president trump and going after his possible pending indictment as politically motivated. un-american, and another a partisan attempt to try to bring him down. a manhattan grand jury is hearing a case related to a hush money payment made to adult film star stormy daniels in the run-up to the 2016 election. today they will hear from one final witness robert costello, a one-time legal adviser to president trump's former attorney michael cohen. he is expected to rebut cohen who has been the key witness against donald trump, isn't he a known liar? just establishing that fact. the grand jury will then need to decide whether it will indict donald trump and that could happen as soon as tomorrow. several legal experts are questioning the strength of this case however, manhattan district attorney alvin bragg is looking to elevate the misdemeanor issue to a felony and make donald trump the first former president in history to face

criminal charges. and house speaker kevin mccarthy went after the case as partisan politics. >> last thing we want or have is somebody putting their thumb on the scale simply because they don't agree with somebody else's political view. that is what's wrong, and that's what infuriates people. and this will not hold up in court if this is what he wants to do. >> does not matter what side of the issue you are on, it does not matter if it was president trump or if this was a democrat. it should be equal justice in america. and stop going after people because you have political differences. i see people all the time that have political differences. i respect their opinion. i may disagree with it, but why would you ever try to use the law for it? it does not matter what side you are on. this is the type of thing month putt america hates and divides us and is wrong.

>> harris: house speaker kevin mccarthy suggested that committees go for it that are applicable to see if there are any federal dollars. congressman and also chair of judiciary jim jordan was on with me last hour, he and others sent a letter to demand an explanation on ongoing accusations, let's watch that really quick. >> we sent this letter saying we want to talk to you, we want to know what is going on. we want to see the communications that have taken place between the federal justice department and your attorneys in manhattan, because we understand, harris, first they went after president trump on russia, then it was a phone call, then they wanted the tax return, then the business record, then his children and out some misdemeanor alleged bookkeeping error, and this is from the prosecutor who initially did not want to do this. in fact, he had people resign because he was not going to do this because no one else will bring the case. >> harris: all sorts of thoughts on the timing of this and all of the crime building out here in the mirror trying to turn things around and eventually the finger is going

to point to alvin bragg and is soft-on-crime policies. but let's set aside what potentially could be personal for him and let's focus in on the case and where it is. what you make of it? >> well, there's no chance that this is going to be successfully prosecuted, and this is just like -- i think the democrats are miscalculating, this is just like the previous efforts to get donald trump, the molar probe, what happened? his popularity went up, first impeachment after ukraine, his popularity went up, so this will backfire on them and it will backfire on them in the sense that most republicans even republicans who don't want to donald trump to be the nominee and 2024 don't hate donald trump. they thought that he was a great president, they may not like how he behaved after the election, they may not like what happened on january 6, they may think he made himself toxic with swing voters and can't win, but they don't hate donald trump. and what this will do is because all of those voters to rally around donald trump and make it more likely that he is the

nominee. and i think that maybe what they want, because if you look at the 2022 midterms, they spent tens of millions of dollars trying to get maga trumped nominee is selected, because they thought it would be easier to beat, and once they missed the clicks, and two, they think you might be easier to beat and they want him to be in the nominee, this helps. >> harris: stick with the politics for just a second, that's ridiculous thinking, because he was not on the ballot and he was the first essay that may be some of those were not the best candidates. maybe some of them he said that about pretty openly, but he is not those candidates, his somebody who is fund-raising right now. >> kayleigh: he is fund-raising, to quote "the wall street journal" editorial here, they basically said this, mr. bragg may not understand the political forces he is unleashing and might want to enforce the babylon bee headline on twitter, manhattan d.a. announcing plans to get

donald trump elected in 2024, which is pretty funny and true and well said by the editorial board. this is a very profoundly troubling time in our country, whatever you feel about donald trump's, his tweets, his actions, whatever you feel about joe biden and the way he acts or how he has put it here, when you have a candidate for the president of the united states in this case former president who is being pursued with a novel legal theory, which i know that emily will likely get into, a 7-year old charge and they are targeting him in as to quote andy mccarthy, no one who is not named donald trump will be charged with this, we live in an troubling time where our republic looks like a banana republic and that should concern everyone. speaker mccarthy said it as best as i have heard it puts, politics aside, this is just simply wrong. >> harris: bananas are delicious. because this looks purposeful in terms of a shiny object, but tell me about the merits of the

case, emily, is there anything here? >> emily: to do the xs and os, this is coming up to the 2016 election, the $13$130,000 payment made by michael cohen, then president trump said turning to stormy daniels for a alleged affair in 2006. according to alvin bragg, that resulted in falsification of business records. now that's traditionally a misdemeanor here in the state of new york, but it is known as wobbler which means it can be elevated to a felony if there was intense to commit another crime or aid to concealed the commission thereof. now here likely what the d.a. will be arguing is that that led to campaign finance fraud and that's why it can be elevated to a felony, but here's why that's important for a few reasons, number one, the statute of limitations for falsifying is just two years, so that's ran a long time ago, but if you elevate to a felony, then that's a statute of limitations for five years that has given the

