indictment. bryan, how are the next 24 hours going to play out? >> yeah, gillian, good afternoon. obviously once the former president arrives here in new york city, he'll spend the night at his residence. and tomorrow morning around 11:00 a.m., his motorcade will come about 11. and we expect him to get his fingerprint, perhaps mug shot taken. at that point we don't expect him to be handcuffed but expect him to make his way down a hallway into a courtroom on the 15th floor. there will be a video camera in the hallway, we'll see that. trump will enter for a 2:15 arraignment, we expect it to last about 15 to 30 minutes. trump will be read his charges, presumably, going to plead not

guilty and released on his own recognizance. then fly home to florida, he's set to speak about 8:15 p.m. in mar-a-lago. as far as security, new york city mayor eric adams said no credible threats to the city at this time. the city is prepared and he's not really that concerned about tomorrow. there will be an increased police presence, he's asked new yorkers to take mass transit and stay off the roads. the mayor said no violence or vandalism in the city. >> there may be some thinking about coming to our city tomorrow, a message is clear and simple. control yourselves. new york city is our home, not a playground for your misplaced anger. >> the mayor said he believes

tomorrow will be a day marked in the new york city museum for its historical significance. as far as what we expect outside the courtroom tomorrow, there is a protest planned by the new york young republicans group, alongside marjorie taylor greene. they are calling for a peaceful protest. >> gillian: bryan, thanks very much. >> john: the former president settles into his luxurious leather seats up to new york city, he could find himself in more legal trouble over the handling of classified documents retrieved from his mar-a-lago residence in january. multiple secret service agents connected to the former president have been subpoenaed and several are expected to testify before a washington, d.c. grand jury. that could happen as soon as this friday. the grand jury appearances are

related to special counsel jack smith probe into the handling of classified documents. comes as a new report in "the washinton post" says the department of justice may have more evidence against the former president and his team, including mr. trump may have personally looked through boxes of documents after being subpoenaed by the government. >> gillian: john, legal analysts across the channel have been telling us for several weeks of the two investigations they perceive the one you just laid out to be the stronger case to potentially pose the greater danger to the former president. >> john: and there are so many people on both the right and the left side of the political fence saying they were not sure why alvin bragg is making a point of this, that he had to take a misdemeanor charge, statute of limitations had run out, boot strap to a felony charge, the statute of limitations ran

longer, and got buy-in from the grand jury, and maybe from the judge in terms of moving forward at least with the arraignment tomorrow. there could be, according to trump sources, a motion to dismiss the case. we'll see where it goes from here. i don't think it's going to be over any time soon. >> gillian: and hopefully the rest of the general public will get a look at the charges unsealed tomorrow as well. maybe that will shed some light. >> john: none of us know what the charges are. >> gillian: amazing the speculation swirling out there. >> john: he's been out of office for two years and three months, still all anybody is talking about. >> gillian: interesting. we'll keep an eye on that. the pentagon will hold a briefing after a new report claims the chinese spy balloon was able to gather intelligence from several sensitive u.s.

military sites, despite the biden administration claiming otherwise repeatedly. complete coverage now. michael allen is standing by, but first mike emmanuel. what else are you learning about the spy craft this hour? >> it was able to send back in realtime images and some communications intelligence. china was able to control the balloon to make multiple passes over key sites, figure 8 formations and transmitting back to beijing in realtime. national security council spokesman said he cannot confirm reports it gathered sensitive intelligence but the u.s. took protective measures. >> intelligence gathering platform, why we took action knowing it was going to enter u.s. air space. we took action to limit the ability of this balloon to

special assistant to president bush and from the national security council, we have been assured the balloon had been in effect neutered, but it was actually intact. >> they deserve to be called out for this. they acted as if they had handled this during the transition across the united states. they suggested, they hinted that they were jamming their particular balloon so it could not transmit signals or intelligence they had collected on or nuclear weapons bases back to china when in fact they had. so, this is deserving of more congressional oversight and taking a close look here. >> gillian: something that shocked me, i don't know about you or anybody else, but from the get-go, the administration never shot down the idea that this balloon was collecting anything, right. they never said it's not operational, not collecting intelligence. now we learn it may have actually collected significance

