that, with his testimony prompt defense or prosecution to change witness their witness roster going forward? >> i do think alec murdaugh testimony will be the thing that makes or breaks this case. right now i think it's making

the case for alec murdaugh. if the jury does believe him, if they can say to the selves i don't care what he did in the past, i don't care about the financial misdeeds, i don't care about his opioid addiction, if they believe him, the numerous times he said i did not kill my wife and son, it's a not guilty verdict. they won't care about the gps, they won't care about any of that since we are in the defense case now, we are going to get more witnesses obviously in the next day or two, i'm not sure where the defense will go but i will tell you where i would go, i want to know more about the gardeners dna under maggie myrtles fingertips because part of the defense in addition to his testimony as you got the wrong guy and you never looked for the right guy so if there's dna under her fingertips

from the gardener, why didn't they look there? another element the caput reasonable doubt in the jury's head. arthel: you only need one juror to have reasonable doubt, correct? >> only one to have reasonable doubt but you need all of them to agree if you are going to get to an actual acquittal and personally i think alec murdaugh has a good chance especially after the days he spent on the stand of getting an acquittal. that motion to me was genuine and the jury will have to say can you guilty and not be guilty? alec murdaugh gave them two days of testimony to answer that question, you can look bad but not be guilty of murder. thus the question they will grapple with ultimately. arthel: so you fell for it, he felt like this man was being honest and truthful? >> you could put it that way that i fell for it, i listened to a lot of liars in my career, this i don't know, this touched me. plus, i think what happened is he garnered sympathy.

alec murdaugh looked sympathetic when he was retelling his story where the prosecutor to me looked plain old pathetic. he is looking for a fight, beating a dead horse. once somebody says i did it, i'm sorry, he's referring to past crimes, the fight is over and the apology -. arthel: in this case he saying you want everybody in the courtroom to believe you lied all these times about all these things and all of a sudden this one most important thing this case is hanging on we are to believe you didn't lie the one time? >> that's exactly the prosecution is doing and what the jury has to believe is why can we believe him now? we can believe him now because he's sober and sorry and it might work. if i fell for it, those people

with the war in ukraine now in its second year, solemn ceremonies marking your one car over and the fighting continues with ukrainian forces trying to stop a new russian offensive in the east. trey yingst live in ukraine's capitol of kyiv with the latest. >> good afternoon, fighting continues and so do the attacks. schools across ukraine are holding remote classes this week worried about more russian missile strikes. last week we went to a school outside the city of dnieper where we spoke with parents and students about their experiences amid the war. >> a bunch of drones are flying and soldiers shoot them down. 10-year-old anastasia explains. the young ukrainian and her classmates make drawings to send soldiers on the front lines.

this is for the wires she adds. to end the war sooner. outside of the beat dnieper, they continue with lessons unfazed by the daily sirens and occasional attacks. principal says she's doing everything possible to have her school running amid the war. the hardest part? keeping both parents and students. we explained that ukraine is it going through difficult times but the victory is won 100% ours and everyone is holding their front. principal explains. our friends is studying. >> outside of dnieper of the school converted bomb shelters to classrooms. they are doing everything they can to continue education for young ukrainians as the war crimes on. in this maze of concrete they put desks and chalkboards trying to ensure ukraine's next generation will receive an

[chanting] eric: blue colors adorning a huge rally in washington d.c. held at the lincoln memorial. there to support and call on congress to continue sending military and financial aid to face the barbaric aggression from vladimir putin. many protesters now at the mall as you can see, gathering perhaps to have a march in washington d.c. cheering and supporting the side of democracy and western values as the world remains inspired by the spirit and determination of the ukrainians. one of the ukrainian american activists at the rally joins us from washington, cofounder and president of raz on for ukraine, a nonprofit supporting ukrainian troops since 2014. maria, welcome back. you've been on with us in the past several times. now it's one year of this war.

what is the message of the rally today and your message to vladimir putin? >> thank you, eric. it's a great pleasure being part of your show and i wanted to thank you for being so supportive of ukraine. the message we have to putin today is that we are here. we are not occupied by russia and we never will. it's time to go home but really, the second part of the mission of the rally is gratitude, and absolute gratitude to the american people. if not the support of the american people, i don't know what would happen to my father lives in kyiv. today i called him and he told me he went to theater and i was happy to hear that. he's trying to resume his normal life and said there was only one air siren for 30 minutes and

they were able to go back and see. there are many examples of brave americans now in ukraine. one group in particular i would like to highlight and think personally is american veterans. these are the people who understand what ukraine is going through more than anyone else, the people in ukraine volunteering and making sure we win this war. another group. eric: i was going to ask as you show the gratitude of the u.s. and americans, there are some on capitol hill and have been to perhaps cut the funding, people wondering why we're spending so much money, taxpayer money for ukraine. what are your concerns, what would you tell those people who question that support? >> i would say it's a great question. i am an american citizen, i live

