the show it's donald trump by a lot. almost double. ron desantis in double figures. everybody else in single digits. still early. we only have four candidates -- three candidates in right now. and we'll see come spring if there is going to be a series of announcements with mike pompeo, with the vice president pence seemed like to be a lay up. and then governor desantis maybe later in the fall after his legislative session is done, unless something else comes up. >> lawrence: you know, brian, you were talking about a battle there is a battle going on right now in the white house. after that report came out from the department of agency saying that it was actually a lab leak. this is after months and actually years now of them making fun of anybody that suggested the lab leak got dr. fauci as well. the department of energy partnered with the fbi and they both came back with the suggestion that it was actually a lab leak. but, john kirby, who is normally great at spinning, great with communication says that the white house has not reached a consensus.

watch. >> the president made trying to find the origins of covid a priority, right, when he came into office. he has a whole of government effort designed to do it. there is not a consensus right now in the u.s. government about exactly how covid started. there is just not an intelligence community consensus. >> ainsley: he is saying not an intelligence community consensus. the fbi saying they think it was a lab leak. then over the weekend we learned the energy department that confirmed that. here we are years later after that theory was being talked about in the press. tom cotton was talking about it, amongst others. and they were deemed conspiracy theorists, right? remember that? they were all told that what they're say something wrong, but then you have the democrats who were listening if you talk to the republicans what the chinese government wanted them say. listen to this montage. a flashback of the media just going after anyone who said it

killed his wife and son while in the throws of opioid addiction and financial ruin. murdaugh maintains his innocence despite admitting to being at the scene of the crime but only doing so once he took to the stand last week. yesterday the defense introduced a two shooter theory. >> my opinion is the totality of the evidence is more suggestive of a two shooter scenario. all of that activity was in direct alignment with the shooter and so i think minimally. minimally, that shooter is getting covered with this material, getting more or less the shock wave of that effect and more than likely getting hit with at least something that could have done injury. >> that's all trying to plant seeds of reasonable doubt there. the state has a chance to respond and prosecutors are expected to call on four witnesses today. the judge also granted a request by the defense for the jury to visit the scene of the crime. cameras are not going to be allowed there and security is going to be provided due to how much attention this case has captured, guys? >> ainsley: all right,

>> lawrence: it's really bad, ainsley. dr. siegel is in east palestine and spoke with many of them and he joins us now. doc, what can you tell us? >> hi lawrence, hi ainsley. the people in east palestine are suffering. they are hearing a lot from the government everything is fine, the air is fine, the water is fine. but, do you know what? a lot of them are not feeling fine. i spoke to a number of them yesterday. some with pre-existing conditions who are feeling worse instantly just from coming to east palestine. very disturbing. take a look. >> this is your pulmonary fibrosis but it looks like it's gotten worse, right? >> yes. since this accident come back i have had some type of reaction. >> because i was having such strong nausea, vomiting, rash, and had all the blood work and everything done. >> since all this started we have been renting hotel rooms on the weekend to see our kids because we don't feel safe bringing them home. my daughter had been here, unfortunately. >> do you have underlying lung conditions. >> yes, i do.

joins me now. congressman, good morning. >> good morning, ainsley. how are you? >> ainsley: good morning. doing well. shouldn't would he be focused when it comes to 401(k)s investing funds we can make the most money to retire and have more in the bank. >> absolutely. americans don't want their retirement politicized. they don't want politics as part of their retirement portfolio. they want financial performance. they want investment returns. this is especially true given the fact that there is a $3.8 trillion gap between the amount that americans have saved for retirement and what they are estimated to need in retirement 8 out of 10 americans are concerned whether or not they will be able to afford a comfortable retirement. now is not the time to put politics or climate or social justice or other political factors ahead of financial performance in 401(k)s and other retirement plans. >> ainsley: congressman, where does this go? i know you will get the house. joe manchin son board you will

need another democrat. if it does pass the senate it goes to the president's desk and he is expected to veto it. >> we expect the senate to be able to pass this bill. we are going to pass this bill disapproving this department of labor regulation that would steer americans into lower performance, higher fee, less diversified portfolios. and we expect all republicans to be in favor of the legislation today. we expect democrats, some democrats will also support it as well because whether you are a republican or a democrat, we think most americans don't want politics to be a factor in allocating their capital and determining whether or not they value secure retirement. yes, we expect bipartisan, bicameral support to disapprove of the department of labor regulation. we will get this resolution of disapproval on the president's desk and the president unfortunately has threatened to veto the bill. putting every member of congress on record to decide for their constituents whether they are going to put their constituents'

retirement security first or own progressive political agenda ahead of their own constituents, i think that's an important effort to hold america's members of congress accountable. and then, ultimately, we may need a new administration to reverse course on this. but i also expect an effort in litigation to invalidate this regulation that will hurt america's retirement security. >> ainsley: there are a lot on board to reverse this retirement option. give an example say you wanted to invest your money in oil and gas, what would happen? >> see, this is the problem. because according to the department of labor regulation, many of these retirement plan sponsors would be able to put workers into esg or environmental social and governance funds without the investor's consent without the worker's consent. they wouldn't even necessarily know that they're invested in

underperforming portfolio. here's the sad reality, that over the last five years, if you were invested in esg funds, your returns would be 250 bases points less than if you are in broadly diversified funds. you know, the track let's say the s&p 500 index. these are under performing stocks? because energy has -- energy stocks have out performed the broader market over the last year significantly. and tech stocks, which are heavy in these esg funds they have under performed the market. so, these are the type of nondiversified investments that don't deliver the returns that americans deserve and need. >> ainsley: i know you are introducing this legislation today. it's your money, you should be able to do with it as you please and not have the government tell you. thank you so much, congressman, for coming on. >> thanks, good to be with you. >> ainsley: check in with senior meteorologist janice dean. we were talking about this when we were getting lety for the
