surrender to the manhattan's d.a. office on arraignment from a supreme court indictment which remains under seal guidance will then be provided when the arraignment date is selected. since it is under seal we don't know the exact charges. what we do know is bragg has been trump for alleged payments made leading up to the 2016 election including $130,000 to adult film actress stormy daniels. bragg questioned witnesses about an alleged payment made to model karen macdougall. the former president has denied any wrongdoing and has denied the affairs. and he has also responded to the indictment with outrage writing a lengthy response including this is a political persecution and election interference at the highest level in history. he also called d.a. bragg a disgrace writing, quote: he is doing joe biden's dirty work and that the american people realize exactly what the radical left democrats are doing here. trump's attorney said last night that there's no crime. >> he didn't have any information, any evidence but, again, that was nazi germany. that was soviet union.

there is plenty of reaction from rank and file republicans and democrats on capitol hill. >> ainsley: and peter doocy joins us live from outside the white house with the latest. peter? >> peter: nobody in this town is really saying trump didn't do it. instead, they are just arguing about whether or not he should be charged. >> you talk about the line that you can't cross. in my view, jesse. they crossed it months ago when they weaponized the fbi against parents. when they weaponized the fbi against everyday americans who want to exercise their right to free speech, now they are just accelerating i think democrats know this doesn't have anything to do with the maul they are sending a message. >> mr. trump is subject to the same laws of every american. he will be able to avail himself to the legal system and juries not politics to determine his fate according to the facts and the law. and nancy pelosi says the grand jury has acted upon the facts and law. no one is above the law. and everyone has a right to a trial to prove innocence

emerged of him after he testified a couple of days ago. believed to be the last witness that he had his head in his hands. he looked totally shaken up. they thought that is not a good look. did something he say leave the indictment to happen. according to the "new york times," two people familiar with the case said there is 24 counts at least, meanwhile, it turns out around 2:00 in the afternoon when things became clear that something was happening. that's when lawyers -- three lawyers walked in with the penal code of law and explained it to the 24 members of the grand jury through the back door and started official process. the "new york times" did research knowing the "new york times." they showed that prosecutors in new york have never before filed an election law case involving a federal campaign. but this is how they want to break the glass. >> steve: what's interesting you mention david peck his or her used to run the national inquirer and still was consulting. he was among the very first

witnesses this grand jury heard from. and then one of the last ones. so, presumably, he was brought in to answer some more questions about stormy daniels and, brian, you mentioned the former playmate of the year karen macdougall who apparently from mr. pecker's "national enquirer" for the exclusive rights to her story. then they never ran that story. it's suggested that mr. becker was being called in along with others to corroborate the story that apparently there is a fact pattern there is a pattern with donald trump and these women. they will wind up with money and then they don't tell their story. >> brian: there's nothing illegal. >> ainsley: hush money is not illegal. prosecutors can argue improper donations to the trump's campaign. i'm not sure how those two connect but maybe this will all unfold. class e felony has a potential to serve four years behind bars.

they spent two years looking into that. then we all learned that was fake. it was all based on a fake document, the steele dossier. then they finally impeached him over ukraine, when now what we're learning the real quid pro quo wasn't donald trump. it was joe biden when he tried to hold up foreign aid when he was vice president in exchange for firing the federal prosecutor in ukraine that was investigating the corruption from his son. then the democrats released all of his taxes for years and years and years, thinking that that would create some type of legal backlash. >> brian: nothing happened. >> it didn't. thought d.a. gets him on local campaign finance violations. >> steve: maybe. >> it makes no sense and it's another example of why the american people have lost confidence in our judicial system. when you look at this case and understand the facts. paying a woman. she is accusing him of something. he has to pay her so it doesn't come out. that happens all the time in business, especially, you know, when you are talking about

politics or wealthy people who are public figures. >> whether it's true or false. >> exactly. so, many people thought this isn't going to be a big deal in new york. there is no way they are going to indict him. then you look at what happened with january 6th and you know they are working on cases in d.c. you know there are possible cases in georgia. so what was your reaction yesterday when this news broke? >> well, one thing that we're concerned about in washington, congressman jordan and myself is if there is coordination being conducted here between merrick garland, doj and all these different entities that are going after donald trump. this is a political witch-hunt, they are doing everything in their ability to create a narrative that would hurt donald trump. but i will tell you, i was at a baseball game last night. my son played baseball there were parents coming from both teams up to me news had just broken that trump had been indicted and people were coming up. they weren't real political people why won't they just leave him alone.

why can't we stay out of our elections and let the american people decide? so i think that democrats risk a backlash from this. you look in the midterm elections in new york. and the voters turned their backs last november on the democratic party because of crime. and here we have, you know, newark, a very high crime city. we have got the local district attorney trying to be a hero for the national left wing of the democratic party and indict a presidential candidate where the statute of limitations expired years ago. >> brian: they are going after elon musk now. hero because of twitter. and twitter files with matt tiberiasy. the irs knocking on his door could be a coincidence. i doubt it. talk about new york city crime rage. bragg is an embarrassment to the country. but especially to the city. he -- his first statement how little crime is he going to prosecute. and he got what he wanted. a lot of crime. robbery is up 25%.

>> what we don't know. that's the problem. and keep in mind there were some misdirection this week. it was leaked that there wasn't going to be an indictment this week lo and behold there was. now, we have an indictment that is not going to be unsealed. it's announced but not going to be unsealed until next week. for all we know there is something that nobody has any idea of, some new alleged crime that's been discovered, but, right now what we have to go on is what the best information we have is this state law that really have a misdemeanor. and it only becomes a felony when it's used to cover up another crime. and what's novel here, let's make this clear. what's novel is that this law has never been applied in this way in a new york courtroom. what i mean by applied in this way is, they jump it up to a felony, when they say it was committed, falsification of

business records with the motive to hide another felony. what is that felony? a federal election law violation, it's never been applied in this way. it's election law violation violation, didn't even charge him. it's interesting. we will know more on the charges until next week we do sol though are able to survey the political damage. we have heard a number of republicans say the democrats are trying to destroy donald trump. but we saw the poll that came out a couple of days ago. donald trump when he has been talking about alvin bragg, his popularity has actually gone up so i think there are some democratic party bosses who are thinking all right. let's make donald trump a martyr, this is just my crazy theory. let's make him a martyr, he will win the primary but ultimately he will lose the general.
