6:00 pm
>> despite all that that's happening in america the people are still great. enjoy the weekend. >> welcome to andy. right now, it is official. former president donald trump will be arraigned in manhattan on tuesday coming up the president's attorney joe, also laura trump, tulsi gabbard and more on florida governor ron desantis and his move not to
6:01 pm
cooperate with extradition requests. we have new details from alvin braggs political witch hunt. according to sources donald trump turned himself in today after the grand jury vote unfairly to indict him. because of security concerns the arraignment won't be until next week probably tuesday afternoon. donald trump will be booked and fingerprinted. there will be a mug shot. media mob will get their so desired mug shot. my instinct tells me my colleague pete last night is going to be proven correct that photograph will end up on more t-shirts and hats that say maga trump 20 2457bd appear before the judge who by the way the same judge who was accused of railroading the former cfo of
6:02 pm
the trump organization. according to trump, quote the judge assigned to my witch hunt case hates me. at this point, would you expect anything less? this is not a criminal case. this is a political hatchet job. there will be no settlement according to a trump source. he plans to fight it to tend. the first will be a motion to dismiss amen tall charges on three grounds. we will go over this with our attorneys, one in the faulty legal theory. we don't know the exact charges but allegedly what bragg is doing is trying to bootstrap a misdocuments crime to an fec charge that has never been done before and might not be legal. trump's lawyers will argue the case is beyond the zach out of limitations which they are.
6:03 pm
after all there's a two-year limit on charges related to mislabelling documents. third reason for dismissal process key toral misconduct, a d.a. responsible for the charges alvin bragg ran on campaign promise to go after one man, donald trump, one family, the trump family, one organization the trump organization. now i think all that clearly reeks of political bias. don't you? maybe the end result should be that he gets disbarred. as the "new york post" points out. would this case have been brought against any other person? of scores the answer is know. the doj, the fec, the muller investigation bragg's predecessor and bragg declined to bring the charges until to now he rarely brings felony charges against anybody in new york, even violent offenders
6:04 pm
according to and open ed from jonathan turley he said, quote, donald trump would have been better off robbing stormy daniels with a gun. bragg would have thrown that case right now. he's correct. under bragg 52 percent of every felony case gets reduced to misdemeanor and of all the felony cases that bragg actually brings to trial he loses 49 percent of the time. other words he has one of the worst conviction rates in the country. in september a man named justin washington received a sweetheart deal after allegedly rapeing a teenage relative. he was set to serve 30 days in jail but before that terrorizing 5 more victims. look at your screen. another sweetheart deal by bragg to the perpetrator of a vicious anti-semitic beating in midtown manhattan in new york city and trooudz charges for a man who tried to rob the same pharmacy
6:05 pm
in one day at knifepoint. the guy had a lengthy rap sheet more than 20 arrests four for rape robbery assault other crimes, bragg didn't care at all. another case the person freighter had 46 prior arrests out on parole but bragg again reduced the charges and then there's the well new york resident known as hillary rodham clinton never charged with a crime despite a mountain of evidence of misdeeds the clinton campaign and dnc committed the exact same crime that donald trump is accused of. they mislabeled a campaign expense. steal sturdy dossier the russian bought and paid for dossier they said it was a legal expense but there were no felony charges no criminal investigations into clinton. instead last year her campaign merely agreed to pay $113,000
6:06 pm
fine. never find deleted subpoenaed emails. those were destroyed with something we never heard of bleach pit and then we had devices destroyed with hammers and we had sim cards removed as well. doesn't that sound a little like obstruction of justice to you? she was never charged and her home never raided. the dossier case we mentioned stems from the very same dossier that the clinton campaign delivered to james comey before the 2016 election but in early october comey's fbi flew to britain and met with christopher steele and offered him a million dollars if he could corroborate that dossier. even though the steele dossier couldn't be corroborated he didn't collect his million dollars because his allegations
6:07 pm
