>> trump's legal team says the president is expected to turn himself in early next week according to district attorney alvin bragg's office. quote. we contacted mr. trump's attorney to coordinate his surrender to the manhattan's d.a. office on arraignment supreme court indictment remains under seal. guidance will be provided when the arraignment it date is selected. fact that the grand jury indictment remains under seal means we don't know the exact charges. bragg has been investigating trump for alleged payment made leading up to the 2016 lengsdz. that includes $130,000 to adult film actress stormy daniels. bragg questioned witnesses about another 150,000 paid to model karen macdougall allegedly that is. the former president has denied all of these allegations along with affairs with both. all the while bragg has been trthrust national debate. saying in part this is political persecution and election interference at the highest level in history. manhattan d.a. alvin bragg is a

manhattan prosecutor and his political agenda. and in response to all of this, we are learning this morning that the nypd is gearing up to potentially deploy officers citywide. guys? >> steve: thank you, alex. every single police officer was told to come to work today, even if it was their day off what is extraordinary they have got to be in uniform. they want a show of strength on the streets of new york. >> ainsley: keep in mind the grand jury, 9 #% of the cases that go before the grand jury end up with an indictment. because you only hear one side of the case. the defense doesn't get to present their case. >> steve: they did in this case. >> ainsley: nothing stops him from running for president. sources have even said that he is still planning on running, even if he is indicted or convicted, i should say. because, in order to run for president, you have to be a citizen, a natural born citizen at least 35 years old and a resident of the u.s. for at least 14 years. his attorney joe tacapino on hannity last night. he was shocked.

i was shocked. today the rule of law in the united states of america died. >> brian: he didn't put his case on. instead of him appearing. why don't have you bob costello come in where he just eviscerated the story. >> ainsley: legal adviser to cohen. >> brian: so kind of interesting. the "new york times" said the first sign there would be an indictment was around 2:00. when three lead prosecutors walked into the courtroom where the grand jury was sitting and had a copy of the penal law. three hours later, they walked out. the county clerk's office through a back door and started the official process and next thing you know within two minutes of when they closed you saw the announcement. you saw alvin bragg go out the door. what is he actually charged with? at much as 34 counts of fawtion falsification business records, perhaps. it is centered around the stormy daniels case. but what about the karen macdougall factor. what did david pecker say as the last witness to go in there and

the essential witness still going to be michael cohen looks like it will be which obviously has huge credibility issues. a lot of things people jumping to conclusion people saying it's wrong or right. this is fantastic. we just don't know until they unseal the case. the one thing pretty clear this has never been done before. everyone agrees unprecedented for this case to go to -- this election case in new york to go -- become a federal case. so it's unproven ground and is this how you want to do it? >> steve: well, we will find out. there is a story that i think i saw in the daily mail or the "new york times" this morning that said that apparently the department of justice in washington is irritated by the indictment because they think this -- of the four cases that donald trump is currently being investigated for or probed, this is the weakest of the cases. and the worry is that it would damage the georgia case, which, keep in mind, the grand jury has already finished their work and they have suggested indictments.

we just don't know what they are because the d.a. has got to figure out and announce it. so, anyway, they worry it could damage the georgia case or the january 6th probe. if this case collapses or if donald trump is acquitted. the white house and the department of justice did not have a single word to say yesterday. understandably. >> ainsley: the president was putting all kinds of messages on truth social and trump said this is an attack on our country the likes of which has never been seen before. it is likewise a continuing attack on our once free and fair elections. the u.s. is now a third world nation. a nation in serious decline. so sad. many lawmakers and even candidates that are running against him were coming to his defense, including mike pence and speaker mccarthy. said this is an attempt to interfere in an american election. the american people will not tolerate this injustice. they are not planning to assist in the extradition request given the questionable circumstances, he says. and nikki haley was tweeting,

tim scott was, governor glenn youngkin, and mike pompeo. all in support of president trump. >> brian: i would also add this. as you might have noticed the "new york post" has been pretty negative towards the former president of late. in their editorial today here is a brief excerpt. make no mistake this is politically motivated prosecution. questions whether this all happened because of palm member rants wrote a book saying that alvin bragg dropped the ball and send ended up being a pride thing. predecessors did not bring the case after six years. what has changed? let's bring in former federal prosecutor. elliott, what changed over the last few years? >> it's hard to understand looks like the criticism glowt a book. it's not supposed to work this way. the only reason you can say this

has a shot. jury pool come from a jurisdiction that voted 85% for joe biden. it's not supposed to work that way in this country. not supposed to bring criminal cases where the viability of the case only hinges on the pre-existing unpopularity of the defendant. >> ainsley: what do you think will happen on tuesday? will we see him in handcuffs? he had said originally bring it on. put me in handcuffs. >> will we see him enter the court house through the garage underneath so he is safe and i know secret service will accompany him. >> i don't think the secret service would allow a former president to be handcuffed. they have a legal obligation to protect him. so i don't think we will see him in cuffs. i don't even know if they will do a perp walk there are various cat combs and little secret back entrances into that courthouse bring him into court without having to pass by the cameras. walk into court and handed a paper copy of the indictment like any other defendant. told formally what the charges are and they are adjourn it. >> steve: exactly. we don't know what the charges are we have heard there are dozens, cnn, i think is

reporting 34 alvin bragg wants to get reelected. he can't blow this. maybe every time many stormy daniels payment they will say it's a separate charge. i don't think they have a provable misdemeanor here. the misdemeanor provides a materially false statement. is it really materially false, criminal false to say an nda payment is a legal expense? it was arranged by his lawyer acting in his capacity as a lawyer a legally binding agreement. i challenge everyone whether your politics are right, left, or center to say that an ordinary citizen would be indicted seven years after the fact for characterizing an nda payment as a legal expense. >> steve: could one of the charges be on struxz.

