the area are reporting headaches, nausea and respiratory issues after the train ran off the rails earlier this month. good afternoon, mike. mike: good afternoon, mike, it looks like a communication breakdown has halted the clean-up of contaminated material here from east palestine. much of the contaminated dirt and water were being move today hazardous material handling facilities in wayne county michigan as well as harris county texas but officials on the receiving end said -- say that no one told them that the hazardous material was coming to their state. 15 truckloads or 210 tons of contaminated dirt have arrived in michigan. wayne county executive is not pleased. >> i don't know how you do that without contacting the local officials so that we can number 1, know how to respond to our

communities and number 2, give at -- advice in terms of routes that you may take and those sorts of things. >> 5 truckloads or 70 tons contaminated have been returned to east palestine. expected to receive million and a half. until things can be worked out. you have 202 gallons of contaminated water that are parked here in east palestine and the cleanup is halted until this can all be worked out, mike. mike: mike tobin live in east palestine, ohio, many thanks. for more on this i'm joined by republican state senator from the great state of ohio michael ruly, welcome. >> good afternoon, mike, how are you today? mike: thank you for being here. let's talk with pause in contaminated material being removed by the epa. >> we instructed norfolk southern to pause shipping waste off site moving forward waste

disposal plans including transportation routes for transportation waste will be subject to federal epa review and approval. mike: is that good senator or is that federal bureaucracy likely to slow things down? >> it's horrible news. the town is worried about the pause and we are anxious to keep the ball rolling and the idea they had to stop communication is disheartening. mike: transportation secretary pete buttigieg visited 20 days after the train crash, are you satisfied with his response? >> well, of course, i'm always appreciative and we have a national figure come to east palestine because it's important to keep the spotlight on the area so we can continue to try to become whole again. for that i'm appreciative but it seemed pretty hollow. didn't seem like it packed a punch. i think people need to realize if we don't keep the spotlight

east palestine they will try to clean up 30 or 50 billion when we need a billion to fix it. mike: are you satisfied with epa and national transportation board which have been on the scene for longer? >> i'm appreciative and the director of the ohio epa, she's done a lot of good. we have kept the focus on cleaning the houses out. 2100 houses in east palestine and these need to be hasmat clean, 10 to $20,000 per house. we have 2100 homes just in east palestine. 800 homes miles south. you're looking at tens and tens of millions so they have put pressure on the u.s. epa which has norfolk move ohingen that. there's been a little bit of progress with that. mike: president biden announced health and human service will go to east palestine to conduct testing, is that good news? >> well, as far as the testing goes, i'm a little bit

concerned. i've been one of the few elected officials that say do not drink the water. i'm worried about you even bathing in the water. you know, it's hard to believe the government in certain areas just after 9/11 we saw the dust that was in the air when the u.s. epa gave the all-clear sound. it really wasn't that strong, was it? we look at very recently there's been a crew of researchers from texas a&m that have been studying the molecules that are in will air and even though the initial epa said it's all clear to go back, that's for initial danger. it doesn't talk about the carcinogenc: s that will hurt you 5 or 10 years from now. mike: how worried are you about property values in the area and also small businesses like restaurants going forward? >> of course, when i say figure like 700 million up to a billion dollars, that's what you have to sort of think about. when i was at the town hall meeting, in fact, yesterday when i was there, i had two different families and, mike, they tell me my house used to be worth

compared to last year. only 12% say they have more. going back to 2018 this is not a trend that is going in the right direction for the white house. and a majority of americans also disapproving of the president's handling of other major issues. the opioid epidemic, guns, immigration, the economy and inflation. the president's approval rating all under water. now as the white house prepares for biden to announce reelection campaign, something the first lady says is already to go. notable that a majority of democratic primary voters sampled some 53% want someone else. only 37% want to see the oldest president in u.s. history run again. joe biden first came to washington as a u.s. senator when richard nixon was president 50 years ago. now recall nikki haley taking flak for recommending competency for over 75. more than 3 quarters of the country, in fact, 77% only 20% are opposed to that test. now our colleague bret baier will be sitting down with fbi

director christopher wray. the fbi is the other federal agency that thinks coronavirus emerged from the wuhan lab. mike: lucas, thanks very much. for more on this let's bring political panel, gary, grv strategies and former senior communications adviser to senator chuck grassley and jonathan cott, gentlemen, welcome. welcome to fox news poll numbers. the economy is top issue although it seems to have slipped followed by immigration, border security, climate change and other issues in the single digits. any surprise in those numbers, jonathan? >> no, i think that's what people care about. it's pocketbook issues and impacts your daily life. once a lot of the policies that the president and the democratic congress passed in the last two years start taking effect all those numbers are going to change because americans are going to start seeing more money

