>> john: this after the fourth circuit court of appeals upheld the state law in 2020 went to a bar transgender participation in sports for middle school all the way up to college. david spunt is live in washington with the story. this will be a test for the supreme court. david, what more came out of the news conference? >> john patrick morrissey the attorney general in charleston, west virginia, said this is not about politics. it is a simple request and he wants to take this directly to the supreme court. he thinks that is his only option. this is a state law signed by governor jim justice in 2021 that stops transgender athletes from participating and women sports. it is all about a fairness issue and parents across the country should watch this, with that they like or not hear of the supreme court and the nine justices are likely involved in a firestorm depending on how they look at this case. it would affect millions of students and parents across the

country. 18 states including west virginia have transgender athlete bands and schools. justice signed this law claiming these transgender students have an unfair competitive advantage. the american civil liberties union and west virginia chapter sued on behalf of an 11-year-old transgender girl who wanted to compete on a cross-country team. the district judge in west virginia upheld the state law but appeals court recently put that ruling on hold giving trans athletes to compete in female sports for now. morrissey is taking his fight to the high court in washington, d.c., but not on the merits of the case. here he is. >> west virginians and the american people know this is a matter of basic common sense and basic fairness. >> so morrissey wants to get this in front of the justices as soon as possible. but the question, can display out in the lower courts as the justices go ahead and debate

we are eradicating women as a whole. we are changing the dictionary definition and sitting supreme court justice that can't define what it is to be a woman because she claims she is not a biologist. i am also not a biologist, but it doesn't take much to acknowledge what a woman is and we deserve to be celebrated on our own physical limitations. >> sandra: there are 18 states. we can put the map up banting transgender females from competing and women's sports and schools. we know that is happening purity but on the latest decision, the usa powerlifting, transgender women can compete in usa power lifting. this is the ruling for the judge in that case and the same powerlifting's evidence with competitive advantage does not take into account competitive disadvantage a transgender might face, for example increased risk of depression and suicide with practice facilities and other

suppression, to transgender persons peer that is the judge that ruled in favor of transgender athlete in that case. what is your reaction to that in the powerlifting case? >> if there is one sport where the difference between male and female in terms of sheer strength and athleticism, it is powerlifting. we know testosterone has performance outcome and strength. men on average, and this is not opinionated by the fact, men are taller, stronger, more powerful, faster than women. again, to deny that is to deny science. we have so much data and scientific evidence that proves this. you know what i bet it is ironic, the same organization that deemed this extreme strict doping policies for women, which lots of organizations have contradictory policies. i think this is the same case.

>> sandra: riley the the pew reactions, what have you lived with speaking out on this issues we have as an athlete and as a woman? >> there is so much support, which shows me how the true majority of this country feels. i have parents, athletic directors and people within the ncaa and so many good athletes young and old messaging me constantly, thanking me and telling me their stories and letting me know my story is not unique and telling me to fight on peer that is how the overwhelming majority of people that are directly impacted by this feel. >> sandra: riley gaines, i appreciate your story and sharing your thoughts on this debate which seems to be raging across the country. >> of course, thank you. >> sandra: we will check back in with her, john, as this continues. state-by-state, they were dealing with this in the country right now. it is a debate so many are having. i asked that final question because so many athletes that live through this as she very

first amendment violation with the government doing it so. the question is i spoke to some lawyers on this. you as a private citizen don't have much recourse against the government. it is not as if they will suddenly pay you out, sorry, we stepped on your first amendment rights, here is $1 million. you might get a letter saying we are sorry about it or something like that. in essence what we need more than apologies or anything else is just for some honesty from the government and say, we are not going to do this anymore. because as matt taibbi pointed out, most of what was accused of being misinformation often turned out to be true, whether it was reporting on hunter biden's laptop whether it was covid related, vaccine related, mandated related to, russian collusion, et cetera. not all of it was done by journalists. i tell people what i think for a living and people can agree or disagree but the average citizen who is out there on twitter sharing information. that is what we thought the promise of social media was.

innocent woman was killed in the shooting. they go on to blame for five men they left there essentially saying these were five undisciplined men who were not following orders from cartel leadership but essentially they did this on their own. they were doing so without the cartels permission. the cartel letter says in part, we have decided to turn over those directly responsible in the offense who at all times acted under their own decision. and the letter goes on to say these men violated cartel rules, which is you do not harm the innocent. again, the cartel stresses these men never got any orders to conduct this attack from cartel leadership. they are essentially trying to say these five guys went rogue. it is all there are a fault. here you go, authorities appeared in the meantime, mexican media outlets say mexican law enforcement is
