joining us now david former trump impeachment lawyer and saul former independent counsel and assistant us attorney. jim representing trump in a different case said today he expects to see pretrial motions to dismiss in a matter of days. that would be expect asked at this point, yes? >> certainly pretrial motions. i don't know about a matter of days but there's a number of issues here. i think something that really highlights how chilling this thing ought to be to every american citizen, i went back and pulled some of alvin bragg's campaign slogans and speeches and so on. can you imagine, this is what he said in january of 2021. whoever has this job, are they going to convict donald trump? i have the most experience with donald trump. it is unheard of, not to mention completely unethical, for a prosecutor to target an american citizen in order to gain an election, and then indict that american citizen by crafting

together a convoluted criminal charge. it should be chilling to every single american. there will be plenty of pretrial motions to dismiss. >> laura: i mean, saul another issue i know you're hot on is whether they were actually required to seal the announcement or publicly announce it under new york law. >> yeah, i asked that today. i asked that, my number one authority on new york state criminal law scott greenfield who writes the simple justice blog, is that a requirement of new york law to seal an indictment and is it a requirement, if you seal it, to announce it publicly. and it absolutely is not. and it has to make you wonder, since that wasn't necessary, and the whole timing of this where they do it under seal and then they announce it and nobody gets to see what it is in a few days, is not normal. that's not the way a normal

straight-shooting, non-partisan prosecutor's office should act. and so i think it makes me wonder. >> laura: well, david, it seems like this is an attempt at even more drama in a situation that is unprecedented. i mean, we don't need more drama but it seems like that's what the da's office is really pushing here. you know, drag this out, don't announce the indictment but tease the indictment. it's like a production like that we would do in television not so much the normal course of the way these things normally pro as sol just said. >> absolutely. this is the kind of thing that's done when there there's a fugitive out there. they pulled this in the bannon case also. there was one other corporate defendant, we build the wall, it doesn't even exist. it barely exists anymore and they sealed the indictment until a few more before the arraignment. there was absolutely no need for it they never justified it. it's just more gamesmanship. >> laura: sol michael cohen's

attorney was on cnn with new spin. >> the prosecutor said publicly it is a such a serious crime it requires democracy because the american people were not aware of somebody paying hush money. michael cohen went to jail in in case but now we have to look at donald trump. >> laura: sol are those aggravating factors is writing them into the statute? what he is talking about? >> well, i'm aggravated by him. and he really -- and he knows nothing about criminal law, federal or state. the key is, the really key here, i've said it before, i'll say it again. this is an extremely novel application of the state faults records, faults injuries and records statute. it has never been tested in a new york court of law, never. this particular application, where you are saying it is a

felony, because normally it's a misdemeanor, it is a felony because the defendant had the motive to commit another crime. what's that other crime? a violation of federal campaign finance law that, contrary to what mr. davis said the federal government decided they could not indict donald trump for and one reason they couldn't indict him for it is because none of these were campaign if you understand that were used to pay ms. daniels if she was indeed paid. >> laura: another thing david is the concern raised by some who actually support president trump that he's saying too much. like, i was a white collar criminal defense attorney in my day. you didn't want your client to speak to the press generally. not a good idea. okay? well he's obviously speaking out a lot, including trashing the judge in the case. which, if i were his lawyer i would say that's not a good idea. are you concerned about that?

>> you know, listen. >> donald trump is donald trump. he speaks his mind. he has every right to. i don't like when he or mr. tacapina discuss a substantive theory of defense because first we haven't seen the indictment and there may be some business related things in it but i don't like the lock in in position. as for the judge you raise an interesting point, if it is indeed judge merchant that's another pretrial motion no recuse. he was the judge in the trump organization case in the bannon case and now in the trump case. there's an historic practice in this da's office, this da's office alone of hand picking a judge, judge shopping to supervise a grand jury because that judge then stays on the case for the trial. they swore several years ago in federal court that they no longer engaged in that practice. the practice was challenged in state court and they lost but in federal court they suggested it could be a constitutional

district attorney. alvin bragg on his day one memo said that he wasn't going to enforce all sorts ever crimes across the board and other offenses he would treat as lesser included offenses. we see with eroded law enforcement, it's the agenda, the defund the police agenda and all the different prongs of it that george soros is behind with the da races across the country including this year. that's what people are attacking on the merits. nothing to do with had his religion. >> laura: now, jason, bragg's office responded to house republicans in a letter today writing that you and many of your colleagues have chosen to collaborate with mr. trump's efforts to vilify and denigrate the integrity of elected state prosecutors and state judges. we urge you to let the criminal justice proceed without unlawful political interference. now, jason as former oversight chair your reaction to this? i guess you never can say anything about an ongoing judicial process. no comment whatsoever. >> yeah, you know, hands off. and, of course, that works both