in their pocket, more projects being built in their area, more work getting don't, inflation is going down, gas prices are going down, all of that takes a little bit of time, biden came in a horrible period, he came passed historic legislation and in the next two years you are going to see all of that take effect and that's going to be great news for president running for reelection. mike: okay. so speaking of pocketbook. money in your pocket versus last year, 12% say they have more money in their pocket, 31% less. 57% the same. so garrett, how do you read those numbers? >> i think it's just bad news for the president when you've talking about people, you know, having less money in their pocket, less money in their savings, still being hurt by inflation when the president took office inflation still at 6%, it's been up to 9% during the time of presidency. he's under water handling the economy by under 50%. he's under, you know, negative 50 and approval in handling the economy. so he has big problems going

into 2024. a lot of these, you know, issues that we've come to handle now are caused by democrats reckless spending, unified democrat control which led to reckless inflation and people feeling that they have less economic outlook going forward. mike: on democratic candidate preference, lucas made 37% keep biden, 53% someone else. how troubling is that for the white house, jonathan? >> not troubling at all. those 53% are i guess the democrats who don't like winning. i'm the democratic wing that likes to win elections so i can't wait to joe biden to announce he's running again. i can't wait for donald trump to be the nominee. you are only going to see bigger margin of victory in 2024 after what he's accomplished in the last 24 hours. a lot of that is progressives that are upset that he didn't go far enough. i think those people all come back home the second he's the nominee and the second he has no opponent. mike: are you surprised he hasn't announced yet?

>> no, i don't think he cares when he announces or what poll numbers say, he's actually getting stuff done. he's focused on making sure the world is safe, making sure the country is safe and making sure he's doing the daily work that he needs to do that he got hired to do. he's not focused on the politics. that's just who he is and will announce whenever he feels like. mike: former president trump, 43%, ron desantis, 23%, nikki haley 7%, mike penn 7%. texas governor greg abbott 2%. will there be pressure for those ultimately for those who want someone other than trump for those to get out to make it a two-person race. >> it had been two-person race. -- that's a strong performance. it shows he's the leader of the republican party. he has the best fundraising numbers. when you look at track record if you're a conservative. 3 supreme court justices he appointed.

the economy was strong under, border security, his foreign policy was strong against china, things like that that republicans care about and so i think it shows he's the leader of the party and any republican that's going to challenge him is going to have a tough time doing that and head to head matchup, 48-45. he's in a strong position against biden as well. mike: 55% disapprove, worst than last october and january 2022. jonathan, does he need to fix that? >> yeah, i think he needs to fix it. i think what he's going to do and you will see him doing it more in this year is going out and showing people what they actually accomplished. i think one of the things that you learn in campaigns if you're talking about ten issues, nobody is listening. you have to really focus on one two or three issues and i think it might actually hurt joe biden and many people may disagree with me on this, he's gotten so much done that it's hard to focus on the big things that he

actually has gotten done because there are 15 or 20 of them but i think at the end of the day he start talking about all the good that's been in the ira and all the good in the infrastructure bill, those numbers will go up and you'll see him traveling the country, you will see surrogates around the country, cabinet secretaries around the country, ribbon cutting. there's nothing a campaign wants to see more ribbon cutting right at their event. mike: mental competency test something that former governor and ambassador nikki haley floated, 70% favor, 20% oppose. we are looking at potentially front runners who are north of 75, one north of 80. so she's connecting there. >> the only issue she's connecting on the republican primary voter but everybody can get behind that. lower it to everybody. all of these people need to take a competency test. 80 years of age, voters, it's a fair question to ask and fair question for candidates to participate in that age.

you are getting a live look at our southern border where migrants continue to stream across at an unprecedented pace. encounters passing the 1 million mark since the beginning of the fiscal year october 1st. as border agents grapple with drug smugglers and high-speed chases. matt finn live in mission, texas with more, good afternoon, matt. reporter: hi, mike, a couple of hours ago our crew saw rather large group of migrants cross into the eagle pass area, dozen migrants processed by the u.s. border patrol and over the past couple of months we've noticed that in the eagle pass area which historically has been very busy our cameras have showed you tens of thousands of migrants across the area, the past couple of months the larger groups has slowed down and texas dps tells us they are still seeing upwards of 1,000 migrants per day in that sector but the migrants are

coming in smaller staggered groups. this afternoon we are also monitoring an investigation into a use of force incident, border patrol say agents used force on one person who was taken to the hospital, a woman in her exact condition is not known right now. our own border patrol and law enforcement sources say border patrol agents shot a female who refused to pull over and might have put agent lives in danger. it's not often that we see agents use their weapons so that is a rather unique situation at the border. also we are following a deadly high-speed chase from yesterday border patrol says around 3:40 a.m. in rio bravo, texas, u.s. border patrol agents were involved in failure to yield pursuit that resulted in car crashing into utility pole reportedly cutting the car in half ejecting six people and killing two according to newspaper. we are working to confirm more on both of these incidents yesterday. it was a violent and dangerous saturday for border patrol