in new jersey, a state that is most taxed state in the whole united states. i want to know where my money is going, i want to know how money is spent in ukraine. i will want oversight and i am grateful congress implements a $42 million for the oversight programs. i also wanted to tell you every single person in ukraine is watching every single dollar given to ukrainian government and humanitarian aid. every dollar lost means of life lost. this is no longer just a question of corruption, is a question of life and death. we have western countries led by united states willing to sacrifice and give to ukraine and to have crane fight for all of us and destroy this evil. we will make sure every single

dollar is accounted for. ♪ eric: what were your thoughts on scene president biden in kyiv walking alongside president zelenskyy, going to shops while he was there meeting people, talking to people and your thoughts about the president support as well as your thoughts about average americans sitting at home right now sharing this fight with you? >> it was a wonderful morning monday when president biden in kyiv, not just in poland. i was extremely proud to see that support of united states and not aspect. i think it is born for us to know the end is near. everyone is asking the question, when will the war end? it will end when every single person will do at least something to bring us closer to

she attended a conference of top donors in austin alongside other potential presidential contenders. speakers include former vice president mike pence, senator ted scott, former governor chris christie. eric: thanks. arthel. arthel: eric, national polls on the 2024 republican primary race suggest it's a two-person contest with former president trump meeting governor desantis who of course has not yet entered the race but gop voters are hinting there may be, th ovs as well. joining us now, susan, national political correspondent for the washington times. susan, how much room is therefore gop candidates and how many is too many? >> as many as want to jump in the race. then it will fill up as they head from the early states into the rest of the u.s. who can get the 270 delegates to become the nominee. president trump is leading in

most polls leading all candidates, former president, he won the primary twice and he's a leader and now we have ron desantis, popular florida governor and polls, is leading all other trump alternatives and some polls leading trump as w well. he's a top candidate not only for national name recognition which is really important if you are going to be a non- trump candidate running in the primary but also donors the previous package you were talking about donors and trump and desantis, he's got a lot of mega donors behind him. they were behind him during his race for governor, he raised to $17 million, more than 70 million left over he can use in super pack if he wants. he's sitting ready right now in terms of trump alternative candidates with polls suggesting he can win potentially and also the money to do it. arthel: but he's not in yet

officially. once he gets in, what are the focal points? not just desantis but everybody who gets in, what are focal points of the primary? how does it shift in the general and how different are those general platforms? >> of course the primary the candidates, the base turns out during the primary, you tend to get candidates you more toward the base and the argument goes well, those of the voters, candidates who may have a harder time in the general election so the talk about desantis trump fight, some people think desantis would do better in the general election than trump but trump may have an advantage with primary voters because of the people who show up. now enter . arthel: but hang on for me, what i'm trying to get at -- we are just talking about base and numbers but what is the platform? was going to get them to get from the primary into the primary and also the general?

>> you can already see what desantis may do, soft lunch he's already done already touring the country talking probe law enforcement issues and big blue cities. he's almost every day having a press conference with the big announcement about his unfolding legislative agenda for 2023 where he goes after things he thinks are popular with voters, with republican voters, anti- woke, anti- esg, all these things that are rebelling against. governor desantis taking it on in the state of florida and can do it easily, he's got gop super majority in the state legislature so he's passing all these things he can take on the road and tout that the economy is great in florida, employment rate is low and he didn't shut the state down and force mandates on people. he can run on a strong agenda. you heard him say on the preview of his interview with living

he's talking about the pace of what he's done. he's really been do something governor, he's been out there passing legislation, conservatives rocksolid conservative legislation and popular. that's what he can run on. the president, former president what he accomplished during the first term which was quite a bit. i think where he may stumble and weave talked about this a million times, if he relitigate's 2020 when he makes his campaign about, i think it weakens him, you may have a base between him and desantis. he's still the leader, no question about that. you see desantis breaking through and now that we have other candidates getting involved in voters are interested in them as well, potentially mike pence, nikki haley and others, that could break up the non- trump field and make it harder for desantis. arthel: nikki haley, she's strong on foreign policy. see how the others can hold up to that.

>> she left the classroom, he chased after her into the hallway and violently pushed her to the ground so hard that it completely knocked her unconscious. >> deputies say the teacher's aide remained unconscious the rest of the attack. the student was pulled back by bystanders and was turned over to the department of juvenile justice charged with felony aggravated battery with bodily harm. deputies say they cannot confirm if the team is a student with special needs because of the family educational rights and privacy act. you can hear the teenager speak after he was taken into custody. >> for how long? >> i don't make that determination. >> the teacher's aide was taken to the hospital with severe injuries. she is believed to have suffered broken ribs and bruising. authorities have not released details on her current condition. a very tragic situation. arthel: it's so tragic on
