rachel: we begin the hour with a fox weather alert. the number of dead from the tornadoeses and severe storms slamming the midwest and the south rising to at least 10. will: the damage is cats pick, tornadoes -- catastrophic, tornadoes flattening homes, downing trees. pete: max gorden is live in little rock, arkansas, with the latest. st tragic to the hear, it's now up to 10. >> reporter: yeah. it's just horrible to see this death toll rising. you've, we've been seeing

neighbors wandering around this neighborhood that was so so hard hit, really just in disbelief. they can't believe what has happened to the place that they call home. you can see behind me trees uprooted, the roofs of houses that have been torn apart. and over here you can see this power pole snapped into multiple pieces, just incredible behind this power pole you can see the wall of this garage torn apart. all the con ends inside visible -- [audio difficulty] on the street to see. now, this tornado hit around 2:30 in the afternoon. even the national weather service's little rock office had to shelter in place so that they could be safe. they had to change over the duties to the memphis office while they took shelter, essentially. you know, after the tornado hit, there were, you know, first responders out in the streets, you know, rescuing folks, just a harrowing scene here in little

rock. arkansas' governor, sarah huckabee sanders, declaring a state of emergency here. she is expected to visit the hard-hit areas here in arkansas later on. but just for so many people lives completely torn apart after this tornado ripped through this neighborhood. really a lot of lives, it'll take a while to rebuild. rachel: thank you, max. pete: if all right. starting this hour with yet another fox news alert as well, former president donald trump expected to make his way to new york monday before his arraignment which is expected to happen on tuesday. will: but he won't be many in new york for long, reportedly, after answering charges for the criminal complaint. rachel: jonathan serrie is live from mar-a-lago. >> reporter: small groups of protesters most of hem in support of the president have been gathering on this causeway just outside the mar-a-lago

estate that you see behind me in palm beach, florida. the former president is expected to leave his florida estate on monday, overnight at trump tower in new york and appear in court on use. a source els fox news he will not be handcuffed during the process based on an agreement with the district attorney's office. he is expected to return directly to mar-a-lago after the arraignment. >> i'm going to be with him. wherever he decides to go, i'll go. and, of course, with the detail, secret service detail and lawyers, but i don't know where we're going. i don't know if we're coming in front door, back door, through the roof, i mean, i really have no idea. [laughter] i'm just going to be sort of following the guys with the microphones in their ears and the black students on. >> reporter: the indictment remains under seal; however, the former president reportedly faces more than 30 counts at this arraignment, and sources tell "the new york post" at least one of those counts involves a felony charge of falsifying business records in connection with hush money

allegedly paid to porn star somemy daniels. this type of -- stormy daniels. this would be considered a low-level felony and carry a maximum prison sentence of four years although the post reports a conviction with could also lead to probation without incarceration. on his truth social platform, the former president writes. the radical democrats have lied, cheated and stolen in their ma niall obsession to get trump, but now they've gone too far, indicting a totally the innocent man in blatant the election interference. how much more are american patriots expected to take? and and axios reports that the former president is shoring up a wall of support in the house, now endorsed by 37 house republicans including more than a third of gop representatives on both the judiciary and oversight committees, two committees that he has been pushing to investigate both president biden and the manhattan district attorney. back to you guys. will: thanks, jonathan.

rachel: well, let's bring in eric trump, the son of former president trump and executive vice president of the trump organization. eric, good morning, welcome to "fox & friends." just give us your take on what's been going on. this must be so i tumultuous in your family, and it must feel like just a lot of injustice. >> listen, rachel, we're pretty work-hardened at this point, right? we've been attacked from moment number one. i'll never forget when hillary called to concealed to my father, i was right there -- concede is. and it was within minutes "the washington post" comes out and says this is when the impeachment of donald trump begin cans, right? this is ten minutes after hillary called to concede. guys, this was the plan the entire time. they're not bashful about it. they've admitted it. al have you been bragg is out there -- alvin bragg is out there on tv saying i've gone after trump a hundred times, i went after his administration, his family. you have other prosecutors in new york, leety shah james, i'm going to the sue the hell out of

him. this isn't after the fact when hay knew something or thought they knew something, this was during the campaign where they're not actually sitting in the seat, where they have no inside information, where they have no relevant facts x. they campaigned and fundraised off of going after my father and taking him down. now, you guys live in new york, i used to live in new york. i know that city very, very well. i go back to new york and i said this other night, you literally can't walk into a duane reade and buy advil because everything's locked up behind plastic because there's so much looting and crime. homelessness is through the roof. you know, little girls are getting shot in times square, women are being thrown in front of subway trains, and this has been the priority of the manhattan d.a.'s office for six years, is going after donald trump. and they went through 11 million corporate documents, 11 million documents, they didn't find a damn thing. and so on the eve of my father, you know, obviously just running for president, just announcing his candidacy again when he's up

