first david spunt from washington and more on the other legal troubles that still lurk out there. david, hello to you. >> hi, bill. multiple investigations on a federal and state level that could come to a head before election day 2024 or if donald trump wins, inauguration day 2025. we want to show you a picture of jack smith, the merrick garland appointed special counsel looking into the former president in two active federal investigations, one deals with the former president's involvements in efforts to overturn the 2020 election and what happened on january 6th at the u.s. capitol. the other investigation overseen by smith, the mar-a-lago document investigation, 10,000 documents seized by the f.b.i. in a raid of the former president's home last august. about 100 of them with classified markings. sources familiar with the probe say smith is looking at possible obstruction, intentionally not

cooperating with authorities. smith was able to get trump's attorney in the documents case corcoran, the man right there, to testify before the washington, d.c. grand jury last week. right now he is fighting, smith is fighting to get former vice president mike pence to do the same. pence is weighing his legal options. the other big case facing the former president out of the state of georgia. it is a state case. we know a grand jury met for months over the president's phone call with this man on your screen with the glasses, brad raffensperger, the secretary of state of state. he claims that donald trump quite pointedly tried to pressure him to find more votes in georgia. specifically 11,780. raffensperger said sorry, those votes don't exist. on capitol hill some house republicans are insinuating merrick garland and the justice department was pulling the strings on the manhattan d.a. probe working with alvin bragg. d.o.j. officials tell me that is

false full stop. two separate investigations that have nothing to do with one another. bill. >> bill: david, thanks. for more jonathan turley and trey gowdy join us for continuing coverage and analysis. great to have you on, gentlemen, professor, you write this at foxnews.com. you say the indictment of donald trump leaves america with a legal puzzle. there are reports of 34 counts of business record falsification but multiplying a flawed theory 34 times does not make it 34 times stronger. serial repetition is no substitute for viable criminal charges. that's your statement. where are you now on this, professor? >> we're hearing different reports it may be 24 as opposed to 34. it may be a simple count stacking measure that prosecutors can take each individual transaction or filing as a separate violation. there is also discussions that

they may be incorporating other subjects like money given to mcdougal, another woman who was allegedly involved in an affair with donald trump. but these simply replicate the same problems. those mcdougal payments were about 2016. they have the same statute of limitations problem if they are using this new york misdemeanor. it gets us to the boot strapping problem where if you are using the falsification of the business records, if that is the basis of most of these counts, you have to essentially zap it back into life by turning it into a felony and the argument is that they may be trying to bootstrap a federal crime that the department of justice never prosecuted. and it didn't prosecute it for good reason. it did that in the john edwards case and it was a disaster. this is a very difficult crime to prove and this is weaker than

the edwards case. >> shannon: we're hearing the president's team we aren't even going to discuss a plea. we will go to the mat. we'll have to watch over the next year or two if he is actively campaigning and also doing a trial, if he was your client, what would you tell him about taking the stand and how that will play with the jury? i have to imagine he is going to want to. >> i have no idea what the facts are. i haven't read the indictment. to the professor's point i don't know if it's 34 independent fact patterns or 34 bad checks written on the same day or if they're just counting or stacking the counts of the indictment. we just saw a trial in south carolina where a defendant insisted on taking the stand but not with a great result. so ultimately it is the client's decision but that is so far down the road, you have statute of limitations problems, you have real legal issues with this

indictment. shannon, my concern is a former prosecutor you are supposed to lead with your best set of facts. your best case. this to me is by far the weakest of the four investigations that the president is facing. it is the wrong prosecutor bringing the wrong case. so look, no lawyer is going to tell donald trump what to do. but he doesn't have to make the decision today because there is a lot of things that can happen between now and the time the jury is im paneled. >> shannon: yes, we're waiting to see the indictment and hopefully we can figure it out in the next few days. what we know about the case right now, it may not get to trial. pre-trial motion maybe throws this thing out. >> the professor raised exactly the right point. this is a misdemeanor that someone put a suit on and want to call it a felony. you have real statute of limitations problems here. what is that underlying or what is that overarching crime that

makes it a felony? why did the feds pass on it? it is relevant in the court of public opinion. the best prosecutors in the world, which happen to be in new york, federal prosecutors, they said no thanks on the very same fact pattern. i think there are real statute of limitations problems here. we'll see what the judge does. >> bill: professor, last question. as we understand it the feds saw this case and passed on it. this d.a. saw the case and passed on it. two of his colleagues, prosecutors in the office, resigned because he passed on it. one wrote a book about it. and then suddenly it has been resurrected. i would assume there must be some information in this indictment that would suggest that a new witness popped up or a new set of facts popped up? will we know that answer when the indictment is made public?

>> we likely will. the thing is, we have to wait to see the indictment. we don't know what the crimes alleged will be or the underlying evidence. but there haven't been other crimes that have been discussed the last few months. the reason many of us view it as a political prosecution how it came about. the very history you cited. what that prosecutor did in writing that book is one of the most unprofessional acts in my view that you can take. this was a case currently under investigation by a person who wasn't charged let alone convicted. whether or not it violates ethics is a matter of debate between lawyers. i think it was deeply unprofessional. bragg's office asked him not to do it but it worked. bragg caved. that's why this has this patina of politics to it that is unavoidable. >> shannon: all right, professor and trey. thank you very much.

