it is everywhere right now. it has such policies allowing retirement plan managers to consider things like climate change in their investment decisions even if that's not your priority. senator manchin of west virginia unloaded on the president. here is a quote. this administration continues to prioritize their radical policy agenda over the economic energy and national security needs of our country. biden is putting his administration's progressive agenda above the well-being of the american people. a democrat is saying this. republicans say this shows exactly the president does not care about everyday americans. >> instead of telling an investors that you need to invest only for the best financial return for the person working at home or in a truck instead you tell them to prioritize the president's agenda.

the president, his agenda is more important than their better retirement. >> harris: senator marsha blackburn republican from tennessee, member of the senate is in person today on the mez. this is an important in a presidency. the first veto. you hardly see it covered anywhere. i would think it's political for some folks. >> this is a very political move. harris, they prioritize esg and dei. diversity, equity and inclusion. these are their -- if he follow this like a religion. it is woke and wokeism. when you look at this veto and he is saying to 152 million americans your retirement savings are not as important to me as meeting the goals of esg

and dei, so i'm going to veto this measure. then look at what they did with svb, silicon valley bank. they went in and they bailed out this bank. the bank got in trouble because they weren't focused on their fiduciary responsibility. it was bad management. what were they focused on? they were focused on diversity, equity, inclusion. they were focused on climate change, environment, social justice govern nance. federal government comes in and does a bail-out there for signature bank. would they have done that for a bank if tennessee that was there for a ag industry? of course not. >> harris: i want to pull apart a little what you said and go deeper. so esg, dni is not for the purpose of goals necessarily set that they are reaching. it is to check some boxes so

that they are able to either get funding. an example of that is in silicon valley bank's situation, with the exception of i think one board member for that bank, none of them had any banking experience. they were clearly there for another reason. >> that's right. they were political a point -- appointese, rewarding the green new deal. look at the money to had their money there. green emergency companies and start-ups. this is another continuation of this. >> harris: an excellent point. they were so confident that they had checked the right boxes and those green energy companies would be more important to the federal government than abiding by the rules. abiding by the rules means you

don't have more than $250,000 in an account you would expect fdic to covered. they are getting covered by tens of millions because they know the flavor of the left. >> silicon valley bank tried to get goldman and then tried to find a buyer and auction. all of that didn't happen. then the federal government. yellen and brainerd and powell. they all come in and say we'll bail you out. we'll guarantee every deposit, even those deposits to the chinese communist parties and the companies connected to the chinese communist party. >> harris: there are quite a few. maria bartiromo said it on this program a week ago. let's get back to the president's veto and what it means. after the veto president biden took to twitter. this bill would risk your retirement savings by making it illegal to consider risk factors

border security to rail against our budget is like a pyro maniac taking interest in fire prevention. all more fear and smear, deception and denial. we're seeing fentanyl and families ruined by loved ones they are losing and seeing young women and children at the border dying. >> yes. >> harris: they don't have enough of what they need. they are trying to be sneaked into the country by the cartels. the ones they don't kill they leave to die. a mark against our soul. how can the white house make this political? >> there again these people making this journey are physically, mentally, emotionally, drugged, sexually abused by the cartels on this journey. there is nothing compassionate there. now in joe biden's budget, he didn't have one dime for building that border wall. what has the border patrol told us for three decades? they need a physical barrier, better technology. where they cannot have a barrier. they need more officers and

agents. and when you look at the fact that chinese nationals are pouring into this country, 1,000% increase, you have people from 176 different countries, you've got 107,000 american overdose deaths, 66% of those were fentanyl. the fentanyl is manufactured by the chinese, it is brought into our country by the cartels, the cartels have operational control of the border on the mexico side. harris, nobody and nothing comes across that border without paying the cartels. >> harris: california kamala harris knows walls work. she was partying a couple days ago. she is not worried. >> she hasn't been to the border to meet the families. i've sat down with survivors of

personal attorney michael cohen. he has been to the d.a.'s office 20 times and testified in front of the grand jury twice. yesterday robert costello who briefly served as cohen's legal advisor told the grand jury the cohen is a serial liar claiming cohen said he decided on his own to pay $130,000 of his personal money to adult film actress stormy daniels. costello adding cohen said he kept the payment secret and it didn't come at the request of trump. costello said he gave d.a. bragg's office some 330 emails to support his claims but was surprised to find the grand jury had only seen six of the emails picked out by bragg's prosecutors and how he characterized bragg's investigation. >> weak to say the least. i just spent two hours or so testifying before the grand jury in downtown manhattan and i got

my point across, although it was clear to me that the manhattan d.a.'s office did not want to get to the truth. >> cohen insists he made the hush money payment in coordination with and for the benefit of former president trump noting trump would never have reimbursed him otherwise. >> donald trump generally doesn't pay anybody back for anything. it's the most stupid argument. i am 100% certain that everything that pretty much almost everything that bob costello said will be once again proven to be inaccurate as it relates to me. >> law enforcement sources say trump could be arraigned next week. this morning during an unrelated court hearing involving a separate lawsuit against trump the bomb threat was called in. it was unfounded and an all clear was given. heightened concerns about security. >> harris: thank you very much

