made to former model karen mcdougle. alvin bragg's office says we contacted trump's attorney for a supreme court indictment which remains under seal. guidance will be provided when arraignment date is selected. the former president saying this is political persecution and election interference at highest level in history. alvin bragg is a disgrace, he's doing joe biden's dirty work, the american people realize what the radical left democrats are doing here. people in florida are rallying around the former president, protesting in front of his home in mar-a-lago. ron desantis says he will not assist alvin bragg in this case. florida will not participate given the questionable circumstances at issue with this soros-backed manhattan prosecutor and his political

institution. we can no longer have moral authority against dictators and despates, who compete in free and fair elections. >> this is about power, demonstration of raw power, they are sending a message that they will use any power they have to interfere in the next presidential election. >> house speaker kevin mccarthy wrote this, the american people will not tolerate injustice and the house of representatives will hold alvin bragg and unprecedented abuse of power to account. there are committees looking into da alvin bragg's investigation, those are taking a brief pause to see what happens next in the former president's arraignment. jim jordan is chair of the house judiciary committee. he tweeted one word, outrageous. you have democrats celebrating and others highlighting the legal challenges that alvin bragg faces in this case.

we have not heard from the senate, we have senate majority leader who tweeted should be no interference in this case. >> todd: alexandria hoff, thanks. bring back in brooke. i'm fascinated what will happen on capitol hill when it comes to republicans holding da alvin bragg accountable. there is matter of what comes next with regard to the indictment, what are you hearing and what do you know? >> brooke: this indictment is under seal. alvin bragg was looking into the payments, the payments have been investigated by other offices for five years, the payments were investigated by the u.s. attorney's office in the southern district of new york and in 2019 they opted not to charge trump. michael cohen pleaded guilty for

arranging the payments, but trump was neverinvolved. he was not charged there. federal election commission was investigating the payments and they tossed that investigation into the matter in 2021. it is interesting, we don't know if the charges are actually for the hush money payments, we know that alvin bragg was investigating them. we'll see. we won't understand what exactly he is charged with until that indictment is unsealed. >> ashley: to flip the script on that, when it comes to alvin bragg investigating trump, when it comes to republicans wanting to question alvin bragg on capitol hill, is that something sources are saying the trumps want? >> i'm sure that is what they want. you have house judiciary chairman jim jordan and house oversight committee james comer requested alvin bragg come testify before the panel and former prosecutors who resigned in january of 2022, when it

seemed like alvin bragg wasn't going to charge trump, that was dunn and pomerantz. jordan and comer wanted to hear from them, what is this investigation, how did the charges come about now? it is interesting, the statute of limitation on the hush money payments if this is what he's charged with, it would seem like those would have run out or are running out soon temperature is really interesting to watch. >> ashley: the woman, the legal analyst we talked to at the 4:00 say it ended in 2021? >> todd: that is for specifically the misdemeanor charges, but that is why alvin bragg is trying to contort himself into a legal pretzel to get the felony, which i would argue still is running foul statute of limitation, the way alvin bragg is trying to get around the statute of limitation is saying trump wasn't available

for four consecutive years because he was in the white house. i think this is a false notion that alvin bragg will have trouble with. another thing we haven't talked about this morning, the fact that prosecutors put that out there. former prosecutors put that out there, that can't help the legal case in and of itself. there is this notion out there that you can turn any misdemeanor into a felony based upon da alvin bragg's approach here. i can't think, if trump is convicted by a deep blue jury in deep blue state like new york that will fly on appeal with third circuit, even though it is deep blue, it is court of appeal, there is higher standard on appeal. >> ashley: the charges were brought in new york because the prosecutors know he can't get a fair trial here, he put it on truth social last night. it will be interesting to see

how this plays out. there will be outrage, there are protesters outside mar-a-lago showing support for trump. republicans are uniting, even people considered maybe his potential rivals f2024. even ron desantis says this is unamerican. alvin bragg is a soros-backed prosecutor. this is first time a president of the united states has been charged and this man has been investigated for everything from seven ways to sunday from the russia investigation, from the impeachment number one, impeachment number two, now under special investigation and classified records and democrats investigate him for his taxes. new york attorney general leticia james is investigating

view the world of law the way americans view the rule of law. as a lawyer, i'm looking at what happened over the last 12 hours and i'm sad for the country. you study law and law is to be applied without bias. scales of justice are blind. when you're in a country like russia, china, north korea, and you live in a state where anything goes, we will find the person and find the crime later, that is not the american way. they have to be watching this and saying, maybe our way is the best. look at what is happening in the united states of america, doesn't seem to be working well for them. their democracy over there and their rule of law and that is sad, we are supposed to be a beacon for the world. >> ashley: beginning of that sound byte, her first words were, i don't recognize our country. i brought this up in the 4:00 hour, imagine what immigrants

are thinking right now, they fled this type of situation and life to come to america, the greatest nation in the entire world and then they are seeing this play out? she's right. i don't recognize our country. i can only imagine these people who left everything they know, a lot of times their family, just to have a better life and it is concerning this is happening for the immigrants and for americans, as it is. >> todd: i love that point. they came here for an american ideal, for a concept that has been 200 plus years in the making, right? in a span of a few short years, accelerating like it has been doused with rocket fuel over the course of the last few, we are destroying that and that is sad. >> ashley: look at that poll that we've been talking about, the patriotism poll. people don't feel patriotic.

>> todd: we are back with the border crisis, texas dps trackers find illegal immigrants sneaking through texas, caught on video. you see the migrants dressed in full camouflage and hiding in a cave, the migrants came from mexico, guatemala and canada, located in big bend section of texas. cbp reporting one million encounters since october. earlier this week, texas dps is uncovering a stash house with another 23 migrants inside while enforcing operation lone star. >> ashley: elaborate shrine to the saint of death, it is worshiped by the mexican cartel who pray to it for protection.