intelligence. that from u.s. sensitive u.s. military sites where classified information is handled and stored. why is that ok? sort of boggles my mind. prosecuting a former president for mishandling information yet allow the balloon to hover over and do what it wants. >> i didn't appreciate them downplaying the threat. they know good and well it's critical to the chinese, trying to prevent surprise. they want to know where the nuclear weapons are, what kind of signals are on the base, and that's so the chinese can get a signature so that they might be able to figure out when it is in a time of conflict how or whether we spin things up and for the biden administration to sort of underestimate it and oh, nothing to see here is

administration that opec made this move over the weekend. >> john: once again, phil, when global oil production diminishes because of cuts implemented by opec, reforces the idea that the united states was self-sufficient and could be again. the president approved a willow project in alaska, a few hundred million barrels of oil. the same time he did, throwing a bone to his left and environmental groups, he put off limits, thousands of other acres of federal laughed that could be developed for oil exploration. if we look at how the united states catches a cold when the global oil market sneezes, do we need to kind of look at whether or not we are doing a better job of i mmunizing ourselves? >> we have to. the policy is inconsistent,

incoherent and don't know what they are for and against. he killed the keystone pipeline, put on drilling moratoriums, and complains when prices go up and says the oil companies should produce more. the biggest mistake, the immature way he handled saudi arabia, saying we are going to make them a pariah state, and use the oil reserve to teach them a lesson, and if they don't what we want them to, we are going to flood the world with oil. >> gillian: to that point, phil, john kirby earlier this morning on the u.s. supply, your reaction. >> i can say we have been

consistent in our plans to refill the strategic petroleum reserve and try to do it at a good deal for taxpayers. that will be subject to what constraint, by congressionally mandated sales, but still have every intention to rebuild the reserve. >> gillian: so they have every intention to refill the spr, but they have not been able to. prices have remained stubbornly high for them, the administration is months behind schedule. its own timetable for replenishing because prices have remained to high to make sense for u.s. taxpayer dollars. >> they sure failed at that, right. it's a lot easier to sell it from the reserve than buy it back. and the administration said what a great trade, we sold oil below

$100 a barrel and bought it back below 70. they signalled to the market they were going to buy oil back when it went below 70 and 1 of the reasons why opec cut production this week is because the united states reneinged -- renegged on that, right? energy secretary granholm said we might not fill the reserve this year or years to come, and i think that angered saudi arabia, they blame the united states for the selloff in oil because of our banking issues here and now they are paying us back with this production cut that every american is going to feel at the pump. >> john: it won't take long, prices are already on the rise. phil, thank you so much. >> gillian: thanks, phil. >> john: dramatic issues, abandoned migrant child drifting alone down the rio grande.

bring to light what's happening, this is a crisis -- >> and you mentioned chinese nationals. this is video over the weekend in the rio grande valley, mass release of chinese nationals released in front of a parking garage in downtown brownsville. border patrol sources telling fox news they are released via the notice to appear with their own recognizance, released into the u.s. with a future court date. take a look at this video showing the chinese arrested over the weekend. we were up in the early morning hours in texas as this group of 12 chinese nationals came across and was apprehended by border patrol. the number of chinese continues to shoot through the roof. more than 1700 apprehended since october 1st. those numbers reflecting a more than 900% increase. and lastly, another moving truck, human smuggling bus.

candidate, and taking aim at trump and his announcement urging him to drop out of the race due to his distracting legal issues. >> now that he's been indicted should he drop out? >> i do. first of all, the office is more important than any individual person and so for the sake of the office of the presidency, i do think that is too much of a side show and distraction and he needs to be able to concentrate on his due process. >> john: political panel now, david and kevin. gentlemen, good to spend monday afternoon with you. so, asa hutchinson, only declared republican candidate to be calling for the former president to drop out of the race. david, that is not going to make him popular with a large percentage of the republican base. >> it will not, and he does have to hope that that percentage of

republicans who are looking for an alternative candidate, that he can coalesce them. running for president seems to be the favorite activity of former arkansas governors, mike huckabee and bill clinton, and asa hutchinson was on the indictment team that ultimately impeached bill clinton and can hutchinson use that to get him the numbers he needs and level of support and fundraising so he can make the debate stage to make the case to republican primary voters he should be the nominee. >> john: let's take a look at that. 2028 when sarah huckabee might throw her hat into the ring, extending the dynasty of former arkansas governors, although she would probably be the current governor. look at the polling, latest fox news poll, former president