>> bill: the white house facing calls for action after more than 1,000 experts in the tech industry called for a six-month pause on artificial intelligence projects. peter doocy asked the white house about this yesterday and, well, we'll let him tell the story from the north lawn today. hello, peter. >> first these 1,000 very smart minds in the world of tech want more red tape. part of the open letter they signed onto says developers must work with policymakers to dramatically accelerate development of robust a.i. governance systems. these should include new and capable regulatory authorities dedicated to a.i. some lawmakers are saying it's a good start. >> the problem is right now we don't have a good handle around exactly what those dangers of a.i. are. certainly not enough to be able to develop a regulatory framework for it. >> a six-month pause may not be

enough to protect humanity according to at least one expert. >> there is an expert from the machine intelligence research institute who says if there is not an indefinite pause on a.i. development, a quote. literally everyone on earth will die. would you agree that does not sound good? >> your delivery is quite something. >> it sounds crazy but is it? >> all i can say there is a comprehensive process in place. we put out a blueprint back in october. i don't have anything to share. >> they understand the concern and they are looking at ways to rein in a.i., bill. >> bill: peter, thank you from the white house. >> shannon: former president trump is calling his indictment a political prosecution. he writes the democrats have

lied, cheated and stolen in their obsession with trying to get trump but now they've done the unthinkable indicting a completely innocent person. bring in our panel. former white house chief of staff and a co-host of the five. start with you and go back to a different job. you were counsel to the rnc and know how fcc files work. what do you make of this case based on what we know so far? >> well, good morning. yeah, before i was chairman for six years i was also general counsel of the rnc. in that span of time, i've probably filed under my watch millions upon millions of line items with the federal election commission. that's the commission that governs whether or not campaigns are doing things properly with their disclosures of both expenses and income and revenue. in this particular case, what the district attorney is trying to do is hook a federal election

campaign violation or any other federal law to revive an otherwise time-limited misdemeanor in new york. the fec looked at this case. a complaint was filed several years ago. 18 months ago the federal election commission decided the trump campaign did everything properly and that, in fact, if the democrats were correct, if their wish came true and that the trump campaign would have disclosed this on their campaign finance report, that would have been a violation and an actual misuse of campaign funds for personal use. so the fec said already this case was dead in the water back in july of 2021. so the actual federal election commission that governs the actual disclosure to the world and to the people of the united

states has already ruled that there was no violation. just like there is no violation when someone gets a haircut. if someone gets botox, when someone uses their personal car to drive to the pancake breakfast on saturday morning. there are things that need to be disclosed and things that do not. and in this particular case, the trump campaign did everything properly in their disclosure to the federal election commission. it's already been decided. so it will be real interesting to see what kind of novel theory that creates this federal hook here as to what wasn't done properly because, in fact, it was done properly and the fec has already ruled on this. >> bill: before we go to jessica, when will we see the indictment? do you know that typically? >> typically you would see it at the arraignment. you would see it when the defendant is brought before the

judge. >> shannon: its possible it could be put out early but unusual. >> bill: you were on the air, jessica, when the news broke. do democrats want this fight? >> i think they want the fight generally. but everyone is being cautious with this, as they should be. we're waiting to see the indictment. if it is exactly as reince lays out on no information that would be astounding. this is months of grand jury testimony. the d.o.j. looked at it and fec looked at it. alvin bragg thinks he has something more to offer. the fact that we could have more than 30 counts indicates it is not just a simple exchange of donald trump paying michael cohen to pay off stormy daniels. there must be something more to it. there has been great apprehension. i have expressed this on the air a number of times, this was not the case to lead with. donald trump is being pursued potential indictment in georgia

for pressuring election officials to overturn the 2020 election. a special counsel in jack smith looking at the documents he took inappropriately to mar-a-lago and refused to give back but his role in inciting an insurrection. alvin bragg better have crossed his ts and dotted his is on this it will seem like a generally flimsy case and baked into the cake. jess watters made this point as reince said this morning. the same thing of getting a haircut or botox. paying off someone while you cheated on your wife with while she was pregnant is not the same as getting a haircut. in the wake of the access hollywood tape, that hurt him

not fatally. mike pence saved his butt and stayed on the ticket and say i've forgiven him. the american public would have cared the affair happened and payoff happened. >> bill: we're running out of time. go ahead and answer that, reince. >> here is the deal to jessica's point. this issue was disclosed to the public. it was disclosed the weekend before the actual vote took place in 2016. it has been disclosed to the american people for years. the point is whether or not it is a proper disclosure to the fec. what the fec decided is that there was no violation and, in fact, if it was disclosed, that would be a violation on top of it. the u.s. attorney already also decided to take a pass. last thing. it is a political prosecution. when bragg ran for office he ran as a politician running and made

