afternoon. he will not be placed in handcuffs after an agreement struck between alvin bragg and trump attorneys. >> sandra: bryan is live outside the courthouse here in lower manhattan. how is local law enforcement preparing for the arraignment next week? >> sandra, good afternoon. we are told law enforcement, fbi, secret service, new york state, nypd, are meeting at one m -- 1:00 p.m. to discuss logistics before the arraignment on tuesday afternoon. today, a bit of a media circus, barricades as well as nypd officers. we are told every nypd officer citywide has been ordered to be dressed in full uniform and ready to be deployed as soon as they are called. as far as what to expect on

up as our coverage continues here on the fox news channel leading into next week. >> john: looking forward to all that. president biden is calling on russia to release the wall street journal correspondent arrested for espionage in moscow. detention of the american journalist is the first since the cold war and marks another diplomatic flash point for the u.s. and russia. robert o'brien is a former national security adviser to president trump, he will join us on that in just a moment. he's got a long and storied history of getting hostages out of hostile places. begin with greg palkot, and greg, what more do we know about evan gershkovich's status at this point? >> sadly, john, we don't know a whole lot more about his status. he is now in his third day of captivity with russian authorities. 31-year-old american wall street journal reporter was arrested wednesday by the fsb intelligence agency on assignment in a city, 800 miles to the east of moscow.

thursday he was brought to a court where he was charged with espionage, carries up to 20-year sentence and taken away to pretrial detention. it's reported he is now at a prison in moscow. it's a tough one for political prisoners and others, marine veteran paul whalen, also held by the russian, has spent time. the wall street journal denies the charges, condemns the detention and more saying in a strong editorial today, thuggish leaders keep doing thuggish things if they think they will pay no price. biden administration will have to consider diplomatic and political escalation. they suggest vladimir putin's government might have seized gershkovich in response to charges the u.s. has pressed against a russian national just last week, perhaps seeking a prisoner swap or that putin might have been angry about a tough article gershkovich wrote about the russian economy this week. one thing is for sure, john, as the war in ukraine rages,

journalist, a missionary, priest or reporter, don't go to russia. it's too dangerous. they have shown like the iranians, the chinese, they'll take americans hostage and so americans need to pay attention to the state department even if they think they are working for a wall street journal or fox or a big news agency, that's not enough to protect you from vladimir putin. number two, i think putin is probably looking for a prisoner exchange. i assume that's what he wants, and he demonstrated he could get that with britteny griner and so i assume he's trying to set this up for something he wants, whether it's a prisoner exchange or policy concession he believes by taking an american, in this case evan, he may try and claim he's a dual citizen, his parents came from the soviet union. i think he's an american, not born there, but putin said because his parents were russian

he's russian, so less protection. >> how do you send a message to vladimir putin, to russia, this is unacceptable and hold them responsible? >> well, look, what i've said from the start with the ukraine situation and larry kudlow and i talked about this on his show before the invasion, we have to put full sanctions on russia. they are allowed to do oil and gas purchases and sales, allowed to sell commodities and farm products, so we need to up the level of sanctions on the russians because of this action but also because of ukraine. and again, we have to tell our american citizens there's not a lot we can do. russia has nuclear weapons, we can't send a seal team in, he's in a notorious prison in moscow, it's a dangerous place, don't go. >> sandra: we hear from the white house they condemn the action, we'll see what they intend to do next.

many running against donald trump if i were compromise the or not in the race but speaking as an american saying this is a national disaster. we should not live in a country where the party in power uses police power to arrest political opponents and especially in a prosecution that is as politicized as this one. alvin bragg made a campaign promise to investigate trump. he is delivering on a campaign promise. charging something as a felony through an untested legal theory tying it to a federal law he's not responsible for enforcing, an example of politicized persecution through prosecution and the thing i fear as an american, this is about defending the principles of this country, because if they can do it to trump, they can do it to anybody and i think this is dark day, dark moment in american history i'm worried about. >> john: do you think it helps or hurts the campaign? >> i haven't thought about that, but on first principle as an american, yes we all want to run and occupy the white house but

tech founders who signed the letter pointing out the problem but i don't think the solution is for the united states to take steps unless china and others are marching to the same beat, say in the nuclear arms treaties, right answer is not for the united states to do it when china is unwilling to do the same. >> john: one of the big things you've been fighting against in the personal life and central plank of your presidential campaign is wokism. there is the book, "woke inc." some republicans have a difficult time defining wokism. >> wokeness basically says you are in part, race, gender, sexual orientation the day you were born, and either an oppress sore category or oppressed category. agree or not, that's what even the proponents of wokeness would say. i'm against it because i think that's inherently divisive and

massacre in a las vegas music festival that left 60 dead and hundreds more injured. william, what is the possible motive here? >> well you know, that's always been the mystery in this case, why did the 64-year-old gambling addict open up on a field of strangers? based on an interview at the time with a fellow gambler, steven paddock was angry over how the casinos treated him despite his high roller status. paddock opened fire from the 32nd floor of the mandalay bay, randomly shooting concert goers below. they found no evidence he was motivate the by resentment toward the casinos. >> questions of who, what, when, where and how. what we have not been able to answer is why paddock committed this act.

sector, seeing a tremendous increase in activity over the last few months. what's driving this increase? >> it's the ease of crossing our border illegally from canada to the united states. there are huge gaps to do it. when i was assigned to malta, montana, i was patrolling 60 miles of the border by myself and look at swanton, holton, maine, new york, we are doing duties processing the individuals on the southwest border so we have too many agents behind a desk processing paperwork from southwest border illegal crossings. >> the agreement between canada and the united states, up until the last few weeks, dictated that if you tried to cross the border illegally at a point of entry, you could be turned back whether you are entering canada

or entering the you state. but if you crossed in between ports of entry you are turned back. that law has since been tightened up so either at a port of entry or between, caught entering the country illegally, you'll get turned back. you expect that will have much effect on cross border traffic? >> it simply depends on how many people are crossing the border illegally and detected and apprehended. if a tree falls in the forest and nobody is around does it make a sense? and if they are not detected, did they cross illegally? there are way too many people and ways to cross the border into the united states without being detected. we have intelligence that shows that people have been crossing the border for many years without being detected. so, that's the problem that we face. we just don't have the resources and when -- when agents on the canadian border are dealing with the fallout from the southwest

border, that exacerbates the problem. we have to have the proper policies. we can stop the death, stop everything that is happening on the border if we have the proper policy and just don't have that right now. >> john: that whole area up there is wide open, you know, along the st. lawrence river. one side is canada the other side is new york state. and then on toward vermont and new hampshire as well where the separation is greater. but in between quebec and ontario, quebec and upstate new york, just good across the river in a canoe and you can enter either country illegally. we were showing some pictures of the road, illegal border crossing area unmanned and pretty much wide open until the new agreement between the u.s. and canada, they are told if they cross over they'll be

arrested and sent back. cross border illegal immigration in the swanton sector, the bulk from the united states to canada. 40,000 people last year crossed from the u.s. into canada. 3577 people crossed from canada into the united states. any way you look at it, the situation is far different than the southern border where the traffic really is just one way into the united states. >> well, and that's what's so frustrating to every single border patrol agent out there. this treaty came about, we had the long standing treaty at the port of entry, and now they expanded on the treaty to go between the ports of entry. but with you look at this, this is more beneficial to canada than the united states. canada was upset that so many people were crossing into their country illegally they pushed the united states for the treaty. why didn't we push for it a long time ago when it was one way into the united states. we just react all the time and that's what this administration does and that's what's so frustrating to us.
