d.c. city council is trying to backtrack on its plan to soft in the city's criminal code. the chair of the d.c. city council has told the senate it will resend the changes. the senate was slated to be quote the local changes this week. a senior senate leadership aide says that d.c. can't pull back at this point and they expect the vote to still occur. president biden last week told senate democrats he would not veto the legislation. congress can serve as a super city council for d.c. under the constitution. the house to prove bill last month to rebuke the city council 31 democrats joined with all republicans. about 20 senate democrats were expected to vote and intervene with the d.c. criminal code. g.o.p. senator bill hagerty called the gambit to pull back a "made up maneuver." he says a city cannot avoid accountability. expect a vote on wednesday. >> john: chad pergram will talk more about this with

senator john cornyn as well. as to whether or not they will go ahead with all of this, we will see. thank you. >> so this is a national network and international group of people that are organized to come to our state all but two are from out of state. and 23 individuals have been charged with domestic terrorism. protesters use words, writers use violence. >> gillian: new questions about the identity of the protesters that attacked atlanta police officers and their $90 million training facility after police say 35 people have been detained after they storm the side and set fire to policing construction vehicles throwing molotov cocktails at officers. fox team coverage begins now, leo terrel is standing by first, we go to charles watson who is in atlanta. what are you learning about the protesters. >> yes, hey, good afternoon. authorities tell us that both of these folks are not from the state of georgia, they tell us

all but two of the protesters who were arrested are from out-of-state and some cases from an entirely different country. >> some of those arrested yesterday were from massachusetts and new york, and france and canada. so this is a national network, an international group of people that are organized to come to our state to undermine a public safety training session. >> yes, and take a look at the video released by the atlanta police department. you can see things get violent pretty quickly at the sight of the city proposed police and firefighter training facility often referred to as cop city. you see protesters and many dressed in black, many with their faces covered set construction equipment on fire and throw large rocks, bricks, fireworks, and molotov cocktails at police. some of those projectiles just narrowly missing officers as they take cover.

police say the protesters were originally at a nearby music festival before lead to being to allegedly coordinate their attack on officers. it has led to dozens of arrests, but according to the atlanta forest, the group that opposes the training site police got it wrong. the group saying in part in a statement that police arrested people with no connection to or awareness of the action on the other side of the nearly 600-acre forest, things have certainly gotten heated in a pass between protesters and police and january, georgia state trooper shot and killed a protester at the training facility who says fired first. and went over to the streets of downtown atlanta where protesters smashed windows and said at least one police cruiser on fire. in at least 23 people who were involved in this latest clash between police and protesters are facing domestic terrorism charges and if they are convicted, julian, they could

spend anywhere between 5-35 years in prison. we will send back to you. >> gillian: charles watson in atlanta, thank you. john. >> john: let's bring emily leo terrel, fox news contributor, not surprisingly, the number of people who are arrested are from nowhere near where this cop city has been in going in their professional agitators i guess from out-of-state. they are saying that they were in environmental concerns in play, but this used to be a prison farm. so i'm not sure what the environmental concerns are. if it has all of the trappings of being anti-cop, and that's it. speak on this has started since 2020 with the summer riots, these are professional agitators, outside of georgia coming inside to basically destabilize the law enforcement in atlanta, and what is happening, john, and you have the state now counteracting the absenteeism of the democratic mayor in atlanta. he is going to file domestic charges against these

individuals, why? to act as a deterrent. and normally these protesters ever since the 2020 riots because they are on the left, the antifa, the black lives matter, there is no charges filed against them. so this attorney general is taking action against these rioters, because they are not, john, protesters, because they received cooperation from the police. these are criminals basically creating criminal misconduct. >> john: it looks that more and more democrats are looking at being soft on crime, almost in a about-face some of them. and mayor eric adams said in recent days that mayor lori lightfoot's defeat in chicago should be a wake-up call to soft on crime leaders. listen to what he said. >> i think that this is the one to time for the country. eric adams has been talking about public safety not only on the campaign trail, but for the first year. i showed up at crime scenes, i knew what to new york was

saying. and i saw it all over the country. i think of anything it is really stating that this is what i have been talking about. america, we have to be safe. >> john: there you have the leader of the biggest crime-ridden city in america saying we have to keep people safe here, leo. >> let me be as clear as possible, democrats in this country want law enforcement. you saw what had been a lori lightfoot, 80% of the democratic voters in chicago voted against her, because they want to be safe in their city. and what you have a new york as a mayor who likes to talk a lot, but he does nothing. new york city is still aided crime-ridden city. i say it every day on fox, and he knows that, but he talks a good game. if you really wanted to stop crime in new york city, he would change the no bail law, he gets these career criminals off the street and calls out by name, first and last name the district attorney, the governor, but he does not do that. he talks a good game on

