that's his home in that town. national correspondent bryan llenas, how all of this is playing out right now, bryan. >> trump's lawyers say that manhattan district attorney alvin bragg wanted the former president to be arraigned today. instead his surrender and arraignment will happen early next week likely on tuesday at the manhattan criminal courthouse behind me. once former president trump gets on his plane and arrives in new york city and makes his way to the courthouse we're told there won't be a public arrival or perp walk in front of the cameras. secret service protection on his side we expect trump to be fingerprinted, have his mug shot taken before being brought into a courtroom, told his charges, presumably pleads not guilty and then released on his own recognizance. >> i don't think the secret service would allow a former president to be handcuffed. they have a legal obligation to protect him. i don't think we'll see him in

cuffs. i don't know if they'll do a perp walk. there are various secret back entrances in the courthouse and bring him into court to by pass the cameras. >> the indictment is sealed. trump and lawyers will not know the charges he faces until he is inside of that courtroom at his arraignment. reportedly he is facing dozens of charges related to business fraud. this morning d.a. alvin bragg's office sent a letter declining republican house judiciary chairman jim jordan's request again to testify and provide documents related to trump's indictment writing we urge you to refrain from these inflammatory accusations, withdraw your demand for information, and let the criminal justice process proceed without unlawful political interfere unless. republicans, as we know, are accusing bragg of orchestrating

how does his team fight this effectively? >> thank you for having me. i will tell you exactly what they do. they file a series of pre-trial motions. in this particular case, the underlying charge is a steal misdemeanor. i would be filing pre-trial motions to dismiss these charges. why? because they have passed the statute of limitations, the underlying charge. i would submit that the trump team before this case ever goes to trial, well before that, a series of pre-trial motions to dismiss this case outright. if you don't win you appeal it all the way possible. >> harris: speaking of dismissals, a george washington university law school professor laid out three grounds that trump's attorneys will likely argue for dismissal of the case. leo, i want you to hear these and take us through what you think works best. number one, bragg's case is based upon a faulty legal theory which he used to stretch a

misdemeanor into a felony. two, charges are barred by statutes of limitations what you were just talking about. and number three, a dismissal based upon the argument of prosecutorial misconduct. >> the statute of limitations is the one i would per sue immediately. the last one, selective prosecution. the prosecutor has the right to decide which cases. but they don't have the right to abuse that discretion. i will sit here and tell you after 30 years of practicing law, this case is ripe formal i shallous prosecution, civil lawsuit after it is dismissed. regardless of people's political affiliation or who people will vote for on 2024, everyone should rally around trump on this particular case. this case jeopardizes you and me. if they can use a frivolous case

hide it to censor americans concerned about election integrity and transformed during the pandemic into the viralty project. the number of times fauci said he couldn't recall. another number, this particular piece of censorship was 1 of 66 covid narratives, as they describe it. 66 covid narratives that they silenced and censored and proud to do it. one was about the origin. there were others, for example, about people saying online, for example, that the pharmaceutical companies would benefit financially from a mandated vaccine. whatever you think about the vaccine, this is a perfectly legitimate argument that someone can make. they said no, you can't say that. you can't actually tell the truth about where the virus came from because it is embarrassing

for the man who pushed through the reckless research that now is clearly the most likely origin of the pandemic, anthony fauci. he pushed it through and broke the rules and placed in 2014 the revised rules under the trump administration. he pushed it through because he is so arrogant he ignored all the scientific advice. many scientists saying this gain-of-function research is dangerous and could lead to pandemic. he said we would do it anyway. look at the result. that's why he is stonewalling because he is embarrassed. he knows that he, fauci, wasn't some passive relationship with the wuhan lab. he personally pushed through this research. in 2011, remember, he said that engineering of potentially dangerous virus in the laboratory is a risk worth taking. that's what he thought. he took the risk. and the result was a global pandemic that killed millions. of course he will not try to help anyone trying to get to the

people being taken in russia. >> look, first i think we always need to do a shout-out to our american reporters there and in ukraine doing dangerous work. this is another example. i think it is just a characteristic of the nature of the putin regime. these authoritarian regimes. they'll grab americans when they see it in their advantage. i think it is part of this broader competition and really new era of authoritarian aggression we have with regard to the dictators in moscow, vladimir putin and in beijing, xi. american reporters take risks over in china as well. >> harris: we saw that around the olympics. the warning that people were being locked in rooms and mysterious things happening. do you think our perceived weakness around the world now through some of the foreign policy decisions or lack there of by president biden is making

it unsafe to a greater degree for americans? >> that's an issue. i think reporters have to deal with that. i was recently in the middle east and a number of different countries. the one thing americans -- we haven't forgotten about but on the front of the minds of every leader i met with is the incredible botched withdrawal from afghanistan and what a shock that was to the system of every country in the world that has relied on america. they were telling us you can't believe what a shock that was in terms of relying on you and your loss of credibility. that still reverberates and a big reason why putin moved into ukraine. it impacts where americans go to do work overseas. >> harris: i want to get to this. new fox polling shows 63% of voters feel president biden is being too accommodating in his

dealings with russia. your take. >> the one thing that i think is really important is that when the president talks about these challenges with thor -- authoritarians, we need to be dealing with them from positions of strength. the president -- two examples where we don't do that. the president put forward their defense budget. the third year in a row that this administration puts forward a budget for the department of defense that is inflation-adjusted cuts. it shrinks the armed forces. >> harris: the inflation he is bringing us. the world sees it. >> what they expect. i have heard from administration officials they expect members of the armed services committee to boost it. we've done it every year.