were completely bs, comey in late october used that dossier contrary to the law and unlawfully obtained a fisa warrant to spy on the tram transition teamed and witt a president of the united states. the top of the fisa warrant the words truth and verified are there. the dossier was neither but the fbi used to it get donald trump. comey said no reasonable prosecutor would ever prosecute but now is cheering for alvin bragg. jim comey is corrupt, petty bu bureaucrat. the current leader of the fbi doesn't seem to be better. christopher wray's fbi was in
6:08 pm
poll says from hunter biden's laptop since 2019. since of authenticating the laptop and investigating the crimes recorded on it the fbi told big tech had in the lead up to the 2020 presidential race to look out for russian disinformation related to people like joe biden and hunter biden. they knew they had the laptop. and big tech by the way was more than happy to oblige and got money from the fbi $3.5 million in the case of twitter censoring if hunter biden laptop story weeks before the election can you count me in the column as somebody that believes the fbi knew this laptop was real. they knew rudy giuliani and copy and would likely release it before the election. my guess that is the real reason the fbi was warning big tech companies to look out for misinformation on people like
6:09 pm
joanne hub had today hunter has yet to be charged with crimes even though there's video of hunter biden smoking crack cocaine. hiring prostitutes. lying on gun applications. assemble access to the federal government. yet, where's that case? there's also extensive evidence from the laptop and separate senate and house investigation showing that the "big guy" and other members of the biden family might have benefited from access pedal, tax evasion money laundering charges and now we know there was quid pro quo, donald trump ukraine, joe biden on tape bragging that ukraine won't get one billion taxpayer dollars unless they fire a prosecutor in six hours. that prosecutor ended up getting fired in six hours and ukraine got your billion dollars taxpayer dollars and guess what, son of a bee when he was fired
6:10 pm
the investigation that prosecutor was going into hunter biden ended right there and then. and hunter kept getting checks from burisma holdings. get this straight. there is digital and video evidence that hunter biden committed multiple felonies but was never charged with a kriemt his father used your taxpayer money to protect the family syndicate. no indictments. on the other hand donald trump is getting hit with over 30 charges because of a mislabeled not disclosure agreement over an legend affair from 2007 that both parties denied based on testimony from a convicted felon admitted hire by the name of michael cohen who we know is hellbent on getting revenge against his former boss? does that seem like equal justice under the law, equal application of our laws to you? of course it doesn't to me. democrats don't seemed to care about justice. they only seem to care about
6:11 pm
winning elections and destroying any and all political opponents. now, this far fetched case against trump is not about keeping new york safe or new yorkers safe. it's about interfering in the 2024 election just like fbi did in 2020 when of course, the hunter lab top from hell that they had since december 2019 just flying 2016 with hillary's dirty dossier beer now entering a very, very dangerous new era in this country where justice is no longer blind, where judges juries d.a.'s have become political weapons where we have a dual justice system. joining us now with the latest, is donald trump's attorney, friend of the program long-time jock tapepena. the president, i agree with him you've tried over a hundred cases in new york. president is believing and i'm believing when you have democrats out numbering
6:12 pm
republicans in new york city, 9-1 he's saying he doesn't think he can get a fair trial. you've tried a hundred cases in new york. do you believe he can or would it be better to get a change of venue? >> look. it would be better to get a change of venue and a lot of things that we will be moving for in our legal papers sean just for the sake of fundamental fairness. that being said you know while i understand the political geographics of new york city new york county, new york jurors are smart and their gritty and even they don't i'll be sure to remind this is not a political election. this is the rule of law being applied across this country and today it's donald trump. tomorrow it could be a democrat. the day after it could be a brother or sister and we have to be careful about saying, oh, he's unpopular, i don't like the way he acts. i'm a very left wing individual so i'm never going to vote to
6:13 pm
