"daily mail" reports trump will be indicted tomorrow and arraigned next week. democrats are already drooling. biden is going to use trump's mug shot in every campaign ad between now and next november. it will be the lead story of every network and cable show. democrats will print t-shirts up and put it on bill boards. it will be the most famous meme of all time. once released, it will be the most viral image ever. >> harris: all right. you heard the first line that i said of this hour. we don't know why the process has been cancelled for today. but, emily, we do know some things were already set into

motion. it could be many reasons they would cancel going forward with the grand jury for this day. there was at least one other witness that might be called. >> emily: at this point all things are on the table for why this was cancelled, including a scheduled delay. up to and including the testimony yesterday of robert costello who said this guy, cohen, couldn't tell the truth if you put a gun to his head. he said he went in there attacking the prosecutors. he said they seemed clearly one sided and not after the truth. he testified in front of the grand jury but prosecutors cherry picked information from a packet of 300 e-mails he had provided them. at one point he waved the pack tote the grand jury and said, this is what you're missing. so at a minimum we have a potentially theatrical testimony the grand jury has heard. he was an impeachment witness. we don't know now what happens

after that. again, all things are possible, but it seems likely that at a minimum that particular testimony had a big impact on the grand jury. >> harris: an impeachment witness for michael cohen, because we know michael cohen to be someone who has criminally lied. >> right. michael cohen said i never waived attorney/client privilege. costello said, wait, here it is, here's michael cohen's signature. he said five or six grand jury members were nodding in affirmation as he spoke. this is information they had not heard. the prosecution was not displaying this. we'll see what this means. i hope this grand jury delay. i hope it means they are really taking in the idea of not indicting the former president. i won't hold my breath with bragg. the corner stone of our justice system is justice. you remember how hillary clinton was under investigation for her e-mails.

they came out and said no reasonable prosecutor would bring such a case. only an unreasonable prosecutor would bring this charge against the former president. the new york times surveyed legal analysts and found according to their research, the new york da's office in manhattan has never brought a charge on a federal campaign violation before. this would be unprecedented. you have to think it would only happen because of the last name of the person they are going after. >> as a former federal and criminal attorney this is important for viewers to understand. number one to that point that was the underlying charge upon which this was elevated to a felony. that's why in part it was so filmsy, yet untested in these waters. over 98% of grand jury convenes results in an indictment. if it does not, it absolutely illustrates what you just said, which is the filmsy nature of this presentation by the prosecution. how utterly preposterous.

environment. the issue becomes when you're faced with these kinds of question, who you become and when the pressure does come. they can't imagine it. they think the scenario in this world has just been made for trump. none of that would ever happen to him. so we don't know how he would respond. the debates will matter. right? in order to beat the democrats, you do have to beat trump. if you can't beat trump, if you need him removed, then you're at risk when it comes to beating the democrats. but in the debate. rick perry showed this. he said it is a very good example. rick perry was going to save the party. i think it was the first debate. he crumbled. there's a difference between when you're in an interview and when you've got a press conference and press releases and he does deliver. president trump delivered. there's also though a difference in style. we saw the style work when it came to reforming the country. best economy in the world. dealing with the bad guys around the world. so that is an incredible

state. there's a reason people are going there. that track record will bode him well as he goes into a presidential campaign. the question remains, does he have the performance chops and the fight to take it to trump in a way that doesn't alienate the maga people. this is a difficult balancing act for ron desantis. he has to show what a good manager he's been in florida. saying it without drama is a little bit of a stretch. there was the disney thing. on the other hand, you have the question of, what i call the michael corleone shuffle where he defended trump while stabbing him over that. i don't know anything about a porn star but -- >> i found that cheap. i like ron desantis. i found that cheap. >> what you're summing up is when he basically came out and said, i don't know anything about hush monies and porn stars. it was a little jab. this potential looming

indictment has really put let's say pence and desantis both on their heels. they've both been critics of trump. but it's forced them to defend him in some way. >> i'm taken aback at the idea of indicting a former president of the united states at a time when there's a crime wave in new york city. the fact manhattan da thinks indicting president trump is his top priority i think this tells you everything you need to know about the radical left in this country. this feels like a politically charged prosecution here. >> there's a lot of speculation about what the under lying conduct that is purported to be it. that's outside my wheel house. that's not something i can speak to. i hope it doesn't come to where you end up seeing this going forward. if you are a very strident prosecutor. you're going to go after somebody on the other side for

