brag. we will go to cba cotton first with a arraignment. she is at the courthouse downtown where mr. trump will appear on tuesday. >> eric, good afternoon for two days from now expecting her president donald trump to turn himself in here today manhattan criminal courthouse binding. sources tell fox a former president will arrive at 11:00 a.m. then trump's arraignment proceedings will begin shortly thereafter at 2:15 p.m. there's been extensive planning and coordination between a local, state, federal law enforcement to include trump's legal team for this historic moment. because the indictment is still sealed we do not know the exact charges or exact number of counts. reportedly there are at least 30 for the charges are expected to be related to trump's 2016 alleged hush money to two women including adult film star stormy daniels. trump has denied the affairs in any wrongdoing. but has acknowledge the payments, and this case in pa alvin bragg is reporting to take

a misdemeanor charge of falsifying business records and upgraded to a felony by connecting it to a campaign finance law. democratic congressman adam schiff has called the indictment a vindication of the rule of law. but republicans, include one thing could be political opponents to trump in the 2024 presidential race, those have called this case a politically motivated to include form arkansas governor asa hutchinson who again announced his own presidential bid today, we will listen. but what is happening here is a shame for america because he is a former president of the united states. the fact is thousands of americans have to go through this process. we do believe in equal justice of the lot. i do not believe this is a good case to bring. i would not have brought this case based upon the fact that i know. asked as she mentioned, trump is not expected to be in handcuffs

this is support sources telling us at legal arrangement made between trump's legal team and the manhattan das office. trump is also facing other federal and state investigations, erica. before cb thanks so much, molly. molly: former president trump remains and omar lago nay former president spent some time on the golf course yesterday. this is florida's governor ron desantis widely expected to run for president himself, teed off on trump's during a stop in new york. jonathan serrie is a life outside of mar-a-lago and palm beach, florida the look ahead. flex hi there, molly. ron desantis did not mention the former president by name, speaking in new york the florida governor said if the allegations are true they are no more than misdemeanors. he criticized the manhattan district attorney alvin bragg for prosecuting a former

president, again not one that he named showing leniency for common criminals. all of these legal gymnastics to try to act like it is a felony. when almost every other time he's trying to take the families and downgrade them to misdemeanors. this guy is doing politics. he has an agenda. that is not the rule of law. >> mr. trump has been traveling locally in the community surrounding his mar-a-lago state this weekend. we saw his motorcade return late yesterday after they spotted him leaving the trump international golf club in west palm beach. the trumpet legal team is expressing confidence in its ability to defend the former president as he prepares to head to new york. flex it seems like we are guessing the indictment will look like is it will have legal frailties that will be subjected to a very legitimate motion to dismiss early on. >> on his truth a social

platform mr. trump. >> i want to thank everybody for the tremendous support you have given me against this assault on our nation. the former president plans to leave at mar-a-lago on monday to travel to new york. of course that hearing is on tuesday. and then tuesday evening he plans to meet back here at mar-a-lago where he will deliver some public comments. molly: will certainly be interesting, it showed 90 thank you for watching it all for us we appreciate it. c4 molly, turns out former president trump's possible will be judged by citizens for jury pool of a residence in new york county, that is manhattan. you know how manhattan voted in the 2020 personal election? overwhelmingly for president biden. in fact manhattan jury last year convicted to trump organization companies on tax fraud charges. trump's attorney reportedly considering a trial request to move to the more conservative borough of staten island because of the possible bias against

