with no crime being able to be proven into based on an old and debunked by numerous other prosecutors fairytale, the far and away leading republican candidate and former president of the united states of america will be arrested tuesday of next week. protest, take our nation back. this case centers around a one hundred $30,000 hush money payment to adult forum actress stormy daniels on the eve of the 2016 presidential election. michael cohen pleaded guilty to his role in that payment in 2018, he claims it was meant to keep daniels quiet about an alleged affair that trump denies. federal prosecutors claim the former president and his business reimbursed cohen for the payment. trump is a leading contender in the presidential race, front runner in the republican primary, he claims it is a political motivated attack to prevent him running in 2024. >> whether it is the mar-a-lago

good having you. nate ended saying the most significant issue here is how the da's office has to coordinate with the secret service, how to go about this process, what does that mean? >> to talk about a former president and candidate for the presidency for the first time in history being arrested and indicted, this never happened before, the question you asked goes to a deep problem with the whole prosecution which is it is a mixture of state law and federal law, donald trump is being arrested for state crime that occurred seven years ago, the falsification of business records but he's also the former president. he has an office, a former presidential office so this question, can state official under state law for something that happened seven years ago

treated in the same way every one who is arrested by the new york city police are treated which as you say, finger printed, photographed, he should have the chance to plead not guilty, guilty, get presented to a judge and he should be released because this crime is a misdemeanor under new york law, not punishable for more than one year, falsification of business records, people are not generally held for misdemeanors, he will be given a trial date and have the opportunity to return and put on his defense. paul: talked about a protest and this would trigger a protest, people are free to protest. i guess i'm asking is that analogous to the type of inciting comments that he made ahead of and on the day of

january 6th and that that is complicating things as well? >> i can see why donald trump is upset about the way he's being treated, he may be cleared of the charges, for example the state crimes usually only have a statute of limitations of two years, this is something that happened seven years ago. it will be very complicated, first of its kind prosecution but i wish he wasn't calling for protest. it is hard not to analogize this to the january 6th protest. just calling for protest itself is not illegal, he's saying i protest, my first amendment right to protest, people who support me should protest, but as you see, it is going to draw closer to the january 6th problem, what if he has out of the courtroom after he is finger printed, photographed, what he comes out and start saying insightful things but

because the crowd to engage in violence? it's going to be exactly like january 6th and he will be subject to prosecution under state law and have the same problems he's having with the january 6th investigation. paul: he called prior lines of legal attacks on him a witch hunt, he said specifically on this calling for a protest to take our nation back, similar things he was saying right after the election he said was a sham, just wondering where this goes and what tuesday looks like. i can imagine it's going to be a zoo, a lot of people, both supporters of his and those hoping he does go to the clink, but he could get very nasty. i'm just wondering, how do you think this goes down? >> i feel bad for you, you will be in new york city tuesday. i will be out here in california.

i think it will be a zoo. new york city is not like washington dc where you have these broad plasmas, if you are near the federal courthouse these are narrow streets, it is located back from where new york city was a colonial british city, narrow streets, a lot of people on both sides and the media and onlookers who will crowd that space, could be dangerous. the police and secret service will have a hard job maintaining crowd control making sure nothing like january 6th happens. that the important thing, it is in donald trump's own interests to make sure protests don't get out of hand and make sure something like january 6th does not happen, no matter he feels he's a victim or might get cleared of the charges, he should not want there to be violence, he should not want people to be harmed, just because he's getting arrested.

paul: his safety counts for a great deal, great seeing you again. until you mentioned this whole affair, the thing i saw next week, the federal reserve interest rates, we see how that goes after this. let's go to lee carter on this, there's an argument to be made that the president can -- they are doing it again, none of this affected his poll numbers. all of them that i have seen, i don't imagine this dense that but you are the expert, what do you see? >> i don't think this will change anything. he's holding a solid lead in the polls, he's got 40% of folks who want to vote for him in the primary, look at the numbers underneath that, his support a strong, of all the

candidates has the strongest support, 75% to 80% of those who support him are very likely to vote for him, solid support, worst-case scenario, those who are not strong in their supports for him start dropping out and he holds 30% to 35%, but now he has 30% of the vote that will fight for him because they feel it is a witchhunt, they feel this is enough is enough. the statute of limitations is usually two years, 7 years old, they are not willing to let anything go, classified files, all sorts of tax returns, like they seem to not stop. trump supporters will be likely to support him. it will get ugly. democrats are going to make hay about how corrupt the republican is they would