>> bill: 10:30. most americans not happy with president biden. fox polling shows that 56% disapprove of how he is handling things. biden has not been in positive territory since september of 2021. want to bring in josh from axios, got a bunch of numbers to throw at you. you can do the analysis, all right? when asked among democrats would you like to see joe biden as the nominee? we found last month 53% said someone else. this month 52. numbers are consistent. the second line is what i find interesting, right? last month it was 36%. he has gone up seven points in the keep biden category. can you mesh those two together and make sense of it is to where the party is on that? >> well, bill, there is this big disconnect between democratic party leaders, lawmakers, strategists, consultants who view biden's nomination as inevitable and they are locking

down support as the president prepares to announce his re-election campaign in the spring but if you look at democratic party voters is consistent with every poll we've seen this year. a majority of democratic voters want someone new. they want someone fresh. they want someone younger. there is a persistent concern about president biden's age and ability to do the job into 2028. there is this disconnect between the elites in the democratic party who are really excited about biden running for re-election and a lot of voters, especially those on the progressive side of the party that have a lot of concerns. shannon the other side of the ticket, this is g.o.p. presidential primary voters are adding to the former president -- democrats need somebody and want somebody new. primary voters don't. donald trump has picked up 11 points since february. he has a 30-point lead over ron

desantis who is not officially in the race. is this all but over? >> well, it does look like we are more likely to have a rematch of biden versus trump the way things are going than having the change that a lot of voters really say they want in our political system. the fox poll on the republican side is just extremely news worthy in that trump even before the indictment and before all the news of the last 24 hours had doubled his advantage over ron desantis. he has been gaining ground, desantis not even a candidate has been losing a little ground. the big picture with the indictment is that it will be hard, shannon, for any republican candidate other than trump to even get media attention with all the legal circus that will be surrounding donald trump over the next month or many months to come.

so these are desantis known among republicans and a good image. a lot of other republicans trying to get known and make a name for themselves. this will be the donald trump show for the foreseeable future and make it hard for any other republican to puncture the advantage. >> approval numbers on job performance on the issue and security under water. 53% disapprove. foreign policy 54%. ukraine and china, right? border security 60%. immigration clearly. economy 64%. that's inflation. on the issues, josh, biden is under water. >> absolutely. there is a lot of vulnerability when it comes to president biden. but i also think there is a sense of deja vu with a lot of republicans if donald trump ends up becoming the republican nominee and is facing the legal jeopardy, the legal exposure he is currently facing, we could have a repeat of 2022 when biden was very vulnerable, democrats

28% say it is a crisis. we get a fresh look at inflation and edward lawrence has that story from the white house as well today. >> this morning the feds look at inflation. the measure came out this morning. it dropped slightly but not where the federal reserve would like it to be. they look at core number without food and inflation and energy prices. core year-over-year. it came down a small amount tying the december number. the newest fox poll shows nine out of ten registered voters are extremely or very concerned about inflation. the federal reserve admits government spending pushed inflation. the president's proposed budget increases that spending. experts say a whole of government approach should be focusing on inflation. >> i think most businesses including restaurants would trade consumer spending coming down a bit for their costs, the cost of commodities and the services they need to run their businesses coming down. these pressures are really

loved color. >> shannon: heartbreaking. to hear those young voices. >> bill: paul mauro, good morning to you. one thing we have not gotten out of nashville is what is inside the manifesto. >> puzzling. >> it seems to have gone over to the f.b.i. i'm skeptical as to where it is not being released. normally when you get something like this, a manifesto it will be a big part of the case. on the west side highway who ran the people over. he had a manifesto. it wasn't released because it was central to the prosecution. in this instance, the perpetrator is dead. so what is this stuff it has to be analyzed by federal authorities first before we can reveal what's in it? sure let federal authorities analyze it. they should. profilers want to look at this. unless somebody looks at that

manifesto and says there were co-could conspirators out there there is no reason to hold onto it. what the tell was. in one of the press conferences the chief of police, nashville police did a bang-up job. let's acknowledge that. i felt like they were almost snatching defeat from a victory. they had done so well and got evasive at the press conference. the chief of police said the day after i have haven't read the manifesto. now come on. of course he head the manifesto. you have to see if there were other activities or perpetrators to be apprehended. the first thing you do is start to scrub the perp to see if there is anything else out there. the idea they didn't look at it be lies belief. >> shannon: police have obligations and burdens on them. what happens when the perp is

dead? >> as soon as you know there were no co-conspirators or not part of an organized group doing something else you have to worry about copycat stuff nationally. you have to worry about that. in the immediate instance in nashville, now a little bit of the pressure is off once you decided she worked alone and now you get meticulous and put analysts on it in the intelligence bureau you have civilian analysts who are brilliant and they will go through all this stuff and detectives will put it all together and say looks like she was in contact with this person who seemed to be of a like mind. let's knock on the door and say hello and say are you thinking about something like this? what was your take on this? you have a little bit more time to be a little more meticulous to do a considered investigation to make sure there are no attendant threats coming from this isolated incident. >> bill: no leaks, either. which is quite remarkable. paul, 30 seconds.
