radical left in this country it. just feels like a politically charged prosecution here. >> the d.a.'s office declined to provide comment but the expectation is that trump would be charged with falsifying business records which prosecutors could then try to elevate to a felony offense by framing it as an improper campaign donation. brian, steve, rachel. >> steve: alexandria, let me ask you a question. i know a lot of this reporting is coming from the "wall street journal." they say because prosecutors control the grand jury, the defense can request a witness appear but, ultimately, the jurors then are going to vote whether or not to hear that person, right? so this guy might not show up. >> yeah. that's really interesting. we don't even know if the jurors then will get any indication of what costello would have said today. but it's impactful that the judge had allowed costello at least to be presented as a potential witness in this and we will hear if he is, in fact, heard. >> steve: all right, alexandria a thank you very much.

charged, let alone convicted. >> brian: of all the cases coming down against the president this by far seems on its face on every aspect so political, so unnecessary, something that happened 17 years ago that came into fray four years ago or six years ago, now getting brought up again by a district attorney that has gotten elected for political offers, running on a left wing democratic platform. attorney general targeted trump before she got elected election platform. all these things if they were said behind closed doors they said it in front of a huge crowds. this is a loser all around. in the beginning people might say rallying around trump. but, for the most part nobody relishes walking up toes steps, getting a mugshot, and getting fingerprinted over something that is not both of our time. and if anyone has been to new york lately, you see the recidivism. you see the criminals on the streets. you see what's happening

♪ >> brian: spring breakers facing a curfew on miami beach after two fatal shootings over the weekend. >> steve: just terrible. the curfew now lifted as of 6:00 a.m. eastern time. at least two people were killed as police say the partying clearly out of control. >> rachel: todd piro joins us live with more. >> just moments ago miami beach officials lifting that curfew put in place after the city issued a state of emergency following two deadly shootings over the weekend. the curfew going into effect just before midnight last night lasting six hours. officers responding to a shooting in miami last night, found a man suffering from a gunshot wound. he was taken to a local hospital but later died. they arrested one man in connection with the shooting, recovering two guns as well. officers say a second victim was putter but treated at the scene and released. that shooting comes two days after a man was killed and another injured after a shootings near south beach. no official word what led to either shooting. the mayor of miami beach blaming the huge influx of spring breakers for making it hard to

keep order in the city. this is the third straight year that a curfew has been issued in the city. he adds that the shootings will not be tolerated. >> the volume of people in our city, the unruly nature of too many. and the presence of guns has created a peril that cannot go unchecked. >> todd: miami beach officials are meeting later today to discuss other restrictions moving forward even another curfew start on thursday and go through march 27th. guys, a much different spring break experience for these kids than all four of us experienced. >> rachel: i was going to say from the 90's, i was on mtv we did the mtv spring break stuff. >> steve: that was crazyish. >> rachel: crazyish until i saw. this the mayor of miami getting blamed by some of the business owners for this chaos. in some ways not his fault. maybe biden's fault influx of people going to go to mexico but can't because now mexico is now

former prosecutor elliott feel something here to explain. >> good morning. >> steve: you have got three problems with this. >> three questions that have not been satisfactorily answered that make me really doubt the vint of this case and make me question the motivation behind this prosecution. first and foremost, the timing, the underlying act occurred seven years ago. nornl public 4reu five years any sprucing is long gone. why is this case being brought now? is it a politically motivated response to the criticism alvin bragg received for financial improprieties? that's what it looks like apparently somebody wrote a book attacked mr. bragg and now that is payback. >> if that's what it looks like why would you wait two years after he has been out of office to bring this case in the immediate aftermath criticism of that book.

i'm also curious why are we even in state court? these are federal election laws, they're typically and almost exclusively prosecuted by either the fec or the department of justice. i'm not aware you have any legal theory whereby these acts would constitute a violation of state law but not also federal law only inference that the fec and biden department of justice looked at these facts and said there is no viable case here. i don't know anyone who would argue with a straight face a alvin bragg is somehow a more responsible prosecutor than merrick garland. merrick garland passed. >> brian: the doj fasted the federal election passed and now the local guy talked about with the crime situation lehr is he going after him. you also suggest the john edwards defense may come into play. >> absolutely, john edwards was charged in 200811 under very similar circumstances in federal