by 35% in the polls, this is how they take him out? guys, this is a coordinated effort between attorney generals, district attorneys from various different states. hay couldn't get him through the executive branch. hay tried damn hard. we all know that. we saw that with impeachment one and two and all the other hoaxes. so they turned to the state level. they turned to these weaponized prosecutors funded by george soros to go after him and his family, and it's a disgrace to this country. pete: eric, you guys have fought back from minute one, how do you continue to fight back now? what do next weeks look like for your father and your family? >> well, we fight, will. i mean, that's what we co-- pete. we go out there and fight. that's what we've had to do since the moment he came down that escalator. we've cone it as a family, we've been incredibly successful. they wanted to throw him behind bars, you saw that with this russia hoax. remember, i was the guy that got the phone calls, do you have secret servers connected to the kremlin in the basement of trump

tower. i started laughing, we're mainly cloud-based computing, we don't keep servers in a basement because with basements flood, what kind of nonsense is this? they pursued that for three years and, guess what? we had to go out and fight, and we came on these shows and fought and made the american people understand this whole thing was a sham. the problem with the democrats is they always dill dig so deep that they end up finding themselves, and that's exactly what's going to happen here. [laughter] americans are sick and tired of a two-tiered system. if i was hunter biden, i'd be in jail. if you go on my laptop, you'll find pictures of laura, my kids, there's going to be no hookers, no cocaine, no illegal drugs. it's going to be the nice pictures obviously my two beautiful, young children, yet i'm the guy that they're coming after while hunter biden sells finger paintings, you know, for $500,000 to random people all over the world -- rachel: they raided barron's bedroom, and they still haven't gone into hunter's.

>> yeah. think about that. a beautiful 15-year-old kid who adores soccer, they raided his sock drawer. yet a guy who has laptops, i mean, guys, the question i want to ask everybody, the whole nation, is what product was the bidens selling? you know what we do, right? we've been in the hotel world for a hundred years, we've been in the golf business, we have commercial real estate, residential, retail, a bunch of other things, properties like mar-a-lago. what product was he selling that china is writing him a check for a million dollars? we all know the answer to that,st it's kind of a rhetorical question, but, guys, it's influence, and everybody knows it. that's why hunter's taking air force two with his father overseas. he doesn't know a damn thing about oil and gas. what does he know about ukraine? he doesn't speak the language, but yet he's sitting on all these boards? and again, they're raiding barron's closet, a beautiful 15-year-old kid in high school, and not doing a damn thing about hunter. people are sick and tired of this this two-tiered system of

justice, and people in this country understand it. i was on a commercial flight when this indictment broke, people were coming up to me, giving me hugs. the support is unbelievable out there because people understand that we've literally become a banana republic. they made a mockery out of our legal system in this country. will: we've talked about what happens next for your mauer, what type -- can for your father, what type of legal process begins tuesday. i'm curious about your -- i think we have some insight about your father's belief about a prospect of a fair trial in new york. he said last night on truth social the judge assigned to my witch hunt case, a case that has never been charged before, hates me. his name is juan manuel marshaun. the same person who railroaded my 75-year-old former ceo into taking a plea, pled guilty even if you're not, 90 days, fight us in court, 10 years, life in jail. he means life because he's9 -- 90. he strong armed alan which the

judge is not allowed to do and deleted my -- treated my companies which didn't plea viciously. it sounds like there's no expectation for a fair trial when it comes to any of these pretrial motions or whatever may happen in front of this judge. >> alan's a good man. i know allen incredibly well, and literally they told allen, you tell us anything about trump, give us anything, give us any little bit of dirt that leads to a conviction of trump, and you're gone. guys, that's all this is. they put a 75-year-old man in jail because he said that, you know, he wasn't going to cooperate because there was nothing to cooperate with. but that's been their game plan. they've gone after so many people. just go through the list. not just allen weiseling berg, right? they've gone through all of us, they've tried to get to all of us, they went to allen. look at general flynn, look how they tried to destroy his life. look what they did to manafort. just go through the list of lawyers that they've attacked, of, you know, of, you know,