support a candidate like this and republicans will get more defense of, stop attacking us rather than just the president and it will go from there, the way i see it. laura: think of people likely to join the presidential contest for the republican nomination, just a couple of others but could be a lot of others, they are in the position of having to comment on this, that puts them in a kind of a weird position, they went all out and said this is what you are dealing with, there could be political blowback. >> i don't think any of the candidates opposing donald trump sorted out how to deal with their relationship to him, their feelings towards him and their distance, mike pence made clear he distanced himself as much as possible, nikki haley has too but the more candidates

in the race the more the anti-trump vote gets fractured. 60% vote, the more ways it has to get cut up, the more areas it will go to which means harder to beat donald trump. i don't think we've seen a candidate successfully take him on. in this case they have to figure out how to find his weakness in a way that doesn't minimize the people who support him. laura: next tuesday is the day, the arrest will take place, prosecutors who really kind of put out the rumors, former president trying to take the offense on this, it is a witchhunt but it is on for tuesday in lower manhattan. the latest on the bank meltdown, not that big a melt down yet but when it comes to

>> we need regional banks anymore. you could argue the commercial real estate they hold is an issue but it isn't really because if that real estate has value the market will absorb it. laura: regional banks are dead and don't deserve to be supported in this day and age in the internet and other

banking and big money center banks take care of a lot of that other banking, the read from kelly o'grady on what that could mean. >> it has been a roller coaster of a week as these contagion fears spread, receiving cash lifelines of 54 billion, major bank stepping in to rescue the latter as all eyes turn to those regional banks. for some context the of the icy defines regional as having 10 to one hundred billion dollars in deposits, first republic is a good example, they are important because communities across america depend on them, the a more flexible it he than larger banks while lending to small businesses that might be ignored. you sense vulnerability in this number, it equates to 36% of all outstanding loans. there's a reason these banks are under pressure but a big one is uninsured deposits.

90% of these deposits were uninsured. it's not bad for big regionals but they hold upwards of 50% uninsured and that is why you see volatility in the stocks, they are taking their deposits out and putting money in the banks perceived as too big to fail, bank of america sharing 15 million the cayman since svp went down but we are seeing those cash infusions, you spoke with kevin o'leary who shared the answer isn't a rescue but these regionals, bailing as a national cleanup of the national system. >> don't understand why as a taxpayer i have stuff support these management bankers. i say let them go to 0, take some volatility but what's making me unhappy as i have to take my shareholder value in banks i do own and put it at risk, if a bank has to fail and and is a regional bank, let it die. >> that's one school of thought but with the regional bank customers very vulnerable, they may not get the same loans and

services also and it would create fear. that something the fed ways next week when it comes to those rate hikes. >> that is next week, thank you for that, let's go to lydia on this other story that touched on those bank customers who one way or another have stuck. >> reporter: smaller banks are concerned about the fdic's plan to make the depositors of silicon valley bank and signature bank hole through a special assessment that is applied to all banks both large and small, the trade association that represents the nation's 4200 community bank says it is unfair because they say community banks have a different and more solid business model, watch this. >> look what happened here, very volatile institution making some risky decisions. we do not feel community banks that don't engage in that

activity should be forced to pay for this. >> reporter: 90% of all fdic insured banks are small community banks according to the independent community bankers of america, these banks hold nearly 5. $9 trillion in assets and $4.9 trillion in deposits and with high net worth of silicon valley, these banks primarily serve main street america. they are responsible for 63% of agricultural loans, 39% of small loans to farms and businesses. >> it is unfortunate we likely have to pick up the cost of some of the safety features. >> the cost would come by virtue of higher fdic insurance that would beloved against depositors. >> reporter: we asked the treasury department and the fcic if there's an estimate now on how much it will cost to make the depositors whole, right now there's not an estimate available and that is underscoring the concerns of smaller banks across the