acquit donald trump. these jurors have to go home and look at themselves in the mirror. it's not a game it's not a civil case. it's not an election. this is the rule of law being applied. about in we start to decide who woe want to target the rule of law falls. in mind the rule of law in tons of america really fell and it's something i never thought i would saw. your dialogue was amazing, some things we used in some of our papers but jonathan turley's piece was funny. >> waits grace cold up. >> except it's true. that's what's happening in new york. new york, our great city is not the saves place in the world anymore. it's a dangerous place because people are being let off with slaps on the wrist for violent crimes but they put the force of
6:14 pm
their entire office into this case, three years they investigated and come up with a non-crime they're trying to criminalize on a federal statute they clearly don't understand the fec has come back and said there's no offense here no violation not even close of campaign finance laws and one day they're going to have to answer for this charge and decision. >> let me ask you this. there are a number of legal grounds. you're going to make a motion i think for change of venue, other motions to dismiss. walk us through the three that i've been focusing on. would you argue it's based upon what i would call faulty legal theory bragg is arguing that a mere misrepresentation, when you misrepresent something on a government document in other words recording a payment of money as a legal expense which by the way hillary clinton did herself is by itself criminal and it becomes a felony simply because the purpose may have
6:15 pm
been to violate a federal not a state campaign statute. that's never happened before. i'm sure you're going to argue that the charges are barred by the statute of limitations and i think you will also argue and seek a dismissal based upon the argument of prosecutorial misconduct and selective prosecution because going after one man one company one family. >> i'm going to ask them to show me another case where this has ever been done because it's nevada bun done. by the way sean you said something that's not accurate but is important. you said filing a government document. that's the point. nothing was filed here. had donald trump tried to assert a tax deduction. >> by the way, you are right. you're right in your correction. i agree with you. i misstated that. >> it's important. there was a document they're
6:16 pm
saying, well false business records, they're his own personal records and they weren't false. they were in fact legal fees. that's how they were billed. but assuming they were false, purchase of 10 gallons of ice cream because joe biden likes ice cream it's still not a false record as a crime because there was no filing obligation. they didn't go to irs and seek and deduction. they didn't file this with the fec because they didn't have to. this wasn't a campaign exclusive campaign expenditure. this was something that would have been made irrespective of the campaign so there was no file made and where is it a false business record in his own records? in his own personal files? that's the keep point here. had he used campaign funds because they're saying now this was something that should have fallen under the fec this was a campaign finance violation also had he used campaign funds they
6:17 pm
would be baying for hi scalp saying he used campaign funds personal expenditure so your damned if you do and don't. that's why this prosecution is rot tone the corp and weaponization of our criminal system which is in full effect and now you're seeing calls for biden's prosecution. >> it's going to happen. >> this is where we are going. from now on justice will be used by whoever is in office republican or democratic prosecutors going back to political opponents. now we are harking back to days of communist china soviet russia and nazi germany. hear we are. >> on tuesday the president will be arraigned. we expect a mug shot. we expect the president will have his fingerprints.
6:18 pm
what is he going perp walked in handcuffs? are they had going to try and say he can't have bail? >> i don't think anything dramatic like that is going to happen. even if they tried to that would further solidify the notion he is being so selectively targeted and treated differently. you can smack a police officer in times square knock him out hul be out on bail. are they going to ask bail on a misdemeanor case? >> they don't have the last name trump. >> of course not. here's the thing. we don't really know what's going to happen tuesday because lodge igs particularly this has never happened. we have the secret service involved in ana arrangement. when have you seen that before? never. >> you have not worked out all those details yet as of this point? >> they're not worked out yet. we have some ideas but no, nothing is worked out yet. >> all right. joed takapena thank you. we will be checking in with you next week.