for that information to help infuse into the conversation. phil holloway criminal defense attorney and former assistant district attorney. phil, always great to have you in "focus." can we pop that statement back up, please, i'm asking my team? phil moments ago we heard from alvin bragg's office. fox digital did and the part i want to focus on. we will not be intimidated by attempts to undermine the justice process. angry to appear on capitol hill. alvin bragg says nor will we let baseless accusations deter us from fairly applying the law. my first question to you, phil. if all of this were such an important case, if the facts were really supportive. if all of this could hold together against former president donald trump, why did he, why did the former d.a. vance and justice department pass on the case initially? >> great to be with you as always. listen, what we see with this

back and forth is the political sort of back and forth fighting that this type of prosecution and this type of effort invites. i share the frustration of congress because what they are trying to get at is how this local prosecutor is wielding the awesome power of his office. we as members of the public elect these individuals to do so responsibly. we want them to use the police power of the state, the power to incarcerate people. we want them to use that ethically and we want them to use it responsibly without bias or prejudice in a way that makes us all confident that the justice system is working. we bring people off the street, members of the public and bring them into a courtroom and put them on juries and make this sit in judgment of other people in criminal cases. if the public at large does not have confidence, harris, that our prosecutors are doing their job wisely and responsibly, it

could jeopardize all sorts of criminal cases, not just this case, but legitimate criminal cases. we want prosecutors to keep our streets safe from violent criminals and not get bogged down in political quagmires like this. >> harris: why didn't they press the case the first time. the former d.a. and the justice department and alvin bragg? the reason you give us the case hasn't changed but the politics have. the politics are now part of the stew and that's what they are capitulateing to. let's get to this. some comparisons of this case to that of democratic presidential candidate john edwards back in 2008. remember him? news of an affair forced him to drop out of that race. he was accused of campaign finance violations for allegedly funneling $1 million to his then pregnant mistress. a jury couldn't come to a verdict on five of the six

charges and acquitted him on the sixth. soon there after a zealous prosecutor dropped the case. talk to me about this. >> so the edwards case is a great example of how members of the public can use their common sense and they can see that these things are basically political prosecutions. common sense tells the members of the jury that this is not a crime. this doesn't violate campaign finance laws. of course, we would prefer that federal money, if it is used to fund these campaigns, is not used to hide the dirty laundry of political candidates. but at the end of the day, harris, prosecutors understand and members of the public i think understand that these things happen. these types of arrangements are made on a regular basis, these non-disclosure agreements are matters of contract. not at all uncommon not for

celebrities or politicians. they are common place and nothing illegal about them. nothing illegal for that matter about being a philanderer and you can legally pay people to not talk about that if it happens. this case with edwards demonstrates that the members of the public, i think, can see through these political efforts at weaponizing the justice system. >> harris: the bible talks about you can't be a philanderer but i don't think they'll take that to court. do we see alvin bragg testify on capitol hill? >> i don't think it will happen. what i think it will do is cause him to perhaps be more circumspect in how he is exercising his power. >> harris: or drop the case? >> i don't think he will drop the case but before he brings a charge, he is going to have some way of perhaps trying to explain himself. certainly will make other prosecutors think twice before they attempt to weaponize the

kits the chinese have sold the russians that doesn't work well. they sell them rubbish goods. you can play on stuff like that. you could have much tighter sanctions on the chinese and what they are planning to do in the future. you can sanction more chinese officials, do all sorts of stuff like that. there is a lot you can do before you get into kinetic force in regards to trying to split off the china/russia axis. russia only has a couple allies left in the world. macron thought he would bring peace, that didn't work. the turkish president wanted to bring peace but didn't work. >> harris: the french president spoke on the phone a lot. what happened? >> it wasn't in the gift of the french president to bring peace. it is not his gift. xi thinks it is in his power to do this. we have to make sure that it is clear that the united states is

>> harris: school districts across america are arguing over top social media companies. the schools are saying the platforms are fueling the teenage mental health crisis that is sweeping the united states and these social media platforms need to be held accountable. seattle public schools, for instance, filed the first lawsuit followed by districts in several other states and attorneys say more are coming. mark meredith live for us in washington with details. mark. >> good morning to you. a lot of people watching this one. school districts say due to social media their students suffer a wide range of mental health issues. now they are taking the claims to court. as you were talking about, multiple districts have filed suit. in january seattle public suits sued tiktok and meta and other states have now all filed

similar claims. last week bucks county officials near philadelphia sued writing the rising rates of e.r. visits for suicide and self-harm leave little doubt the physical nature of the threat has changed dramatically in the last 15 years. the suits target facebook, instagram tiktok say it increases depression and eating disorders and suicide. these sites say they monitor for these health issues. we checked in with facebook saying we don't allow that kind of content and of the content we remove or take action on we identify over 99% of it before it is reported to us. several social media sites have launched controls to limit how much time is spent on apps or what kind of content can be viewed. cyber experts argue more could still be done. >> if we can start having these social media companies be held accountable, having them be able to be sued and pay out for those damages we'll see more action

taking place to prevent it from happening in the first place. >> we know we've seen a number of different groups, cdc or other agencies looking into this but congress involved. later oh this week lawmakers will be hosting the ceo of tiktok testifying before the house committee on energy and commerce. of course, so much of the focus is going to be on who has access to the data but also i would imagine they will look at what kind of algorithms are being used and what harms comes from too much use of the site. >> harris: even the u.s. surgeon general children under 16 shouldn't be subjected to the these. the other thing too senator blackburn is working on bipartisan legislation with this very issue. the house side and the senate. we'll watch it all. mark, great reporting. vice president kamala harris ready to campaign for biden.