stearns they were creating the expectation of further bailouts and no doubt in my mind lehman brothers would have solve its own problems earlier on, raised more capital, all of the above, if they haven't got in the back of their minds, they wouldn't bail us out, we are bigger than bear stearns, that is the problem, the expectation that you create and then you don't do a bailout and then you really have the system seizing up as we saw when lehman brothers went to bankruptcy. paul: she was the head of the federal institution when they were imploding and she was trying to stave off the ones that could still be rescued but back then, long before lehman brothers did bite the dust, robert kiyosaki said it would bite the dust, he's been saying similar things with the latest banking quagmire, the company cofounder back with us, always

good to have you. you first said it look like credit suisse could be next to go, got a big government injection from the swiss national bank and just as you predicted, has done squat to shore up its stability so is that the one you think could be next to go down? >> it's worse than that. in 1965 i read this book, the communist manifesto and went to military school in new york and read this book here, janet yellen just put the nail in the coffin, she said that from now on the fdic's and her personally will determine which bank lives or survives. you are earlier program talking about how they will take out the rich and the banks, i'm afraid they are going to centralize banking which is this guy here, he predicted that in 1848. that's my concern.

will: paul: you say leaving it to the big money center banks is drastically whittling down the thousands of small and medium banks they have, that would be a bad thing. >> that's what they are after, it's called communism, centralized banking. so i am very concerned, yellen and biden, what they are doing to this country is criminal, it is criminal and we are going get -- biden came out with executive order 140. 67 which says the fed coin, once fed coin comes in which is probably this year or next year, our freedoms are gone. paul: that is a backup to the system we have, to shore up support for banks. wouldn't that actually be a good developer to in their eyes that it would prevent a lot of banks from going under? >> the problem i think it is

intentional. that's the difference. it is one thing when a bank gets just managed but when you have betrayal, collusion, and corruption from the top, what janet yellen said this week was the most frightening thing i ever heard. going after all the small banks and get centralized banking which sets up the door for fed coin and there goes our privacy. paul: you could look at a lot of institutions that were not well-run they brought it upon themselves, are you saying to clean up their act or get them out of town is bad? >> i'm not saying that. i'm saying it is intentional. when you raise interest rates all the bonds that crashed, as we talked about earlier in the program, systemic and what is happening next, inflation will be systemic, the biggest news

paul: you have been saying, looking at the stock market, it's a scary place to be, but metals are not. would you elaborate on that? >> this is silver. you've allowed me to say this for 25 years, today it is 25 an ounce. when i was a kid it was $50 an ounce, the biggest bargain on earth. every tomahawk missile they fire is 30 pounds of silver in it, and this is gold and that is real money and this here is toilet paper, they are going to print more of it which is going to cause marked inflation which wipes out the middle class. we are in serious trouble. paul: i hope you are wrong on this but you have been prescient on the other bigger issues. good seeing you again, i think, be well. in the meantime kevin mccarthy is commenting on the arrest of donald trump on tuesday.

paul: vladimir putin might want to hang out in russia because there is essentially an international warrant out for his arrest coming from the international, the court saying he should be arrested on more crimes in ukraine. let's get the latest from mike tobin in kyiv, ukraine ahead of vladimir putin's one on one visit from the chinese president later next week, what's the latest? >> reporter: xi xinping will

meet, but meeting shadowed by the pressure and isolation on russia as a result of this war in ukraine. putin's foreign policy advisor says this meeting will be about strategizing a new approach to the worn ukraine, the world's want to give china is going to supply russia with weapons as resources are strained and the war drags on. they met on the sidelines of the regional summit in his pakistan and they met briefly at the opening of the beijing olympics shortly before putin launched this invasion of ukraine. the meeting follows the arrest warrant issued by vladimir putin and russia's commissioner for children's rights, the charge alleges the forced deportation of 16,000 children who were sent to russia as war raged east of ukraine. >> translator: i'm grateful to the international criminal court. everyone who has held up in the fight on justice.