d.a. this time to bring it. and another thing for viewers, is to your point, kayleigh, it was investigated for years, and declined to be prosecuted not only by the department of justice, but the federal commission and also declined and dropped by alvin bragg himself in 2021. and guess who protested? the lead prosecutor of the case under cyrus, the prior d.a. and he eventually wrote a book that just came out excoriating the d.a. saying, how dare you not have prosecuted president trump, there were clearly crimes and stung by the criticism, it was called a political justice ironically when he declined to prosecute the case and did the investigation, people said that's really fair because if you had pursued this, it would been clearly political, so what has changed? no more witnesses are no new facts have come to light. the only intervening factor is

that president trump announced his candidacy for 2024. and so here we have the d.a. that has not only reduce 50% of the felony is in this town to misdemeanors, he also prior to this declined to prosecute this person and proceed with the investigation has now resurrected the investigation and potentially will bring charges if convicted in the grand jury if they bring an indictment and has elevated it to a felony. so there are a few more things. remember white collar crimes about 38% of referred are actually prosecuted. so the numbers on its face are staggering. the infant to a small chance that this would've been not only prosecuted, but a successful prosecution and i will close by saying what president trump's attorney has says, who says for the d.a.'s office to charge former president trump a victim of extortion with a crime because michael cohen when a convicted liar paid the extortionists will be unprecedented and outrageous selection prosecution, because

remember michael cohen's convicted crimes were lying to congress, so the d.a. is saying we are basing this entire case on someone who convicted, lied six times regarding the same concept. it's troubling at a minimum good >> marc: case dismissed. >> lisa: is a perversion of resources, we hear nancy pelosi say that president trump is not above the law, but is also not beneath it. or the equal application of the law, and if this was a john doe, do we think that the manhattan d.a., this would have their attention? $130,000 payment to a porn star, no, that would not have the attention, that tells you what do you need to know and the political witch hunt additives and the left looks at donald trump as a trophy. but what are they willing to do to get that trophy? they have poured gasoline on the country and let it on fire, not a single american, americans don't have trust in the government anymore and they shouldn't. they have corrupted the department of justice and the fbi to try to get trump, and

corrupted the rule of law as well, you look at what is left in the wake and it is a country on fire. >> harris: so lisa, who steps up and puts this to rest? is it going to be one of the republican led committees? how do you see this playing out? >> lisa: this is the president moving forward and you probably see republican governors moving forward going after their political opponents and then we look like the banana republic that kayleigh mentioned when she was talking, that's the path they put us on. and it is sad. this is no longer america. >> harris: there is one more tumbler that has to fall, that is a massive investigation going on right now in the joe biden family, and with those dozen or so for james comer, head of oversight will be really interesting to see how those business dealings in the millions play a part as china's leader just dropped in for somebody time, quality time with vladimir putin, a suspected war criminal. there's a lot of backdrop.

countries, but also serious concerns surrounding china's potential involvement in the war after previously calling for a cease-fire and peace talks. they are skeptical questioning china's motives. >> coming out of this meeting there some kind of call for a cease-fire, that's going to be unacceptable. because all that will ratify the conquest to date. all that will do is give them more time to refit, retrain, reman and try to plan for renewed offenses at the time of his choosing. >> kayleigh: so ahead of this meeting you have the chinese communist party paper saying this, standing on the brink of a new era and our relations, the russia china relations have reached the highest level in their history, and then xi jinping has a piece in a crumbling newspaper in which he says, not alignment, noncompetition, nontargeting of third-party essays based on the relationship and it is about friendship, cooperation, and

peace, and think that ukraine might think otherwise. >> it is a plug add putin, here is the interesting thing, and first of all this whole chinese, russian, special relate relationship partnership started before the war in ukraine, and china has kept them at a arms distance, they have been shocked at the unified response. and did not expect that to happen, they have been shocked at how poorly they have performed, and their principle is that it's protected, and they expect them to be a part of their sovereign territory, so if they were to endorse or support sovereign country, that's kind of hypocritical for them and puts them in a moment for taiwan, so they have been very careful about going too far and helping russian in ukraine. >> kayleigh: we don't know if they are provided weapons or plan to do so, no question of that, but economically they have been helping them evade the u.s.