6:19 pm
mere with more is the host of the rye view podcast laura trump back with us, good to talk with you. let me ask you what i was asking joe, your father in law the former president on tuesday will be fingerprinted get a mug shot, maybe handcuffs, maybe perp walked and have to make a plea in a court of law. this has never happened in american history. this is same guy that went through -- well, you lived through it all since moment he came down that escalator at trump tower and the mueller investigation russia, russia, one impeachment another impeachment it never seems to end. >> it never seems to end. you read out some greatest hits of the democrats and the truth is, we all know what this is about, sean. these third rate third world communist tactics they're employing is not just to
6:20 pm
prosecute donald trump. it is to persecute donald trump because you said it. from the moment an outsider dared come down that escalator in trump tower and announce he was running for president without the help of the lobbyist, without the help. special interest groups and the establishment he became their enemy number 1 and they are petrified that donald trump is going to end up back in the white house so instead of letting the people of this country vote and actually decide on it they decided to take matters into their own hands here. we obviously crossed a line yesterday in the united states of america and we can never come back from that. things will never be the same as they have been since the inception of america starting yesterday. you and joe were just talking about it. it is so dangerous, the precedent that was set here and it is all over the hatred of one man. if can you weaponize the united states judicial system against
6:21 pm
your political oh poerngts we are no better than communist china, than cuba than communist russia, than north korea, quite frankly and i got to say, alvin bragg ought to be ashamed of himself. >> he has no shame. >> i left new york state because it's so bad there. when he is letting criminals run free downgrading felonies to misdemeanors and this is where the taxpayer money in new york city is going, it's an absolute disgrace. >> so my friend my colleague i mentioned pete on last night talked about what the left has wanted for so long. that is a mug shot. and he predicted that that mug shot is going to be on more hats more t-shirts than anyone will ever imagine and i believe you're probably going to see maybe on the back will s say "maga" and maybe "trump 2024" and that will be the mug
6:22 pm
shot but will that boomerang, in your view? >> i think all of this will backfire. here's may can tell you. in the 24 hours post indictment the trump campaign raised $4 million, a quarter of the donors were first-time donors to the trump campaign because sean people look at this and they see it very clearly, the american people are very smart and very savvy and despite what the democrats and the mainstream media have tried to do by poisoning paul of us they see this for what it is and they know that there is one person who will go into that white house and fight for the american people. one person able to expose the swamp. one man and his name is donald trump and they can try anything they want. their goal is to get him to drop out and stop. i can guarantee you right here right now tonight that, day will never come. he will move on. he will go forward and i predict he will be our 47th president. >> i will tell if you my last
6:23 pm
name were trump i would be very angry at what is had a very clear double standard. for example one standard of justice for the trumps but another one for the bidens for the clinton's jim comey the deep state. do you find that frustrating? because i think that would frustrate me. >> it's really frustrating. are you kidding me? as one of us as little as jay walked they would lock us up and throw away the the key. they comb through 11 million documents from the trump organization involving my father in law them couldn't come up with anything. yet you got a treasure trove of evidence with hunter biden's laptop evidence that the bidens have used the position of joe biden as senator as vice-president at least to enrich their family. you talk about hillary clinton and the clinton campaign and how they actually committed the crime that my father in law is
6:24 pm
accused of doing here they got a slap on the wrist. but what about the 10s of millions of taxpayer dollars that went into the russia collusion hoax balls of that dossier? what about the two years of our lives that none of us in america will ever get back because of that? who pays for that? it is very frustrating as a member of our family but sean we are all used to it at this point. this is how it goes if your last name is trump. >> let me ask you about that. >> we know we are fighting for the right side of history. >> i have known the entire family for a long, long time since i've known the president long before he ever thought about running for president and i know all of you are strong. i had don, jr. on radio today, eric your hushs last night on the show i know all of you. i know the entire family and you're all strong but at some point do you begin to get to the point, why not play golf every day? i'd say enough is enough of
6:25 pm
this. obviously half the country is insane and they want to criminalize political differences. it's got to be frustrating as hell, no matter how strong you may be and by the way, how is the whole family holding up and have you talked to the president? >> i have. i saw him today. i took my kids to see him actually after i picked them up from school. i got to tell you he was in great spirits. i have never met someone who could take as much as donald trump. you would be hard pressed sean to find anyone anywhere who has given up as much in current time as donald trump has for this country. he said it in an opera interview in the 80s he would run if he felt he had no other choice and he felt he had no other choice in 2016. he was willing to give it all up. man has he given up a lot at this point and still willing to fight on, he is still willing to take the arrows to, take whatever comes his way because i