campaign individuals that they have attacked. they've taken 24, 25-year-old interns, you know, in the white house, and they literally bankrupted them because they go after them, they send them subpoenas, they need to get legal representation. i mean, this is game that they play. and that's why this, guys, is a coordinated effort. they attack everybody in the inner circle because they think it benefits them, and they also throw lawsuits from every direction, right? they're trying to overwhelm a guy and, you know what? if you didn't have a guy like donald trump who had the backbone and conviction and strength and, frankly, guys, financial resources. my father's the greatest fighter i've ever seen. i've never had more respect for the man a than i do right now, but this is the game the democrats play in order to try to win elections. they're absolutely vicious, and i've lived on the front line of it for the last six years. pete: no doubt you have. i can hear the passion in your voice. but it seems republicans, for the most part, have closed ranks. you've raised $4 million in the last day after the indictment. your father's, the campaign put

out a long list, a statement of congressional members, house and senate, that are supportive of former president trump. do you think this has an inverse effect? does it not ingratiate people more in his willingness to fightsome. >> oh, there's no question, pete. people are pissed off right now, i mean, they are. and they realize what's happening. it's why certain people, i won't mention names, but when they were very late to show up to the party, it makes you realize how naive they are to the actual system out there. this will happen to every single republican. change the name donald trump to whoever's sitting in that number one seat, and you better believe that their family and friends are going to get attacked and hair cabinet nebs are going to get attacked -- members are going to get attacked. and they're going to be the sland orerred, smeared, their going to try to impeach them. they weaponize the legal system. they've literally weaponized every institution that we have in this country, they just have. whether it be the military, the doj, whether it be, you know, the fbi, big pharma, you know,

media, social media, censorship. that's their playbook. schools, higher education, lower education. guys, that's their playbook. they weaponize everything to their advantage. go out and win at the ballot box, but people are sick and tired the of indicting a guy who is literally leading by 35 points because, you know, they realize that their candidate can't walk up the stairs to air force one without tripping and falling on himself. rachel: yeah, you know, eric, it's interesting, i do think there is a ground swell of support for your father because they do feel like this is a political persecution. but a lot of it is the also because they look at what's happening to your father, and they go what does that mean for me? they saw the way some of his supporters were so unfairly treated january 6th, many of them still sitting in, you know, awful prisons without proper justice being applied to their cases. so talk briefly, we don't have a lot of time, but why this should matter if to every american whether you like donald trump or

not. >> yeah. rachel, we're supposed to live in a free country. you're supposed to have freedom of speech, right? it's just the number one thing that makes up our constitution, freedom of speech, freedom of expression, yet you have conservatives who are getting deplatformed, their businesses are getting shut down, their banks stop banking them, their web service provider s decide to turn them away. you know? their being -- they're being targeted by the irs. we saw it this week, you also saw what happened under, you know, barack obama where he's literally targeting conservative organizations using irs. people understand the weaponization of government, and that's extremely, extremely frightening. we're supposed to be the greatest democracy on the face of this earth, ask we're literally turning into a banana republic. i think putin would be impressed by some of the things the democrats have goal over -- can done over the last six years. it's why we fight. believe me, it's hard to fight every single day. we take arrows every single day as a family, but we'll never back down from the fight because, honestly, if we don't

take back this country, we're not going to have a country. we're going to be speaking mandarin. i'm joking when i say that, but in a certain way not really. rachel: i'm not. >> it's awful awfully scary, what's happening out there. you guys have covered it better than anybody, but that's why we fight. my father's the greatest fighter i've ever met. pete: eric trump, thanks so much. >> guys, thanks so much. rachel: it's not just the democrats, it's the democrats with the complicity of a lot of republicans as well. all right. well, a private funeral will be held today for 9-year-old hally scruggs who was killed in nashville on monday. hally is daughter of the christian school's senior pastor. she'll be laid to rest just one day after the celebration of life for her classmate, 9-year-old evelyn. who died trying to pull the fire alarm to save others. pete: alexandria hoff joins us live with more details. >> reporter: there's no greater sadness than what has

been felt, what will be felt inside of these services. hally was among three 9-year-olds who lost their lives decades and decades too soon. her family move to nashville from dallas in 2018 where her dad took the role as lead pastor at the covenant presbyterian church which is associated with the school, it's so hard to see these photos of their sweet faces. yesterday mourners were asked to wear pink or other colors that expressed joy as a tribute to evelyn. her family told the daily mail they do the believe she was killed while trying to pull the fire i alarm to warn her classmates of danger. her to bitch ware expresses the young -- expressed the young girl's constant beacon of joy. all of that plus the lives of 9-year-old william kinmy and three school employees were taken on monday when authorities say audrey hale, a former student who recently identified as transgender, went on a violent rampage after gaining entry through a locked door.