sanctions. >> harris: they have been doing that, and the other part we don't know about what they are doing, the national security adviser for the white house said that we were going to wait about ten days ago. we are going to wait on china to tell us exactly what they want to do. i have sources that say that they put soft kits on the grounds they are, you get some video if you try. it's chinese markings with the gear, some of the softer gear that the guys are wearing, meaning they are not handing them tanks, but they are giving them other things, and the kids are so poorly made, they are basically getting russians killed, or the mercenaries killed which is a really interesting idea, because we are not going after that. i guess it would be part of a minor incursion, but i don't think we know what our foreign policy is when it comes to ukraine, i think that we are so thrilled that people are coalescing with us and all of that, but that is not a policy. it just because you have friends who are willing to take the walk with you is not policy, what is our end game? what is the doctrine?

what are we hoping? do we think we can talk ukraine out of taking those drones? no, do you think that they can talk them out of taking any semblance of a friendship with china? no, so what is the end game? >> kayleigh: i can tell you globally, stepping back, china and russia all buddy buddy, i saw this headline a few weeks ago about xi jinping helping to broker normalization of relationships between saudi arabia and iran, so they've's were no more lies, instead should end as to have been in brokering saudi arabia and israel normalization on the world stage. it would've been if my former boss was still here. >> lisa: and on the way with the abraham accord, we live in a dangerous world because of joe biden's weakness. and my only thing is that there is this argument that if we don't intervene and ukraine and we don't fight russia and ukraine, that then china would invade taiwan, but if you are china, wouldn't you want us to be doing what we are doing in ukraine, because we are

distracted, we have depleted our resources and are depleting our military arsenal right now, so why would you not want that? and meanwhile, president xi jinping has a war cabinet with the air force general saying that there could be, likely a military confrontation between china and the united states in 2025. so i don't know, if you are china, why wouldn't you want this to be happening? >> marc: it's different capability, and we need -- they are an island, it's a tired different set of capabilities depleted, number two, ask yourself a simple question, did joe biden's disastrous withdrawal from afghanistan and bold in the vladimir putin to invade ukraine? 100% true, if that's the case, how much so would a russian victory and bold and xi jinping in china? in taiwan? it would send a message that america is not a serious world power, and all of the people, if we have taken that advice, all of the people criticizing

joe biden for supporting ukraine, if he had not supported ukraine, then every conservative would be saying coming to see what happens? joe biden, he led the taliban take over, and now he is letting vladimir putin take over kyiv. >> emily: i think it was defending the air force base and doing what he did was getting the 13 service members, but what is mining look like to you then in ukraine? how do we get to that point? is it 20 years like afghanistan? putin don't make >> marc: actually, it's not, general jack keane said the reason they can't win it's because joe biden is only giving them the weapons they need to not lose, but not the weapons they need win. if the russian military has been proven itself so weak, if you gave them the weapons that joe biden is not giving them, the long-range missiles, f-16s, all of the tanks and things like that, they could

drive russia out of all of ukraine including crimea by this time next year. and it would be over. and that's without a single american troop on the ground. facebook.com/outnumberedfnc i know we watch this illustrative of a divide in the g.o.p. on this issue, one thing mark levin said that, intention and i am paraphrasing here is that if you told me for a couple billion dollars we could decimate the entire russian army, i would say that's a deal and i am paraphrasing. which i think -- reflects how a lot of people feel, why has this been allowed to drag on so long with our tax dollars if we could've gotten it done in one second if that's how everybody felt ideologically. regardless whether chinese was surprised at the might that they extended over the last year, they will proceed come hell or high water with their own plan, i think that that's a blip on the radar, because keep in mind that their tendrils are globally entrenched far deeper than the administration will discuss, and every country in every continent today of capital, that's why it has been brokering between iran and saudi arabia, that's why they are in the arctic council,

is not college students, the us not college students descending on miami beach, they are adults going down to cause a ruckus, they want to drink, do drugs, do bad things and it turns a city into chaos and they do this curfew and have to declare a state of emergency, but i saw some things. >> marc: you will never uns unseal. >> lisa: this one lady with her bathing suit, and i was like in case mom is watching. >> harris: cover up buttercup. >> lisa: woman to woman, just trying to help you out, lady. >> emily: and the assistant chief of police department said they dread this, it's an absolute risk to the officers, to the students, to the drugs, violence, you name it, overdosing on alcohol, so many risk factors and they do all they can and they argue that we should stop incentivizing the businesses for spring break. if anything we want to deter them, these hotels that give deals and whatnot, because all it does its risk everything for

>> harris: california governor gavin newsom is facing pressure to take executive action and unilaterally enacted a massive plan for reparations. far left just putting pressure on him. proposals across the state are calling for big payouts, even though california is facing a nearly $23 billion projected deficit in its budget. still, one plan wants to hand out $360,000 per person to nearly 2 million black californians. the total cost of that program