some novel offense. that just does not inspire confidence. people see that as weaponizing the justice system. >> harris: it's interesting. they didn't take risks with the answers in terms of supporting trump. that's not what i heard there. what they said is basically taking a look at this almost forensically and say what else would alvin bragg do other than go after republicans when he can't get his own democratic led senator in gear? we say that. we're not running. and other people say that. i think it's interesting that they are at that dance. i love that you liken it to a fight. when you meet trump and you know he was your boss. one thing you walk away knowing about that former president is, he likes to fight. some people get into the fight because they like to fight. i don't know if those gentlemen have that. i don't know that about ron desantis because i haven't seen him fight as har as he's going

>> harris: it all comes down to readiness. are we ready for the next battle? from what i'm reading we don't have the numbers to take on the largest navy in the world. currently, according to the department of defense we have 337,884 members of our navy. that's not enough. if china decides it wants to take on taiwan, we are still at least a decade ahead of them in some of the technology and all of that. but the fact of the matter is they have more stuff and they have more people. that's problematic. our ships are in trouble. we can't even get them maintained on schedule. we are falling behind. that's just one of our five branches of military. we used to be the nation's 1% just in terms of military. now you add in the families and we're about 1% of the nation. my mom used to proudly call us the other 1%. it takes everybody else in the

house hold plus that soldier, marine, sailor, whomever, to say that we are 1%. we are not big enough. you don't have to be a hawk. you don't need political terms like that to know readiness means in 20 minutes. can you defend us? that's all it comes down to. you need willingness. are we taking away the willingness for people to volunteer to be in the military. not lowering the standards, but raising them by making part of the standards pronouns? >> without that under class coming in, we're losing that legacy knowledge. right? that everyone remembers admiral william, that level of leadership and experience that resounding important stream line from the very top to the very bottom so that everyone joining our military understands exactly what opportunities are out there and understands exactly how to go about securing it. you contrast that as well within this country one of the most

asian, black, latino, native american or lgbtqai plus. so many letters. >> so many letters. >> what if you exist in all the boxes? >> yeah. well, see, that's what college was supposed to engender, right? to have you go to a place that was different from your home town, had people that you have never seen before, got you used to different cultures, different sorts of living and life and opinions, and then you became a part of the university. right? you were -- that was your team. that was your group. to now move us back out into that dynamic, kind of eliminates the power of the importance of going to college.

of seeing such a diverse frame work of what america is an learning all of these things. like this panel right here. that we come from very different places. we have different complexions. we have different life experiences before and now. economically we're different. but we sit here and we find out, wait a minute. we have more in common. that's what college is for. this is a deliberate effort to continue the division of america based on the policies and should be rejected. >> they argue -- they argue white supremacy. what about the millions of people who are also white? what happens if you are a student who identifies with those boxes and also an identity

that that university argues you deserve protection from. are you banned from that commencement exercise? what i have always encouraged my children to do, get rid of the boxes. it's about what's inside your head. and when the world wants you, you better be ready. be ready so you don't have to get ready. what happens if you want to go to your best friend's graduation ceremony and graduate with threpl but they are not in the same box.

are you not able to go to the other box? i'd be there with whomever was there. you don't think i'd show up? they'd show up for me. >> i recently filled out my passport renewal. four boxes for gender. male, female, one that was all or whatever. i had to include whether it was a change from before. as boxes increase for allowing of whatever identity is yours at the moment so, too, you could argue would be this. why are we even doing it if everybody is going to identify how they wish and what they want all of this energy and money going to this and time that will ultimately be destroyed anyway. >> it is totally insane. you go to college and no matter your race or gender, your preferences, you go to orientation together. you then sit in the classroom together. you go to the cafeteria together. when we graduate everyone separately and then you go into the work force and guess what?

everyone is back together. as it should be. i don't understand the rationale behind it. maybe there's something i'm missing. why do we separate people at graduation? makes no sense. >> i found this hilarious, my parents did not. i put a sign on the back of my gown saying will work for food. you have to earn your income from then on. has nothing to do with separation. >> what happens with school spirit, community. this is progressive segregation. that's what this is. in school setting. >> so are the reparations. they are going to test us to see how black we really are. >> one of the things i love about being in new york. we're all together. different people. nine or ten.