ways, right, laura? it always works that way with the democrats. come on, look, i was a chairman of the oversight committee which was founded in 1814. you can investigate anything at any time. you can do it to inform legislation, look at where federal money's being sent and you can certainly do it when you believe there might be election interference. so what congressman jim jordan, the chairman of judiciary is doing, and comer and the others is exactly legitimate. there is no reason why they can't do this. and all these excuses, the democrats will come up with, there's an ongoing investigation, oh, there's a prosecution, or there's all these things, that didn't slow them down on january 6th did it? it didn't slow anybody down after 9/11 and it should no slow them down in this case. he should come to congress and testify and there should be a paperwork trail between his office, the white house, and any democratic operatives. that is fair game for congress

and the american people deserve to know it. >> laura: i have to ask the question of mike here about the makeup of this office in the new york da's group. what do we need to know about them as a whole? because there's a big effort to say, oh, well, you're attacking these brave men and women who are just public servants. you're viciously attacking them. so to that you say? >> well, i think that you have to look at these prosecutors in the manhattan da's office for potential bias including, i understand that they hired someone from the biden justice department to come help sorrows funded manhattan da alvin bragg. if you look at alvin bragg's twitter account his personal and manhattan da twitter account they're showing his obvious bias they're out to get trump. he ran campaign commercials on this. and to say congress can't look into this is silly. congress has a responsibility under section five of the 14th

amendment to make sure we have equal justice and due process in the states in this country. that is clearly a legislative function. also federal if you understand go from the justice department to the state of new york and the manhattan da's office. also is there any collusion from the biden justice department and the manhattan da they're using a federal election law statute apparently as the predicate to bring this bogus new york felony indictment. so this is all within congress's oversight purview. >> laura: again holding back the document itself so we don't know quite what's in the document, that in and of itself raises a lot of eyebrows. lee, i noticed order the cover of today's, front page of today's wall street journal, it presented kind of a chilling image. and, on the one hand that the story trump indicted over hush money and the other story, you see there on the right, talking about the u.s. condemning russia's arrest of a wall street

journal reporter. of course we all condemn that. but is there any irony in that lee? trying to put in jail your chief political opponent, putting in jail a reporter who's writing critical pieces about your administration. anyone else notice that? >> oh, yes, absolutely. and in this case, you have an endity -- and we are he not talking about the federal election commission taking action or the department of justice taking action. we're talking about a highly partisan district attorney in the borough of new york county trying to lock up a former president who is also right now in the lead to get the nomination of the republican party. as a new yorker and i've been an attorney 19 years, i'm not even aware, i can't think of any case where a county district attorney in this state has ever prosecuted a federal campaign finance charge at all. and alvin bragg said before he even took office that this was going to be his highest priority, he was going to be

bombshell tonight. your reaction? >> i'm glad that you're putting the truth out there, laura. you know, from what i've observed, there is absolutely a dual standard that exists within the justice system and, let's be clear, the fbi has been caught multiple times not acting in good faith on behalf of the american people or law enforcement. if i can segue into real quick what i saw at the dc jail when i went there to checks on some of these j6 prisoners they're, one not being treated the same as the other inmates and if i could share quickly for those who may not know, i was told by two separate j6 prisoners that they were actually basically threatened to be raped one by a gate guard and another by a fellow inmate and that yet they've been doing nothing about this. so this is really disgusting. but the fact is is that, from the beginning it seems as though there is a narrative that the left is really trying to push, and that is that, if you are conservative, if you are republican, that you are an enemy of the state, and it's

time to legislatures together against this injustice. >> laura: you also had two democrats join you at the facility where these j6 defendants are being held. here's what one had to say about it. >> we were supposed to talk about or review how bad the conditions were. if anything, i have never seen a jail that afforded so many privileges to anyone. it's still prison, so prison is never going to be the ritz-carlton. are they living in inhumane situations or not and i can tell you there is noggin humane about this. >> laura: your response to congresswoman crockett. >> you know congresswoman crockett actually sits on house oversight with me and what i was actually told by the inmates is that, about a week prior to us visiting that not only did they completely clean the facility, but some of those inmates were not even given access to the other programs that exist that they had tablets taken away from them and also some of the inmates were not able to receive

information from their attorneys via letters. so to say that these conditions were good is actually a gross misrepresentation of what we actually saw. and i guess my question to her would be, i know that she has extensive experience within the legal field but when you have inmates telling you they had a guard threaten to rape them, is that considered fair treatment. >> laura: one thing we also know is democrats used to be against solitary confinement. they used to call it cruel and unusual punishment, congresswoman, just the existence of it, but that so called shaman, the qanon sha man who's going released to a half way house, he was in solitary confinement for ten months. nonviolent. he was nonviolent. ten months? where the democrats about human rights? where are they now? >> nowhere to be found. this is not the first time we've really heard them fall on their own sword against the falls
