in "the faulkner focus." it will be a kwik trip as you know to new york city from where he is in florida. facing charges related to the stormy daniels hush money case. he is set to be at the courthouse tomorrow in manhattan at 11:00 a.m. his arraignment begins at 2:15 eastern. it may take as few as 15 minutes. after that trump will head back to mar-a-lago and planning a speech tomorrow night. however we're learning the judge could take an extraordinary step of imposing a gag order on the former president and 2024 contender. trump's legal team is considering adding a first amendment attorney to fight that if they try to put a gag order on him. they will be ready to fight that if necessary. many republicans continue to attack the indictment. one democrat who voted to impeach trump has his own concerns. >> i think people need to ask

the practical aspect. he will be brought in and he will be booked, he will have his fingerprints taken. my guess is that despite the calls for not having his photo, i think they will have a booking photo. can you imagine the political opposition's intention to not have a booking photo in this particular instance? >> harris: i can't imagine that. >> they'll say this is standard operating procedure and why we'll do it. nothing about this is standard. it raises and elevates the prosecutor to a level of scrutiny that is deserving. this type of politization has been happening across the country for many years. but we're now just seeing the end result of making your office entirely political. >> harris: i want to talk about what happens to biden. there is a whole lot of evidence in that case. but let's go here. one of president trump's attorneys said that this is part of their plan for next steps.

let's watch. >> we will take the indictment and dissect it. the team will look at every potential issue that we will be able to challenge and we will challenge. of course, i very much anticipate a motion to dismiss coming. there is no law that fits this. >> harris: motion to dismiss and senttive to the fact every legal i've expert talked with brings up statute of limitations. talk to me about it. >> you know, the motion to dismiss is actually a very foreign motion in the criminal justice system. the reason is because the presumption is that you are presumed innocent until proven guilty beyond a reasonable doubt. they allow the government to go forward on their case and present the evidence and that is the moment at which you get to, you know, make your arguments or try to undermine the argument of the prosecution. so a motion to dismiss is very foreign in a criminal case, harris. this will be unusual and the

judge can easily say i don't get motions to dismiss. let's see what the evidence is. if i believe the statute of limitations or otherwise has been violated, then i will dismiss it at that point. but he could very well punt that issue and wait to see what the government has to present. >> harris: i never used to wonder about this sort of thing but it is like everything is politicized now. what does it matter about what we learn about the judge in this case? >> yeah, it is difficult to put into words how important the judge can be in a case. a judge that is skeptical about the case to begin with may ultimately say you know, i think the motion to dismiss is in order. i think the statute of limitations is appropriately highlighted here. i don't think there is a pandemic exception to the statute of limitations and i will dismiss the case. it depends on the politics of the judge. >> harris: i wanted to hear what

the flip side could be because i'm not hearing that reported. i think it is important to say it. this doesn't have to go as scripted the way the democrats are making it. it could go that way but there are a lot of things on the table. former attorney general bill barr was asked about a potential trial in this case. let's watch. >> if the president was your client would you put him on the stand? i have to imagine in any of these cases if it gets to trial he will want fordefend himself. >> i generally think it is a bad idea to go on the stand and particularly bad for trump because he lacks self-control and very difficult to prepare him and keep him testifying in a prudent fashion. >> harris: bill barr knows the president well with regard to those issues of legality i would imagine. do you agree with what he is saying or would you put the man who arguably has the most name recognition of anybody on the planet right now on the stand? >> well yeah, a lot of respect

for bill barr but i would add this, harris. in those instances where an acquittal had occurred, the percentage of cases where the defendant took the stand is much, much higher. so you have to weigh that when you are representing the president. despite all of the difficulty in putting him on the stand, if there is a jury, they want to hear from the defendant. oftentimes they require it in order to acquit. >> harris: all right. a group of news organizations now is demanding more access asking the judge in former president trump's case to immediately unseal the indictment and they also want to allow cameras in the courtroom if it goes to trial. a new oped argues it cites past examples it claims with fuel speculation due to a lack of information and you can zoo he the list there full on your screen. classified documents, mueller report, other examples there

where people were just left to either a whole load of disinformation or no information. your take. >> the grand jury has a rule assigned to it. a secrecy rule. i am doubtful that a judge will see this case so abnormal that it makes a ruling especially this judge that it will unseal. the unsealing of the indictment will occur at the arraignment. we'll get a glimpse of what those counts are. the thing we may never know is the incrass -- of the grand jury, who voted and -- >> harris: that's important, too. that we learn about other juries can inform us on what worked for each side. the prosecution and the defendant and what didn't. we likely won't get any of that is what you are saying.

not what people here in wynne, arkansas need as they try to gather whatever they have left and rebuild. four people died in this town. a small town of only 8,000 people. this after a line of severe storms tore through the mid section of the united states. at least 33 people died. 76 tornadoes were reported across 11 states between friday and saturday. thousands of flights had to be canceled or delayed because of the severe weather. little rock, arkansas got hit with an ef3 tornado with 165 miles-per-hour winds and a path of decestruction that went up t 30 miles damaging up to 2600 buildings. >> it was like a bomb. i could hear the trees breaking hitting the sides of the walls. it felt like the building was going to fall apart.

story is the fact that we have a former president, who is the number one opponent, donald trump who has been indicted, who in any normal set of circumstances would be thinking it was a win for them. it is not a win for joe biden and his white house. they are talking about this story, which for a lot of democrats they should be like okay, this is not what we should be talking about. they are in trouble here, harris, i really believe that. >> harris: the latest fox poll shows that more than half of democratic voters want to see another candidate and 44% want to keep biden. 52% want somebody else. so i will come back to you and make it really clear. so if he doesn't announce until the end of the summer, does that help or hurt other people who might want to get into the race against him? >> he is the president. the leader of the party. he doesn't have a time clock when he has to announce. he is the presumptive nominee should he chooses to run. i anticipate he chooses to run.

these polls, this mid year polls we saw them before the mid-term election that resulted in historic overperformance by the president's party. you don't take much stock in these things. the leading republican candidate is scraping mid-30s approval rating and scraping 80 years of age himself. we are in a moment where these polls will always be -- >> harris: you haven't looked at the latest. i assume you are talking about trump. his numbers moved up and raised $5 million in 48 hours. i hear what you are saying. my question is why would you wait whether you go to the coronation of a king in the u.k. or not? what about the race for president if you know half the people polled. potentially don't want the incumbent present who would be 82 at the time. they don't want him. they want somebody else. why wouldn't you get in?