trump. he is the new york senate writing quote, the former president, like all americans, is a loaded impartial jury but you're likely to find not a welcome mat but it unfriendly jury eager to convict. it raises a question both practical and constitutional, candy former president get a fair trial in his hometown? former new york republican congressman leah selden joins us now from long island. congressman, always good to see you. are they all licking their chops? click really hard to find a jury of his peers anywhere in america you talk about the lore for president but especially tough to do that at manhattan. you have a will probably be a very difficult jury selection process. the be a lot of candidates have very strong opinions about the former president with a wide ranging views. ultimately in order to secure a fair trial is going to be a
9:08 am
massively uphill effort at that venue is not changed from manhattan. eric: what you think a president trump customer did you vote for president trump? would he think of joe biden? you think president trump is guilty of you ever had any president with president trump, the ever gonna buy trump tower? could you ever possibly get somebody to say i don't know? >> it is a great question. can you actually end up filling out an entire jury to be able to deliver a fair trial? there is going to be a lot of different motions for this a motion to dismiss as you analyze the merits of the charges themselves. we will see with the indictment reads when it ends up getting unsealed to have this motion to change the venue. there is going to be a lot of motions and questions right out of the gate. we will see if you ever end up with that day in court. because, as has been discussed you are talking about a
9:09 am
misdemeanor charge with a two-year statute of limitations with a massive link to try to turn into a felony. stretching a five year statute of limitations even further. and i am not aware of, and i have been an attorney in new york for over five years. i can't think of a district attorney anywhere in the state of new york who is ever charged a campaign federal finance in violation of the tap and i cannot think of it offhand. this is quite the complex convoluted legal strategy. i think there will be a lot of motions here. the motion to change venue will be one of them. if our break is a poorly charged 117 cases of falsifies business documents. but as far as we know, as you know none of that lisa federal charge. let me show you about the change of venue. let me show some statistics in manhattan. here is the jury pool in manhattan, the number of democratic voters but let's take a look at the numbers that we can put them up. you have almost 800,000 democrats versus 80000 republicans.
9:10 am
almost 10 times more registered democrats than republicans. here is how president trump did in manhattan, 12% of the vote. 86.7% against the president biden to 12.3% of the votes. now, in manhattan, and all of new york state as you know congressman, there are assembly districts. assembly districts there are election districts a few blocks along for a look at the deeds in manhattan but look at this on president trump got 1% vote in one of them. he got one vote. the bestie did it any manhattan election district is 27% of the votes. as in the upper east side of manhattan near where the rich people live and park avenue. that the best seated, not even one third period while in staten island where the attorneys reportedly want to change the venue, president trump won the vote in staten island did better in 2020 that in 2016. what do you expect? to think they can get a change of venue? if it's not in new york and they change it to new york state?
9:11 am
>> i definitely should be changed in the venue. that would be important for fairness. i think there are a lot of americans, who may not even like president trump who will be defending him. we have seen that already just because they care about equal justice under the law. and i believe as you analyze those numbers that you just pointed out from manhattan, in many respects it helps explain why is it the manhattan district attorney would even be bringing these charges. a lot of people, myself included, believe this is a political prosecution. alvin bragged he said before he even took office he was going to be leading this charge to prosecute the former president. he did not articulate with the facts are going to be. what the chargers are going to be. he said he is going to make this a top priority. then you add all of the other charges that have been downplayed from a federal to a misdemeanor charges. not just the downgrading of
9:12 am
charges but also a number of other offenses across the board but he will not even allow its prosecutors to charge. and for alvin bragged a politically, it may be just help some of the democratic party primary if he were to run for either reelection of district attorney or some other office. if you look close at the numbers you just put up on the board it tells a story not just about whether he could get a fair jury, but also may be why is that the district attorney is this political? and why that district attorney thanks it is to his political benefit to be going forward with this prosecution? that really is the only justification that anyone is able to come up with. the merit certainly is not there. eric: he says as district attorney he is a point of the law fairly and accurately and appropriately. but as you point out, when he ran and elected his first stop was how sharpton's national headquarters to give a speech there. finally, how do you think this will affect the race for asa hutchinson formally announced his canonicity today.
9:13 am
when he think will happen? what you think the president was down tuesday night 8:15 p.m. from mar-a-lago when he flies back to palm beach from his arraignment hearing in new york? >> we have seen over the past week or two is president trump has gotten stronger amongst the republican party primary base. lead as more polling comes out over the coming days of next week or two you will see he will likely get even stronger. there are a lot of people who are very unhappy with this targeting of a president trump. the critics are not just people who strongly support president trump, are loyal to him, or who are already supporting him. quite frankly for those who are with eyes wide open looking at what everyone is saying there are a lot of people commenting, not just thought he should be impeached. i saw with peter meijer and the former congressman of michigan, he voted to impeach president trump. he got kicked out of office and he is out there defending
9:14 am
president trump. and others as well who president trump has been very critical of it. it's very telling and i think in many respects this will make them stronger for others in this field. you mentioned former governor asa hutchinson. these presidential primaries in many respects are about lanes. publican party as it is, obviously president trump has the trump lane everyone who is not president trump, it is getting more and more crowded. the more crowded it gets you end up sharing the rest of that vote amongst a lot of other people. it is very difficult path are somewhat like the former governor of arkansas just because of how the 2024 presidential primary is shaping up with president trump in the race. for four finally, quickly your prediction for the president? an acquittal or will he end up in the pokey? >> i do not believe that even if he was convicted by the way, that this would appropriately
9:15 am
lead to a prison sentence. i do not believe that he should be convicted. if he wasn't should be appealed. that appeal should be succ successful. there is so much on this on the facts and the charges, and what is been reported. having him talk about what we believe the indictment will say we'll see what actually ends up saying. so far with what we have to talk about, this is something that is very unfair. not equal scales of justice. clearly a political prosecution one i think will actually help president trump politically and becomes hunger coming out of it. eric: of course mr. bruegel disagree and probably have a news conference of its own on tuesday so we will wait for that after the president tuesday night, the former president. congressman of new york got a lot of votes it almost became governor, maybe it will try again. congress get to see you thank you. period b5 clinic efforts

closer and could we expect perhaps he may spend more time behind bars in russia? flex it is. the charges against him brittney were trumped up themselves. she allegedly had some vaping oil and they turn that into being a drug trafficker when in fact it was obsolete something for personal use. obviously something most countries of the world would result in a slap on the wrist if it were illegal in the first place. that is very different than the charge and espionage against evan this likely to be tried in a secret court. he is not my belief that any access to u.s. diplomats, the few that remained in the country being what he is being accused of what he faces theoretically would carry a much longer sentence. of course it is completely trumped up. i have the cia may have a big bad at repetition in hollywood. the ideas the intelligence community would be using wall street journal reports or any reporter seemed genuine espionage is ludicrous. molly: absolutely. we are pulling for evan