thursday the tennessee state ap capitol was swarmed by protesters demanding that lawmakers take action on gun violence. and the shooter, while they did have a manifesto that is expected to be released, we don't know exactly when that will be. the fbi is reportedly involved right now in analyzing that. guys? will: thank you, alexandria. rachel: thank you so much. will: you can see in that video the people in those protests at the tennessee the state capitol holding up seven thing inners claiming seven victims in this obvious tragedy. they're blaming it on guns and, therefore, counting the assailant. pete: yes. will: counting the murdererrer among the seven victims. just absolutely atrocious. and, pete, i can see -- i don't want to give too much attention, i think there's an appropriate amount of attention to give to this shooter, their trans identity, their manifesto which is important to read, but i think it's more important to say put some focus, put most of the focus on -- there was so much

heroism in this 9-year-old who died trying to pull the fire alarm. the headmaster, apparently, who went out and confronted -- pete: confronted the shooter. will: -- and the police officers who you can see that body cam footage, it is nothing short of absolute heroism. pete, i know you have experience with this and many of us civilians do not, there was not a corner that they hesitate thed on, not a door where they pauseed. they came around every oneselflessly and aggressively and, ultimately -- pete: boldly, when you watch that that body cam footage. you're exactly right. that's where the spotlight should be. but our viewers would not be wrong to be upside down and confused by the conversation that's ensued since. hearing the white house press secretary and others say trans kids are under attack? what are you talking about? christians are getting shot in a school -- rachel: thank you. pete: -- and you won't call it a hate crime, which it is. we'll find out from the manifesto ooh ooh. but we're focusing on the plight

of trans it's so upside down and so frustrating, the focus, will, as you said, should be right on the victims here who, hopefully, are with god -- rachel: yeah. make no mistake, this was a targeting of christian childrenif kris chan people who worked at this school. we have seen these kinds of targets before. they're happening in pro-life centers. they're happening everywhere. and so if you are a conservative, there are a lot of conversations going on right now, a lot of interesting conversations because people don't feel protected by this administration, and they know they're under attack, their values are under attack and now their children and their institutions, their christian institutions, are being, are under attack. and we should, we should talk very directly about this. we should not allow those liberals, media to drive this conversation to be about trans or guns or anything else. will: all right. still ahead, an american

>> to who? >> to russia. as they're detowning this "wall street journal" reportersome. >> let him go. pete: that was joe bidens underwhelming response after evan gersch coslip was detown the on spying charges, the first american reporter to be arrested on espionage charges in russia since the cold war. polaris national security founder and former state department spokesperson morgan ortegus joins us now. morgan, thanks for being here. so an american reporter's been detained in russia. now, russia doesn't believe in the free press, so are hay accusing a journalist who's digging into that what they're doing of being a spy, and what does that mean for his future? >> that's exactly what they're doing. what's really sort of shocking about the russian behavior here is they're acting like a terrorist group, right? as you know very well,, pete, terrorist groups will take the hostages to negotiate for political purposes. and this is the one of the reasons concern can. pete: sure.

>> -- you'll remember brittney griner, i was very critical of how the administration negotiated and the concessions they gave, so what you're seeing concern we're always glad to have an american home, but unfortunately what you're seeing is this is how the thuggish regime behaves. now they know that they have a new bargaining chip. they're going to know how much we want a journalist back, and they'll use that to their favor. so when we talk about weak leadership at home, it sort of permeates everything around the world. and the russian leadership knows that they've got a great bargaining chip now, and heir going to continue to take people as long as they can get something that they want from the united states. pete: exactly right about that, morgan. i want to move real quick to another topic because the heritage towning case just released an important study. you were one of the folks involved in that study, recommendations about how to minimize pretty -- politicization in the military. eliminate dei, improve readiness efforts. one of the staggering figures of

it is seven in ten members of the military today have witnessed politicization in the military. you not only were a part of that reporter -- report, you just came back from three months on active duty. is this what we're seeing today? >> speaking for myself only and not for the department of defense, i will tell you being a part of that report, pete, and looking at the statistics, that number you just mentioned, the seven in ten worried about or witnessing the politicization, what's really scary about that number is we are not meeting, by far we are not meeting our recruitment and retention goals especially in the army. and what we saw in the report is that the number of people on active duty are thinking, you know what? i may not want my children to join the military. pete: yes. >> now, why does that matter? every industry has a recruiting way, and for the -- base, and for the military, disproportionately the number of people who decide to serve are people who saw it within their family, who saw their parents or grandparents, aunts or uncles serve. for me, and i'm sure for you as well, pete, it was a part of my

culture. i raised my hand and took the oath, i want my daughter to do it as well, but when you start to demoralize the base of people who served on act active duty and they don't want their children to join, that's a really, really scary thing for the military. and i think it just shows you that we need to be ready to fight real wars, not culture wars, right? pete: yeah. >> we need to be worried about what happens, can the chinese communist party, can they sink an american aircraft carrier if we get into a fight over taiwan, for example? but instead, we're worried about all these other initiatives that don't impact readiness and, in fact, could actually hurt readiness. pete: two findings i want to highlight real quick and then we've got to go, 41% when asked what they were most concerned about, 41% of military members, reduction of physical fitness standards to promote equity. 41% an certain us consider emphasis on diversity, equity and inclusion. nothing -- it's not about readiness, it's about other thing, and the military's seeing it to your point.