6:26 pm
think he truly negotiation that he is just about the only person who can turn this country back around, who can bring us back to the great america that we once were, but yes it gets frustrating. yes it gets tiresome but for all of us in our family i can't tell when you people come up to us and saying we are playing for you, we are praying for your family your father in law nothing means more to us. we feel i. i think everyone in this country feels it's not just about republican and democrat. this is good vs. evil. there is speier at all warfare going on right now. there is one man up above us leading all of us, and that's who we are looking to. so whenever it gets tough we think about what we are fighting for and continue on. >> god is in charge. harrah a trump thank you for being with us and fox news alert at mar-a-lago in palm beep,
6:27 pm
florida keeping an eye on any movement of the former president. nothing so far. we know the president's plans to return to new york in coming days and alvin bragg's indictment of donald trump is so political teen department of justice worry he went too far reportedly fearing he may have ruined their own trump witch hunt with their bogus charges. some of the other hosts at msdnc including number one psycho conspiracy theorist rachel mad ddo. >> this is as questionable fact. only the grand jury knows this
6:28 pm
is a sealed indictment. he's making a statement something he doesn't nope the answer to and throwing out dog whistles. historically this miami this idea among the right that african-americans that black folks who are folks in positions are controlled, by some jewish oversear who is pull their strings. that's what that statement reads like. saying that the legal process for extraditing somebody from one state to another is something that will not be followed. that could break us. if anything it's the first proverbial shot at fort superintendent terry fired not by donald trump but bit ron desantis. >> here now the author of the upcoming book trial of the century fox news lehmann list greg jarrett and author of the new best selling book get trump how appropriate, harvard law professor alan dershowitz is
6:29 pm
with us. let me go through the grounds i discussed with joe takapena. professor, they'll argue this is based on faulty legal theory. secondsly they'll argue about the statute of limitations and most importantly perhaps held the seek a dismissal based on the argument of prosecutorial misconduct and selective prosecution. those are arguments you have made. i think all three of them are strong and there's a strong case you should have a change of venue because i don't think new york is going to be fair to donald trump. >> that's right but before we get to that i want to mention president trump called me a couple days ago to thank me for writing get trump and be -- and
6:30 pm
he asked me for advice. one piece of advice buy stock in a t-shirt company that can put your mug shot on as a logo and that t-shirt will be more popular since frank sinatras mug shot. >> i think you will agree with me when they get a mug shot there will be t-shirts and habits and probably say trump 2024 and on the back say maga. >> there's no doubt about that. he will use this to his advantage. look. i think you got it absolutely right what the grounds will be but i don't think you have the order correct. i think the order will be first a dismiss an on the statute of limitations. that's jurisdictional issue and that's been ana peopleable issue if he loses.
6:31 pm
second, there will be a motion for change of venue, again appealable if he loses. the last the much harder ones to make not appealable are dismissal on the grounds of selective prosecution and dismissal on the grounds that the statute does not actually cover this conduct and you can't stretch these two statutes, so i think good lawyers, and these are good lawyers, will first make motions that if they lose are appealable so they can take them right up to the court after peels and get the court of had a peels to throw the entire thing out,chy think there's a substantial chance will occur. >> greg let me ask about the motion to dismiss and the statute of limitations prosecutorial misconduct selective prosecution and my original argument i made that in fact you have made in numerous columns now that this is the first time anybody has even attempted to make a charge this way in this particular case
6:32 pm
using a state law and then marrying it to a federal election law. >> yes. you know, i wrote a column outlining all of those things on fox this morning. you know, i agree with the professor. i think the biggest hurdle will be the statute of limitations which bars going forward with this case. in terms of selective prosecution, it's an interesting point. it's usually a defense at the trial, but it's not a defense on the merit of the charges but rather , it's an effort by the defendant to shift focus on the prosecution and their motivations and here we all recognize what the motivations any sentient person does of alvin bragg because he made it clear when he ran for office he vowed he was going to go after
6:33 pm
trump with a vengeance and prosecute him. keep in mind this is a guy who had no access to the files. he had no no knowledge of any of the relevant evidence. yet, here pre-judged a case and pre-ordained the outcome with respect to a grand jury. then he went about engineering his convoluted legal theory by con for theing the laud and twisting the facts. i do think as i wrote in my column there will be several motions one will be that the law simply doesn't support the charge and under no view of the fact does it support the law so i think that will be one of many motions filed and if a perfect world with an honest objective neutral fair judge you know this judge has to look at knows motions quite seriously because