>> reporter: poland got the ball rolling to send fighter jets to ukraine. roughly a dozen fighter jets ready for transfer to ukraine, four are ready to go, slovakia quickly followed suit promising to donate their entire aging fleet of mig 29s to ukraine as the slovakian air force upgrades. the cullen spokesman says it will bring additional trouble to ukraine and its people, during the special operation, he said, all this equipment will be destroyed. following the bad news russia launched new attacks into ukraine, 16 attack drones sent toward the capital city here in kyiv, others were sent to the second largest city, all three of the 16 drones were shot down, the three that made it crashed in poland without harming anyone. there were rocket attacks, no casualties.

paul: general jack keane, i was reminded this was the ninth anniversary that russia stormed in and took crimea. so they are patient, aren't they. i'm wondering what we can glean from that? >> they are patient. they went into the eastern don bass region and did not take the territory they wanted to take back in 2014 largely due to the volunteer partisan battalions and people showed up by the thousands, russia with lessons learned said we didn't have enough conventional forces. they waited until they believed the time is right at my analysis and others is they believed they could get away with this with the biden administration and that proved wrong because the biden administration has responded and so is europe, they thought europe would take a knee as well. paul: all of this with the

backdrop of growing impatience in this country largely among many in congress, not all but a good many who want to know whether this is worth the fight, the president is sticking to his guns, and open intended, but a growing number of conservative republicans say this is money better spent here, you've heard this story again and again but i wonder what president zelenskyy makes of this divide, if it extends to a presidential candidate like florida governor desantis. what do you think? >> i'm certain president zelenskyy is frustrated, he appreciates the support he gets from the biden administration and i know for a fact is frustrated it's not timely enough and he doesn't get everything he needs and my own view of this, there's an argument people say we have to focus on china but look what is happening here, president xi is visiting president putin, he has seen him 39 times in the

past, putin has been in power 23 years, xi is going to his 11, this is a firm partnership, if russia wins, china wins and that will influence their aggressive behavior in the indo pacific region and if ukraine loses and russia loses, that is a profound impact, that's why he is considering giving legal aid, supporting him with other aid that isn't per se, quote, lethal because he wants russia to win and those who want to focus on china aren't seeing the larger strategic picture, that they are joined at the hip. the second thing, i wish those who are opposed to supporting ukraine would talk to poland and the other eastern european countries. five of those eastern european countries as percentage of gdp, the amount of wealth available to them are providing more support as a percentage than the united states is.

talk to those leaders, why are they so aggressive in their support to defeat russia in ukraine? they know they are next, they've lived for 45 years under the communist regime, they know what to expect. that's why slovakia is going to give all of their airpower to ukraine. poland, the leaders who i've spoken to told me general, i'm giving up capacity tanks and other things and units for my operational units and giving them to ukraine, the answer is we've got to stop russia now, we have an opportunity to do that and i'm not going to lose any soldiers doing it, we are going to help them. that's a powerful argument, i wish those who want to pull out support for ukraine would consider what is next if russia wins? and i think the eastern europeans are telling us what is next, they are coming after nato and their countries.

>> you mentioned this upcoming visit to russia to meet with vladimir putin, there is talk, you know more about this than i ever will that he is going to come up with a peace agreement for ukraine and russia similar to how he was able to broker at least niceties between saudi arabia and iran. what do you think of that, should we support that effort? what do you think? >> we seen 12 point plan. it hasn't stuck on the wall with anybody, doesn't have credibility because it is so biased towards russia. he wants all sanctions removed immediately, that's not going to happen. secondly he wants immediate cease-fire. zelenskyy will not accept that. why is that bad? a cease-fire on the surface sounds like a good thing but it

>> he said a number of things, he said he's going to campaign against any republicans who support going after the cartels. the assumption is we would do that by, with and through the mexican government, disappointing that he lashes out in this way. makes me think he is more offensive of the cartels in his own people. paul: talking about ratcheting things up, us troops to the border, and support in congress for doing just that. griff jenkins in mission, texas with how that is going down including the latest numbers on getting to that border. >> reporter: that's right and the number of give ups, migrants who turned themselves in are down a little bit the past few winter cold months we've had, january and february, but the number of got aways is surging and that is what i saw this morning.

i've been out since 4:30 this morning with texas dps troopers, we have pursued three separate groups of migrants, observed on cameras crossing. we were not able to bring any of them into custody. they were not apprehended. that's exactly what they were trying to do, get away. take a look if i could show you the texas dps video you will see some smugglers in val verde county near the del rio eagle pass area, you can see hay bales under which they found three mexican nationals being smuggled by a smuggler that was an american citizen from florida. he was arrested and charged with human trafficking. let me show you the chief of the border patrol putting out the week in review across the southwest border, you can see on this extensive list he leads with 7 agents that were assaulted with the numbers, 35,000 apprehensions in one
