out of time. that's it for our studio audience. [ applause ] [ cheers ] good evening, welcome to america's late news, i am trace gallagher in los angeles. breaking tonight a triple blow to the biden administration and it comes from within the administration. the border patrol chief today testified that his agency does not have control over the border. that it is not secure and we need trump's wall. matt fin is live with more on that and why democrats did not show up to hear it. good evening. >> reporter: the burden of the border crisis falls on the
9:01 pm
shoulders of law enforcement on the front line. that includes texas dps and u.s. border patrol. today, the head of border patrol told lawmakers the united states have lost control of its own border. >> does dhs have operational control of our entire border? >> no, sir. >> that's border patrol chief raol ortiz, ortiz disputed homeland security myorkas who previously said our border is under control. >> do we have our border under control? >> yes, we do. >> chief ortiz testified there is been a staggering 385,000 known got aways at the border pushing the total to 1.4 million gotaways. they are the threat,
9:02 pm
they are the migrants who do not surrender. ortiz defended his horse back agent who he is accused of whipping migrants. the chief also told lawmakers that he does not agree with president biden's decision to shutdown construction on the 200 miles of border wall. the goal was to examine the link between president biden and secretary myorkas on the crisis of the borborder. i just got back froe border of mcallen t, texas, tha border wall drastically helping them with the immigrant flow. >> thank you, matt fin. let's
9:03 pm
bring in jonathan fahey. it is great to have you all. raul ortiz put a few silver spikes in the biden administration. this may have been the most painful one. listen to the questioning and what he said at the end. >> so, prior to the administration, we had 200 plus walls that was appropriated and president biden by executive order shuts it down. do you agree in this decision by shutting down construction? >> yes, sir. >> it is one thing to defy the administration but it is another thing to side with president trump. that's got to hurt. >> yes, exactly, do you know what's really amazing about this is people were acting like it is a big revelation because it is so surprising that somebody from this administration is actually telling the truth about the border because everyone knows the border is not secure. everyone knows that we don't have operational security. it is such a revelation for someone to tell the truth about it because
9:04 pm
the line of this administration is really pathological at this point on this issue. that's what really is the stunning thing about it. >> pathological and ongoing, jonathan. this is the white house's six days ago quoting here, "president biden taken historic steps to secure our border and rebuild a safe, orderly and humane immigration system that was gutted by the previous administration over the past three years. the biden administration secured more resources at border security than any president proceeded him. i mean it is a good thing that border security begins with bs because that's what we are dealing with here. >> really laughable. it is not the resource issue. it is the fact that they invite people to break our laws and encourage illegal immigrations in every respect and giving people the de facto and all the rights and
9:05 pm
benefits of citizenship once they get here. secretary myorkas refused to enforce the law. there is no other reason. >> here is more of the hearing. this may be the most important part of it. listen, i will get your response. >> we are 25 times likely to have an overdose death in the united states than mexico. >> we have a fentanyl problem, we need to fix it. >> yet, there had been 0 consequences for fentanyl coming across the border for two plus years now. your final thoughts, jonathan. >> exactly. because border patrol had to process their time. they're not able to stopping fentanyl coming over. this administration had 100,000 overdose deaths a year to keep these open. >> there is a brand new conversation that's about to
9:06 pm
open up with this whole thing. jonathan fahey, thank you for coming on. we appreciate your time. >> thank you. former president trump holds a 14-point lead against potential candidate ron desantis. trump leading the 32% for desantis who had not announced his candidacy. for more on this, let's bring tennessee's senator marsha blackburn. it is great to have you on. i want to put up this poll. this is the head to head between desantis and president trump. it is a little closer. trump at 51% and desantis at 40%. what do you think of these new numbers coming out of quinnipiac? >> i am going to leave that race
9:07 pm
to you and people in the media. i have got my own race that i am going to be on the ballot for this year. i do spend a lot of time defending president trump, and his record and his administration. i can tell you this. the american people were much better off under his policies and trace, there is a deep bench of republicans that would love to serve this country, and the american people would be much better off under them rather than under joe biden. when you look at inflation, you look at the problems that are there with our foreign policy, you look at what's happening at the southern border with chief ortiz saying the border patrol does not have control of that border. so,
9:08 pm
republicans are the ones that's right on this policy. >> i want to play the sound byte, this is the border patrol chief, raul ortiz, talking about being asked about border security. watch. >> does dhs have operational control of our entire border? >> no, sir. >> you heard the secretary said he said we had operational control. that's the definition. >> we don't have operational control. >> no, sir. >> senator, that's a blow to the administration. their person down at the border kind of saying this thing is messy and went onto say it is a crisis. do you think this changes anything in any way? >> i do think that it will change some things. border patrol has been really patient with joe biden and this administration, i have been to that border, i have seen it. congressman mark green is a
9:09 pm