6:34 pm
no trial court jaujts to be overturned embarrassingly on appeal. >> let me ask you both about governor desantis saying number 1 this is unamerican but also, professor he's saying that he won't help with extradition. i think he had made the right call. i was glad that he did that. i know they've been kind of battling a little bit. maybe this might bring harmony between them. we will see but i thought that was the right call by the governor and i'm glad he made it. >> it's a hard argument to make against extradition, because there are constitutional proposal visions for extradition. it's moot of course, because the president, president trump voluntarily will go but i think the key argument here, again has to be trump would never ever have been prosecuted for any of this no mat ware -- matter what
6:35 pm
the indictment said. the title of my book is not original. i'm not an original title maker. it was campaign of latisha james and the district attorney. they ran on that campaign. it is unethical in my view for a prosecutor to run on a campaign promise to get somebody before they know the evidence. even the bible says to prosecutors do not recognize faces. do not focus on people and then find the crimes. that's what stalin did. that's what dictators do all over the world. you look to the crime. there are leaks in the grand jury. that's a five-year felony. is he investigating it? i don't know. he doesn't seem to be. here there's a crime. we have to know who committed it. bragg is saying i'm going to find something against trump and even if i don't find it, i'm
6:36 pm
going to create, and that's what he did. he took would be misstatutes utterly inapplicable because it says everybody who pays hush money has to disclose it. nobody has ever done that in history or indicted for not doing it and then marrying to a federal statute. the worst abuse of prosecutorial discretion i've seen in 60 years of practice of criminal law. maybe indictment will show something i don't know about and i apologize but based on everything i know this is the worst example of prosecutorial abuse. >> i talk about the conspiracy theorist the head among them rain el maddow they seem to be want to focus on the extradition and joy says the governor does not know the facts.
6:37 pm
the only granl knows them. it's a sealed indocument and lash out at desantis saying this quote idea among the right that african-americans that black folks in positions are controlled by some jewish oversear who is pulling their strings. that's what that statement read like. okay. can you decipher that for me? that sounds nuts. >> no, you can't make sense out of nonsense sean. it's no surprise joy reed's intelligible comments she is consistently obtuse. she had sees everything had a happens in the world through the lens of racism. he's become an inveterate race baiter but that is the kind of garage that she spews and others consistently over at msnbc only
6:38 pm
to be outdone by the hosts on the view when news of the indictment was revealed, they acted like giddy kids in a candy store, salivating over a potential mug shot of donald trump. and by the way, as to the extradition, it's a none issue here. trump sees this case for what it is, incredibly weak and a non-crime and is going to face it head on with his legal team and fight it and you've got to give credit instead of running and hiding. >> professor i got to roll. thank you both as always. lot more coming up on this busy friday news night. they can't help themselves. wait until you hear and see bizarre reactions to the trump indictment. we check with tulsi gabbard when

>> so, democrats friends in the media mob are always preaching about justice but their reaction to the presume indictment makes it pretty obvious that it is all a charade. former house speaker nancy pelosi tweeted that donald trump has the right to prove his innocence at a trial. nancy, trump is innocent until proven guilty. now even the president of el salvador says it will be very hard for america try to condemn political persecution in other countries. fox news contributor tulsi gabbard is with us and you were in the caucus with nancy pelosi when she was leader. right? >> yes. >> correct me if i'm wrong.
6:44 pm
maybe she went to one of the thousands of failing public schools in the country and maybe actually believes what she said, and that is that everyone has the right to a trial to prove their innocence. for some reason my school said you're innocent until proven guilty. you tell me. you were a congresswoman. >> sean, you are not wrong about this one. there's so many things that are concerning about. you look at nancy pelosi who represents the democrat establishment in washington and we are not surprised they are totally fine with abusing they're power, abusing their position, whether in her case it's to enrich herself through insider trading and making lot of money based on the job that she happened to have or enriching the political party weaponizing law enforcement agencies, national security state just to advance their political interests and they don't discriminate on who their targets are who the political

what did he do? he went out and kicked hillary clinton's ass and joe biden is not going to be run a weekend at bernie's part 2 campaign because covid is gone now. they can't hide him in his basement. he can barely walk. you think he's going to stand on a stage after four years of incompetence and be able to beat donald trump or any nominee in debate? i don't think the so. i think democrats are in trouble and what they are doing is lifting up donald trump and uniting everybody behind him right now and they're creating a collosus that is going to sweep over us. as much celebration as there was, can you emergency? the rending of garrs. >> you have not send pam the let's goatee shirts.