courtrooms. ive got two questions. first, will they say this is extraordinary. it's a former president of the united states, let's have cameras in the courtroom? >> judges have the discretion to allow, sure. >> steve: what do you think? >> i think it will happen. >> steve: will donald trump take the stand if it goes to trial? >> wow, if i were his lawyer, i would make it clear that the prosecution has the burden entirely and i don't want to shift the focus to my client. >> steve: because you know he would want to go to the stand to protect his name. >> but the -- john edwards avoided conviction in a comparable case. john edwards did not testify. >> brian: do you think same judge that presided over the grand jury that was the judge overseeing the case and trial of the trump organization and put the cfo at rikers island? >> he will almost certainly oversee the arraignment. so much time gets passed and time between arraignment and trial. >> ainsley: what happens to

trump between arraignment and trial behind bars? >> no. >> steve: given the dynamics being so largely in favor of joe biden in the last election, could donald trump get a fair trial in new york? >> it's going to be very challenging. the judge, his lawyers will seek extremely broad discretion, extremely broad latitude in questioning jurors for potential bias. and the judge should grant that very broad latitude. >> brian: and the timing would be after the 2024 election by the time the jury is said and this gets on the calendar. do you agree with that. >> could be before the 2024. typically case goes to trial in a year march 2024. theaterly happen before the next presidential election. >> steve: man o man. were you surprised that the indictment -- he he it was announced. >> i thought it would be adjourned further. and so many unanswered questions regarding the viability of this

will only boost his candidacy. democrats argue this indictment shows no one is above the law. senate majority leader chuck schumer says in a statement mr. trump is subject to the same laws as every american. he will be able to avail himself of the legal system and a jury not politics to determine his fate according to the facts and the law. former house speaker nancy pelosi echoing a similar sentiment saying the grand jury has acted upon the facts and the law. no one is above the law and everyone has a right to a trial to prove innocence. hopefully the former president will peacefully respect the system, which grants him that right. while they say the legal process should play out, at least one g.o.p. member says democrats have already overstepped. >> you talk about the line that you can't cross, in my view, jesse, they crossed it months ago when they weaponized the fbi against parents. when they weaponized the fbi against everyday americans who want to exercise their right to free speech. and now they are just

the century" are gregg jarrett joins us. good morning to you. >> good morning steve, ainsley and brian. >> steve: people have been talking since late yesterday afternoon about the indictment nobody knows what what's in th. we hear there could be 34 counts against him. what could some of those counts be? >> well, i think there's one primary count and then, you know, he sort of chopped it up. every reimbursement payment to michael cohen was probably counted as a separate crime, which is frankly quite ludicrous. i think the whole case is novel to the point of being bizarre. trying to take a misdemeanor of falsifying a business record and super charging it into a felony, citing a campaign finance violation will not, i don't think, withstand judicial

scrutiny. i don't think this case will ever get to a jury. forget about the statute of limitations that already expired, but there are other major obstacles for alvin bragg. first of all, you know, nondisclosure disagreements in exchange for money are enter perfectly legal. second of all, he would have to show that trump was personally involved in falsifying records and third, he would have to show that trump understood these convoluted, complex campaign finance laws that nobody exrendz and that he then intended to violate those laws the department of justice long ago looked at this trump case and so did the federal commission and both of them concluded that there was no crime. why? because the so-called hush money payment does not qualify as a campaign contribution. read the law. it's quite obvious.

so i think this is a prosecutor who is going to be facing a motion to dismiss the case. >> brian: it's interesting. this guy john ban zawf. george washington university professor and hardly a right winger. there are grounds to dismiss. number one faulty claim. not solid. selective prosecution. you could prove that compared to other crimes that are not. prosecution misconduct or statue of limitations. we don't know if they will have this covid axiom that said it would have evaporated but court cases had to go on hold because of covid. >> no. that doesn't apply. have to show that the prosecutors stopped their case at some point because of covid. and, of course, we know the d.a.'s office was operating all throughout the pandemic. and, you know, the other argument i heard was trump was

out of the jurisdiction. sure he was. but read the fine print in the law. it says if his whereabouts is unknown outside the jurisdiction. well, everybody knew where he was. the fact that they have charged him now seven years later means they could have charged him five years ago or seven years ago but they chose not to primarily because they knew that the law doesn't support the charge and the alleged facts don't support a recognized crime. so, you know, and i think it's interesting you point out selective prosecution. nobody considered investigating and charging hillary clinton under new york law and, yet, she did the exact same thing, paying a million dollars secretly for the anti-trump-steele dossier. >> brian: she got find, right? she got find for that. >> this is selective prosecution and unequal justice.
