we are out of time. thank you so much to our guests. trace gallagher is next. i love you, america, all of you. [ applause ] >> thank you, greg, good evening everyone, welcome to america's late news. fox news at night, i am trace gallagher in los angeles. another bomb shell on the origins of covid-19. the virus originated from a lab in wuhan. social media calling it a debunk conspiracy theory and even racist. the white house's correspondent kevin corke is live with us.
9:01 pm
>> always great to be with you, my friend. lying is so hard and hardly makes people blush. let's go back a little bit of the hunter's laptop and the new jim crow lie or so on and so forth. the lie that the coronavirus could not possibly come from a lab leak in wuhan, china, that was said by many in the media or some in the government. that lie may top of it all. the energy department joined the fbi in saying, yep, the virus spread via mishap at a chinese lab. the white house is hopeful that the obvious made out the truth. there is still no consensus within the administration. >> the president believes it is important that we continue that work and that we find out as best we can how it started so we can better prevent futures
9:02 pm
pandemic. >> the community and the rest of the government is still looking at this. there is not a definitive conclusion. >> meanwhile, the chinese are pushing back that won't surprise you. if you follow the story at all, here is what they are saying tonight in a statement and i think it is interesting. they're saying a laboratory origin of the pandemic was considered to be extremely unlikely. it is a science-based, authority activity conclusion, reached -- well, certain party should stop rehashing the lab leak narrative and stop smearing china and stop politicizing origins. trace, of course, in washington, republicans are ready to pounce. lawmakers on the hill says the energy department actually backs up suspicion and now they are urging the declassification of more evidence related to the outbreak and it won't surprise
9:03 pm
you to expect new house hearings on china including the lab leak and the not too distant future, that's according to our sources. >> does not surprise me one bit. kevin corke is live for us, back to you later, thank you. well, meantime the fox news at night common sense department is amazed of how times have changed. the energy department concluded that the lab leak theory is the most likely explanation for the covid-19 pandemic. had this news come out two years ago, the department energy would have been labeled racist. in 2021, anybody put the word covid and lab leak in the same sentence, were clearly conspiracy. the lab leak and the mass mandates are not the only pandemic pillars that are following. the medical journal says natural immunity is as

9:05 pm
correspondent, jonathan hunt, is live with a preview of a landmark decision. >> this is a case one way or another affect the financial fortunes of tens of millions of americans. president biden plans to forgive some student debt that gathered outside the supreme court to voice their support for programs that'll cost the country an estimated $400 billion. if the supreme court rejects two challenges to the plan and rules that the president acted legally in introducing it. >> you got to give me a break. my administration is making our case and the supreme court, i have confident that legal authority carrieses the plan is there. i promise you, i have your back and this is so much more we can do. >> under the president's plan, individuals earning less than 125,000 in 2020 or 2021 and married couples making less than a quarter million dollars could see up to $10,000 canceled,
9:06 pm
federal pell grant can see 20,000 wiped clean. around 26 million borrowers applied for relief. the president justified by passing congress by tieing the program into the covid pandemic and invoking a 2003 act that allows the secretary of education to grant relief in times of national emergency. six republican-led states have called the president's plan an abuse of executive authority. >> student loan cancellation was a big power grab and it by pass congressional authority for appropriation. this is illegal and it costs $400 billion and it was done just before the election to buy votes. >> the supreme court will begin hearing arguments at 10:00 a.m. on tuesday, it will be loud. >> indeed, thank you. let's bring in our panel, assistant attorney john yu and chairman

jason shaffer. i want to get back and double check on this covid-19, i think it is important, jason, and jonathan turley wrote the following here. he goes on the say, for my part, the most alarming part is the censorship and not the science. all were called racist were suspended by the media and that's why this is about censorship. for you, jason, is it more about the science? is it the censorship kind of a mix of both? >> i think it is the mix of both because there were those credible scientists who did not believe and didn't just swallow everything the administration said. and, they were not allowed to be given a voice in the public square. we had people trained at stanford or harvard who had degrees and highly decorated in terms of their sights of approach. the party of

science did not pursuing sides, they were pursuing a political agenda tchl that was what's critical clear. that was what's fundamentally wrong, trace. >> common sense, i agree with that. here is the media montage of the lab leak. i will get your response, john yu. watch. >> the coronavirus originated and perhaps manmade inside a lab in china. >> then there is this near theory. this paper from two chinese researchers that it is plausible that the virus leaked. >> dr. fauci rejected the conspiracy that coronavirus was made in a lab in wuhan china. >> >> debunk bunk them, yu. >> the government had an ideology. they were not trying to find the facts. they're

trying to reinforce their power used to scare the people of these destructive mandates. you had scientists and medical doctors, like scott atlas and raising many points that they were right and dr. fauci was wrong. >> biden taking executive action to cancel student loan debt. 44% said no. this is always a question, is this really up to congress? former congressman, jason chafetz, it is your thought. >> you have to enact this type of appropriation and a president can't delay it. they have done so some eight times along the way. but, you have to to have an act of congress. we are talking about $400 billion. yet, the democrats have the house and the presidency, could
9:10 pm
not pass that bill. >> it is amazing. john yoo, as a legal question, it seems to me that it should be a pretty simple solution if you are going by what jason just talking about there. what are your thoughts? >> i don't think this is a close constitutional question. the constitution gives only to congress the power of the purse. congress appropriated money as loans. they were not giving away gifts, they expected this money to be paid back. the biden administration relied on the 2003 law that allowed soldiers sent over to iraq in afghanistan to justify letting everybody off their payments throughout the country? that shows how weak their case is. the only hiccup is that the supreme court may be skeptical that the state plaintiffs here allowed to bring suits. they're going to overcome it and strike it down. >> it is hard to argue because
9:11 pm
the pandemic is over. it does not quite go. john. >> that's exactly right. the pandemic is over. they got every part of it wrong and the student loan part, when the president said he promises that he could get this done, not true. >> yeah. >> jason and john yoo, thank you both. >> thank you. the department of transportation inspector general now says it will audit secretary pete buttigieg following a report in december found pete buttigieg taken 18 flights using taxpayer-funded since he took office. pete buttigieg flies commercially, quoting here, "the vast majority of the time." desantis is upping the an