ard joins us now. tulsi, so great to have you on this morning. >> thank you. rachel: a lot of people commenting on why this is happening, and it feels very pretty if call. some people -- political. some people are saying this is really all about foreign policy, that donald trump bucked the system, was a ooh big of a disrupter when it came to the foreign policy, and that's why he's still target of so many, so much ire in washington, d.c.'s establishment. what do you say to that? >> i think that's probably, certainly, a contributor to it, but i also think that this is something that shouldn't be surprising to any of us. this is something that the democrat establishment has been doing, weaponizing and politicizing our government, our law enforcement agencies against donald trump even when he was a candidate in 2016. rachel: yeah. >> before he was even elected president. so this is just the latest serious escalation of that weaponization coming from a democrat establishment that doesn't believe in the constitution, they don't care

about the rule of law, and their only interest is how do they advance their own political interests and the influence of the military industrial complex is strong not only in the democrat establishment, but also in the republican establishment as well. rachel: yeah, it's bipartisan, for sure, and i think the timing with the financial documents coming out showing payments from this chinese energy company to the bidens, that seems to have gotten no attention to be since this dropped. so the timing's interesting too. i want to move to another topic with you, tulsi, and that is joe biden. he was originally expected to announce his re-election bid early this year, but now we're hearing april, and at the same time this time in the presidency both bill clinton and barack obama had already announced their re-election. but there's nothing yet. we showed a commercial of gavin newsom looking pretty fine and showing that he can, you know, he looks like he's getting into the race himself. not officially, but definitely putting some markers out there. what do you say? is joe biden going to run or

not? [laughter] >> it's a good question. i think probably joe biden's the only one who really knows the answer to that, but i think it's important for us to remember as we look towards 2024 that, you know, the declaration of independence reminds us that we are a self-governed people. there is no predetermined outcome to these elections, and it's up to us as the american people to decide what kind of leader we want, what kind of commander this in chief we want. whether it's a democrat or republican, we need someone who is serious and committed to upholding the constitution, to protecting our civil liberties and our freedoms, to standing up, having the courage to stand up to the military industrial complex and not put us as this administration has done on the brink of world war iii and nuclear annihilation. we need a president who will fight for us to have a future that is peaceful and that is prosperous where we can feel safe, secure and free. rachel: yeah. i think we can all agree no one feels safer today with all the things that are going on in terms of foreign policy. >> that's right.

rachel: i want to talk about the restrict act, because it was billed as a ban on tiktok, but the weird thing is it doesn't even mention tiktok, chinese-owned app, in the bill. so what is this really about? is it about restricting, you know, tiktok? that's not mentioned in it, or is this really a power grab? what are your thoughts on this? >> people should pay really close attention to the restrict act because the democrats and republicans that have introduced this legislation are trying to market it as something that it's not. it does ban tiktok, it makes it illegal for americans to use tiktok, but it does a whole lot more than that. it gives power, unfettered power, to unelected bureaucrats in the commerce department to tell us what social media apps we are or are not allowed to use. it gives them access, unfettered access, to our data, our browsing history, how we're using different apps on our phones. and it basically criminalizes the use of vpn ifs with some pretty serious consequences, and they're doing all this in the

name of national security. this sounds a whole lot like what we saw with the patriot act. rachel: yes. >> we as the american people need to be smart enough to not fall into this trap again where, ultimately, we have people who took an oath to support and defend our constitution, our civil liberties, our rights, but they are hell bent on taking those rights away. and dangerously in this bill, the restrict act, not even allowing us to challenge their actions through our court system. this is a very serious bill that threatens the very foundation of our democracy and our god given rights that are enshrined in the constitution. and we cannot allow them to do this. rachel: you know what's even more scary? that cosigners like lindsey graham didn't even know that they had cosigned on this bill, these big decisions that are affecting our civil liberties and our freedom are being decided by a bunch of staffers. that was embarrassing and humiliating, and he should be embarrassed about that.