tennesseean and we are so pleased of the job he did today and bringing for ward of the operational issues. they have said for decades, they need a barrier at that southern border. we know they are very frustrated with the lack of response they with getting from this administration. they'll put their money into their budget for attorneys and illegal immigrants but they'll not put one thin dime in that budget to build a wall. >> as we talked about quickly with jonathan fahey, he said the border patrol chief that the wall should have been built under trump. that's another blow to the administration. i have got about 15 seconds, senator. >> yes, it should have been built. the american people wanted built. right now you have all of these fentanyl that's from china, and it is being distributed into the united states by the cartels. it is coming across that southern
9:10 pm
border and it is a humanitarian crisis. unbelievable proportion and the way it is affecting our communities with drugs on the streets, fentanyl loss of life and the people that are being trafficked by these cartels, they're being mentally, physically, emotionally, sexually and drug abused as they make that journey. >> no consequences against the cartels or china for shipping all those chemicals into mexico. senator blackburn, thank you for your time. >> you got it, take care. we keep on hearing aviation had never been safer, why was the federal aviation forced to hold a safety summit today focusing on very close calls involving commercial airlines. white house kevin corke has more on we have learned. >> reporter: good evening, the
9:11 pm
recent incidents including flights being clear to use the same runway at the very same time should be a wake up call. as you pointed out, there was a summit and it comes as federal officials say they are investigating six, six runway incursions this year alone. among the ongoing probes, what went wrong during the incident that happened just eight days ago, when a regional jet crossed the runway at d.c. reagan national airport without clearance, putting a dangerous close which a plane had been cleared to take off. >> reporting take off in 2003. >> scary stuff. air traffic controllers were able to catch the error just in time and the united flight as you heard there was able to abort the take-off. no one was injured, fortunately. officials argued the nation's
9:12 pm
aviation systems are indeed safe. the controller says its most concern is staffing shortages. they're asking the white house to put money where their mouth is and recruiting more comptrollers. republicans have criticized the choice of denver national airport ceo, phil washington, to leave the agency, they are arguing his experience is in efficient. >> we'll see how that goes out. now to texas and the major news in the abortion debate where the federal judge is considering the request by pro-life group to ban sales of an abortion pill nationwide. marianne is live with us onset. >> this case is at the center of abortion debate right now.
9:13 pm
today, the u.s. judge matthew heard arguments for the lawsuit challenging the abortion drug which had been widely used for the last 20 years. the fda inappropriately fast tracked if drug's approval and it is not safe. the defense which includes biden administration's attorneys say the plaintiff lacks merits and they aroover are over stepp putting in a national ban. the use of the drug could be described by telemedicine and sent through the mail. something critics say giving the case an unfair advantage. the judge is under fire trying to reduce press coverage and citing threats made to the court. whoever loses will have the opportunity to appeal to the

fifth circuit court of new orleans. if that does not resolved, we could see this head all the way to supreme court. >> yeah, marianne, thank you. we are losing thousands to the spike of fentanyl. now, there is an increase fear for parents as college students around the country going on spring break. dr. mark seagal warren quoting here, "this spring break could be the not so silent killer." doctor mark is join us now. i am interested in the fact that now the state department is warning we know a lot of kids either down in mexico or heading down to mexico. u.s. citizens have become seriously ill or died in mexico after using synthetic drugs or counterfeit medication is common and may proved to be ineffective. your thoughts on what's happening down there.
9:15 pm
>> as far as mexico is concerned, and it is disturbing the mexican president came out and said, it is all the u.s.'s fault and we should ban fentanyl by medical uses. it does not drift over into the illegal markets. we are talking about two huge cartels down in mexico where he is. that's where the problem is. we are 95% of the problem is and dea last year confiscated 380 million doses that were actually lethal. so, as you just said, tracy, it is getting into counterfeit pills and in mexico, some of these are over the counter and there is an aderal type drug that you can buy over the counter. more teens are going on vacation being told to bring narcan. if they see someone else on the beach that falls down.
9:16 pm
in panama city, you are seeing canine on the beach and crying cameras. this is a tremendous mess going on during spring break time. >> we want to point out there is this case of a georgia student went down to mexico and suffered a brain hemorrhage and had nothing at all to do with drugs. she's in serious condition down there. >> yes, i want to talk about that for a minute because i actually was involved in an amazing case of somebody recently who actually fell off the boat and broke their spine. we air lifted him to miami. the problem with this young woman and i don't know the details of the case because i am not involved. they did air lift here to jacksonville clinic. you got to act quickly with a radio logical technique. it saves lives but you are not going to be able to get it down there in mexico. it points out when you

go there, don't assume that you will get the same level of medical care. >> yes, exactly right. i want to play this sound byte, roger marshal, watch this. this is a frankinstein virus. this was made in a laboratory. this is why we have to stop, until we get our arms around it. we need to stop lending equal help until we hold them accountable as well. why do we allow this to continue? our research grant are out of control, much like so much of the federal government. >> dr. marc, i got about 15 seconds left. we need all opinions and debates on this theory. >> completely, listen, 15 seconds, they use the fact that this supposedly came from nature covid to justify research to stay ahead of the virus. that's why that group does not want to admit that it came from a lab. if it came from a lab, this kind of research becomes more and
9:18 pm
