still seven people missing after these boats crashed into each other. that death account can potentially go higher but authorities are having a hard time conducting a search because of all the fog. they cannot get helicopters up and there they are operated under the assumption these were illegal immigrants and both trying to went up the southern california coast. a woman called 911 after one of the boats capsized think they'd come in from mexico and cbp is now involved. again they are still looking for more potential survivors and or bodies but here's what officials out there are saying about the loss of life. >> there are a lot of people who are no longer with us. we are continuing to search the water will be here through all through the day. we also have a debris field of 130 yards down here like i said conditions behind us right now it's a large effort with a large amount of personnel to ensure everyone's safety. >> in the meantime to texas sisters and their friend are still missing today.

ways. they said quote what happened with inconsistent with our policies on free speech and we are very sorry about the experience you had while visiting our campus. judge duncan accepted the apology but stated he also hopes an apology for the quote mob action is also offered to the schools federalist society the group that invited him to speak on campus. he also says he would like to know what concrete steps are being taken to ensure this kind of disruption does not happen again. video of the incident shows protesters heckling him on thursday. fox digital reports they were particularly upset with the judge for refusing to use a transgender offenders preferred pronouns in a 2020 opinion. judge duncan is seen on video trying to get a word in at this event shortly before someone shouts and accuses him of ra racism. >> out you have invited me too speak here and i've been heckled nonstop. i'm asking for an administrator. the first thing we need is we need a per se rule where if you sell fentanyl in new york state, we can seek it bail on you for the other thing is many death by dealer statute in other words if you sell fentanyl results in the death of another individual you can be held responsible for that death. >> what happens now? >> what happens all too often now is without an individual who sells the fentanyl, we cannot seek it bail in all instances they get out, they continue to sell deadly fentanyl. in deaths and soup with the other thing is we need to up the penalties for death by dealer when they sell fentanyl so that we can hold him responsible for those deaths. when the sanction gets higher dealers will think twice before dealing this deadly substance precooked tooth another dealing fentanyl is it like murdering somebody? >> the thing about fentanyl is, incredibly small amount of drug can cause the death of someone. in other words 2 milligrams which is basically a rice grain

or the weight of a mosquito, that amount of fentanyl can result in death. it is extremely dangerous. before you hear of college kids and others having some other type of drug and it turns out to be fentanyl, explained that. people often think you've got to have fentanyl and only fentanyl to diet. >> what is happening now is because the fentanyl is made in a lab and it's coming across our board it's flooding across our border from mexico it is very cheap. so now you drive bugs on the street you think you're getting a percocet, oxycodone or heroin or cocaine really what you're getting is fentanyl. because such a small amount of fentanyl can result in death we are seeing the opioid overdose crisis is being fueled primarily by fentanyl. >> you had a case of fake percocet pills questioner. >> yes they take the fentanyl and they put them in pill presses to make it look like they are oxycontin or percocet. we have caught a deal it with

what looked to be 10 percocet pills. eight of the 10 or percocet two were fentanyl. that was essentially russian roulette. if the user took one of those fentanyl pills they would overdose and die. >> that's on the street that's all i confirm his scenes okay let's make that clear you think you have built from the street theoretically could be fentanyl. ask all of the legal drugs regardless of what they are they are either exclusively or partially fentanyl because it is so cheap for the drug dealer to use fentanyl and dealing drugs. eric: what type of penalties would you like to see from dealers who knowingly deal fentanyl? >> first bought the guard to fence in only 2 milligrams can cause death or a per se rule if you deal fentanyl and you are arrested we can seek bail. number one and number two if you sell fentanyl results in the death of others we wanted to be like a homicide statue.

>> what kind of penalties? >> 25 to life. what happens now? >> right now is our death by dealer statute under new york law. watson aggregate baiting factor sent in and of itself a separate charge we can get additional time in jail. support if you arrest somebody they go behind bars you got the bill reform law. >> absolutely. >> what does that do? what's the billing form on the do not allow us to seek bail. we had a case in suffolk county word individual and undercover about fentanyl from him. the next day eight user used fentanyl purchase from this defendant. that user died. we resold fentanyl to him again because we could not prove the death yet, he got out on bail and continue to sell fentanyl until we arrested him an additional time. and then we were able to keep him in from the bail before the two month interim. he is continuing to sell deadly fence onto the street too.

>> he was arrested, gets out on bail because of the law the government passes out the for two months allegedly selling drugs. someone dies. if you kept him behind bars in prison perhaps someone would be alive to pay. >> exactly pretty soon as he got out he contacted the undercover officer and immediately sent them back in business would you like more fentanyl? eric: finally when you think it happened to get these laws passed what is your message the politicians to be tough on drug dealers? suffolk county alone we had about 30 homicides. we had over 300 opioid overdose deaths. i think our public officials and live every day citizens are realizing we need to do something. there's definitely an appetite for it. eric: this is an epidemic causing deaths across the country. suffolk county district attorney thank you for joining us in your efforts to try to protect the citizens of the state and country. >> thanks for having me.