mike: the double murder trial of disgraced south carolina attorney alex murdaugh will resume tomorrow after week of bombshell revelations from the witness stand. murdaugh took the stand earlier this week to give account of what happened the night his wife and son were killed. for more insight on the shocking case joining me now live attorney lexy rigden, welcome. >> great to see you. mike: great too see you. let's talk with alex's explanation on why he thinks his wife and son were murdered. >> i believe that boat wreck is the reason why paul and maggie were killed. there were so many leaks, misrepresentations of paul that ended up in the media. they hated paul murdaugh and they had anger in their heart. mike: lexy, how do you assess

murdaugh on the stand? >> well, it's actually kind of twofold. i think that in terms of the content of his testimony he didn't necessarily help himself because his explanations for things didn't make a whole lot of sense. he doesn't remember certain times where he was during -- times when you'd think he would and he remembers with clear recollection times when he wouldn't necessarily. he was caught in a couple of lies, in the 911 call he said he checked the bodies and then called 911 and he testified he called 911 and then he checked the bodies. the content of testimony wasn't great but what might have happened with one juror because that's all we need or that's all he needs is the fact that he came across as likable and i hate to say that about an accused murderer but i'm not the only that's saying that. his body language was good. he wasn't combative with the prosecutor, he has snowed a lot of people over the years so it's really not surprising that he turned on the charm for the

jury. he got away with significant white-collar crime for ten plus years and fooled a lot of smart people and took advantage of people. it's no surprise that he comes across as sort of likable and all he needs is to convince wasn't perp -- person on that jury that they feel bad for him and kind of believe and that's all it takes to have a hung jury or mistrial. mike: we saw a lot of tears, really having a hard time keeping it together at some points. is there any way of knowing the impact of that on the jurors? >> well, we can't see the jurors but i did hear report that is there were some of them that were crying. at least one of them that were crying when he was talking about wife and son who is now calling papa and mag and social media was on fire with the papa thing and even the prosecutor called that out. but if he's actually moving the jurors to tears then that could be a problem for the prosecution but he's been very emotional the

entire case because it's cameras have been fixed at him at counsel table. mike: he's acknowledged drug addiction and talked about taking a lot of pills every day his memory was sharp on some things as you mentioned, not sharp on other things. any idea of what the impact could be on jurors on that front? well, if you look at how he behaved in the past ten, 11 years when he was committing significant white collar crimes that he's admitted to and fooling everybody around him it doesn't seem that the opioid addiction had effect on that. he was successful at it. for him to say this he wasn't thinking the night of the murders and every other time because of opioids doesn't ring through in contrast to the rest of his behavior when he was still suffering from significant addiction. mike: what about the potential life insurance scam potentially having himself killed for millions of dollars of insurance money?

>> well, for normal people like you and me that doesn't make sense. honestly i'm not sure i would put anything past him at this point in terms of his decision making and his planning but all i can think is that the jury is going to be looking at that and thinking this man is pathologically damaged from head to toe with the financial crimes, stealing money from sick friends and -- and people who cared for -- help cared for his children with gloria that died at his property. honestly, this was the true crime super bowl being able to watch him testify. mike: attorney lexy r -- rigden. five people including patient member are dead after medical airplane crashed in northern nevada. the plane's pilot a flight nurse

and flight paramedic were also among those killed. christina coleman live on the latest tragic crash. hello, christina. christina: all five people on board died. according to care flight the company that provided the medical transport flight it says those on board were a pilot, a flight nurse, a flight paramedic, a patient and patient's family member. the crash happened in mountainous areas near stagecoach nevada about 45 miles southeast offeringo. it's unclear what caused this pc12 aircraft to go down. >> at this time right now it's pretty contained within an area, away from many houses and residences. a single incident that's being contained right now.

christina: faa is investigating the incident and happened while national weather winter storm in effect for that region. one witness said he heard the plane crash. >> it sounded pretty crazy. it sounded -- i actually told my wife that it sounded like a ship, like a ship sinking, the noise of it. and then we heard big motor and a big boom. christina: the president and ceo of care flight says they are holding off on their other flights for now as part of the company safety process in a statement he said, quote, our organization is grieving the loss of valued team members and extends our deepest condolences to their families. our job as ems agency is to care for the communities that we serve and at this time we are also caring for one another. again, the ntsb is scheduled to hold a press conference later today. set for 6:00 o'clock this evening in carson city, nevada. mike: heartbreaking crash. christina coleman, thanks a lot.

international space station where they will send six months before returning back home to earth. phil keating live in cape canaveral where preparations are underway, hello, phil. >> hey, mike, the weather spectacular the weather favorability for the launch tonight, tomorrow morning is 95%, so it's perfect weather to take up the 3 astronauts and one russian to international space station, 12 hours from now. 1:45 a.m. eastern time. out there on launch pad 39a, that's the falcon 9 rocket with the dragon capsule on top and about 11:00 p.m. tonight that's when the crew will start getting into their seats and prepping for the launch. new crew will replace 4 others who have been living on the station for six months. they have been training for more than a year down at johnson space center in houston. they'll be up there doing science research as well as