donald trump leads with 54%, he has improved his standing. ron desantis, his standing has declined. asa hutchinson at 1%. it's a big hill to climb if he hopes to get near the nomination. he was a popular governor but does not necessarily translate to the national stage. >> it's a huge hill to climb for the former arkansas governor, and a direct play for the never trumpers as part of the nomination fight. and folks, nikki haley, and mike pence, others coming to the defense of donald trump as part of this indictment. but you are seeing asa hutchinson stake his entire candidacy and the announcement around the indictment, and south carolina specifically early primary state, that's where i am right now, allows for undeclared voters to participate in the

primary. so i think he is going to make the case with a majority of independents, making a case to those voters. but interestingly enough, the one person that is celebrating this, is donald trump, the more people that aren't donald trump in this race the better it is for the former president. >> john: right. let's take a look at trump as he's winging his way to new york city, i've been in contact with eric trump. eric says his father's mood is good. he's as tough as nails and i promise you he's going to save america. david, what do you think will happen politically in terms of the arraignment and the aftermath of it. >> what we know, john, we will continue to be a divided nation. you'll have those on the right who feel he is being unfairly

prosecuted and they will further be angry at the system if the president -- when the president is successfully cleared of these charges, then you will have the left be upset and they will look -- move on, unfortunately, the next trial they want against the president. whether it be when he was running for president or when he was president or now that he's post president, what we are guaranteed on is that the progressives and democrats are going to sue him and they are going to try to bring him to trial for anything. and will continue for the president until he's no longer on this earth. the democrats will go after him through the courts and it only leads to a more divided nation, which is not good for us. >> john: some advice that former white house press secretary jen psaki doled out over the weekend. >> now is not the time for a mass order of lock 'em up t-shirts and mugs. that's exactly what trump and his supporters would do.

now is also not the time for democratic candidates to celebrate, to brag, predict the outcome. if you can, i would put your head down and stay out of it for now. >> john: can democrats resist the temptation, kevin? >> yeah, i think that's great advice from jen psaki. and you saw president biden when asked specifically about this, he has declined to get engaged and comment. the white house wants to focus on the president travelling to minnesota today, for example, talking about the chips investment and infrastructure with the split screen of, you know, the former president arriving for the indictment and arraignment tomorrow. so i think hopefully democrats will heed that advice and cooler heads will prevail and let the process play out. >> john: kevin, david, good to talk to you. it's going to be a big political week, gillian. >> gillian: oh, yeah. it's amazing to may that people are continuing to enter the race as this all unfolds.

continuing to grapple with rising violent crime rates. l.a. county is considering a plan to decarcerate jails. proposal reportedly advocates releasing anyone facing bail of $50,000 or less. joining us now is leo terrell. thanks for being with me. the first question i'm had and i'm sure some viewers will, what are we talking about, what kind of crimes are people committeeing who are facing up to $50,000 bail? so take a look at this. might surprise people like me who are not experts in this. includes vehicular manslaughter, d.u.i., and sexual battery, assault with a deadly weapon, assault with a firearm, sex with a minor and child kidnapping. i mean -- there's a big range in there. >> gillian, the list is scary to the average american citizen who lives in los angeles.

supervisors, we have people of color. where is the racist bogeyman? but the democrats play that card and los angeles county, state of california, we have a socialist system of government where they allow criminals, these criminals who have committed the crimes to get out of jail and join the existing criminals who you portray in the videos to roam the streets and terrorize citizens. >> gillian: i pulled thshgs i wanted to read it to you, give me one second. this proposal in l.a., the democrats who proposed it say they want to declare the state of mental health services and overcrowding in the l.a. county jails a humanitarian crisis, requiring the county to move with all deliberate speed on meaningful solutions. let's say for the sake of argument right now, that there is a humanitarian crisis. are there any sort of -- are there any interim measures available to these city officials, somewhere between

opening up the jails, freeing all the convicted criminals, and keeping everything status quo. what else might be available to them? >> fantastic question. because that is being used as an excuse, as a pretext. there are alternative shelter, alternative facilities. the question here is why do you have to release them. gillian, you can show videos. we have a homeless disaster in california where we have mental health issues. they are trying to reassign the individuals to shelters. don't let the criminals roam the street, do what you are trying to do for the homeless, mental health issues, put them in other locations, other facilities. what they are saying, they have to release all these criminals based on that list you just showed, in order to resolve this problem. that is a lie, gillian. because we have the problems on the streets right now with the homeless population. >> gillian: interesting. sounds like maybe it's not --