television, but he has no action. >> john: of something really interesting happen this morning in washington, d.c., the city council put forward this new set of crime measures which really rolls back penalty is on a lot of crimes, some that were felonies and misdemeanors, the police chief did not like it. the mayor did not like it. the city council went ahead and voted for it. then the house of representatives because it is jurisdiction over washington, d.c., voted to rescind, the senate is supposed to vote on wednesday as chad pergram was reporting, but phil mendelson, the city council president this morning said oh, by the way, we are going to pull back that legislation and take another look at it and maybe revise it. i mean, it looks like even d.c. city council is saying maybe this isn't the best course to pursue. >> too little, too late, what is happening, john, the next year and a half? the 2024 election, they are looking at the polls and joe biden through the democratic city council under the bus

constituents. the people who i have been elected to represent, they tell me this is what they want. they tell me they want safer streets, so you know, people are fighting over whether he is taking appropriate action or not, but he says that he is not following the politics here. he is following what his constituents tell him that they want. >> and i don't understand why it's a difficult concept, that people appreciate safer streets and being able to walk down the street without being robbed. store owners appreciate being able to conduct business without smash and grab robbers feeling blind. >> gillian: a lot of americans see it as a nonnegotiable great government benefit. if your government cannot keep you safe from other americans assaulting you on the streets where you live, and really, what is the point? that is the fundamental commitments, right? between governments and the people, whether it is a city government or the national

$90 million in his campaign accounts, so should he be able to decide his run, he will be able to utilize. he is getting all of the advantages of being a presidential candidate and not having to declare, and the clips you showed our spot on. you have states like california and illinois and new york who are leading the migration to not only florida, but also texas and south carolina and north carolina all the states leading in net gain and population. so ron desantis is right on the mark with where he needs to be right now. >> juan, except for the fact that ron desantis is pretending he does not have to fight what might be a very drawn out and rejected primary battle. he is talking about this like he is the candidate, the g.o.p. candidates. at some point he is going to have to take on the trump factor if he wants to overcome that 42% polling deficit. that emerged at cpac.

>> yes, that was pretty strong victory for donald trump, jillian. but the straight answer to your question about when he will announce is the end of may. and why do i say end of may? because i will be the end of the florida legislature's meeting and what you see is that he is pushing an agenda. and he has the votes in a republican majority legislature to do very much a culture wars agenda that signals to people his campaign agenda. and i am talking about things like concealed carry of guns without a permanent, no more diversity training in the public universities. tighter restrictions on abortion in florida. he is going to use that and by the way, offer that as a model to other states like iowa, other states with conservative legislators to say we are getting something done. donald trump does not have any legislative platform, in which you can say, here are actions i am taking. so he wants to draw strong

contrast with donald trump on those culture issues that i think you will see as you just did in terms of the speech at the reagan library. about covid restrictions, what happen when donald trump was president in terms of covid versus what was happening in florida. he is not just going after democrats. he will go after donald trump on that and similarly on immigration. so he thinks that this legislative agenda will boost him for the big announcement, the cherry that david was talking about come the end of may. >> john: of david, the challenge for ron desantis and regardless of how well he is doing, he is going to have to take this agenda, political and policy agenda that he has been executing in florida and really translate that for in the national stage. he will have to commence majority of the republican party and then out ultimately the general majority of the american people that what he has done works, not only that it works, but that it actually can

translate to the rest of the country. that's not something you can do in just a couple of months. >> it absolutely is with the amount of coverage that he is able to get in with the ability for social media to amplify your message, it absolutely is. we talked last week, you look at the fox news poll where you had 42% and were supportive of president trump and the republican primary, that leaves 50% of republicans who said that they would be open to someone else. ron desantis big challenge is keeping others from getting into the field right now and we had one just this weekend and former governor larry hogan say that he is not going to run. in the more if you are ron desantis, you want us to become a one on one race. i mean, one last thing. i will say they all were talking about cpac earlier, and i applaud juan williams for how well he must of stay behind the camera's, because i know he did not want to miss it. he had to be there in person i want all of that in person, but i did not see many of the

♪ ♪ >> gillian: the fbi now is searching for a four u.s. citizens kidnapped friday in mexico, traveling in a minivan when they cross the border from texas into matamoros, gunmen opened fire on their van, drag the four americans into another vehicle and sped off. as this unfolds, cartel operations continue pretty much on abated on the southern border, fox news has been embedded with the texas department of public safety as troopers busted a stash house in the rio grande valley. texas senator john cornyn is back from the tour of the southern border last week, first we go to bill melugin who joins

us from michigan texas this afternoon. what cartel is operating with the review where you are right now? >> jillian, good afternoon to you, it is the gulf cartel operating the human stash houses that have them all over the place here and we are with texas dps as a bus to one of them. take a look at the video that have been in palm vue about 10 minutes away from where i'm standing right now, troopers coming up across the house with eight illegal immigrants being held inside of it. including a 15-year-old girl, you will see in the video some of them are wearing those cartel wristbands that we often see down here indicating that they have paid the cartel to cross illegally into the united states. some of those migrants telling us they paid about $1500 each to cross. that has horrible conditions, there was no running water with the cartels they hold people in the stash houses in an effort to get them deeper into the united states. then take a look at this video where we were with texas dps once again in the rgb as they

arrested a drug smuggler from mexico on felony charges, he was a part of the group of drug smugglers that they were tracking on cameras who were bringing five bundles of marijuana into the country. they ended up retrieving all five of those marijuana bundles, 137 pounds total, some people wonder why the cartel is still trafficking marijuana, it is still illegal for recreational use in texas. still a market and people still want it and now cartel still profit. take a look at the picture of this guy right here, they arrested him after he was crossing the river while guiding nine illegal immigrants across in working with border patrol they later identified this man as a goal for cartel member, a gulf cartel guide/pogo tate who brings in illegal immigrants across the river. he was arrested by texas dps out here. and lastly take a look at these images. border patrol here in the rio grande, they arrested five gang members who cross illegally here in recent days including men from ms-13, lowe serino's,

and 18th street, all with lengthy criminal history and some of their crimes including negligent homicide, aggravated assault, and weapons and explosive offenses, so just gives you an idea of some of the people agents are resting down here in the rio grande valley is a cross illegally. and back out here live over the weekend, early saturday morning, a female border patrol agent was violently assaulted by an illegal immigrant. she was trying to take into custody and coaches county arizona, that's tucson, arizona, sector, cbp reports that she suffered injuries to her face and hands, i am told however she is going to be okay. she was working alone when this happened and cbp confirms that the fbi is now investigating and handling this case. this assault on a federal agent. will send it back to you. >> gillian: bill melugin back at it in texas this afternoon, thank you. >> john: let's bring in john cornyn, senator, go w to be with us this afternoon. i want to start with the fbi

search for these four americans who were assaulted and kidnapped and mona morris, according to the next bunt mexican president, he said, these are people from the united states and the information we have is that they crossed the border to buy medicine in mexico, and there was a confrontation between groups and they were detained. we don't know the exact situation or what type of medicine they were trying to buy, was at antibiotics or something else. but it does suggest that americans are at greater risk going into mexico particularly in these border towns. >> absolutely, it's -- it used to be commonplace and along the border towns he would travel over to shop or go to a restaurant in northern mexico, those towns like we have rebuilt laredo and matamoros and others. but it is not safe any longer, and kidnappings are fairly frequent and the kidnappers will keep you until the atm machine

hodgepodge of migrants coming across, some of whom are turning themselves in, because they want to seek asylum, others who are economic migrants who traditionally have come back and forth across the border, but then you have a criminal element, and people carrying drugs into the interior. and this is the tenth a delegation of senators that i have posted at the border over the years, just so they can see what i have seen and what i have learned from the experts, people like the border patrol and we saw what it was like on the river, we took a vote trip along the river as well as to a stash house where migrants and weapons were discovered, and at a night patrol as well, where people from all around the world are literally coming to the border and taking advantage of our asylum laws and making their way into the interior, perhaps never to be heard from again. >> john: i remember taking one of those tours with louie gohmert, and one of the

most surprising things we saw were huge tarantulas. that were up on the levee, they are frightening to encounter at 2:00 in the morning. but i wanted to ask you, senator about this d.c. council crime bill, because of vote in the house already took place to repeal that law, the senate scheduled for later this week to repeal the law, but the d.c. city council president phil mendelson this morning called the senate nsaid by the way, we are going to pull that bill back and take another look at it and reconsider it. so what is going to happen in the senate? will you still vote to rescinded an override? or will you let it go? >> well, until they do rescinded, it's man's and it will be overridden by a bipartisan vote of congress, and president biden says he will not veto the ads. the district of columbia is unique and not like any other city, it's a federal district and commerce has oversight over the laws that are passed. in order to protect the visitors and people who live and work as well. but the d.c. city council and
